The question of what is truly just in the matter of a country's currently established human-rights interpretations appears not to be the same as the question of what it is morally right to do by way of coercively effectuating a given set of such interpretations. There are grounds for contending that acts of support for a coercive political regime can be justified morally on the condition that the regime's prevailing human-rights interpretations are made continuously available to effective, democratic critical re-examination. This chapter considers the establishment freedom, concentrating on three aspects where recent European Court of Justice decisions have appeared to enlarge its scope but have also left unsolved questions on particular aspects. First, it looks at the nature of the establishment freedom, distinguishing it from the other freedoms, in particular the right to provide services and free movement of capital. Second, the chapter examines who are the beneficiaries of the right of establishment and, in particular, the position of legal persons, (...) companies, where harmonization of member states' company laws has achieved results but has not solved all problems. Finally, it addresses the question of which parties are obliged by the treaty to respect the right of establishment and considers a 2007 judgment, Viking, which, with the Laval decision concerning services, caused much criticism. Certain artworks are––whatever else they are––statements about the value of art. A particularly striking form of such a statement is made by a class of artworks we can call “high-cost art.” High-cost artworks are those with greater costs relative to benefits for their artists or displayers. I will argue here that those art forms that are most likely to include high-cost works are particularly effective at communicating artistic value-claims, and suggest that by so championing the value of art, these artworks (...) themselves increase in artistic value. One common way of framing the recent history of definitional theories of art has it that Wittgensteinian challenges to the definitional project were not successful in establishing the impossibility of a successful definition, but they were successful in providing limits on the kinds of theories that can work. A key part of this story concerns Morris Weitz’s argument that “art” is indefinable because art is – as he calls it – an “open concept”. The argument has since been refuted by (...) definitional theories that account for art’s openness. Doing so, in fact, has become something of a motivation for and a requirement of subsequent theories. I argue here, however, first that accepting Weitz’s premise that art is open has led to an unfortunate pessimism about providing thoroughly informative definitional theories, and second that such pessimism is unwarranted. Art is not, in fact, open in the way Weitz suggests. Recognizing this should enable us to once again seek more informative definitional theories. (shrink)

This paper argues that the deconstructionist reading of Heidegger does not take fully into account the subtleties of his account of temporality. These subtleties include the mutually effacing character of being and temporality which allows for the event of disclosure to happen. The paper concludes that Heidegger's version of temporality can be upheld without conflating it with a view of time defined merely as flux.

Most experts would agree that the current medical malpractice system in the United States does not work effectively either to compensate victims fairly or prevent injuries caused by medical errors. Policy responses to a series of medical malpractice crises have not resulted in effective reform and have not altered the fundamental incentives of the stakeholders. In Medical Malpractice, economist Frank Sloan and lawyer Lindsey Chepke examine the U.S. medical malpractice process from legal, medical, economic, and insurance perspectives, analyze past (...) efforts at reform, and offer realistic, achievable policy recommendations. They review the considerable empirical evidence in a balanced fashion and assess objectively what works in the current system and what does not. African trypanosomes, which cause sleeping sickness in man and other mammals, are able to evade immune destruction in their hosts by altering the expression of a major cell surface molecule, the variant surface glycoprotein (VSG). The VSGs are encoded by a multigene family, and antigenic variation occurs when the trypanosome switches from expression of one VSG gene to another. This switching process involves changes in the arrangement of the trypanosome genomic DNA.

Selbst dort, wo vielfiiltige Positionen in Forschung und Lehre dargestellt werden, geschieht dies selten systematisch vergleichend. Auch werden hierbei keine Methoden entwickelt, die herausfinden lassen, ob es sieh bei den verschiedenen Positio nen urn Alternativen handelt und wie unter ihnen gegebeneofalls LOsungen als die vorerst besten (...) auszuzeichnen sind. There are signs of both secularization and religionization in the world today. Consistent with the modernization-secularization thesis, structural factors such as increasing economic security, societal complexity, and information flow are broadly associated with greater personal autonomy, worldview individualization, and erosion of some religious forms. At the same time, ‘counter-secular’ reassertions or transformations of religion have arisen for psychological, cultural, and political reasons. Amid these broad developments, active or public forms of atheism have also emerged, particularly in Europe and the Anglophone (...) world. Self-conscious, assertive atheism and other forms of philosophical or ideological secularism have both intended and unintended effects in the processes of secularization and religionization. But a quieter and potentially more pervasive result of all these forces may be greater worldview diversity and individualization across the secular-religious spectrum. (shrink)
