Background The prioritization protocols for accessing adult critical care in the extreme pandemic context contain tiebreaker criteria to facilitate decision-making in the allocation of resources between patients with a similar survival prognosis. Besides being controversial, little is known about the public acceptability of these tiebreakers. In order to better understand the public opinion, Quebec and Ontario’s protocols were presented to the public in a democratic deliberation during the summer of 2022. Objectives (1) To explore the perspectives of Quebec and Ontario (...) citizens regarding tiebreakers, identifying the most acceptable ones and their underlying values. (2) To analyze these results considering other public consultations held during the pandemic on these criteria. Methods This was an exploratory qualitative study. The design involved an online democratic deliberation that took place over two days, simultaneously in Quebec and Ontario. Public participants were selected from a community sample which excluded healthcare workers. Participants were first presented the essential components of prioritization protocols and their related issues (training session day 1). They subsequently deliberated on the acceptability of these criteria (deliberation session day 2). The deliberation was then subject to thematic analysis. Results A total of 47 participants from the provinces of Quebec (n = 20) and Ontario (n = 27) took part in the online deliberation. A diverse audience participated excluding members of the healthcare workforce. Four themes were identified: (1) Priority to young patients - the life cycle - a preferred tiebreaker; (2) Randomization - a tiebreaker of last resort; (3) Multiplier effect of most exposed healthcare workers - a median acceptability tiebreaker, and (4) Social value – a less acceptable tiebreaker. Conclusion Life cycle was the preferred tiebreaker as this criterion respects intergenerational equity, which was considered relevant when allocating scarce resources to adult patients in a context of extreme pandemic. Priority to young patients is in line with other consultations conducted around the world. Additional studies are needed to further investigate the public acceptability of tiebreaker criteria. A. N. WHITEHEAD SUGGESTS philosophy is akin to poetry. Let me count the ways or, more exactly, identify four facets of this kinship. After touching upon these facets, I will in the second part of this paper focus directly on the relationship between being and articulation, regardless of the form in which being comes to expression. Then, in the third section, I offer Charles S. Peirce’s categoreal scheme as a compelling articulation of what are, arguably, the most ubiquitous and indeed (...) basic features of being. Finally, the last section of this paper considers human beings precisely in their ongoing efforts to give adequate expression to human experience in its broadest reach and deepest import. Philosophers and poets alike struggle to speak in an intelligible, arresting, and acute voice: they would have their utterances stop us, so that we might discern more sharply and attentively the meanings in which we are enmeshed. On the part of both, one observes countless “attempts to escape our humanness,” but one also hears deliberate endeavors “[t]o speak humanly from the height or from the depth” of experience. The philosophical no less than the poetic voice has been a distinctively human voice in which a finite, fallible, and mortal animal has given arresting expression to the most telling disclosures of human experience. It is, accordingly, to the kinship between poetry and philosophy that I now turn. (shrink)

The transference theory reduces causation to the transmission of physical conserved quantities, like energy or momenta. Although this theory aims at applying to all felds of physics, we claim that it fails to account for a quantum electrodynamic effect, viz. the Aharonov-Bohm effect. After having argued that the Aharonov-Bohm effect is a genuine counter-example for the transference theory, we offer a new physicalist approach of causation, ontic and modal, in which this effect is embedded.

Uffink and Valente claim that there is no time-asymmetric ingredient that, added to the Hamiltonian equations of motion, allows to obtain the Boltzmann equation within the Lanford’s derivation. This paper is a discussion and a reply to that analysis. More specifically, I focus on two mathematical tools used in this derivation, viz. the Boltzmann–Grad limit and the incoming configurations. Although none of them are time-asymmetric ingredients, by themselves, I claim that the use of incoming configurations, as taken within the B–G (...) limit, is such a time-asymmetric ingredient. Accordingly, this leads to reconsider a kind of Stoßzahlansatz within Lanford’s derivation. (shrink)

Is the current state of international governance by the United Nations and related organizations a preface to what eventually might become a world government? Is it at all similar to what was the structure of government in the United States after the adoption of the Articles of Confederation in 1781 and before adoption of the Constitution of 1787? Are changes in the way international institutions like the United Nations operate related to changes in our conceptions of the role of these (...) institutions in providing international governance? When governmental institutions prove to be too weak to adequately perform the tasks expected of them is there a natural evolution toward greater centralization of power? If so, might an early sign of this evolution be decisions by public officials that afford greater deference to the decrees of international institutions that previously might have been sidestepped? In this essay, I maintain that the issue of whether the right to die is viable as a constitutionally protectable right remains open. I intend to reconcile the Supreme Court's holdings in Glucksberg and Quill by examining the different rationales the Justices offered for their decisions. I do not believe this issue can be resolved simply by asserting that the intention of the actor is different when assisting suicide, as compared to when life-sustaining treatment is withdrawn. Rather, the right to (...) die continues to be viable due to the level of abstraction at which the Court chose to frame the issue in these cases. (shrink)

Recent U.S. Supreme Court decisions regarding the scope of the Establishment Clause have failed to provide a clear framework for determining what government actions are prohibited. Part of the problem concerns what kinds of actions constitute an establishment of religion. What criteria should determine the boundaries of an establishment challenge? Are governmental actions that may only indirectly affect religion (either positively or negatively) prohibited? This article aims to provide a coherent and normatively justified understanding of the Establishment Clause to help (...) answer these questions by considering not just the history of the Clause or the cases the Court has decided under it, but also considering overlaps from various philosophical justifications for the Clause—including justifications from rights theory, political liberalism, utilitarianism, and communitarianism. In the process, the article eliminates from consideration the Supreme Court’s so-called “accommodationist” approach and presents a new understanding of the neutrality test that anchors itself between strict separation and the current neutrality approaches. This it does by also taking into account what in moral theory is known as the doctrine of double effect and by showing how the doctrine further limits the various judicial views to just neutrality in the new sense I suggest, while also providing both clearer and firmer conditions. Terrorist attacks throughout the world and particularly within the United States have given rise to a new chapter in the ongoing debate over liberty versus security. The most recent manifestation of this dispute focuses on whether Muslim refugees can be denied entry as a class into the United States, based on their religion alone, for fear they might be harboring potential terrorists. This Essay shows that such a policy cannot be justified under the First Amendment Establishment Clause, as well the (...) United States’ expressed international commitments to preserving international human rights. What can be done is to engage a broader set of investigative approaches that are more likely to provide greater security than any policy focused on religion alone. (shrink)

Where did the right to privacy come from and what does it mean? Is there an underlying principle uniting various applications of the right? When privacy conflicts with another right, how does one decide which right takes precedence? And how does privacy relate to the government's 'compelling interest' in protecting the health and welfare of its citizens?

Jean-Luc Nancy is one of the leading contemporary thinkers in France today. Through an inventive reappropriation of the major figures in the continental tradition, Nancy has developed an original ontology that impacts the way we think about religion, politics, community, embodiment, and art. Drawing from a wide range of his writing, Marie-Eve Morin provides the first comprehensive and systematic account of Nancy’s thinking, all the way up to his most recent work on the deconstruction of Christianity. Without losing sight of (...) the heterogeneity of Nancy’s work, Morin presents a concise articulation of the organizing concepts, which structure Nancy’s body of work. The guiding thread is that of an essential rift at the heart of any “self” by which this self is exposed and relates to itself and other selves. Nancy’s ontology undercuts dichotomies between individual and community, interior and exterior, matter and spirit, thing and thought, not in the name of mere deconstruction, but in seeking to open a thinking of the “limit” or the “edge” as the locus of sense. While Nancy’s work has often been presented in relation to Heidegger or Derrida, Morin demonstrates the originality of Nancy’s work and argues that, despite the variety of its preoccupations and topics, it possesses its own rigorous internal logic. This paper studies some model-theoretic properties of special groups of finite type. Special groups are a first-order axiomatization of the algebraic theory of quadratic forms, introduced by Dickmann and Miraglia, which is essentially equivalent to abstract Witt rings. More precisely, we consider elementary equivalence, saturation, elementary embeddings, quantifier elimination, stability and Morley rank.

In metaphysics, there are a number of distinct but related questions about the existence of “further facts”—facts that are contingent relative to the physical structure of the universe. These include further facts about qualia, personal identity, and time. In this article I provide a sequence of examples involving computer simulations, ranging from one in which the protagonist can clearly conclude such further facts exist to one that describes our own condition. This raises the question of where along the sequence the (...) protagonist stops being able to soundly conclude that further facts exist. (shrink)

Je propose d’analyser une pratique de la recherche en mathématiques constructives, celle qui consiste à reformuler constructivement les théories physiques. Je discute plus précisément trois aspects de cette pratique. Je montre d’abord que celle-ci a la particularité d’être motivée par des considérations philosophiques et comment la physique est utilisée pour arbitrer un débat de philosophie des mathématiques entre constructivisme et classicisme. Ensuite, j’identifie la méthodologie de la recherche en mathématiques que cette pratique implique et montre qu’il s’agit, selon une terminologie (...) empruntée à Poincaré, d’une méthodologie de « logiciens ». Enfin, je montre que dans cette pratique, les théories physiques ont un rôle heuristique sur le développement des mathématiques constructives. Elles permettent avec succès de stimuler la recherche d’énoncés constructifs et d’orienter la recherche en mathématiques constructives vers de nouveaux domaines. (shrink)

Peirce was a thinker who claimed that his mind had been thoroughly formed by his rigorous training in the natural sciences. But he was also the author who proclaimed that nothing is truer than true poetry. In making the case for Peirce’s relevance to issues of education, then, it is necessary to do justice to the multifaceted character of his philosophical genius, in particular, to the experimentalist cast of his mind and his profound appreciation for the aesthetic, the imaginative, and (...) (more narrowly) the metaphorical in their myriad guises. My aim in this paper is to go some distance, however small, toward doing such justice to Peirce. (shrink)

The «extended mind thesis» sounds like a substantive thesis, the truth of which we should investigate. But actually the thesis a) turns about to be just a statement on where the demarcations for the «mental» are to be set (internal, external,…), i.e. it is about the «mark of the mental»; and b) the choice about the mark of the mental is a verbal choice, not a matter of scientific discovery. So, the «extended mind thesis » is a remark on how (...) its supporters or opponents want to use the word ‘mind’, not a thesis of cognitive science or philosophy. The upshot of the extended mind discussion should not be to draw the line further out, but to drop the demarcation project. (shrink)

This article examines Schürmann’s oeuvre in light of his reflections on language. Schürmann’s meditations raise the question whether language is capable of truly expressing the ultimate conditions of human experience. This article argues that, after hegemonies have been broken, or rather are seen to have always been broken from within, one can continue to speak, but only on condition that tragic irony doubles every natal general word with a mortal singular shadow.

The author opens with a general discussion of religion & the beginnings of Law. Each subsequent chapter discusses topics such as: Origin of Laws, Inherited Education, Rulers & Leaders, Evolution, Tyranny, Taxation, & many others. A very readable text, which invokes additional thought on a variety of topics.

Scientific models need to be investigated if they are to provide valuable information about the systems they represent. Surprisingly, the epistemological question of what enables this investigation has hardly been investigated. Even authors who consider the inferential role of models as central, like Hughes or Bueno and Colyvan, content themselves with claiming that models contain mathematical resources that provide inferential power. We claim that these notions require further analysis and argue that mathematical formalisms contribute to this inferential role. We characterize (...) formalisms, illustrate how they extend our mathematical resources, and highlight how distinct formalisms offer various inferential affordances. (shrink)

This paper explores the apparently forgotten area of community education. It examines the dominant modes of community education practice, dubbed the status reform model, and concludes that one of the key explanations of its failure to change practice was its reluctance to tackle professional domination of existing power structures in education. The article also examines New Right definitions of appropriate parental roles, of citizenship, and of community.
