Stark variations exist in U.S. immigration enforcement. These variations have persisted even during the COVID-19 pandemic, when special measures that should have constrained variations were in place. This Article argues that variations in discretionary enforcement decisions based on resistance to national policies, bias, illegal tactics, or arbitrariness are unjust and should be curtailed. The Article first distinguishes between transparent sources of variation in immigration law and variations that stem from non-transparent, discretionary determinations. Within the category of discretionary determinations, the Article (...) argues that there are just and unjust variations. It contends that unjust variations raise serious constitutional concerns, weaken preemption doctrine, and require us to reconceptualize the immigration federalism debate to account for cooperative and uncooperative behavior within the federal government itself. Tahâvî (v. 321/ 933), hicrî üçüncü asrın sonları ile dördüncü asrın başlarında yaşamış Hanefî fakihidir. Tahâvî’nin daha çok muhaddis olarak tanınmasına rağmen hadis ve fıkha derin vukufiyeti, her iki alana da temas eden hadis-sahâbî kavlî münasebetini onun üzerinden incelemeyi daha anlamlı kılmaktadır. Müctehid fakihlerin hüküm istinbâtında başvurduğu sahâbî kavlî, Hz. Peygamber’e dayanması bakımından semâ/tevkif ihtimali bulunan bir delildir. Bu sebeple sahâbî kavlini sünnet birlikte değerlendirmenin lüzumu ortaya çıkmaktadır. Ayrıca Tahâvî’nin sahâbî kavli ile sünnet arasında net bir ayırım yapmaması, Hanefî usûlünün (...) teşekkül süreci açısından önemlidir. Tahâvî, ictihad usûlü anlayışında sahâbî kavline deliller hiyerarşisinde Kur’an, sünnet ve icmâdan sonra yer vermektedir. Eserlerindeki tercihleri dikkate alındığında Tahâvî, sahâbî kavlini tevkife hamlettiği yerlerde sünnet olarak değerlendirmektedir. Hatta sahâbî kavli ve uygulamasının icmâa dönüştüğü durumda sünneti neshedebilecek mertebede gördüğü anlaşılmaktadır. Tahâvî ictihadî olan, re’y ve te’vil ifade eden sahâbî kavlini ise mutlak delil almayıp bu durumdaki sahâbî kavli karşısında kıyasa gitmektedir. Tahâvî’nin sünnete ve sahâbî kavline bakışı birlikte değerlendirildiğinde dönemin hadis anlayışı gereği, sünnetin çerçevesini sahâbe ve tâbiûn kavillerini dahil ederek geniş kapsamda ele aldığı anlaşılmaktadır. Erken dönem Hanefî usûlünde sahâbî kavli hakkında Tahâvî’nin görüşlerinin incelendiği araştırmada metin incelemesi ve analizi yöntemi kullanılmış; Tahâvî’ye ait eserler ile erken dönem Hanefî usûl-i fıkıh eserleri mukâyeseli olarak ele alınmıştır. It is essential to run a continuous improvement system for the Plan-Do- Check-Action cycle to be achieved and sustained. It is inevitable to consult stakeholder opinions to determine the improvable aspects of the activities carried out in the quality process. Student opinions, the main subject of educational activities, are one of the most critical data sources for continuous improvement. It is recommended to consult students’ views in all processes from the planning to the output of courses, which are the cornerstones (...) of education programs. When the field is examined, it is seen that the number of studies in which students’ opinions are sought to evaluate the quality of the courses is quite limited. This study, built around the main problem “How to design a lesson effectively in all processes, from planning to assessment and evaluation?” is a scale development study. It is thought that a lesson plan designed with the data obtained based on student opinions will increase the quality of the lesson. It is known that the programs which carry out the quality and accreditation process use different questionnaires in the continuous improvement mechanism to measure the quality of courses. 636 students from Hitit University participated in this study in 2022. The scale's validity was evaluated using exploratory factor analysis and confirmatory factor analysis. The scale has a four-component structure with 24 items, according to the results of the exploratory factor analysis. Confirmatory factor analysis revealed that the fit indices were within a reasonable range. The reliability coefficients the factors were 0.93, 0.91, 0.86, and 0.93, respectively, with a Cronbach’s Alpha coefficient for the full scale of 0.94. This finding indicated that the scale items had a high degree of internal consistency and that the scale was made up of objects with a strong tie. According to the correlation study, all of the scale’s variables had a tangible link. It can be said that the “Course Evaluation Scale (CES),” which was developed as a result of all these analyses, is a valid and reliable measurement tool consisting of 24 items that can be used to measure the effectiveness of a course taught in higher education, according to student opinions. A genealogy of the relationship between Islam and knowledge focusing on the Muslim West and, in particular, Algeria explains the current chaos within Muslim societies. The West, on its side, has difficulties understanding a cultural tradition which differs from its own. Islam did develop an aptitude for knowledge that put into play ‘different intellectual modalities, among which were dialectic argument, intuition and controversy’. However, ‘the accession to knowledge is shown by assent’. A long tradition of debate and controversy drew to (...) a close and was abandoned in favour of the exercise of authoritative and absolute power. Intellectual life in the region suffered notably from the successive departures of the elite, at the end of the Ottoman Empire, at the onset of the colonial period and upon independence. Colonialism founded a new system born of different traditions and entailed the breaking up of traditional scholastic institutions. After Independence, fewer and fewer interlocutors were capable of undertaking a reasoned critique of the West. ‘Mistrust with regard to the West’ translated into a ‘refusal even of controversy’. It is a vicious circle that can be broken only through a minimum of democracy. (shrink)

The purpose of this study was to explain differences between employees who feel a sense of belonging and those who feel a sense of otherness in terms of their opinions about diversity works in their organizations. We conducted an empirical study to examine the perceptual differences between two independent groups of the study “who feel a sense of belonging” and “who feel a sense of otherness.” We collected data from 792 employees working for organizations in different sizes, industries, and capital (...) structures, which enriched the representativeness of the sample. The findings show that out-group members remain less satisfied with diversity works in their organizations based on four main issues such as “competence of diversity actors,” “embeddedness of diversity works in organizational policies/practices,” “diversity awareness in the HRM functions,” and “diversity-related employee satisfaction.” This paper makes two contributions. First, it contributes to the extant literature an understanding of the differences between those who remain indifferent to diversity works and those who care to see, speak, and hear about them. Second, with a few exceptions, extant studies on diversity works have been dominated by Western-centered research. Research is needed on countries with different macro-contextual conditions, such as different legal regulations, socio-political status, and history. For this study, survey data were collected from people who work in Turkey, a country which has limited legal measures and underdeveloped discourses for equality, diversity, and inclusion. The paper provides significant insights into leading diversity works in national settings with less developed supportive mechanisms for diversity. (shrink)

We often hear the term “dignity” in our age. Especially in societies with multicultural and multi-faith, peace, respect, tolerance and human rights ideas are associated with human precious beings. However, understanding what dignity is and which rights it includes are difficult. Because human dignity has social, philosophical, theological and legal dimensions in which its content changes in historical process. Dignity is a term discussed in western societies and has a place in international contexts. That’s why the emphasis is on its (...) naming in western thought and conceptualization types. The definitions of term in terms of legal, moral and cultural are analyzed. This analysis shows it is described as classical and modern with different meanings. It is thought that perceiving the term as classical far from modern meaning results from monotheistic religions. But it is also expected that these religions contribute to social peace. Therefore, in order to understand the monotheistic religions’ attitude towards human and human rights, Holy Scriptures should be reviewed. Analyzing the dignity in Holy Scriptures is out of our studies. Our purpose is to discuss how Islamic attitude towards this term should be in accordance with understanding types of the term. Bu makale, Fahreddin er-Râzî’nin (ö. 606/1210) mantık sisteminde yer alan bitişik ve ayrık şartlı önermelerin doğruluk kriterlerinin ne olduğu ve bu önermelerin doğruluk işlevli (truth functional) olup olmadıkları sorularını ele almaktadır. Bu doğrultuda çalışma iki ana bölüm olarak kurgulanmıştır. Birinci bölümde mesele, lüzûmî ve rastlantısal (ittifâkî) bitişik şartlı önermeler, ikinci bölümde ise ayrık şartlı önermelerin üç türü bağlamında tartışılmıştır. Bu tartışma neticesinde lüzûmî bitişik şartlı önermelerin doğruluğunun, bileşenlerinin doğruluk değerlerinin yanı sıra bu önermelerin içermeleri gereken lüzûm ilişkisine sahip olmalarına; ayrık (...) şartlı önermelerin doğruluğunun ise bileşenlerinin doğruluk değerlerinin yanı sıra ifade etmeleri beklenen ayrıklık ilişkisini ifade ediyor olmalarına bağlı olduğu sonucuna varılmıştır. Bunun sonucu olarak, Râzî’nin sistemindeki lüzûmî bitişik şartlı ve ayrık şartlı önermelerin doğruluk işlevli olmadığı ve bu önermelerin, önermeler mantığındaki doğruluk işlevli bileşik önermelerle anlam açısından örtüşmediği belirlenmiştir. Rastlantısal bitişik şartlı önermeler ise bileşenleri arasında gerektirme veya ayrıklık ilişkisi bulunmaması nedeniyle doğruluk işlevli olarak değerlendirilmiştir. (shrink)

The paper explores the impact of the corona virus disease-19 pandemic on the Saudi higher education system. The research focuses on the relationship between digital learning in COVID-19 time, life satisfaction, and stress among female students. The study discusses measures, practices, defense mechanisms, and coping strategies to face challenges. Using an online survey based on psychological effects and its role in defense mechanisms and coping strategies, findings show that digital learning provides flexibility in terms of time and offers resources at (...) a lower cost compared to traditional learning. In addition, results show that the coping strategy perception is higher in obtaining a good score and succeeding than to get over the pandemic and recovering from the illness itself. Finally, results confirm that a positive attitude influences positively life satisfaction. (shrink)

In this article, disasters as a factual reality will be discussed within the framework of Allah's justice and human responsibility on the basis of husn-qubh. In this context, the ontic structure of man and the universe, man's being in the process of being tested, the definition of good-bad/goodness-evil that enables this process, the evaluations in the literature, and the meaning of taklīf within the scope of Allah's justice (‘adl) will be discussed. The problem of evil is the problem of reconciling (...) a God who is omniscient, omnipotent, and does good deeds with a universe in which evil exists. As a problem of evil, disaster is a phenomenon that must be addressed in relation to God, the universe, and human beings. While its relation with God in terms of creation appears as the legality of the universe, its relation with human beings in terms of dealing with the phenomenon and responsibility is within the scope of being subject to the offer. Therefore, a correct understanding of creation and justification of the reasonableness of the offer will answer many questions regarding disasters. The aforementioned issues and concepts in the theological literature have been discussed thoroughly (dakīk) in the schools of theology. Theologians defined God and divine action, human beings and human actions, and the universe in accordance with the paradigm of their discourse groups, and they made discussions based on the meaning they gave to these definitions and concepts. The basic determinants of the discussions are God's possession of knowledge, power, will, wisdom, and justice, and the creation of human beings in the nature of reason (‘akl). These concepts and definitions have been understood differently by the discourse groups, and the debates have moved back and forth between determination/compulsion and free will. It makes sense here that a person who experiences the phenomenon and wants to know what is happening theologically should know the Qur'anic conception of God and man. The relationship between God and man needs to be right and moral. Therefore, it is necessary to evaluate the topics that have been studied many times in terms of each concept together. In this respect, the article aims to seek answers to some questions about the human profile and the conception of Allah. There are three aspects to be questioned here: First, an ontological inquiry into the nature of the concepts of existence that contain moral value; second, an epistemological inquiry into whether moral value is determined by reason or revelation. In this context, the last inquiry is moral. Accordingly, what is good-bad and goodness-evil? What determines good and evil as a value? Who is the agent of the good-evil action? What is the position of the divine will if the perpetrator (fā‘ıl) is human? What is the relationship or boundary between divine will and human responsibility? What is the theological status of the perpetrator? On this basis, what is a disaster? What is the value judgment of disasters? What is the relation of disasters to God's actions? Who is the perpetrator of disasters? Are disasters a test? Are disasters a divine warning? Are disasters a divine punishment? If they are a divine punishment, what is the possibility of knowing it? These questions will be answered in the article, sometimes explicitly and sometimes implicitly. (shrink)

Mâzerî et-Temimî (ö. 536/1141) Endülüs’ün düşmesinden önce Kuzey Afrika’da yaşamış son fakihlerdendir. Malikî fıkhının usûl-i fıkıh yapısının oluşumunda önemli dönüm noktası olarak kabul edilen Îzâhu’l-Mahsûl min Burhâni’l-usûl isimli eserin müellifidir. Hadis, fıkıh, kelam, tıp ve fetvâ alanlarında kayda değer bilgi sahibi Mâzerî’nin usûlcülüğüne dair bir çalışmanın yapılmamış olması bu çalışmayı gerekli kılmıştır. Çalışmada Mâzerî’nin usûl anlayışı usûl-i fıkıh alanında yazdığı Îzâhu’l-Mahsûl isimli eser üzerinden incelenmektedir. Îzâhu’l-Mahsûl, Mâzerî’nin Şâfiî âlim İmâmü’l-Haremeyn Cüveynî’nin (ö. 478/1085) el-Burhan fî usûli’l-fıkh isimli usûl-i fıkıh eseri üzerine (...) yapılan bir şerhtir. Şerhedilen Cüveynî’nin el-Burhân isimli eseri, Şâfiî usûl-i fıkhının temel metinlerinden birisidir. Mâzerî bu önemli eser üzerine yaptığı şerhte, hocası Cüveynî’nin konu tasnifi ve sistematiğini takip etmiş, usûl-i fıkıh yazımında mütekellimin yöntemini uygulamıştır. Hocasının eseri ile benzerlikler taşımasına rağmen söz konusu şerh, tamamlanmamış hâliyle dahi yer verdiği görüşler ve değerlendirmeler ile müstakil bir eser mahiyetindedir. Mâzerî eserde hocasına muhalefet etmekten çekinmemiş, kendi ictihad usûlünü ortaya koymuştur. Araştırmaya inceleme konusu edilen Îzâhu’l-Mahsûl isimli eser, Şâfiî usûl-i fıkhının Malikî usûl-i fıkhını yöntem ve içerik açısından etkilemesi açısından önemli bir örnektir. Bu eser ile birlikte Mâlikî usûl-i fıkıh literatürü ve metinleri Îzâhu’l-Mahsûl’den örnek alınarak oluşturulmuştur. Mâzerî sonrası Malikî usûlcülere kaynak olan bu eser, aynı zamanda Şâfiî-Malikî usûl-i fıkıh etkileşiminin izlerini barındırdığı için inceleme konusu edilmiştir. Çalışma kapsamında Îzâhu’l-Mahsûl eserinde Mâzerî’nin usûl anlayışında öne çıkan ilkeler tespit edilmeye çalışılmıştır. Böylece Mâlikî usûl-i fıkhının hangi hususlar üzerine inşa edildiğinin net olarak ortaya konulması hedeflenmiştir. Mâzerî’nin usûl anlayışının içinde yetiştiği fikri ve siyasi ortamdan etkilenmemesi mümkün değildir. Bu durum göz önünde bulundurularak Mâzerî’nin hayatına, hocalarına, eserlerine ve yaşadığı dönemde Mağrib bölgesinin düşünsel ve siyasi atmosferine kısaca temas edilmeye çalışılmıştır. Yaşamına dair tüm detayların, Mâzerî’nin ilmî hayatına ve özelde usûlcülüğüne etkisi anlaşılmaya çalışılmıştır. Ayrıca Mazerî’nin usûl anlayışının öne çıkan unsurlarının tespiti, Mağrip bölgesindeki fıkhî yapının anlaşılması ve İslâm hukuk tarihi açısından bölgenin aydınlatılması açısından da önemlidir. Söz konusu saiklerle yapılan çalışma, Mâzerî’nin usûl anlayışını temel özellikleri açısından ortaya koymayı amaçlamaktadır. Böylece Mâzerî’nin Mâlikî usûl-i fıkıh anlayışına ve literatürüne yaptığı katkıya ışık tutmak amaçlanmıştır. Araştırmada nitel araştırma metotlarından doküman incelemesi yöntemi kullanılmıştır. Bu bağlamda Mâzerî’nin görüşleri, kendisinden etkilendiği hocası Cüveynî’nin görüşleri ile mukayese edilmek suretiyle metin analizi uygulanmaya çalışılmıştır. (shrink)

Ahlâk konusu dinler üstü konuşulan ve tartışılan evrensel bir olgudur. Her toplumun kendi sosyolojik ve psikolojik durumlarına bağlı olarak kabul ettiği ahlâkî değerler mevcuttur. İslam, Arap toplumuna geldiği ilk andan itibaren toplumun sahip olduğu ahlâkî değerleri düzenleme ve yenilemeye başlar. Düzenlenen ve yenilenen ahlâkî değerlerde örnek insan olarak ise Hz. Peygamber gösterilir. Bu çerçevede Hz. Peygamberin vefatından sonra İslam toplumunda oluşan karışıklıkların ahlâkî sonuçları ve toplum içinde bozulmalara tepki hareketi olarak ortaya çıkan sûfilerin eleştirileri meydana gelir. Her ne kadar fıkıh (...) ve kelam alanları teşekkül süreçlerinde farklı konular üzerinde tartışsalar da ahlâk konusuna ait özel bir bölüm fıkıh ve kelam alanında mevcut görünmez. Sûfiler, İslam din bilimlerinde ahlâk alanının göz ardı edilmesini eleştirir ve bu eksiliğin giderilmesi gerektiğini savunur. Erken dönemde yaşamış olan sûfiler ise bu açıklığın kapanması ve İslam düşüncesinin tekâmüle ermesi için çözümün tasavvuf olduğunu iddia ederler. Bu durumu meşrulaştırmak için de tasavvufun kelam ve fıkıh alanı gibi bir bilim olduğunu ispatlama yolunda eserler kaleme alırlar. Bu süreçte ise tasavvuf pratik ve zühd esaslı bir anlayıştan, diğer din bilimleri gibi bilgi çıkartan bir ilme dönüşür. (shrink)

There is a prevailing opinion in the literature that the first name to mention the interpretation of the Qur'an with the Qur'an as a method is Ibn Taymiyya. He puts it at the forefront in the hierarchy of evidence in his Muqaddima. However, Abu Bakr Ibnu'l-Arabi, who lived two centuries before Ibn Taymiyya, also refers to the same method in the first place among the tafsir methods he suggested. Based on this finding, in the article, after briefly mentioning the aforementioned (...) tafsir method, a brief information about Ibn al-Arabi's Qânûn al-Ta'wîl is given and his approach to this method is examined. Within the scope of this subject, the common and different aspects of both authors' methods of interpreting the Qur'an with the Qur'an are presented. In addition, the findings regarding the problems arising from the authors' putting this method in the first place are shared. Finally, the possible reasons why both authors put this method in the first place are discussed. The aim of the study in this background is to reveal that there was another scholar mentioning the method in the first place before Ibn Taymiyya among the exegetical methods in the classical period and to perform an analysis within this framework. By the application of "data and content analysis", the content in Ibn al-Arabi's Qânûn al-Ta'wîl and Ibn Taymiyya's Muqaddimah in the context of the Qur'an's interpretation with the Qur'an has been analyzed. This content has been subjected to comparative analysis in terms of commonality and differences. (shrink)

On December 7,1999, a divided Oklahoma Supreme Court held in Nealis v. Baird that a claim may be brought under Oklahoma's wrongful death statute on behalf of a nonviable fetus born alive. The decision represents a departure from the traditional notion that “viability”—the ability of a fetus to sustain life outside the womb with or without medical assistance—is the standard for wrongful death recovery. In replacing the “viability” standard with a “live birth” standard, the majority maintained that live birth is (...) the “unassailable point at which legal rights must be said to attach to the human person. “ By holding a nonviable fetus a legal “person” for the purpose of a wrongful death claim, the court's decision emphasizes the limited application of the United States Supreme Court's holding in Roe v. The problem of evil and theodicy is one of the most important subjects in the field of Philosophy of Religion. The problem of evil is basically understood as the problem of incompatibility of the existence of God with evil. While the problem of evil is used to justify atheistic claims, theodicy has been developed to strengthen theistic claims. Mawlânâ D̲j̲alāl al-Dīn Rūmī (1207-1273), who is the important sufi thinker of Turkish-Islamic culture, is generally known for his mystical and literary works. (...) Although Mawlânâ 's philosophical views have not been studied sufficiently, it is seen that he presents his important ideas in the philosophical field, especially in the philosophy of religion, in a non-systematic and hidden way in his works. In this study, the problem of evil has been studied in the case of Mawlânâ, within the scope of the evil’s types and the problem of evil’s types in the literature. In addition, it has been examined whether Mawlânâ discussed the evil as a philosophical problem and contributed to the solution of the problem of evil. Then, one of the theodicy used by Mawlânâ, which is related to contrasts, has been called the theodicy of contrasts and has been explained and systematized. It is known that theodicy related to theme of contrast was developed before Mawlânâ. As a result, Although it cannot be said that Mevlânâ made an original contribution to the problem of evil with his theodicy of contrasts in terms of content, it can be said that he approached originally to this problem in terms of his metaphorical manner and expression style. This chapter will argue that due to a lack of genuine consent, some of Russell’s practices in his romantic/sexual relationships are morally objectionable according to his own normative theory (utilitarianism) and these practices are intellectually objectionable according to his post-1913 meta-ethics (expressivism) and his understanding of rationality. On utilitarian grounds, Russell’s actions would maximize pleasure and minimize pain for all the parties affected by the relationship if the authenticity of his partners’ consent were maintained either by a more or less (...) equal social and political standing of the partners or, failing that, by the powerful partner’s exercise of the virtue of restraint; neither of these conditions was satisfied in Russell’s relationships with Vivien Eliot or Helen Dudley. On expressivist grounds, the expressions of desires upon which Russell’s romantic/sexual practices were based, such as the disregard for the humanity of women, conflict with his calls for world peace based on a concern for the well-being of humanity. The aim of the present study is to evaluate Sonja Foss’s Rhetorical Schema for the Evaluation of Visual Imagery as well as reflect upon several points for further consideration; and finally suggest a renewed triadic approach as a method for analyzing art-relevant visual imagery. The triadic approach to be discussed assumes three correlative layers: the intellectual knowledge, function of the artistic content as the visual representational component, and aesthetics as modality. This study will include the analysis of a print advertisement (...) that used an artwork as its content of visual rhetoric, and this will inform further discussions on the proposed approach. The contribution of this renewed triadic approached to the field of visual rhetoric has the advantage of expanding and possibly improving rhetorical analysis methods of visual imagery. (shrink)

Temel karakteristiği Allah, nübüvvet ve meâd konuları üzerinden şekillenen kelam, bu konuları ele alış tarzında ahlakî perspektifi merkeze almıştır. Bu açıdan kelam, bir yönüyle Allah bir yönüyle insanla ilişkilidir. Dolayısıyla kelamcılar Allah-insan ilişkisini hem ontik hem epistemik hem de ahlakî açıdan ele almışlardır. Tanrı ve insan tasavvurları tüm boyutların birlikte değerlendirilmesiyle anlam kazanmaktadır. Konu hakkındaki farklı yaklaşımlar, söylem gruplarının ya da düşünürlerin paradigmalarına göre şekillenmektedir. Mu‘tezilî bir âlim olan Arap dili ve edebiyatının yetkin isimlerinden Ebû’l-Kāsım Mahmûd b. Ömer b. Muhammed (...) el-Harezmî ez-Zemahşerî’nin (ö. 538/1144) de eserlerinde, Allah-insan ilişkisine gereken ilgiyi gösterdiği bilinmektedir. Dinî pratiğinde Hanefî aidiyete sahip olan Zemahşerî, aklı ön planda tutan, aklın işlevsel yönünü vurgulayan bir din anlayışına sahiptir. Bu sebeple ona göre takdîr gereği akıl ve irâde sahibi olarak belirli bir fıtratta yaratılan insan yaptıklarından sorumludur. İnsanı teklîf temelinde tasavvur eden Zemahşerî’de yaratmanın ilk aşamasından itibaren adaletli bir Tanrı fikri hakimdir. Dolayısıyla onun Allah tasavvuru ve bağlantılı olarak irade konusundaki değerlendirmeleri, Allah-insan ilişkisini nasıl bir temelde ele aldığına işaret etmektedir. Bu bağlamda araştırmamız Zemahşerî’nin söz konusu ilişkiyi nasıl ele aldığını ve ahlakî boyutunu konu edinmektedir. Çünkü bu çalışmayı ortaya çıkaran temel saik Zemahşerî’nin eserlerinde Allah-insan ilişkisini ahlakî olarak değerlendirdiğine dair güçlü kanıtların mevcudiyetidir. İlişkili olarak konu, Zemahşerî’nin ilahî fiiller, insan fiilleri, akıl, bilgi, taklit, hüsun-kubuh, hidâyet-dalâlet, dâî, fâil, kötü/kabîh ve fâili, hikmet, maslahat ve tüm bunları içine alacak şekilde teklîf yaklaşımını kapsamaktadır. Buna göre çalışmada öncelikle Zemahşerî’nin Allah tasavvuru daha sonra Zemahşerî’ye göre Allah-insan ilişkisi ele alınacaktır. Çalışmanın amacını belirleyen ahlakî boyuta dair veriler değerlendirmeye tabi tutulacaktır. Allah-insan ilişkisinin ilk aşaması olarak yaratma, mîsâk ve takdîr, ikinci aşaması olarak teklîf karşımıza çıkmaktadır. Teklîfin karşılığının alındığı yer olarak ahiret son aşama olup teklîf ve sonuç kısmında bahse konu olacaktır. Çalışma, söz konusu veriler ve üzerine yapılan analizlerle şekillenmiştir. Kaynak olarak kullanılan Kitâbü’l-Minhâc, Zemahşerî’nin konu hakkında genel çerçeveyi belirleyen bir eseridir. El-Keşşâf ‘an hakâik-i (gavâmizi’)t-tenzîl ve ‘uyûni’l-ekâvîl fî vücûhi’t-te’vîl isimli eseri ise Zemahşerî’nin görüşlerini ve derinliğini birçok açıdan anlama ve değerlendirme imkânı veren telîfidir. Buna göre çalışmamız, Zemahşerî’nin Allah-insan ilişkisinde ortaya koyduğu ahlakî yaklaşıma dolayısıyla insanın sorumlu olmasının ahlakîliğine dikkat çekmeyi amaçlamaktadır. Çalışma Zemahşerî ile sınırlandırılırken, gereken yerlerde mukayeseli değerlendirmelere başvurulacaktır. (shrink)

In the formation of the acquis of the science of fiqh, many scientific figures have been associated with the methods of the Imams of the sect and their views, which are passed on to the next generations. In the history of the Ḥanafī mad̲h̲hab, there are many scholars whose works, views or just their names have survived. The views of the scholars who are at the forefront of this work can be accessed through their works. The opinions of some scholars (...) who did not have works, or whose works have not survived, can be found in the jurisprudential corpus of other scholars. Unfortunately, there are many scholars whose works and opinions have not survived, and only their names are mentioned. This study focuses on the Ḥanafī jurist al-Baqqālī (d. 452/1060), whose scholarly personality, position in jurisprudence and works have not survived to the present day, although his name is mentioned in fiqh literature. The article analyses various sources and evidence for the identification of al-Baqqālī. The main argument of the article was clarified by examining fiqh books, which are among the authoritative sources of the Ḥanafī fiqh corpus, rather than works of ṭabaḳat, and by scanning digital resources. The determination and presentation of the scholarly personality of al-Baqqālī and his jurisprudential views are the distinctive feature of this article. Baqqālī was recognised as an influential jurist within the Ḥanafī fiqh tradition and was considered one of the mashāʼịḵẖ (eminent jurists). However, detailed information about him could not be found. However, considering the available evidence, it is proven that al-Baqqālī, who stands out with the attribution of al-Baqqālī, is not al-Baqqālī whose views are consulted in the Ḥanafī mad̲h̲hab and among the possibilities that arise, the views that predominate in the identification of al-Baqqālī's identity are given. For this reason, it is emphasised that Baqqālī is a figure that requires further research and study. It is emphasised that this article can contribute to the understanding of the Ḥanafī fiqh tradition. Baqqālī's jurisprudential views on some matters of worship and transaction reflect important debates. Although al-Baqqālī adhered to the basic principles of the Ḥanafī mad̲h̲hab, he occasionally developed original ijtihād against the general views of the imams or the mad̲h̲hab. Baqqālī's original jurisprudence and jurisprudential views occupy an important place in the sect's literature. He was particularly influential in matters of fatwa and left his views to later jurists. Such a study aims to solve a scholarly problem in the fields of the history of science and the history of fiqh. Clarifying the identities and specialisms of those involved can help to ensure historical and scientific clarity. The purpose of this article is to contribute to the accumulation of historical and scientific knowledge by seeking to learn more about this issue and to reduce uncertainties. (shrink)

Background: Rising levels of burnout and decreasing job satisfaction can inhibit healthcare professionals from providing high-quality care due to a corresponding decrease in their ethical sensitivity. Aim: This study aimed to determine the relationship between the level of ethical sensitivity in emergency service nurses and their levels of burnout and job satisfaction. Research design: This research employed a descriptive and cross-sectional design. Participants and research context: This study was conducted with a sample of 236 nurses, all of whom worked in (...) emergency service between 24 July 2015 and 28 April 2016. Data were collected using the Moral Sensitivity Questionnaire, Maslach Burnout Inventory, and Minnesota Job Satisfaction Scale. Ethical considerations: This study was approved by the Institutional Ethics Review Board of Ondokuz Mayıs University. Findings: There was a weak and negative correlation (r = –0.158, p = 0.015) between Moral Sensitivity Questionnaire and Maslach Burnout Inventory scores. There was also a weak and negative correlation (r = –0.335, p < 0.001) between the Maslach Burnout Inventory and Minnesota Job Satisfaction Scale scores. Discussion and conclusion: Decreased job satisfaction and increased burnout levels among emergency service nurses might result in them indulging in improper practices, frequently facing ethical problems, and a decrease in the overall quality of service in hospitals. In order for emergency service nurses to recognize ethical problems and make the most accurate decisions, a high level of ethical sensitivity is critical. In this respect, it is suggested that continuing education after graduation and training programs should be organized. (shrink)

Media news can be regarded as an important teaching material to be used in lessons in terms of being interesting, containing up-to-date information, reinforcing what has been learned in the course, and combining it with many methods and techniques. In addition, the fact that media news provides a more concrete learning, helps the subject in the lesson to be connected with real life and helps students to develop their empathy skills. Therefore, the use of media news in religious education can (...) increase curiosity and interest in the lesson and enable students to actively participate in learning processes. This article, which focuses on how to benefit from media news in religious education, has been prepared to raise awareness about the use of media news for teachers who attend religious education classes, and thus to guide them in using media news in their lessons. In the study, the use of media news in religious education was first addressed in a conceptual framework, and then the extent to which media news was used in the textbooks of the religious education courses was investigated. Within the scope of the research, 42 books on Religious Culture and Moral Knowledge (RCMK) and Imam Hatip High School Vocational Lessons were examined and four examples were found as a result of this examination. It was observed that the media news used in the textbooks led the students to research, share and discuss. However, the fact that only four examples could be found in 42 textbooks reveals that media news are not used sufficiently in religious education, and teachers are not provided with sufficient material on the use of media news in teaching processes. In the third part of the study, the issues to be considered in the use of media news in religious education are examined in three groups as before, during and after the lesson. According to this media news can be evaluated as lecture, interpretation, concept definition, question-answer and application of discussion techniques during the lesson. Discussion, scientific research and case study methods are methods that can be used effectively in media news activities. In the last part of the study, six activity examples are given for the use of media news in religious education classes. These activities are the activities of the lessons of RCMK (4-7th grade), The Life of the Prophet (7th grade), Basic Religious Knowledge (9th grade), Fiqh (10th grade) and Islamic Culture and Civilization (12th grade). These exemplary activities, prepared at five different lessons and five different class levels, reveal that media news can be used quite effectively in religious education, and all media news from sports to economy, from health to daily life can be associated with the course subjects. In the context of the results of this research, it is suggested that the course books should be updated and media news should be included more. Through a platform to be established by the General Directorate of Religious Education, news in the media can be archived and a guide can be prepared on what subjects and how these news can be used. Additional research can be conducted with focus on a single lecture or a single media tool. In addition, quantitative and qualitative studies can be conducted to asses the contribution of the use of media news in religious education classes to students’ learning. (shrink)

This paper interrogates the challenges and potentials for solidarity between refugees and Indigenous peoples by bringing decolonial, anti-colonial and anti-imperialist critiques in different parts of the world, including in white settler colonies and in the Third World, into conversation with each other and with Refugee Studies. The first section of the paper offers two analytical steps towards decolonizing mainstream Refugee Studies. The first step involves identifying, analyzing and problematizing what we may call “an elephant in the room,” a parallax gap (...) between Refugee Studies and studies of International Politics. The second analytical step is problematizing and challenging the popular discourses of charity and gratitude that dominate refugee discourses and narratives in the Global North. The second section of the paper engages in a more direct and detailed discussion about challenges to and possibilities for solidarity between refugees and Indigenous peoples. Articulating historical and contemporary parallels between refugee displacement from land and Indigenous dispossession of land, this section demonstrates that there are nevertheless no guarantees for political solidarity. It argues that potentials for solidarity are contingent on a politics of place, as articulated by Indigenous and non-Indigenous scholars; and also possibly on a reconceptualization and reorientation of refugee identity different from the ways it has been constituted in colonial discourses.
