If personhood is the quality or condition of being an individual person, brainhood could name the quality or condition of being a brain. This ontological quality would define the `cerebral subject' that has, at least in industrialized and highly medicalized societies, gained numerous social inscriptions since the mid-20th century. This article explores the historical development of brainhood. It suggests that the brain is necessarily the location of the `modern self', and that, consequently, the cerebral subject is the anthropological figure inherent (...) to modernity (at least insofar as modernity gives supreme value to the individual as autonomous agent of choice and initiative). It further argues that the ideology of brainhood impelled neuroscientific investigation much more than it resulted from it, and sketches how an expanding constellation of neurocultural discourses and practices embodies and sustains that ideology. Este libro reduce la distancia entre esa imagen manifiesta y la imagen científica, dotando al lector de referencias fundamentales, enfoques diversos y un amplio abanico de temáticas a partir de investigaciones experimentales sobre nuestra conducta moral.

There is no systematic knowledge about how individuals with Locked-in Syndrome experience their situation. A phenomenology of LIS, in the sense of a description of subjective experience as lived by the ill persons themselves, does not yet exist as an organized endeavor. The present article takes a step in that direction by reviewing various materials and making some suggestions. First-person narratives provide the most important sources, but very few have been discussed. LIS barely appears in bioethics and neuroethics. Research on (...) Quality of Life provides relevant information, one questionnaire study explores the sense of personal continuity in LIS patients, and LIS has been used as a test case of theories in “embodied cognition” and to explore issues in the phenomenology of illness and communication. A systematic phenomenology of LIS would draw on these different areas: while some deal directly with subjective experience, others throw light on its psychological, sociocultural and materials conditions. Such an undertaking can contribute to the improvement of care and QOL, and help inform philosophical questions, such as those concerning the properties that define persons, the conditions of their identity and continuity, or the dynamics of embodiment and intersubjectivity. Since its emergence in the early 2000s, neuroethics has become a recognized, institutionalized and professionalized field. A central strategy for its successful development has been the claim that it must be an autonomous discipline, distinct in particular from bioethics. Such claim has been justified by the conviction, sustained since the 1990s by the capabilities attributed to neuroimaging technologies, that somehow ‘the mind is the brain’, that the brain sciences can illuminate the full range of human experience and behavior, and that (...) neuroscientific knowledge will have dramatic implications for views of the human, and challenge supposedly established beliefs and practices in domains ranging from self and personhood to the political organization of society. We perform an experimental investigation using a dictator game in which individuals must make a moral decision —to give or not to give an amount of money to poor people in the Third World. A questionnaire in which the subjects are asked about the reasons for their decision shows that, at least in this case, moral motivations carry a heavy weight in the decision: the majority of dictators give the money for reasons of a consequentialist nature. Based on the results (...) presented here and of other analogous experiments, we conclude that dicator behavior can be understood in terms of moral distance rather than social distance and that it systematically deviates from the egoism assumption in economic models and game theory. It looks at some of the fundamental ways in which this process involves science, but also more than science: not only data and knowledge and institutions, but also affects and values. This article deals with the relation between a theory of law and a theory of legal reasoning. Starting from a close reading of Chapter VII of H. L. A. Hart's The Concept of Law, it claims that a theory of law like Hart's requires a particular theory of legal reasoning, or at least a theory of legal reasoning with some particular characteristics. It then goes on to say that any theory of legal reasoning that satisfies those requirements is highly implausible, (...) and tries to show that this is the reason why not only Hart, but also writers like Neil MacCormick and Joseph Raz have failed to offer a theory of legal reasoning that is compatible with legal positivism as a theory of law. They have faced a choice between an explanation of legal reasoning that is incompatible with the core of legal positivism or else strangely sceptical, insofar as it severs the link between general rules and particular decisions that purport to apply them. This article shows how epideictic rhetoric and argumentation may be interrelated in a general-interest newspaper framed as a single discourse produced by a collective author. In more specific terms, the view advanced here is that newspaper as whole has an epideictic dimension which, in terms of argumentation, is the fundamental or predominant one. The usefulness of this approach is twofold. In terms of rhetoric, to explore the applicability of epideictic rhetoric to journalistic discourse; and in the field of journalism studies, (...) the goal is to draw on the theory of epideictic rhetoric so as to refine the conceptualization of the nature of argumentation in the newspaper as such. Given this twofold perspective, the account of newspaper discursive practices will be general, and the classical and contemporary epideictic theory will be briefly summarized. Starting from J. Fabian’s critique of anthropology and its study of the ‘primitive’ Other, Fernando Esposito discusses R. Koselleck’s work as a critique of historical practice, not least the practice of periodization. While often understood as ‘merely’ a contribution to the question of temporalities, Koselleck actually aimed to develop a new way of writing and understanding history. Seen in this light, his work on historical time is really about a fundamental theoretical reorientation of the discipline. This fundamental reinvention of (...) history was the central problem Koselleck wrestled with. Based on his personal experience of the Third Reich and the Second World War, he came to the conviction that history had no meaning and no goal, and therefore undertook a historicization of historicism, i.e. a re-evaluation of the way history had been written up to his own times. Koselleck’s historicization of historicism was a decisive chronopolitical act. It was catalyzed by his intention to debunk an unhistorical understanding of history and to replace it with a self-reflective, truly historicist historicism, a metahistory reflecting upon the ‘conditions of possible histories’. En este artículo presentamos las principales corrientes de la Filosofía Experimental y atendemos a una de las críticas más severas a la que se ha sometido este reciente programa de renovación metodológica. Según Antti Kauppinen la Filosofía Experimental está condenada al fracaso porque no puede obtener mediante sus métodos el tipo de intuiciones que interesan a los filósofos –las intuiciones robustas del hablante competente. Aun aceptando parte de las críticas de Kauppinen, en este artículo sostenemos, en primer lugar, que la (...) supuesta incapacidad de la Filosofía Experimental para acceder a las intuiciones robustas de los hablantes tiene que ver en gran medida con los métodos experimentales empleados hasta ahora por los filósofos experimentales. En segundo lugar, defendemos que el proyecto de reforma llevado a cabo desde la Filosofía Experimental resultará viable solo si se adoptan una serie de consejos metodológicos procedentes de la economía experimental. Únicamente entonces podrán los experimentalistas responder con éxito a la objeción de Kauppinen. (shrink)

En el marco del V Congreso Internacional «La actualidad de Michel Foucault» celebrado en la Universidad Complutense de Madrid entre el 6 y el 8 de marzo de 2018, sostuvimos una interesante conversación con Daniel Lorenzini, investigador del pensamiento ético y político de Michel Foucault y editor de varios de sus cursos y conferencias publicadas en los últimos años en Francia. Discutimos sobre el estado actual de los archivos de Foucault adquiridos por la Biblioteca Nacional de Francia (BnF), algunos de (...) los diversos proyectos editoriales que se derivan del trabajo de archivo y análisis de los manuscritos del filósofo, la reciente e inesperada publicación de Les aveux de la chair y su relación con el proyecto de la Historia de la sexualidad tal como fue planteado en 1976, la relación de Foucault con Nietzsche respecto a sus lecturas de la subjetivación y el vínculo, no siempre evidente, entre ética y política a la luz de sus investigaciones sobre el filósofo francés. Desde hace varias décadas, diversas organizaciones internacionales han venido prestando atención a la situación de las personas defensoras de derechos humanos. La Corte Interamericana de Derechos Humanos ha resaltado la importancia de las personas defensoras de derechos humanos para los sistemas democráticos y ha insistido en el deber de los Estados de adoptar medidas de protección en su favor. Este artículo se ocupa de tres aspectos principales de esta jurisprudencia: 1) la definición de la categoría de personas defensoras de derechos (...) humanos; 2) la extensión de los derechos de esta categoría; 3) las reparaciones ordenadas en casos de violaciones a esos derechos. O artigo tem como objetivo analisar a recíproca dependência dos direitos fundamentais, democracia e da paz, como três momentos integrantes do mesmo movimento histórico. Sem a devida proteção das liberdades fundamentais não se perfaz um governo democrático, pois, aludido regime sustenta-se na soberania popular, na separação de poderes e respeito pleno aos direitos humanos. Por outro lado, nota-se a paz como elemento intrínseco da ordem republicana, posto que fundada segundo os princípios cardeais da liberdade, igualdade e solidariedade. Antes de las normas que regulan la IA es necesario conocer las cuestiones éticas relacionadas con el desarrollo, la implementación y el uso responsable de los sistemas de IA. El concurso de estos fundamentos éticos es necesario para proteger los derechos y la dignidad de las personas, garantizar la equidad en el acceso y tratamiento de datos, minimizar los sesgos y riesgos asociados (...) con los algoritmos, promover la transferencia en las decisiones automatizadas y auspiciar la confiabilidad en la tecnología, el beneficio humano y el bienestar social.También se propone el estudio de la ética de la IA desde un punto de vista omnicomprensivo que integre tanto la ética aplicada como la metaética de la IA. Este artigo aborda as questões de regulação de mercados com foco em dois países: China e Estados Unidos da América, ambos influentes na condução de cenários políticos, econômicos, tecnológicos e sociais. O objetivo da pesquisa é demonstrar, por meio da revisão dos dois maiores sistemas econômicos – capitalismo e socialismo – como os aplicativos chineses WeChat e TikTok suscitaram conflitos em prol da regulação de mercados que utilizam inovações tecnológicas. A pesquisa adotou o método dedutivo e bibliográfico, por meio de (...) documentação indireta. Conclui-se que os conflitos eram mais ideológicos-políticos do que jurídicos-normativos. (shrink)

Este artículo busca reconstruir en lo que consideramos sus tres momentos principales el ideal renacentista y moderno de una República literaria. Conforme a esos momentos, el trabajo se divide en tres secciones. La primera estará dedicada a la República literaria tal como la concibieron los humanistas del Renacimiento y la temprana Modernidad. La segunda, buscará comprender el peso que tuvieron los periódicos literarios en la transformación de aquella República. En la tercera, finalmente, trataremos de reconstruir la República literaria en la (...) España de mediados del siglo XVIII, la España del Padre Feijoo, quien asume buena parte del pasado erudito europeo buscando recrearlo en la medida de lo posible conforme a las circunstancias locales. Jean Starobinski on the Reason of Body In posthumous homage to Jean Starobinski (1920-2019) on the centennial of his birth, this article sketches his thought on the «reasons of the body», linking it to certain contemporary fields of research. Prolonging the «somatic turn» of the 1980s, more recent «emotional» and «interoceptive turns» claim to reintegrate the body into history, the humanities and the neurocognitive sciences. Starobinski’s perspective helps bring their limits to light. Conversely, approaching his critical enterprise from their vantage (...) point highlights its unique way of linking history and phenomenology, its sustained attention to the experience of the self and bodily self-awareness, and its demonstration of how the «reasons of the body» may be intimately bound to the literary expression that embodies them. In Dark City, people live in a city that is constantly in the dark. The city is in fact a laboratory constructed by a race of Strangers who live below the urban surface to do experiments aimed at discovering what makes human beings human. The Strangers will survive only by becoming like them. To find out what humanity is, but assuming it is essentially related to memory, every day they paralyze all human activity, extract memories from individuals, mix them, and (...) inject them back. When people wake up, they are totally different persons – but do not know it. This article examines how, starting with such a situation, Dark City explores the role of memory in personhood, the problem of authenticity, and the status of “false” memories in making the self, and how the connect to the experimental psychology and the neuroscience of memory. In his pioneering work in the field of inductive inference, Gold (Inf Control 10:447–474, 1967) proved that a set containing all finite languages and at least one infinite language over the same fixed alphabet is not identifiable in the limit (learnable in the exact sense) from complete texts. Gold’s work paved the way for computational learning theories of language and has implications for two linguistically relevant classes in the Chomsky hierarchy (cf. Chomsky in Inf Control 2:137–167, 1959, Chomsky in Knowledge (...) of language: its nature, origin, and use, Praeger, 1986; Shieber in Linguist Philos 8:333–343, 1985; Heinz in Linguist Inq 41:623–661, 2010). Within that same framework, Angluin (Inf Control 45:117–135, 1980) provided a complete characterization for the learnability of language families. Mathematically, the concept of identification in the limit from that classical setting can be seen as the use of a particular type of metric for learning in the limit (Wharton in Inf Control 26:236–255, 1974). In this research note, I use Niyogi’s extended version of a theorem by Blum and Blum (Inf Control 28:125–155, 1975) on the existence of locking data sets to prove a necessary condition for learnability in the limit of any family of languages with the Gold property in any given metric. This recovers the most general version of Gold’s Theorem as a particular case. Moreover, when the language family is further assumed to contain all finite languages, the same condition also becomes sufficient for learnability in the limit. Finally, we discuss questions that are left open and outline a research program regarding language learnability in the limit from other input types and cognitive feasibility. (shrink)

Este artigo objetiva apresentar os Conselhos de Políticas Públicas como instrumentos de aproximação da sociedade civil com o Estado. Busca-se debater se referidos institutos estão cumprindo de fato com sua função de efetivar o Estado Democrático de Direito. Para tanto, utilizou-se o método analítico-dedutivo, com enfoque em pesquisas bibliográficas e legislativas. Os conselhos, por serem instâncias formais na esfera pública, proporcionam a manifestação democrática por meio da participação ativa da sociedade no exercício de sua cidadania, conquanto seja necessária uma reconfiguração (...) da própria cultura participativa. Social identity poses one of the most important challenges to rational choice theory, but rational choice theorists do not hold a common position regarding identity. On one hand, externalist rational choice ignores the concept of identity or reduces it to revealed preferences. On the other hand, internalist rational choice considers identity as a key concept in explaining social action because it permits expressive motivations to be included in the models. However, internalist theorists tend to reduce identity to desire—the desire of (...) a person to express his or her social being. From an internalist point of view, that is, from a viewpoint in which not only desires but also beliefs play a key role in social explanations as mental entities, this article rejects externalist reductionism and proposes a redefinition of social identity as a net of beliefs about oneself, beliefs that are indexical, robust, and socially shaped. The control principle implies that people should not feel guilt for outcomes beyond their control. Yet, the so-called ‘agent and observer puzzles’ in philosophy demonstrate that people waver in their commitment to the control principle when reflecting on accidental outcomes. In the context of car accidents involving conventional or autonomous vehicles, Study 1 established that judgments of responsibility are most strongly associated with expressions of guilt–over and above other negative emotions, such as sadness, remorse or anger. Studies 2 and 3 (...) then confirmed that, while people generally endorse the control principle, and deny that occupants in an AV should feel guilt when involved in an accident, they nevertheless ascribe guilt to those same occupants. Study 3 also uncovered novel implications of the observer puzzle in the legal context: Passengers in an AV were seen as more legally liable than either passengers in a conventional vehicle, or even their drivers–especially when participants were prompted to reflect on the passengers’ affective experience of guilt. Our findings document an important conflict–in the context of AV accidents–between people’s prescriptive reasoning about responsibility and guilt on one hand, and their counter-normative experience of guilt on the other, with apparent implications for liability decisions. Este artículo discute la relación entre la teoría democrática y las instituciones que pretenden realizarla. Dada la relación entre ambas, en toda explicación de las instituciones democráticas es posible leer, a pesar de sus autores incluso, una teoría de la democracia y viceversa. Este punto es ilustrado por una comprensión “realista” de la democracia, usando como ejemplo la defendida por Hans Kelsen en su Esencia y valor de la democracia. La crítica “populista” a la democracia realmente existente tiene una inesperada (...) continuidad con una teoría realista como esa. La pregunta entonces discutida es si esa continuidad muestra algo acerca de la imposibilidad de la democracia en nuestra época, que sería por eso la época del populismo. (shrink)

A ética do discurso justifica o conteúdo de uma moralidade que salienta a simetria entre os sujeitos e a solidariedade entre todos. Para Habermas “a solidariedade é a outra face da justiça” (1999, p. 42), ou seja, são duas faces da mesma moeda. Esta é uma afirmação chave em relação ao conteúdo cognitivo do âmbito moral. A validade das normas pressupõe uma fundamentação normativa estruturada linguisticamente, de forma a vincular a justiça com a solidariedade. A ênfase está em uma razão (...) prática capaz de fundamentar princípios igualitários e universalistas da moral e do direito (2009, p. 63). A legitimação do estado de direito deve preservar sua neutralidade ideológica, alicerçada em uma moral racional, isto é, laica (ou secular). Com isso, as exigências normativas devem ser aceitas por todos em uma sociedade pluralista, formada por cidadãos de diferentes credos e, inclusive, por não crentes (HABERMAS, 2009, p. 69). (shrink)

Of the many teachings on triadic semiotic that I was fortunate to receive in my life, none was more long-lasting and stimulating than what I learned by reading and exchanging ideas with Joseph Ransdell. And most salient among the ideas he explained with such admirable clarity were those related to iconicity, that apparently simple but most enigmatic relationship of formal identity between a sign and its object.
