Ernesto Laclau has blazed a unique trail in political theory and philosophy since the early 1970s. In so doing, he has articulated a range of philosophical and theoretical currents into a coherent alternative to mainstream models and practices of conducting social and political science.

In this hugely influential book, Laclau and Mouffe examine the workings of hegemony and contemporary social struggles, and their significance for democratic theory. With the emergence of new social and political identities, and the frequent attacks on Left theory for its essentialist underpinnings, Hegemony and Socialist Strategy remains as relevant as ever, positing a much-needed antidote against ‘Third Way’ attempts to overcome the antagonism between Left and Right.

La tesis principal de este artículo se basa en una disanalogía funcional, entre lo que llamaré «derecho internacional basado en la humanidad», constituido por el derecho penal y los derechos humanos, y el rule of law interno. Si se adopta una perspectiva funcionalista, hay que dirigir la atención, para hacer frente a la indeterminación del derecho, tanto hacia el objetivo pragmático del rule of law – una razonable estabilidad – como hacia sus medios – el formalismo y la legalidad. Los (...) actores internacionales clave ¿comparten tales valores, inseparables del proyecto político del rule of law? El derecho internacional basado en la humanidad ¿satisface las exigencias del rule of law? La conclusión de este trabajo es que las instituciones y los mecanismos a los cuales los juristas se refieren usualmente cuando afirman que un orden jurídico constituye un rule of law, están, por lo general, ausentes en el derecho internacional basado en la humanidad. Esto implica que la indeterminación radical es, en los asuntos relacionados con la protección de la humanidad, un obstáculo demasiado grande al momento de cumplir con el ideal del rule of law. Este trabajo examina las intervenciones de la filosofía en los programas de Teoría de la Comunicación y Teoría y Análisis del Discurso Literario, dos asignaturas pertenecientes a la carrera de Letras (Facultad de Filosofía y Letras, UCA). Concretamente, se pasa revista a tres núcleos temáticos (la construcción discursiva de la otredad, la hermenéutica y la deconstrucción como prácticas de lectura y la delimitación de las fronteras entre ficción y realidad) que surgen en los estudios literarios y exigen respuestas filosóficas, instaurando (...) un ida y vuelta entre ambas disciplinas. Para terminar, se postula la estrecha relación entre la poesía y la filosofía desarrollada por autores como Derrida, Agamben y Lacoue-Labarthe en el cambio del siglo XX al XXI. (shrink)

This paper focusses on the experiences of Indian lesbians and gays who are subjected to unethical acts of workplace bullying which get manifested through constant guesswork, comments and questioning about their sexual identity in the hostile Indian context. Given this, LG participants usually opt for secrecy and lead a double life, using ‘passing’ and ‘covering’ strategies to manage economic, social and psychological risks. Nonetheless, this paper rewrites the negative tenor of lesbians, gays, bisexuals and transexuals research by underscoring how LG (...) participants move from fear to courage in their endeavour to live authentic lives while considering the broader organizational and social context. We argue that their courage is manifested mainly through deliberate micro-disclosures and a sense of defiance which can be enhanced if organizations are designed to be more inclusive and ethical. Consequently, participants defined inclusive ethical organizations as having conducive environments with trustworthy, supportive, secure, fair, unbiased and safe non-discriminatory policies open to the idea of diverse sexual orientations. Our findings point to the fact that, first and foremost, organizations must be crafted and sustained to be courageous within a hostile social climate, for employees to overcome their fears. (shrink)

This work brings together trends of current thinking - Lacanian psychoanalysis, deconstruction, neo-Hegelianism and political philosophy - to illuminate the question of identity in the contemporary world. It also examines some of the new political identities which have emerged in recent decades.

Derrida's recent book, On Cosmopolitanism and Forgiveness, offers a succinct and elegant understanding of forgiveness as ‘impossibility’, unencumbered by any conditions or threats of instrumentalization. However it also contains a disturbing implication. The first part of this article discusses the theory at length, followed by a series of critiques in the second part that shows how his aporetic theory of forgiveness is morally dangerous, for it unwittingly rests upon erasing the memory of the transcendental shortcomings of his conception. In this article, we shift the usual analytical attention of the GPN framework from lead firms to suppliers in the network and from production to IT services. Our focus is on how Indian IT suppliers embed in the Netherlands along the threefold characterization of societal, territorial and network embeddedness. We argue that Indian IT suppliers attempt to display societal embeddedness when they move to The Netherlands. Our findings reveal that the endeavour by Indian IT suppliers to territorially dis-embed from the (...) Dutch context is reinforced by their peripheral position in the network and their ability to offshore work in a bid to contain costs, in addition to the influence of client domination. Therefore, territorial embeddedness is considered to be secondary to societal embeddedness which is intertwined with client interest while neglecting the interest of other network members. Nonetheless, the inter-firm relationship is complex, given the tension between societal, territorial and network embeddedness. While preferring Indian IT suppliers because of their low pricing, Dutch clients also insist on compliance with the institutional context of the Netherlands especially when it comes to Dutch employees. This results in hybridization which means that Indian IT suppliers find ways to adhere to the institutional framework for Dutch nationals while simultaneously insulating Indian employees from the same. Consequently, a highly unfair segmented internal labour market develops, with Dutch nationals being treated more favourably as compared to Indian nationals. Nonetheless, to address these violations, Indian employees prefer individual strategies of resilience and rework rather than a collectivization response. (shrink)

This paper analyzes views of the Stoic philosopher Posidonius (1st century BC) in the light of modern Chemistry. I propose that Posidonius’ account on “generation and destruction” bears noteworthy similarities to the scientific notions of chemical elements, chemical species, nuclear reactions, and the law of conservation of mass. I find that his views compare favorably also with our understanding of chemical change at solid surfaces. Provided his thought is correctly placed in the cultural context of his day, I argue that (...) Posidonius deserves a previously un-acknowledged consideration in the historical background of modern Chemistry. (shrink)

The main argument of this article is based on a functional disanalogy, between what I will call ‘international humanity-based law’, constituted by human rights and criminal law, and the domestic rule of law. If we adopt a functionalist approach, the attention has to be focused both on Rule of Law’s pragmatical objective – a reasonable stability – and on its means – formalism and legality, for dealing with indeterminacy. Do international key players share such values, embedded in the Rule of (...) Law’s political project? Does humanity-based international law fulfil the requirements of the Rule of Law? The conclusion of this work is that institutions and mechanism to which usually legal scholars refer when stating that a legal order is a Rule of Law, are almost absent in humanity-based international law. That implies that radical indeterminacy is, in humanity issues, a too strong obstacle for achieving the ideal of the Rule of Law. (shrink)

Adorno’s philosophy has enjoyed a resurgence of attention in political theory over the past decade. In this paper, I challenge contemporary efforts to adopt his critical theory by arguing that his conceptions of mimesis and negative dialectics, which are central to his thought, are ultimately unsatisfactory. I begin by critiquing the normative content of the negative dialectic, and then move on to explore its problematic relation with mimesis. In the following sections I argue that mimesis cannot do the normative work (...) that Adorno requires of it. Rather, his idea of mimesis fails to inform critique (understood as ‘negative’ thought), relies on a problematic pre-modern idea of authenticity, and is incompatible with theoretical analyses of modern complex societies. Increasing global competition has intensified the use of informal sector workforce worldwide. This phenomenon is true with regard to India, where 92% of the workers hold precarious jobs. Our study examines the dynamics of workplace dignity in the context of Indian security guards deployed as contract labour by private suppliers, recognising that security guards’ jobs were marked by easy access, low status, disrespect and precariousness. The experiences of guards serving bank ATMs were compared with those working in large reputed organisations. (...) The former reported loss of dignity though their inherent self-worth remained partially intact, whereas the latter reclaimed dignity despite the precarious working conditions and the absence of unions. Guards from large reputed organisations evolved strategies by which they took advantage of the client’s vulnerabilities, developed ‘thick’ relationships at work and immersed themselves in 'doing dignity work' to ensure that they are not disposable. ‘Doing dignity work’ was a visible device which involved actions that met or went beyond the norms laid down by the client and was used by security guards to limit the extent of their precariousness. Since the opportunity to reclaim dignity was facilitated by large reputed clients’ adherence to legal regulations, we see implications of the study for the moral economy. (shrink)

In this paper we will suggest that a hypertextual representation of the text allows us to show different temporal layers of reading and lets us add new ones. We use the notion “layers of reading” as a metaphor to explain how, historically, each reading of a text creates a new layer, an independent “stratum of meaning” -to use a geological term-, that is superimposed to a previous reading. We think the digital edition and the digital reading could create a philosophical (...) methodology, based on the awareness of the historical construction of each layer of reading. (shrink)

En el presente trabajo se intenta ilustrar con ejemplos de la historia y de la actualidad constitucional de América Latina la paradójica actitud de no pocos juristas y políticos latinoamericanos que simultáneamente profesan una fe inconmovible en el poder de conformación social del ordenamiento jurídico a la vez que aceptan su precaria eficacia. La Constitución se convierte en un mito político y la impunidad en sinónimo de poder. En tales condiciones, parece aventurado establecer una relación causal entre orden constitucional y (...) democracia. Sólo una política jurídica que tome en serio los derechos y deberes constitucionales podrá quizás revertir esta situación. Desgraciadamente la probabilidad de que tal sea el caso a fines del siglo XX es menor que a comienzos de la centuria. (shrink)

Joseph Carens in his 2013 book Ethics of Immigration argues we should not criminalize undocumented migrants. Instead, we should view them as irregular immigrants who are entitled to some general human rights. This article focuses on Caren's discussion of criminalization in light of recent scholarship by John Marquez and Natalie Cisneros pertaining to the Latina/o border death toll, generalized violence, and discourses on undocumented pregnant migrante females as multiplying rats and anchor babies. This article argues that simply relying on a (...) democratic state model to understand the realities of border militarization is not sufficient because it does not perform some of the explanatory functions performed by other non-ideal theories. By synthesizing the views of Cisneros and Marquez, this article distinguishs thick and thin senses of excessive border enforcement and outlines a notion of the racial/sexual state of expendability as a way of making better sense of these violent realities. On the traditional view, Butler maintains that forgiveness involves a kind of “conversion experience” in which we must forswear or let go of our resentment against wrongdoers. Against this reading, I argue that Butler never demands that we forswear resentment but only that we be resentful in the right kind of way. That is, he insists that we should be virtuously resentful, avoiding both too much resentment exhibited by the vices of malice and revenge and too little resentment where we (...) merely condone the wrongdoer and leave ourselves open to future injury. I argue that this Butlerian approach offers us a more attractive account of forgiveness as a “virtue” than many recent discussions. In the final section, I address Butler’s challenging thesis that forgiveness is an unconditional moral duty. I argue against those who claim that forgiveness is supererogatory (Kolnai/Calhoun) or else merely morally conditional and even morally blameworthy in some cases (Murphy/Hampton/Novitz/Richards). By contrast, I defend a context-sensitive account of forgiveness which recognizes that it takes place on many different levels. I conclude by taking up the difficult issue of whether anybody can be ultimately “unforgivable”, offering some Butlerian and Strawsonian reflections that might help mitigate our judgments about such matters. Extensionalism is, roughly, the view that perception occurs in episodes that are temporally extended (and thus capable of accomodating in their entirety phenomena taking a nonzero lapse of time to occur). This view is widely acknowledged to be incompatible with thin presentism, the second most popular position in temporal ontology. In this paper, I argue that extensionalism is also incompatible with several other positions in temporal ontology, namely those positing the existence of non-present times that host sentience—positions I collectively refer (...) to as the sentient non-present view. Most notably, extensionalism proves to be incompatible with B-theoretical eternalism, which is the most popular position in temporal ontology. (shrink)

The computer has three fundamental analogies with the human being (senses, memory and intelligence), but the coming out of the data bases announced a new form of language: the computer language. The data bases not only set several new technical and social problems, but moreover are modifying the traditional form of social memory, supported by paper, by changing it in a memory based on electronic means.
