Most philosophers assume that ‘ought’ implies ‘can’, and most of them hold that this principle is true not only universally but also analytically or conceptually. Some skeptics deny this principle, although they often admit some related one. In this article, we show how new empirical evidence bolsters the skeptics’ arguments. We then defend the skeptical view against some objections to the empirical evidence and to its effect on the traditional principle. Counterfactual thinking involves imagining hypothetical alternatives to reality. Philosopher David Lewis argued that people estimate the subjective plausibility that a counterfactual event might have occurred by comparing an imagined possible world in which the counterfactual statement is true against the current, actual world in which the counterfactual statement is false. Accordingly, counterfactuals considered to be true in possible worlds comparatively more similar to ours are judged as more plausible than counterfactuals deemed true in possible worlds comparatively less similar. Although Lewis (...) did not originally develop his notion of comparative similarity to be investigated as a psychological construct, this study builds upon his idea to empirically investigate comparative similarity as a possible psychological strategy for evaluating the perceived plausibility of counterfactual events. More specifically, we evaluate judgments of comparative similarity between episodic memories and episodic counterfactual events as a factor influencing people's judgments of plausibility in counterfactual simulations, and we also compare it against other factors thought to influence judgments of counterfactual plausibility, such as ease of simulation and prior simulation. Our results suggest that the greater the perceived similarity between the original memory and the episodic counterfactual event, the greater the perceived plausibility that the counterfactual event might have occurred. While similarity between actual and counterfactual events, ease of imagining, and prior simulation of the counterfactual event were all significantly related to counterfactual plausibility, comparative similarity best captured the variance in ratings of counterfactual plausibility. Implications for existing theories on the determinants of counterfactual plausibility are discussed. (shrink)

In four studies, we investigated the role of remembering, reflecting on, and mutating personal past moral transgressions to learn from those moral mistakes and to form intentions for moral improvement. Participants reported having ruminated on their past wrongdoings, particularly their more severe transgressions, and they reported having frequently thought about morally better ways in which they could have acted instead (i.e., morally upward counterfactuals; Studies 1–3). The more that participants reported having mentally simulated morally better ways in which they could (...) have acted, the stronger their intentions were to improve in the future (Studies 2 and 3). Implementing an experimental manipulation, we then found that making accessible a morally upward counterfactual after committing a moral transgression strengthened reported intentions for moral improvement—relative to resimulating the remembered event and considering morally worse ways in which they could have acted instead (Study 4). We discuss the implications of these results for competing theoretical views on the relationship between memory and morality and for functional theories of counterfactual thinking. (shrink)

In the evolution of criminally relevant action in modern crime theory, social action has assumed a particular significance as a dogmatic element that enables the effective protection of legal assets in a society beset by risks. In the vast array of theories regarding the role of the guarantor and its legal and doctrinal development, as well as the jurisprudential extension of equivalence clauses of improper omissions that serve as amplifier devices of the criminal statue through an indirect adaptation, there is (...) a need to identify the most effective means to shield legal assets, which allows for an imputation of passive conducts, despite having an active typical description. This introduces the controversial figure of the improper omission, which is used with the function of perfecting all of the structural elements of the criminal conduct. When an individual knows he is in a position of guarantor and is aware of the potential consequences, but fails to take action, having the means to prevent a foreseeable outcome, this device serves to enhance the criminal protection of legal assets, fostering social solidarity as the basis of the criminal justice system. This system, by satisfying the function of general prevention of the punishment, ideally dissuades the individual from committing crimes with the threat of penalty. These theories are fundamental to understanding criminal responsibility by improper omission in the context of the objective imputation theory. By guiding the evolution and delimitation of its application, they serve as a significant factor in criminal social control in Colombia. (shrink)

What should judges do when faced with immoral laws? Should they apply them without exception, since “the law is the law?” Or can exceptions be made for grossly immoral laws, such as historically, Nazi law? Surveying laypeople (N = 167) and people with some legal training (N = 141) on these matters, we find a surprisingly strong, monotonic relationship between people's subjective moral evaluation of laws and their judgments that these laws should be applied in concrete cases. This tendency is (...) most pronounced among individuals who endorse natural law (i.e., the legal-philosophical view that immoral laws are not valid laws at all), and is attenuated when disagreement about the moral status of a law is considered reasonable. The relationship is equally strong for laypeople and for those with legal training. We situate our findings within the broader context of morality's influence on legal reasoning that experimental jurisprudence has uncovered in recent years, and consider normative implications. Una forma de aproximarse a esta es a través del pensamiento de sus principales autores. Nicolás Gómez Dávila es el mejor representante del pensamiento reaccionario en la filosofía latinoamericana, de modo que, a partir del análisis de algunos de sus escritos y siguiendo la propuesta de Richard Shorten para identificar lo reaccionario con base en tres pilares retóricos: (...) decadencia (_logos_), conspiración (_ethos_) e indignación (_pathos_), este artículo enfatiza algunas características propias de la ideología reaccionaria que la distinguen del conservadurismo, ilustrando esas diferencias con la retórica de algunos líderes reaccionarios que antecedieron a Nicolás Gómez Dávila en la Colombia del siglo XX. University extension is one of the ways through which the university shows being a very important cultural center for guaranteeing the development. In the following article its relevance and impact in the society is assessed; as well as the definition of the concepts of extension and the models that nowadays are very deep-rooted in the life of the high education institutions. These models respond to the different ideological positions and conceptions related to the relationship that must exist between the university, the society, and the sectors involved. Resumen Valparaíso es un ejemplo paradigmático de las crisis e inestabilidades del capitalismo y de la modernización latinoamericana durante los siglos XIX y XX. Su historia de riqueza, segregación, cosmopolitismo y decadencia, se proyecta en la escritura respecto de la ciudad, que problematizamos a partir de los conceptos de desterritorialización y extrañamiento, ya que percibimos una presencia importante de autores extranjeros y afuerinos en la producción literaria porteña. Para analizar la elaboración textual de unas subjetividades cuyos referentes y marcos culturales (...) se tensionan en Valparaíso, proponemos siete períodos: 1) de los viajeros ilustrados; 2) de los debates fundacionales; 3) del modernismo y la poesía social; 4) de las vanguardias expresionista e imaginista; 5) de la novela social; 6) de la novela del aprovinciamiento; 7) y de la poesía del exilio, en que el proceso se invierte y algunos poetas porteños escriben acerca de Valparaíso en el extranjero.Valparaíso is a paradigmatic example of Capitalism's crisis and instabilities and of Latin American modernization during the XIX and XX centuries. Its history of wealth, segregation, cosmopolitism, and decadence is projected in the writings about the city, which we problematize based on the concepts of deterritorialization and alienation, since we perceive a significant presence of foreign and outsider authors in the literary production of Valparaíso. To analyze the textual elaboration of some subjectivities whose points of reference and cultural frameworks are tensioned in Valparaíso, we propose seven periods: 1) the enlightenment travellers; 2) the foundational debates; 3) modernism and social poetry; 4) the expressionist and imaginist vanguards; 5) the social novel; 6) the provincial novel; 7) and the poetry of exile, where the process reverses and some local poets write about Valparaíso while overseas. In futsal there are two referees on the playing court and their capacity to respond to physical and physiological demands imposed during the game is essential for the success. The futsal characteristics such as size pitch, referees position and rules of games or type of league could impose specific physical efforts probably. The aim of this study were to analyze the physical demands of eight elite referees from seven matches of Spanish Futsal Cup 2020. The physical activity of each referee (...) during the match was monitored with a Local Positioning System, which was installed on futsal pitch where the matches were played. The data differences were evaluated as Paired-Samples T-Test procedure. The results revealed a similar total distance between halves. The zone 3 distance showed a significative decrease during the match in comparison to the first and second halves. The number of high-intensity acceleration and deceleration decreased in the second half of the match. Therefore, the use of the tracking device to monitoring physical performance provides knowledge of the specific activity profile from futsal referees. . Scientists, for the most part, want to get it right. However, the social structures that govern their work undermine that aim, and this leads to nonreplicable findings in many fields. Because the social structure of science is a decentralized system, it is difficult to intervene. In this article, I discuss how we might do so, focusing on self-corrective-labor schemes. First, I argue that we need to implement a scheme that makes replication work outcome independent, systematic, and sustainable. Second, I (...) use these three criteria to evaluate extant proposals, which place the responsibility for replication on original researchers, consumers of their research, students, or many labs. Third, on the basis of a philosophical analysis of the reward system of science and the benefits of the division of cognitive labor, I propose a scheme that satisfies the criteria better: the professional scheme. This scheme has two main components. First, the scientific community is organized into two groups: discovery researchers, who produce new findings, and confirmation researchers, whose primary function is to do confirmation work. Second, a distinct reward system is established for confirmation researchers so that their career advancement is separated from whether they obtain positive experimental results. (shrink)

Some theorists think that the more we get to know about the neural underpinnings of our behaviors, the less likely we will be to hold people responsible for their actions. This intuition has driven some to suspect that as neuroscience gains insight into the neurological causes of our actions, people will cease to view others as morally responsible for their actions, thus creating a troubling quandary for our legal system. This paper provides empirical evidence against such intuitions. Particularly, our studies (...) of folk intuitions suggest that (1) when the causes of an action are described in neurological terms, they are not found to be any more exculpatory than when described in psychological terms, and (2) agents are not held fully responsible even for actions that are fully neurologically caused. This article investigates the relationship between emotional sharing and the extended mind thesis. We argue that shared emotions are socially extended emotions that involve a specific type of constitutive integration between the participating individuals’ emotional experiences. We start by distinguishing two claims, the Environmentally Extended Emotion Thesis and the Socially Extended Emotion Thesis. We then critically discuss some recent influential proposals about the nature of shared emotions. Finally, in Sect. 3, we motivate two conditions that an account of shared emotions (...) ought to accommodate: Reciprocal Other-awareness and Integration. Consideration of and discussion of relational accounts of joint attention lead us to the proposal that a construal of socially extended emotions in terms of a constitutive integration of the participating individuals’ experiences is more promising than proposals that simply appeal to various forms of social situatedness, embeddedness, or scaffolding. Replicability is widely taken to ground the epistemic authority of science. However, in recent years, important published findings in the social, behavioral, and biomedical sciences have failed to replicate, suggesting that these fields are facing a “replicability crisis.” For philosophers, the crisis should not be taken as bad news but as an opportunity to do work on several fronts, including conceptual analysis, history and philosophy of science, research ethics, and social epistemology. Second, I discuss methodological, statistical, and social-structural factors that have contributed to the crisis. Third, I focus on the philosophical issues raised by the crisis. There are two ways to approach political representation. We can view each type of representation or each site of representation – namely a representative actor or institution – on an individual basis and study its internal dynamics. Alternatively, we can look at how different forms of representation and representative actors and institutions interact in a system of representation. In this article, I develop the second view. I make three contributions to the theory of representation from systemic thinking. Methodologically, I explain (...) the contours of a systemic approach to political representation. Descriptively, I propose a definition of a system of representation that captures representative pluralism, distribution of representative work and different levels of representation. Normatively, I set criteria for judging the system of representation and its individual components with systemic criteria. (shrink)

This article engages critically with Margaret Gilbert’s proposal that joint commitments are necessary for collective emotions. After introducing Gilbert’s concept of joint commitment (Section 2), and the joint commitment account of collective emotions (Section 3), we argue in Section 4 that research from developmental psychology challenges the necessity of joint commitments for collective emotions. In that section, we also raise a more principled objection to Gilbert’s account, independently of developmental considerations. Section 5 develops a complementary line of argument, focused on (...) the notion of mutual recognition. While we agree with Gilbert that mutual recognition has an important role to play in an account of collective emotions, we take issue with her attempt to analyse face-to-face based mutual recognition in terms of the concept of joint commitment. We conclude by sketching an alternative analysis of collective emotions that highlights the role of interpersonal identification and socially mediated self-consciousness. (shrink)

The experimental interventions that provide evidence of causal relations are notably similar to those that provide evidence of constitutive relevance relations. In the first two sections, I show that this similarity creates a tension: there is an inconsistent triad between Woodward’s popular interventionist theory of causation, Craver’s mutual manipulability account of constitutive relevance in mechanisms, and a variety of arguments for the incoherence of inter-level causation. I argue for an interpretation of the views in which the tension is merely apparent. (...) I propose to explain inter-level relations without inter-level causation by appealing to the notion of fat-handed interventions, and an argument against inter-level causation which dissolves the problem. Las ideas filosóficas del ámbito de la actividad física suelen estar sustentadas en concepciones que trascienden la propia disciplina de estudio aludida, de modo que es importante estudiarlas en profundidad. Este ensayo tiene por objetivo comprender la interpretación de los términos movimiento humano y motricidad humana desde la mirada de tres corrientes filosóficas que han sido utilizadas por referentes de la actividad física, el deporte y la Educación Física. La primera corriente filosófica analizada es la de corte idealista, que entiende (...) el movimiento humano como un acto esencialmente mecánico y biológico. La segunda perspectiva filosófica es la materialista, que entiende el movimiento humano como una manifestación de la motricidad, la cual sería inmanente a la esencia del ser humano. Es decir, estaría dotada de intencionalidad. La tercera corriente sería una mirada ecléctica de las dos anteriores, asemejando el concepto de movimiento humano con el de las contemporáneas interpretaciones de motricidad. En otras palabras, el movimiento humano sería parte de la potencia y el acto. Se concluye que, según diferentes perspectivas filosóficas, es posible utilizar el concepto de movimiento y/o motricidad para trascender la mirada idealista o moderna del movimiento humano. (shrink)

Resumo O fundamento teórico deste artigo compreende uma análise teológica, com especial interesse pelo diálogo com a sociologia e com a antropologia. Investiga as relações de dominação, com enfoque específico nas relações de gênero que se engendram a partir dos ritos religiosos ou profanos, Objetiva-se verificar a importância dos ritos para a construção da realidade social, sobretudo das noções de gênero e das relações que delas advêm; expor com embasamento antropológico e sociológico esta premissa, visando contribuir para a discussão da (...) função social da religiosidade como construtora da realidade social; oferecer uma compreensão dos ritos enquanto espaços nos quais podem surgir relações mais igualitárias entre homens e mulheres. Através da pesquisa bibliográfica, procurar-se-á na sociologia de Pierre Bourdieu conceituar o poder simbólico e compreender de que maneira ele é elemento que constrói noções de gênero; posteriormente, serão averiguados em obras da área da antropologia, conceitos de rito, estabelecendo sua ligação com o poder simbólico e seu possível potencial construtor da realidade social e das noções de gênero que orientam as relações entre mulheres e homens. A conclusão buscará apontar de que maneira podem os ritos se tornar espaços para a articulação de um novo modo de relações de gênero. Palavras-chave: Ritos, Sociedade, Gênero.The theoretical basis of this article consists of a theological analysis, with emphasis on a dialogue with sociology and anthropology. It investigates dominance relationships, focusing particularly on gender relationships engendered by religious or profane rites. The objective is to verify the importance of rites for the construction of social reality, above all of gender notions and the relationships that result from them; to expose this premise on an anthropological and sociological basis, seeking to contribute to the discussion of the social function of religiosity as builder of social reality; and to provide an understanding of rites as spaces where more egalitarian relationships between men and women can take place. Through bibliographical research, especially into Pierre Bourdieu's sociology, the text tries to describe symbolic power and to understand how this element builds gender notions. Then, it verifies concepts of rite in anthropological texts, establishing its connection with symbolic power and its potential to construct social reality and gender notions that guide the relationships between women and men. Research has shown that experiences of discrimination cause harm to the health and well-being of people. In terms of the identity of members of a group, a positive evaluation of that group might involve devaluing the out-group as a way of raising the endo-group, causing discrimination toward the out-group. In the Chilean context, the Mapuche people have historically suffered discrimination and violations of their rights. The aim of this study was to assess the relationship between Collective Identity, perceived experiences of (...) discrimination, psychological well-being and distress in the inhabitants of the Mapuche conflict zone according to their sense of belonging to their ethnic group. This descriptive, correlative, and cross-sectional study involved 200 participants, including 94 men, and 106 women, between the ages of 18 and 83 years old, who had lived for at least 1 year in communities in the Araucanía Region. The sample was stratified according their sense of ethnic identity, including 30% Mapuche, 33.5% Caucasian, and 36.5% Mestizo. The results show that participants with a sense of Mapuche ethnicity experienced more instances of discrimination, had a greater sense of collective identity, and that they also supported the Mapuche social movement and its methods. Based on evidence that well-being is directly related to collective identity, the study undertook a regression analysis of emotional distress and the psychological well-being of participants. The interaction between experiences of discrimination and collective identity has a significant influence. Collective identity and experiences of discrimination in themselves as well as the interaction between them, predict psychological well-being. The results suggest that the importance of the Mapuche group’s identity phenomena are related to a broad socio-historical context that leads them to identify themselves as a collective in conditions of inequality. This relationship between well-being and collective identity could be explained by their sense of cultural belonging, which can be a factor in protecting mental health. (shrink)

On a widely held characterization, triadic joint attention is the capacity to perceptually attend to an object or event together with another subject. In the last four decades, research in developmental psychology has provided increasing evidence of the crucial role that this capacity plays in socio-cognitive development, early language acquisition, and the development of perspective-taking. Yet, there is a striking discrepancy between the general agreement that joint attention is critical in various domains, and the lack of theoretical consensus on how (...) to account for it. This paper pursues three interrelated aims: (i) it examines the contrast between reductive and non-reductive views of (triadic) joint attention, by bringing into focus the notion of recursive mindreading; (ii) it assembles, advances, and discusses a number of arguments against reductive views; (iii) finally, in dialogue with some prominent non-reductive views, it outlines the case for a non-reductive view that gives pride of place to the idea that co-attenders relate to one another as a ‘you’.
