Delivering high quality genomics-informed care to patients requires accurate test results whose clinical implications are understood. While other actors, including state agencies, professional organizations, and clinicians, are involved, this article focuses on the extent to which the federal agencies that play the most prominent roles — the Centers for Medicare and Medicaid Services enforcing CLIA and the FDA — effectively ensure that these elements are met and concludes by suggesting possible ways to improve their oversight of genomic testing.

The British biologist, philosopher, and psychologist Conwy Lloyd Morgan is widely regarded as one of the founders of comparative psychology. He is especially well known for his eponymous canon, which aimed to provide a rule for the interpretation of mind from behavior. Emphasizing the importance of the context in which Morgan was working—one in which casual observations of animal behavior could be found in Nature magazine every week and psychology itself was fighting for scientific legitimacy—I provide an account (...) of Morgan’s vision for the comparative psychologist qua professional psychologist. To this end, I explore the important connection between Morgan and the evolutionary theorist, philosopher, and psychologist Herbert Spencer. It is from Spencer, I contend, that Morgan inherited a number of his key epistemological and methodological concerns about the nascent science of comparative psychology. This extends all the way to the canon, which only works as intended when paired with a Spencerian understanding of mental evolution as a progressive linear sequence. Far from being an incidental residue of a pre-Darwinian time, hierarchy was intentionally built into the very core of Morgan’s scientific comparative psychology. (shrink)

If tokens of 'I' have a sense as well as a reference the question immediately arises of what account to give of their sense. One influential kind of account, of which Gareth Evans provides the best developed instance, attempts to elucidate the sense of 'I' partly in terms of the distinctive functional role possessed by thoughts containing this sense ('I'-thoughts). Accounts of this kind seem to entail that my 'I'-thoughts cannot be entertained by anyone other than me, a consequence generally (...) thought unacceptable. I defend it. I also justify a functional role account of the sense of 'I'. The result should be to make plausible an account of the sense of 'I' in terms of the functional role of 'I'-thoughts. (shrink)

This article gives two arguments for believing that our society is unknowingly guilty of serious, large-scale wrongdoing. First is an inductive argument: most other societies, in history and in the world today, have been unknowingly guilty of serious wrongdoing, so ours probably is too. Second is a disjunctive argument: there are a large number of distinct ways in which our practices could turn out to be horribly wrong, so even if no particular hypothesized moral mistake strikes us as very likely, (...) the disjunction of all such mistakes should receive significant credence. The article then discusses what our society should do in light of the likelihood that we are doing something seriously wrong: we should regard intellectual progress, of the sort that will allow us to find and correct our moral mistakes as soon as possible, as an urgent moral priority rather than as a mere luxury; and we should also consider it important to save resources and cultivate flexibility, so that when the time comes to change our policies we will be able to do so quickly and smoothly. Several writers have argued for the implausibility of there being naturalistic explanations of mystical experience. These writers recognize that the evidential significance of mystical experiences for theism depends upon whether explanations that exclude supernatural agency can be discounted; but they seem unaware of some of the best scientific work done in this area. Part I of the present paper introduces the theory of I. M. Lewis, an anthropologist, and tests it against the case of St Teresa. I use Teresa because (...) of her prominence, and because we have considerable biographical data for her. I conclude that Lewis's approach, suitably supplemented, is strikingly successful in explaining this case. (shrink)

The problem of the many threatens to show that, in general, there are far more ordinary objects than you might have thought. I present and motivate a solution to this problem using many-one identity. According to this solution, the many things that seem to have what it takes to be, say, a cat, are collectively identical to that single cat.

The world contains objective causal relations and universals, both of which are intimately connected. If these claims are true, they must have far-reaching consequences, breathing new life into the theory of empirical knowledge and reinforcing epistemological realism. Without causes and universals, Professor Fales argues, realism is defeated, and idealism or scepticism wins. Fales begins with a detailed analysis of David Hume's argument that we have no direct experience of necessary connections between events, concluding that Hume was mistaken on this fundamental (...) point. Then, adopting the view of Armstrong and others that causation is grounded in a second-order relation between universals, he explores a range of topics for which the resulting analysis of causation has systematic implications. In particular, causal identity conditions for physical universals are proposed, which generate a new argument for Platonism. The nature of space and time is discussed, with arguments against backward causation and for the view that space and time can exist independently of matter or causal process. Many of Professor Fales's conclusions seem to run counter to received opinion among contemporary empiricists. Yet his method is classically empiricist in spirit, and a chief motive for these metaphysical explorations is epistemological. The final chapters investigate the perennial question of whether an empiricist, internalist and foundational epistemology can support scientific realism. (shrink)

Excellence in the care of hospital patients, particularly those in an intensive care unit, reflects esprit de corps among the care team. Esprit de corps depends on a delicate balance; each clinician must preserve a sense of personal responsibility for “my” patient and yet participate in the collaborative work essential to the care of “our” patient. A harmful imbalance occurs when a physician demands total control of the decision-making process, especially concerning end-of-life treatment options. Although emotional factors may push a (...) physician to claim decision-making exclusivity, compounded by a legal framework that overemphasizes individual responsibility, esprit de corps can be preserved through timely communication among clinicians and a recognition that optimal care for “my” patient requires effective team practice. Without needing to commit to any specific claims about what states of affairs have most agent-neutral value, we can nevertheless predict that states of affairs which are relatively valuable are also relatively likely to occur—on the grounds that, all else equal, at least some other agents are likely to recognize the value of those states of affairs, pursue them because they are valuable, and successfully bring them about as a consequence of that pursuit. This gives us a way to promote (...) value as such, rather than promoting it under some more tendentious description. We can predict that actions which help other people—or our own future selves—to recognize valuable states of affairs, actions which motivate them to pursue whatever states of affairs they believe to be valuable, or actions which help them succeed at their pursuits will, all else equal, have positive consequences. So we have a pro tanto reason to take such actions, and the subjective justification of that reason is independent of other moral claims. (shrink)

Jerome Gellman has recently disputed my claim that a naturalistic explanation for mystical experiences is available, a better explanation than any current attempt to show that God is sometimes perceived in those experiences. Gellman argues (i) that some mystics do not 'fit' the sociological explanation of I. M. Lewis; (ii) that the sociological analysis of tribal mysticism cannot properly be extended to theistic experiences; and (iii) that mystical experiences merit prima facie credence, so the burden of proof falls on the (...) naturalist. I reply (i) that the alleged counter-examples either do fit Lewis's explanation or are too poorly known to judge; (ii) that Lewis's theory, supplemented by recent neurophysiological findings, provides a strong explanation for all mystical experiences; and (iii) that the burden of proof, if there is one, now falls on the theist. This article presents a rule-utilitarian theory which lies much closer to the social contract tradition than most other forms of consequentialism do: calculated-rates rule preference utilitarianism. Being preference-utilitarian allows the theory to be grounded in instrumental rationality and the equality of agents, as opposed to teleological assumptions about impartial goodness. The calculated-rates approach, judging rules’ consequences by what would happen if they were accepted by whatever number of people is realistic rather than by what would happen if they were accepted (...) universally or by exactly 90% of the population, allows it to select rules based not just on their ability to give good advice to their followers but also on their ability to attract followers in the first place. The result is a theory that, although fully utilitarian and not at all pluralistic or intuitionist, nevertheless offers a principled justification for giving some weight to seemingly non-utilitarian considerations: Lockean natural rights, Kantian respect for autonomy, and Scanlonian distributive justice. The attraction between religion and politics is perennial. Sometimes, in its long and checkered history, it has led to an adulterous affair. I want to ask what lies at the heart of this attraction, and whether that can shed any light on the current religious/political scene. But the romance metaphor is at bottom not a good one. I shall argue that, in their originary condition, religion and politics are "closer," both ontologically and in their motivation, than woman and man, closer (...) than siblings. Perhaps the image of siamese identical twins would serve best as a figure for the union which binds together these domains, in spite of the peculiar political history which has, in the West and especially in this country, attempted to sunder them. Let me emphasize right here that my project is a descriptive one: I am seeking a deeper understanding of the phenomena, not attempting to develop a prescriptive or normative position concerning what is to be done. Indeed, I shall only be able to sketch the outlines of the descriptive position I shall propose. (shrink)

Traditionally, theories of mindreading have focused on the representation of beliefs and desires. However, decades of social psychology and social neuroscience have shown that, in addition to reasoning about beliefs and desires, human beings also use representations of character traits to predict and interpret behavior. While a few recent accounts have attempted to accommodate these findings, they have not succeeded in explaining the relation between trait attribution and belief-desire reasoning. On my account, character-trait attribution is part of a hierarchical system (...) for action prediction, and serves to inform hypotheses about agents’ beliefs and desires, which are in turn used to predict and interpret behavior. In the twenty-five years since philosophers began to bemoan ‘the dreariness of aesthetics’, students in Wittgenstein's wake have done a great deal to eliminate the grounds of the complaint. Unfruitful essentialist theories have been largely displaced by the vigorous, if somewhat uncontrolled, growth of an enterprise which attempts to characterize and explicate aesthetic phenomena outside the desert of definition. The resulting view portrays typically aesthetic concepts as being indivisibly characterizing and evaluative, relativistic in application, necessarily linked to human attitudes, irreducible (...) to non-aesthetic concepts, and yet as having social conditions which make them capable of intersubjective comparison and test. These characteristics are usefully summarized in saying that aesthetic concepts are concepts of appraisal. The theory of aesthetic appraisal discussed here is clearly incompatible with views which postulate dichotomies between objectivity and subjectivity, fact and value, and it is quite analogous to ‘descriptivist’ theories in ethics which reject these absolute distinctions. Moral examples are thus often useful for explicating the notion of aesthetic appraisal and the theory embodying that notion likewise has an important bearing on contemporary controversies in ethics. Birch sketches out an ingenious account of how the psychology of social norms emerged from individual-level norms of skill. We suggest that these individual-level norms of skill are likely to be much more widespread than Birch suggests, extending deeper into the hominid lineage, across modern great ape species, all the way to distantly related creatures like honeybees. This suggests that there would have been multiple opportunities for social norms to emerge from skill norms in human prehistory.

Critically engages the work of the philosopher Don Ihde.

In this paper we will be concerned with the interpretability logic of PA and in particular with the fact that this logic, which is denoted by ILM, does not have the interpolation property. An example for this fact seems to emerge from the fact that ILM cannot express Σ₁-ness. This suggests a way to extend the expressive power of interpretability logic, namely, by an additional operator for Σ₁-ness, which might give us a logic with the interpolation property. We will formulate (...) this extension, give an axiomatization which is modally complete and arithmetically complete (although for proofs of these theorems we refer to an earlier paper), and investigate interpolation. It has been nearly a decade and a half since Fred Dretske, David Armstrong and Michael Tooley, having each rejected the Regularity theory, independently proposed that natural laws are grounded in a second-order relation that somehow binds together universals.' (l shall call this the ‘DTA theory’). In this way they sought to overcome the major - and notorious — shortcomings of every version of the Regularity theory: how to provide truth conditions for laws that lack instances; how to distinguish laws (...) from accidental generalizations; how to provide truth conditions for the counterfactuals and disposition statements that laws apparently ‘support’; how to justify inductive inferences from past events to laws and future events. For each of these puzzles, an apparently key element in the solution seems to be missing from Regularity theories. That missing element is a genuine connection, a relation with more than merely spatial and/or temporal content, linking the antecedent of a law to its consequent. Once such an additional objective element - however understood — is admitted to be essential to the analysis of laws, one is forced to give up the idea that the logical form of laws can be given in terms of quantifiers ranging over events or states of alfairs, and truth-functions. This study is a new look at the question of how God can act upon the world, and whether the world can affect God, examining contemporary work on the metaphysics of causation and laws of nature, and current work in the theory of knowledge and mysticism. It has been traditional to address such questions by appealing to God’s omnipotence and omniscience, but this book claims that this is useless unless it can be shown how these two powers "work." Instead of (...) treating the familiar problems associated with omnipotence and omniscience, this book asks directly whether, and how, causal interactions between God and His world could occur: both between God and the physical world and between God and other minds, as well as between the world and God. This paper is a critical examination of Harry Collins's investigation into a third form of knowledge, “interactional expertise.” We argue that although Collins makes a genuine contribution to the phenomenological literature on expertise, his account requires further critical evaluation and response due to pragmatic and ontological considerations. We contend that by refining (in some questionable ways) the category of interactional expertise so as to create epistemological equivalence between activists, sociologists, critics, journalists, and some science administrators, Collins potentially undermines the value (...) that a more rigorously construed concept of interactional expertise might have. We further show that Collins misunderstands the nature of embodiment in a way that is exacerbated by the sociological perspective that he adopts. (shrink)

The interpretability logic of a mathematical theory describes the structural behavior of interpretations over that theory. Different theories have different logics. This paper revolves around the question what logic describes the behavior that is present in all theories with a minimum amount of arithmetic; the intersection over all such theories so to say. We denote this target logic by IL.In this paper we present a new principle R in IL. We show that R does not follow from the logic ILP0W* (...) that contains all previously known principles. This is done by providing a modal incompleteness proof of ILP0W*: showing that R follows semantically but not syntactically from ILP0W*. Apart from giving the incompleteness proof by elementary methods, we also sketch how to work with so-called Generalized Veltman Semantics as to establish incompleteness. To this extent, a new version of this Generalized Veltman Semantics is defined and studied. Moreover, for the important principles the frame correspondences are calculated.After the modal results it is shown that the new principle R is indeed valid in any arithmetically theory. The proof employs some elementary results on definable cuts in arithmetical theories. (shrink)

Richard Thaler and Cass Sunstein’s Nudge advances a theory of how designers can improve decision-making in various situations where people have to make choices. We claim that the moral acceptability of nudges hinges in part on whether they can provide an account of the competence required to offer nudges, an account that would serve to warrant our general trust in choice architects. What needs to be considered, on a methodological level, is whether they have clarified the competence required for choice (...) architects to prompt subtly our behaviour toward making choices that are in our best interest from our own perspectives. We argue that, among other features, an account of the competence required to offer nudges would have to clarify why it is reasonable to expect that choice architects can understand the constraints imposed by semantic variance. Semantic variance refers to the diverse perceptions of meaning, tied to differences in identity and context, that influence how users interpret nudges. We conclude by suggesting that choice architects can grasp semantic variance if Thaler and Sunstein’s approach to design is compatible with insights about meaning expressed in science and technology studies and the philosophy of technology.
