This manuscript describes a pilot study in ethics education employing a problem-based learning approach to the study of novel, complex, ethically fraught, unavoidably public, and unavoidably divisive policy problems, called “fractious problems,” in bioscience and biotechnology. Diverse graduate and professional students from four US institutions and disciplines spanning science, engineering, humanities, social science, law, and medicine analyzed fractious problems employing “navigational skills” tailored to the distinctive features of these problems. This approach may provide a model for educating future bioscientists and bioengineers so that they can meaningfully contribute to the social understanding and resolution of challenging policy problems generated by their work. We believe that the professional responsibility of bioscience and biotechnology professionals includes a social responsibility to contribute to the resolution of ethically fraught policy problems generated by their work. It follows that educators have a professional responsibility to prepare future professionals to discharge this responsibility. This essay discusses two pilot projects in ethics pedagogy focused on particularly challenging policy problems, which we call “fractious problems”. The projects aimed to advance future professionals’ acquisition of “fractious problem (...) navigational” skills, a set of skills designed to enable broad and deep understanding of fractious problems and the design of good policy resolutions for them. A secondary objective was to enhance future professionals’ motivation to apply these skills to help their communities resolve these problems. The projects employed “problem based learning” courses to advance these learning objectives. A new assessment instrument, “Skills for Science/Engineering Ethics Test”, was designed and administered to measure the success of the courses in doing so. This essay first discusses the rationale for the pilot projects, and then describes the design of the pilot courses and presents the results of our assessment using SkillSET in the first pilot project and the revised SkillSET 2.0 in the second pilot project. Human genetic engineering may soon be possible. The gathering debate about this prospect already threatens to become mired in irresolvable disagreement. After surveying the scientific and technological developments that have brought us to this pass, _The Ethics of Genetic Engineering_ focuses on the ethical and policy debate, noting the deep divide that separates proponents and opponents. The book locates the source of this divide in differing framing assumptions: reductionist pluralist on one side, holist communitarian on the other. The book argues (...) that we must bridge this divide, drawing on the resources from both encampments, if we are to understand and cope with the distinctive problems posed by genetic engineering. These problems, termed "fractious problems," are novel, complex, ethically fraught, unavoidably of public concern, and unavoidably divisive. Berry examines three prominent ethical and political theories – utilitarianism, Kantianism, and virtue ethics – to consider their competency in bridging the divide and addressing these fractious problems. The book concludes that virtue ethics can best guide parental decision making and that a new policymaking approach sketched here, a "navigational approach," can best guide policymaking. These approaches enable us to gain a rich understanding of the problems posed and to craft resolutions adequate to their challenges. (shrink)

This essay describes an interdisciplinary educational experiment in health law. The experiment was funded by the National Science Foundation, received Institutional Review Board approvals, incorporated inter-disciplinary faculty and graduate students from several universities in Atlanta, and employed problem-based learning. After discussing my motivation to undertake this experimental approach to teaching health law, I explain how the course was developed and structured and how we are assessing its results. I also offer some reflections on why other health law teachers might be (...) motivated to incorporate some features of our experimental approach into their own classes, and some thoughts on how they might do so based on lessons learned.I undertook this experiment to test in an educational setting an approach to problem solving that I have developed for addressing certain kinds of seemingly intractable policy problems. My claim in this paper is that what I shall call the problem of public reason became central to the political theory of the early modern period, and continues to be in ours. However the solutions we have, for the most part, inherited and developed since then are increasingly under pressure in these fractious times. Public justification may be crucial to liberal political theory, but it can take alternative and conflicting forms. Particularly in the sixteenth and seventeenth centuries, the Swedish court and universities insisted militantly that the kingdom was the Gothic homeland, and this has fostered an assumption that Gothicism represents a kind of embryonic nationalism. This interpretation (...) was almost inevitable given the circumstances of modern interest in the phenomenon. Scandinavian scholars were the first to pick up the Gothic thread in the earlier twentieth century, and Swedes in particular have dominated the literature on Gothicism. At least in the early years, this may be [End Page 213] related to a general trend to interpret the past in terms of a relatively inflexible, modern concept of nation. These earlier studies accordingly relied largely on the same, mostly Swedish, sources. Later work has generally not expanded the framework of the discourse, however.1 A number of important early modern texts that show the much broader appeal of Gothicism are not accounted for in the standard narrative of the rise of the phenomenon in the early modern period. I will show that the Scandinavian interpretation has been allowed to overshadow a much broader Gothic tradition that encompassed a broad part of Europe, including the German lands and Spain. Gothicism has thus been reduced to just one aspect of its original scope, and the scholarly nuances and historical jockeying that shaped the narrative have largely been lost. This reduction has had consequences not only for the familiar version of the story, largely derived from Swedish texts, but also for our understanding of history writing in the sixteenth and seventeenth centuries.The Gothicism debate may be unique in its breadth and in the intensity of interest that it elicited. It is also remarkable for the variety of approaches to historical writing that scholars applied as each tried to develop a more impregnable argument than the last. Linguistic, geographical, archaeological, antiquarian, and textual methods intersected freely, inviting shifting and overlapping versions of the Gothic narrative that sometimes trace the linguistic legacy of the tribe, sometimes the ethnic legacy, and sometimes bind the two together. All of these narratives were basically concerned with the antiquity of the Goths and their legacy in early modern Europe. The implications of this were different for various regions and rulers, but most wanted to claim for themselves the strength, prestige, and antiquity of the tribe that toppled the Roman Empire, thus enhancing their own often dubious historical legitimacy. [End Page 214]This debate often took a polemical character, particularly in the political sphere, where there were fierce disputes over which region was the true homeland of the tribe, and thus which area (or people or ruling dynasty) could claim the greatest honor from their exploits and claim to be their most direct descendants. But there was also a very clear corollary to this contentious discourse. As scholars from across a wide area produced mountains of evidence pointing to the Gothic origins of their own regions, it became possible to think of Gothic origins not only in terms of difference—which kingdom, dynasty, or geographic region could claim the greatest antiquity and eminence—but also in terms of shared history and common identity across political, geographical, and linguistic boundaries. In general, the polemic was restricted to the origins of the Goths. Many writers seem to have accepted that the Gothic lands cumulatively formed a sort of historical unity that was lost through later political divisions, but which could still be traced through other means. Particularly in the Holy Roman Empire—a largely political boundary encompassing many smaller states ruled by famously fractious princes of different confessions and languages—the more conceptual notion of deep-seated Gothic origins opened the way for a different alignment of identity both within and without the boundaries of the Empire, and especially with Scandinavia, which contributed such rich arguments to the debate.There are several significant problems in a study of the early-modern view of the Goths beyond the historiographical ones outlined above. By bringing together sophisticated analyses and pertinent case studies from around the world it aims to address the problems facing archaeologists working in areas of violent conflict, past and present. Of all the contentious issues within archaeology and heritage, the study of conflict and work within conflict zones are undoubtedly the most highly charged and hotly debated, both within and outside the discipline. What is special about the philosophy of history when the history is about science? I shall focus on an impasse between two perspectives — one seeking an ideal of rationality to guide scientific practices, and one stressing the contingency of the practices. They disagree on what this contingency means for scientific norms. Their impasse underlies some fractious relations within History and Philosophy of Science. Since the late 1960s, this interdisciplinary field has been described, variously, as an “intimate relationship or (...) marriage of convenience”, a “marriage for the sake of reason”, a “troubling interaction ”, a “precarious relationship”, or one at risk of “ epistemological derangement”. -/- My paper has three aims. First, I characterise two idealised perspectives in this impasse: the sublimers and subversives. Then I describe a curious dynamic in which each perspective accuses the other of, simultaneously, claiming too little and too much. Subliming is dismissed for being scholastic, and condemned for being imperialist. Subverting is disparaged for being merely sociological, then criticised for being irrational or relativist. Here I draw on and extend the analyses of science studies in Kitcher, Zammito and others. Second, I argue that sublimers and subversives often talk past each other. Their mutual dismissals and condemnations arise partly because each perspective misconstrues the other’s claims. Each fails to see that the other is interested in different problems and interprets concepts differently. Third, I suggest that my analysis clarifies some current disagreements and old debates about contingency in science. It may also apply to debates on the contingency of norms in non- scientific realms. (shrink)

Why has the flow of big, world-changing ideas slowed down? A provocative look at what happens next at the frontiers of human knowledge. In recent years, a number of philosophers and social scientists have argued in favor of or against retributive theories of criminal punishment based on empirical findings about folk punitive judgment and decision-making. In this paper, we will argue that these arguments do not succeed. We will raise two objections. First, there are serious gaps between the empirical findings these authors cite and the descriptive premises these findings are meant to support. Second, in many cases, the existing research does not support (...) the specific empirical claims that feature in these arguments. Specifically, a large part of the existing psychological research and some philosophers claim that people are mainly driven by retributive motives. We will show that a large portion of the empirical research is not designed in a way to specifically test this claim, and to the extent that some studies are able to investigate this claim, we show that the evidence suggests that people are motivated by a variety of concerns, including consequentialist motives. We discuss possible responses and implications for the philosophy of criminal punishment, and provide suggestions for improved study designs. (shrink)

This book explores noteworthy approaches to modal syllogistic adopted by medieval logicians including Abélard, Albert the Great, Avicenna, Averröes, Jean Buridan, Richard Campsall, Robert Kilwardby, and William of Ockham. The book situates these approaches in relation to Aristotle's discussion in the Prior and Posterior Analytics, and other parts of the Organon, but also in relation to the thought of Alexander of Aphrodisias and Boethius on the one hand, and to modern interpretations of the modal syllogistic on the other. Problems (...) explored include: Aristotle's doctrine of modal conversion, the pure and mixed necessity-moods, modal ecthesis, the pure and mixed contingency-moods, and Aristotle's use of counter-examples. This book introduces profound reflections of Xavier Zubiri on the history of philosophy to English-speaking audiences. The book discusses the transcendental in Western philosophy and how a firm grasp of it reveals underlying unity, but also fundamental problems that Zubiri believed require a complete rethinking of certain theories.

Two of the probabilistic measures of coherence discussed in this paper take probabilistic dependence into account and so depend on prior probabilities in a fundamental way. An example is given which suggests that this prior-dependence can lead to potential problems. Another coherence measure is shown to be independent of prior probabilities in a clearly defined sense and consequently is able to avoid such problems. The issue of prior-dependence is linked to the fact that the first two measures can (...) be understood as measures of coherence as striking agreement, while the third measure represents coherence as agreement. Thus, prior (in)dependence can be used to distinguish different conceptions of coherence. (shrink)

According to some views of reality, some objects are fundamental and other objects depend for their existence upon these fundamental objects. In this article, I argue that we have reason to reject these views.

Gettier problems or cases are named in honor of the American philosopher Edmund Gettier, who discovered them in 1963. They function as challenges to the philosophical tradition of defining knowledge of a proposition as justified true belief in that proposition. The problems are actual or possible situations in which someone has a belief that is both true and well supported by evidence, yet which — according to almost all epistemologists — fails to be knowledge. Gettier’s original article had (...) a dramatic impact, as epistemologists began trying to ascertain afresh what knowledge is, with almost all agreeing that Gettier had refuted the traditional definition of knowledge. They have made many attempts to repair or replace that traditional definition of knowledge, resulting in several new conceptions of knowledge and of justificatory support. In this respect, Gettier sparked a period of pronounced epistemological energy and innovation — all with a single two-and-a-half page article. There is no consensus, however, that any one of the attempts to solve the Gettier challenge has succeeded in fully defining what it is to have knowledge of a truth or fact. So, the force of that challenge continues to be felt in various ways, and to various extents, within epistemology. Sometimes, the challenge is ignored in frustration at the existence of so many possibly failed efforts to solve it. Often, the assumption is made that somehow it can — and will, one of these days — be solved. Usually, it is agreed to show something about knowledge, even if not all epistemologists concur as to exactly what it shows. (shrink)

The standard contextualist solution to the skeptical paradox is intended to provide a way to retain epistemic closure while avoiding the excessive modesty of radical skepticism and the immodesty of Moorean dogmatism. However, contextualism’s opponents charge that its solution suffers from epistemic immodesty comparable to Moorean dogmatism. According to the standard contextualist solution, all contexts where an agent knows some ordinary proposition to be true are contexts where she also knows that the skeptical hypotheses are false. It has been hoped (...) that contrastivist theories of knowledge can mirror the contextualist solution while avoiding this epistemic immodesty. I review the main problems for contrastive closure and argue that none of the arguments currently in the literature pose an insurmountable problem for the contrastivist solution. However, I argue that contrastivist theories of knowledge, like their contextualist rivals, are indeed committed to epistemic immodesty. (shrink)
