Etienne Balibar se réfère à l’idée arendtienne de la citoyenneté pour montrer que la démocratie se construit nécessairement au travers d’une aporie. D’une part, la démocratie évoque l’idéal isonomique de l’égalité pour fonder la communauté ; d’autre part, elle inscrit la différence dans l’éventualité d’une contestation permanente des principes unificateurs. Ce que je propose, c’est de contribuer à développer le dialogue entre E. Balibar et Hannah Arendt en m’interrogeant sur la possibilité d’aller au-delà de l’horizon de la violence. Le (...) concept d’agon qu’Arendt utilise pour qualifier le vivre ensemble isonomique n’est pas la concurrence entre artisans, ni le conflit entre ennemis, mais renvoie plutôt à l’institution d’un monde commun grâce aux différences. L’agir agonistique comprend le risque de se distinguer, d’être en désaccord, de se différer, non seulement par rapport aux autres mais aussi par rapport a soi-même. Il faudrait alors définir la violence comme une force qui agit sur l’agon, c’est-à-dire, sur la capacité de « devenir-autre ». We applied a technique borrowed from the field of bioethics to test whether justice-related factors influence laypersons’ decisions concerning business ethics. In the first experiment, participants judged the acceptability of remuneration policies and in the second that of executive bonuses. In each study, participants judged a set of 36 situations. To create the scenarios, we varied retributive justice—the amount of remuneration; procedural justice—the clarity of the procedure that determined the remuneration; distributive justice—the extent of the distribution of bonus payments amongst (...) employees; and restorative justice—a special compensation for hazardous working conditions or accidents at work. K-means clustering of all 36 judgments revealed four different personal positions in both experiments. One group of people readily accepted all situations. The other three groups’ judgments were mainly a function of distributive justice modulated in different ways by the context determined by the other variables. Furthermore, people conceive of distributive justice as categorical: Acceptability judgments only increase if companies give bonuses to all employees. Granting bonuses to a subset does not increase acceptability. Our results are useful for policy makers and provide business ethics researchers with a novel technique. (shrink)

Dans cette contribution, nous présentons la base CLAPI développée au laboratoire ICAR dans le contexte de l’évolution des bases de données de langues parlées en France au cours des trente dernières années. Nous détaillons les deux composantes de CLAPI, l’archive de corpus de langue parlée en interaction audio et vidéo enregistrés dans des situations sociales naturelles variées, et la plateforme d’outils.L’usage et l’apport de CLAPI sont illustrés par deux études. L’une décrit comment la base peut être utilisée pour des travaux (...) de linguistique interactionnelle intégrant la multimodalité (« oh là là ») ; l’autre concerne une recherche combinant données et métadonnées (« trop »). L’article est aussi l’occasion d’un bilan plus général. La mise en perspective montre en effet qu’après la période des questions est venue celle des dilemmes. La période des questions, choix et décisions à toutes sortes de niveaux a accompagné la mise en place des bases de données. L’expérience permet maintenant de mesurer leurs indéniables apports en termes non seulement de quantité de données disponibles (et traitables grâce aux outils), mais aussi de qualité (comme conséquence des exigences de standardisation liées au partage des données). La période des dilemmes nous conduit à nous interroger sur les meilleurs choix à opérer aujourd’hui dans les relations entre la poursuite des recherches sur des corpus variés (et parfois sensibles) et les exigences des bases de données ouvertes. Depuis longtemps, la recherche met en relief les influences françaises et allemandes de la pensée de Georges Gurvitch. De récents travaux ouvrent désormais la voie à l’étude de ses sources russes. Cet article vise à poser les bases de l’étude des sources russes de la pensée de Gurvitch. Pour ce faire, il recourt à onze articles publiés par Gurvitch, entre 1924 et 1931, dans la revue russe de l’émigration Annales contemporaines, dont il dégage une propension marquée à l’endroit des totalités (...) sociales. In the organelles of plants and mammals, recent evidence suggests that genomic instability stems in large part from template switching events taking place during DNA replication. Although more than one mechanism may be responsible for this, some similarities exist between the different proposed models. These can be separated into two main categories, depending on whether they involve a single‐strand‐switching or a reciprocal‐strand‐switching event. Single‐strand‐switching events lead to intermediates containing Y junctions, whereas reciprocal‐strand‐switching creates Holliday junctions. Common features in all the (...) described models include replication stress, fork stalling and the presence of inverted repeats, but no single element appears to be required in all cases. We review the field, and examine the ideas that several mechanisms may take place in any given genome, and that the presence of palindromes or inverted repeats in certain regions may favor specific rearrangements. We discuss the latent variables construct, particularly in regard to the following: that latent variables are considered as the sole explanatory factor of a disorder; that pragmatic concerns are ignored; and that the relationship of these variables to biological markers is not addressed. Further, we comment on the relationship between bridge symptoms and causality, and discuss the proposal in relationship to other constructs (endophenotypes, connectionist-inspired networks).

De la production à la transformation, le secteur alimentaire fait face à des risques incertains pour la santé qui impliquent la mobilisation d’approches de précaution. Dans le règlement (CE) n° 178/2002 établissant les principes généraux de la législation alimentaire, le principe de précaution a été énoncé précisément. Sans surprise, il implique de prendre des mesures de gestion en cas de suspicion d’un risque. Il s’adresse aux pouvoirs publics. La jurisprudence est venue préciser les critères de sa mise en œuvre en (...) marquant une relative dépendance du gestionnaire des risques à l’avis de l’évaluateur, mais les mesures de gestion de risques sont parfois légistiquement discutables et cacophoniques. Dans un contexte de désengagement de l’État, les exploitants du secteur alimentaire sont également concernés par la précaution, mais le contour de leurs obligations dans ce domaine reste encore imprécis. À défaut d’interprétation jurisprudentielle, davantage de transparence pourrait venir au support d’une meilleure gestion du risque incertain. (shrink)

Natural selection is commonly seen not just as an explanation for adaptive evolution, but as the inevitable consequence of “heritable variation in fitness among individuals”. Although it remains embedded in biological concepts, such a formalisation makes it tempting to explore whether this precondition may be met not only in life as we know it, but also in other physical systems. This would imply that these systems are subject to natural selection and may perhaps be investigated in a biological framework, where (...) properties are typically examined in light of their putative functions. Here we relate the major questions that were debated during a three-day workshop devoted to discussing whether natural selection may take place in non-living physical systems. We start this report with a brief overview of research fields dealing with “life-like” or “proto-biotic” systems, where mimicking evolution by natural selection in test tubes stands as a major objective. We contend the challenge may be as much conceptual as technical. Taking the problem from a physical angle, we then discuss the framework of dissipative structures. Although life is viewed in this context as a particular case within a larger ensemble of physical phenomena, this approach does not provide general principles from which natural selection can be derived. Turning back to evolutionary biology, we ask to what extent the most general formulations of the necessary conditions or signatures of natural selection may be applicable beyond biology. In our view, such a cross-disciplinary jump is impeded by reliance on individuality as a central yet implicit and loosely defined concept. Overall, these discussions thus lead us to conjecture that understanding, in physico-chemical terms, how individuality emerges and how it can be recognised, will be essential in the search for instances of evolution by natural selection outside of living systems. In this article the view that the Covid-19 pandemic – especially the lockdown that went hand in hand with it – revealed both the indispensability and fragility of morality was substantiated and the response of the church to the moral challenges posed by the pandemic discussed. Findings were based on information gained from South African media regarding the pandemic and the response to it in the South African context interpreted with the assistance of research in academic publications. Various respects in (...) which the pandemic underlined the indispensability of morality were discussed first. This was followed by a discussion of ways in which the pandemic also demonstrated the fragility of morality. The fragility of morality was traced back to the undermining influence of modern life on morality. Finally, the mixed record of South African churches in providing guidance on the moral challenges the Covid-19 pandemic posed, was noted. It was pointed out that the challenge remains to the church to provide moral guidance on life after the pandemic. The church would also have to effectively deal with the challenge to overcome the curtailment of its ability to provide such moral guidance in contemporary modern societies.Contribution: The contribution of the article lies in identifying the moral issues posed by the Covid-19 pandemic and in gauging the response of the church in the South African context to these issues. The challenges that remain to the church to also after the pandemic provide moral guidance and overcome obstacles in providing such guidance were also highlighted. (shrink)

In this final edition of his classic study of St. Thomas Aquinas, Etienne Gilson presents the sweeping range and organic unity of Thomistic philosophical thought. The philosophical thinking of Aquinas is the result of reason being challenged to relate to many theological conceptions of the Christian tradition. The Christian Philosophy of St. Thomas Aquinas offers students of philosophy and medieval studies an insightful introduction to the thought of Aquinas and the Scholastic philosophy of the Middles Ages, insights that are still revelant for today. Not only does it contribute to a major question of debate in Christian, Jewish, and Islamic philosophy and religion in the medieval period but it also insists on the validity of truth obtainable through reason as well as revelation, on rational argument alongside religious faith. This message is as important in the twenty-first century (...) as it was in the fourth century of the young Augustine, the thirteenth of St Thomas Aquinas, and the twentieth of the mature Gilson. Prenant la suite de travaux anterieurs, cet ouvrage d'Etienne Gilson envisage tout d'abord la confrontation dans une perspective genetique (en (...) cherchant dans certaines doctrines medievales les sources de theses cartesiennes comme l'inneisme, l'etude des meteores ou de la circulation sanguine), avant de considerer plus precisement le rapport de la metaphysique cartesienne et de la metaphysique medievale a travers l'examen de certains points de doctrine particulierement delicats. C'est ici notamment que sont rencontres et eclaircis les problemes de la critique cartesienne des formes substantielles, du dialogue de Descartes avec saint Augustin a l'occasion du cogito, avec saint Thomas dans la preuve de l'existence de Dieu par la causalite de l'idee, et avec saint Anselme dans la preuve dite ontologique. Autonomous vehicle moral dilemmas matter less for the particular outcomes of potential accidents than for their role in defining the values of the society we wish to live in. Different approaches have been suggested to determine the ethical settings that autonomous vehicles should be implemented in and identify the legitimate agents for making such decisions. Most of these, however, fail on theoretical grounds, facing severe issues related to moral justifications and compliance to the law, or on practical grounds, being insufficiently (...) universal, action-guiding, or technically viable to be implemented. The analogy with the “trolley problem” has been extensively discussed. However, researchers have rarely tried to adapt this framework to autonomous vehicle cases or investigate how it could be used to address these issues. In doing so, this paper aims to answer the two key problems of autonomous vehicle dilemmas. With regards to the decision-maker, it rejects autonomous vehicle users’ choice-based models, showing the absurdity of both switch of control and adaptative preferences and arguing for common legislator-determined ethical settings. With regards to the decisions themselves, it criticizes both utilitarian views and those based on individuals’ criteria to suggest a deontologist rights-based approach. This allows for the defence of a morally coherent, regulatory compliant, explainable, and easily implementable framework capable of addressing all autonomous vehicle moral dilemma scenarios present in the literature. étienne Balibar has been one of Europe's most important philosophical and political thinkers since the 1960s. His work has been vastly influential on both sides of the Atlantic throughout the humanities and the social sciences. In We, the People of Europe?, he expands on themes raised in his previous works to offer a trenchant and eloquently written analysis of "transnational citizenship" from the perspective of contemporary Europe. Balibar moves deftly from state theory, national sovereignty, and debates on multiculturalism and European (...) racism, toward imagining a more democratic and less state-centered European citizenship. Although European unification has progressively divorced the concepts of citizenship and nationhood, this process has met with formidable obstacles. While Balibar seeks a deep understanding of this critical conjuncture, he goes beyond theoretical issues. For example, he examines the emergence, alongside the formal aspects of European citizenship, of a "European apartheid," or the reduplication of external borders in the form of "internal borders" nurtured by dubious notions of national and racial identity. He argues for the democratization of how immigrants and minorities in general are treated by the modern democratic state, and the need to reinvent what it means to be a citizen in an increasingly multicultural, diversified world. A major new work by a renowned theorist, We, the People of Europe? offers a far-reaching alternative to the usual framing of multicultural debates in the United States while also engaging with these debates. First published in French in 2010, _Equaliberty_ brings together essays by Étienne Balibar, one of the preeminent political theorists of our time. The book is organized around _equaliberty_, a term coined by Balibar to connote the tension between the two ideals of modern democracy: equality and liberty. He finds the tension between these different kinds of rights to be ingrained in the constitution of the modern nation-state and the contemporary welfare state. At the same time, he seeks to keep rights (...) discourse open, eschewing natural entitlements in favor of a deterritorialized citizenship that could be expanded and invented anew in the age of globalization. Etienne Balibar, one of the foremost living French philosophers, builds on his landmark work 'Spinoza and Politics' with this exploration of Spinoza's ontology. Balibar situates Spinoza in relation to the major figures of Marx and Freud as a precursor to the more recent French thinker Gilbert Simondon's concept of the transindividual. Presenting a crucial development in his thought, Balibar takes the concept of transindividuality beyond Spinoza to show it at work at both the individual and the collective level.

Attempts to influence people’s beliefs through misinformation have a long history. In the age of social media, however, there is a growing fear that the circulation of false or misleading claims will be more impactful than ever now that sophisticated technological means are available to those who desire to spread them. Should democratic societies worry about misinformation? If so, is it possible and desirable for them to control its spread by regulating it? This chapter offers an answer to these questions. (...) First, I propose a definition of misinformation and explain how it proliferates in online contexts. Second, I consider four reasons to worry about misinformation by discussing its likely impact on people’s political opinions, emotions, physical safety and personal autonomy. Third, I assess three strategies for regulating misinformation—individual self-regulation, platform-based innovations and governmental action—and suggest that the most effective ones are those that spare human agents from having to successively review individual pieces of content. Western European liberal democracies have recently enacted laws that prohibit the diffusion of fake news on social media. Yet, many consider that such laws are incompatible with freedom of expression. In this paper, I argue that democratic governments have strong pro tanto reasons to prohibit fake news, and that doing so is compatible with free speech. First, I show that fake news disrupts a mutually beneficial form of epistemic dependence in which members of the public are engaged with journalists. Second, (...) I contend that laws against fake news enhance rather than thwart personal autonomy. If these suggestions are plausible, then the same considerations about truth and autonomy that underpin the value of free speech give us reasons to prohibit fake news. (shrink)

The article reflects on the present confusion between the category of enemy and that of stranger as result of a process of multiplication and reinforcement of territorial borders along ethnic and racial criteria. In particular, the text considers the external and internal borders of Europe as complex dispositivs of territorial control, which produce specific forms of foreigners as strangers and as cultural enemies. In order to analyze and stop this process, a cosmopolitan rethinking of the idea of citizenship is at (...) stake here. Transnational citizenship will be discussed in the frame of a philological model of translation between cultures and opposed to the model of an absolute untranslatability that characterizes the global civil wars. Cosmopolitics is thus conceived as a practical universalism, a progressive overcoming of the idea of the stranger in view of an idea of co-citizenship. Transnational co-citizenship does not suppress national identities but puts them in relation to all other sorts of particular identities and interests in order to create a contingent, maybe precarious but always concrete world of commons and communality. I suggest that shaping knowers of facts implies the teaching of intellectual virtues. To justify this claim, I do not appeal to the intrinsic value of epistemic goods such as truth or knowledge. Instead, I suggest that we have political reasons to teach intellectual virtues to high school and college students. The current epistemic environment – especially that found on social media – is not conducive to good democratic decision-making, but acquiring intellectual virtues can prepare students to make good political (...) decisions and increase the epistemic potential of democracy. For this reason, we should envision intellectual virtues as civic virtues, that is, excellencies that relate to the democratic process and that can help individuals become good citizens. (shrink)
