When several agents together produce suboptimal outcomes, yet no individual could have made a difference for the better, Act Consequentialism counterintuitively judges that all involved agents act rightly. I address this problem by supplementing Act Consequentialism with a requirement of modal robustness: Agents not only ought to produce best consequences in the actual world, but they also ought to be such that they would act optimally in certain counterfactual scenarios. I interpret this Modally Robust Act Consequentialism as Act Consequentialism plus (...) a requirement of moral virtue, namely, to reliably act rightly and to act rightly for the right reasons. As a scientific discipline and profession, law has been for centuries at the heart of social and political power of many Western societies. Professors of law, as influential representatives of the profession, are important powerbrokers between academia, politics and the corporate world. Their influence is based on scientific reputation, institutional mandates inside and outside academia or privileged network connections with people in powerful positions. In this study, based on a full sample of all Swiss law professors in the years 1957, (...) 1980 and 2000, we contrast two theories of the distribution of power among law professors: Bourdieu’s thesis on the trade-off between scientific reputation and -academic institutional power vs. the thesis of an opposition between a group of established incumbents and socio-demographically marginal challengers who try to gain access to the profession. We show that among Swiss law professors the endowment with scientific capital is not opposed to the possession of institutional power within academia. Our findings reveal rather an opposition between a challenging group of professors devoid of resources and an incumbent fraction with a high amount of scientific, institutional and social capital alike. In the conclusion we discuss a series of explanations of this specific power structure, including the specific status scientific reputation and social capital can have for law professors. (shrink)

From the Hippocratic Oath on, deontological codes and other professional self-regulation mechanisms have been used to legitimize and identify professional groups. New technological challenges and, above all, changes in the socioeconomic environment require adaptable codes which can respond to new demands.We assume that ethical codes for professionals should not simply focus on regulative functions, but must also consider ideological and educative functions. Any adaptations should take into account both contents (values, norms and recommendations) and the drafting process itself.In this article (...) we propose a process for developing a professional ethical code for an official professional association (Colegio Oficial de Ingenieros Industriales de Valencia (COIIV) starting from the philosophical assumptions of discursive ethics but adapting them to critical hermeneutics.Our proposal is based on the Integrity Approach rather than the Compliance Approach. A process aiming to achieve an effective ethical document that fulfils regulative and ideological functions requires a participative, dialogical and reflexive methodology. This process must respond to moral exigencies and demands for efficiency and professional effectiveness.In addition to the methodological proposal we present our experience of producing an ethical code for the industrial engineers’ association in Valencia (Spain) where this methodology was applied, and we evaluate the detected problems and future potential. El presente artículo se centra en el estudio de la exégesis que lleva a cabo Plotino en torno a la significación de la inefabilidad del uno, planteada en el Parménides platónico al hilo de la primera hipótesis. Este ubica a este primer uno inefable en el centro mismo de su sistema, lo que tendrá fuertes implicaciones tanto a nivel ontológico como por lo que respecta a la comprensión del lenguaje. la concepción de la realidad que se deriva de esta inefabilidad (...) del primer principio, de un lado, y las implicaciones en la naturaleza del lenguaje filosófico que abre este postulado, de otro, ocuparán la centralidad de nuestras reflexiones. Atenderemos a los textos originales en los que se plantea la cuestión, apoyándonos en la labor de la crítica, discutiendo los puntos fundamentales a fin de esclarecer la posición que encontramos en las Enéadas. Tomaremos, asimismo, en consideración la actualidad que tiene esta posición y su capacidad de ir más allá de la crítica heideggeriana a la metafísica. (shrink)

Las reticencias de Hegel sobre la viabilidad de la democracia en el estado moderno pueden explicarse parcialmente como una "querella de palabras", ya que él entiende ese término en el sentido original griego. Cuando se atiende al final del capítulo VI de la Fenomenología del espíritu, y se traduce en sentido secularmente "político" la doctrina del "perdón de los pecados", sustituyendo al "Dios reconciliador" por una conciencia colectiva, formada a partir de aquellos espíritus escogidos que Nietzsche denominara como "buenos europeos", (...) se advierte entonces la posibilidad, no sólo de cerrar satisfactoriamente el curso fenomenológico de la conciencia moral, sino también y sobre todo de aplicar esa concepción a un problema acuciante como el de la futura -y tan controvertida- Konstitution europea, en cuanto plasmación de la interna "Constitución" [Verfassungl de la actual Unión, sin que pueda ser entendida en consecuencia aquélla como una imposición externa sobre ésta.Hegel's hesitancy over the viability of democracy in the modern state may be partially explained as a "dispute of words", since his understanding of the term corresponds to the original Greek meaning. On examining the end of Chapter 6 of the Phenomenology of the Spirit, the doctrine of the "forgiveness of sins" may be interpreted in a secular "political" sense, substituting the "reconciliation God" with a collective conscience, formed from the chosen spirits that Nietzsche calls "good Europeans". It is then noted that not only is it possible to satisfactorily close the phenomenological course of the moral conscience, but also and above all, this conception can be applied to such a pressing problem as that of the future -and controversial- European Konstitution, as an expression of the internal "Constitution" [Verfassung] of the present day Union. En este esbozo de una lógica (...) del exceso, se examinan las figuras decimonónicas de lo criminal, lo fantasmal y lo satánico, las cuales retornan ulteriormente en la llamada postmodernidad como terrorismo, drogadicción y travestismo. The threat of terrorism once again raises some of the classic questions about constitutionalism: is it possible for constitutions to do what they aim to do—channel and control political power in such a way as to make it safe and beneficent for those under its rule but also competent to govern? Does not terrorism reraise the Schmittian problem of “the exception”, i.e., the situation of emergency that necessarily escapes all constitutional limitations? Although they did not face the problem of terrorism (...) as we know it, the American founders developed three different models of constitutionalism, embodying three different ways of responding to emergent circumstances and yet remaining bound to the constitutionalist aspiration. We develop the main outlines of the three models both conceptually and historically and show how they continue to be relevant to current discussions of constitutionalism in the age of terror. Finally, we make a tentative effort to judge which of the three models is most able to do what constitutions should do in difficult times. (shrink)

This collection of original essays on political and legal theory concentrates on themes dealt with in the work of Felix Oppenheim, including fundamental political and legal concepts and their implications for the scope of morality in politics and international relations. Among the issues addressed are the relationship between empirical and normative definitions of "freedom", "power", and "interests", whether governments are free to act against the national interest, and whether they can ever be morally obliged to do so.

Both the sound and the sea are characterized by a constant fluidity and transformation, which has been considered as a creative foundation for expanded sonic practices that identify, capture and experiment with natural elements. The text aims to explore how the idea of sonification as a process of translating qualities and data into sound constitutes the departure point towards contemporary sound practices that encourage deeper listening and immersive experiences. Taking the sea-responsive sound installations of French artist Félix Blume, Rumors from (...) the Sea and Suspiros as a foundation, the article presents a reflective conversation between Félix Blume and Bill Psarras on aspects of such artworks that highlight ideas of sea and limens, listening experience, sound ecology and sonic instruments through performative, inventive and participatory lenses. The aim of this paper is to argue that lying differs from mere misleading in a way that can be morally relevant: liars commit themselves to something they believe to be false, while misleaders avoid such commitment, and this difference can make a moral difference. Even holding all else fixed, a lie can therefore be morally worse than a corresponding misleading utterance. But, we argue, there are also cases in which the difference in commitment makes lying morally better than misleading, (...) as well as cases in which the difference is not morally relevant. This view conflicts with the two main positions philosophers have defended in the ethics of lying and misleading, which entail either that lying is in virtue of its nature worse than misleading or that there is no morally relevant difference between lying and misleading.
