The COVID-19 pandemic crisis has necessitated widespread adaptation of revised treatment regimens for both urgent and routine medical problems in patients with and without COVID-19. Some of these alternative treatments maybe second-best. Treatments that are known to be superior might not be appropriate to deliver during a pandemic when consideration must be given to distributive justice and protection of patients and their medical teams as well the importance given to individual benefit and autonomy. What is required of the doctor discussing (...) these alternative, potentially inferior treatments and seeking consent to proceed? Should doctors share information about unavailable but standard treatment alternatives when seeking consent? There are arguments in defence of non-disclosure; information about unavailable treatments may not aid a patient to weigh up options that are available to them. There might be justified concern about distress for patients who are informed that they are receiving second-best therapies. However, we argue that doctors should tailor information according to the needs of the individual patient. For most patients that will include a nuanced discussion about treatments that would be considered in other times but currently unavailable. That will sometimes be a difficult conversation, and require clinicians to be frank about limited resources and necessary rationing. However, transparency and honesty will usually be the best policy. In this chapter, we attempt to show that J.P. Moreland's understanding of apologetics is beautifully positioned to counter resistance to a rationally defensible Christianity—resistance arising from the mistaken idea that any rational defense will fail to support or even undermine relationship. We look first at Paul Moser's complaint that since rational apologetics doesn’t prove the God of Christianity, it falls short of delivering what matters most—a personal agent worthy of worship and relationship. We then consider John Wilkinson's charge that (...) the use of reason and argument in evangelistic contexts is relationally futile. Since people aren’t looking for arguments, and logic is an arbitrary human invention, we should present Christianity to others as an irrational faith story. (shrink)

Authority arguments generate support for claims by appealing to an agent’s authority status, rather than to reasons independent of it. With few exceptions, the current literature on argument schemes acknowledges two basic authority types. The _epistemic_ type grounds in knowledge, the_ deontic_ type grounds in power. We review how historically earlier scholarship acknowledged an_ attractiveness-based_ and a _majority-based_ authority type as equally basic type. Crossing these with basic speech act types thus yields authority argument sub-schemes. Focusing on the_ epistemic-assertive_ sub-scheme (...) (‘an epistemic authority _A_ _E_ asserts a proposition _P_’), we apply a meta-level approach to specifying critical questions. Results improve the evaluation of this sub-scheme and show how similar improvements are obtainable for other schemes. (shrink)

There is a concern that as a result of COVID-19 there will be a shortage of ventilators for patients requiring respiratory support. This concern has resulted in significant debate about whether it is appropriate to withdraw ventilation from one patient in order to provide it to another patient who may benefit more. The current advice available to doctors appears to be inconsistent, with some suggesting withdrawal of treatment is more serious than withholding, while others suggest that this distinction should not (...) be made. We argue that there is no ethically relevant difference between withdrawing and withholding treatment and that suggesting otherwise may have problematic consequences. If doctors are discouraged from withdrawing treatment, concern about a future shortage may make them reluctant to provide ventilation to patients who are unlikely to have a successful outcome. This may result in underutilisation of available resources. A national policy is urgently required to provide doctors with guidance about how patients should be prioritised to ensure the maximum benefit is derived from limited resources. (shrink)

The article argues that universals of law, i.e. the laws of nature, are the general axioms of a deductive system of all knowledge, and their deductive consequences. Universals of fact are generalisations deducible from these together with particular facts.

The COVID-19 pandemic has created unusually challenging and dangerous workplace conditions for key workers. This has prompted calls for key workers to receive a variety of special benefits over and above their normal pay. Here, we consider whether two such benefits are justified: a no-fault compensation scheme for harm caused by an epidemic and hazard pay for the risks and burdens of working during an epidemic. Both forms of benefit are often made available to members of the armed forces for (...) the harms, risks and burdens that come with military service. We argue from analogy that these benefits also ought to be provided to key workers during an epidemic because, like the military, key workers face unavoidable harms, risks and burdens in providing essential public good. The amount of compensation should be proportional to the harm suffered and the amount of hazard pay should be proportional to the risk and burden endured. Therefore, key workers should receive the same amount of compensation and hazard pay as the military where the harms, risks and burdens are equivalent. In the UK, a form of no-fault compensation has recently been made available to the surviving families of key workers who suffer fatal COVID-19 infections. According to our argument, however, it is insufficient because it offers less to key workers than is made available to the families of armed services personnel killed on duty. (shrink)

I present a “reduced” version of the fifteen Pragma-dialectical rules and inquire into their theoretical status as necessary conditions for a critical discussion. Questions: In what respect is PD’s non-sufficiency a deficiency, can and must it be remedied? Brief answers: with respect to defining the concept ‘critical discussion,’ possibly, yes, if, and only if, one seeks to identify the concept ‘critical discussion’; no, if PD is for fallacy-detection.

Accordingly, this book will be of great interest and benefit to anyone working in the fields of phenomenology, hermeneutics, or Heidegger studies.

_Intellectuals in Politics in the Greek World_, first published in 1984,_ _was the first comprehensive study of this recurrent theme in political sociology with specific reference to antiquity, and led to significant revaluation of the role of intellectuals in everyday political life. The term ‘intellectual’ is carefully defined, and figures as diverse as Pythagoras, Plato and Aristotle; Isocrates, Heracleides of Ponteius and Clearchus of Soli are discussed. The author examines the difference between the success of an intellectual politician, like Solon, (...) and the failure of those such as Plato who attempted to mould society to abstract ideals. It is concluded that, ultimately, most philosophers were conspicuously unsuccessful when they intervened in politics: citizens regarded them as propagandists for their rulers, while rulers treated them as intellectual ornaments. The result was that many thinkers retreated to inter-scholastic disputation where the political objects of discussion increasingly became far removed from contemporary reality. (shrink)

Das Verhältnis von Handlungsphilosophie zu Handlungstheorien kann daher so gefaßt werden, daß Handlungsphilosophie die Grundbegrifflichkeit in kritischer Absicht bereitstellt, die den bereichsorientierten, mehr oder weniger deskriptiven Handlungstheorien abgehen muß. Dazu muß die ontologische Differenz von Handlung und Interpretation methodologisch ernst genommen werden. The individualization thesis has been widely applied to explain women’s increasing autonomy in romantic relationships and marital decisions across both Western and non-Western contexts. In China, individualization is believed to have enhanced women’s freedom in love and marriage, supported by the 1950 Marriage Law, which abolished arranged marriages and granted women equal legal status to men. However, Chinese women still face notable constraints in exercising full autonomy over their choice of partners and the timing of marriage. Parental involvement in matchmaking, (...) pressure from media discourses that stigmatize “leftover women”, and social expectations continue to define women’s happiness in relation to timely marriage and childbearing. Importantly, Confucian family and gender norms now appear to have a greater influence on women’s romantic choices than they did during the early reform era. With the “return” of Confucian marital values and increasing parental involvement in matchmaking, does the individualization thesis still sufficiently explain Chinese women’s marital freedom? By addressing the “nonlinear” aspect of second modernity, this article aims to deconstruct the concept of “traditions” within the marital sphere. It argues that traditions have re-emerged in an “evolved” form, blending both traditional and modern requirements within China’s unique context of individualization. The nonlinear nature of individualization offers a dynamic perspective for understanding the complex relationship between tradition and modernity in rapidly transforming societies like China. Nearly a decade ago, Ingrid Robeyns formulated a distributive justice doctrine known as economic limitarianism. This article posits that Robeyns’ limitarianism is a politically plausible, practically feasible and morally justifiable doctrine. The doctrine effectively addresses concerns regarding incentives, efficacy and unequal opportunities. The article identifies a problem of scope or extensity, which it refers to as an asymmetric argument. The article proposes that this issue can be resolved by fully extending limitarianism to non-democratic states. This extension is justified by the (...) relationship between surplus money and political inequality, which can be explained through various avenues, including causal and constitutive explanations, structural injustice and systemic causation. While this list of avenues is not exhaustive, it is representative of the possible avenues that can be explored. Fully extending the doctrine to non-democratic states would enhance its robustness. This chapter philosophically examines the transformation of “Walter White” into “Heisenberg,” as depicted in the television series Breaking Bad, in terms of Søren Kierkegaard’s “stages of life” and Carl Jung’s “process of individuation.” Though Walt’s transformation is an oft-discussed topic regarding Breaking Bad, there has yet to appear in the philosophical literature an examination of this transformation in terms of Kierkegaard and Jung. Such an examination is important since it also addresses a number of the questions regarding the shift in (...) Walt’s moral compass given his terminal prognosis. That is to say, Walt’s transformation into Heisenberg in terms of Kierkegaard and Jung provides a moral account of his decisions without sacrificing a notion of his free-will or accepting the imminence of death as justification for the perpetration of evil.
