Public legitimacy consists of beliefs among the mass public that an international court has the right to exercise authority in a certain domain. If publics strongly support such authority, it may be more difficult for governments to undermine an international court that takes controversial decisions. However, early studies found that while a majority of the public trusts international courts, this was based on weak attitudes derivative from more general legal values and support for the international institutions. I reexamine these claims (...) with data for European courts, the International Criminal Court, and the International Court of Justice. First, using Google search data and media-analysis I find that, at least in Europe, information-seeking about international courts has increased and is at similar levels to national high courts and prominent international institutions. Second, trust in international courts remains strongly correlated with trust in international and domestic institutions. Countries in which more individuals trust their national courts are also countries in which more individuals trust international courts. Individuals who trust their national courts more are also more trusting of international courts. This undermines at least some interpretations of the credible commitment argument: in the minds of the general public, international courts may not be substitutes for poorly performing domestic courts, but extensions of a functioning rule of law system that they already trust. Drawing on research in the psychology of judgment and decision making, I argue that individual economists acting as experts in matters of public policy are likely to be victims of significant overconfidence. The case is based on the pervasiveness of the phenomenon, the nature of the task facing economists?as?experts, and the character of the institutional constraints under which they operate. Moreover, I argue that economist overconfidence can have dramatic consequences. Finally, I explore how the negative consequences of overconfidence can be (...) mitigated, and how the phenomenon can be reduced or eliminated. As a case study, I discuss the involvement of Western experts in post?communist Russian economic reforms. (shrink)

I argue that the analysis most capable of systematising our intuitions about coherence as a relation is one according to which a set of beliefs, A, coheres with another set, B, if and only if the set-theoretical union of A and B is a coherent set. The second problem I consider is the role of coherence in epistemic justification. I submit that there are severe problems pertaining to the idea, defended most prominently by Keith Lehrer, that justification amounts to coherence (...) with an acceptance system. Instead I advance a more dynamic approach according to which the problem of justification is the problem of how to merge new information with old coherently, a process which is seen to be closely connected with relational coherence. Isaac Levi has claimed that our reliance on the testimony of others, and on the testimony of the senses, commonly produces inconsistency in our set of full beliefs. This happens if what is reported is inconsistent with what we believe to be the case. Drawing on a conception of the role of beliefs in inquiry going back to Dewey, Levi has maintained that the inconsistent belief corpus is a state of ``epistemic hell'': it is useless as a basis for inquiry (...) and deliberation. As he has also noticed, the compatibility of these two elements of his pragmatist epistemology could be called into question. For if inconsistency means hell, how can it ever be rational to enter that state, and on what basis could we attempt to regain consistency? Levi, nonetheless, has tried to show that the conflict is only apparent and that no changes of his theory are necessary. In the main part of the paper I argue, by contrast, that his attempts to reconcile these components of his view are unsuccessful.The conflict is real andthus presents a genuine threat to Deweyan pragmatism, as understood by Levi. After an attempt to pinpoint exactly where the source of the problem lies, I explore some possibilities for how to come to grips with it. I conclude that Levi can keep his fundamental thesis concerning the role of beliefs in inquiry and deliberation, provided that he (i) gives up the view that the agent can legitimately escape from inconsistency, and (ii) modifies his account of prediction alias deliberate expansion by acknowledging a third desideratum, besides probability and informational value, namely, not to cause permanent breakdown further down the line of inquiry. The result is a position which is more similar to Peter Gärdenfors's than is Levi's original theory, while retaining the basic insights of the latter. (shrink)

Constructivist analyses of risk regulation are typically agnostic about what should count as robust or reliable knowledge. Indeed, constructivists usually portray competing accounts of risk as if they were always equally contingent or engaged with different and incommensurable issues and problem definitions. This article argues that assumptions about the equal reliability of competing accounts of risk deserve to be, and sometimes can be, examined empirically. A constructivist approach grounded in epistemological realism is outlined and applied empirically to a particular comparative (...) U.S./u.k. case study of pesticide regulation. The article argues that while the scope for interpretative flexibility when addressing risk issues is clearly extensive, it is not unconstrained. By scrutinizing the structure and coherence of particular risk assessments and policy decisions by reference to both empirical evidence and commonly held robust standards of interpretation, the article argues that the U.K. evaluation was not only less precautionary than its U.S. equivalent, but it was also less well constructed and therefore less reliable. Several social and institutional characteristics of U.S. and U.K. policy making are highlighted that appear variously to facilitate or inhibit the production of reliable knowledge and the making of prudent policy decisions. This paper argues that Isaac Levi's account of preference reversals is only a limited success. Levi succeeds in showing that an agent acting in accord with his theory may exhibit reversals. Nevertheless, the specific account that Levi presents in order to accommodate the behavior of experimental subjects appears to be disconfirmed by available evidence.

This paper provides an analysis of the evolution of thinking and talking about the role of scientific knowledge and expertise in food safety policy-making, and in risk policy-making more generally from the late 19th century to the present day. It highlights the defining characteristics of several models that have been used to represent and interpret the relations between policy-makers and expert scientific advisors and between scientific and political considerations. Both conceptual and empirical strengths and weaknesses of those models are identified, (...) focusing in particular on the ways in which they deal with scientific uncertainties and social choices. By drawing on both empirical evidence and conceptual analysis, a novel and more realistic model is provided along with an account of some conditions for food safety policy-making achieving both scientific and democratic legitimacy. ABSTRACT The future development of bioethics has been discussed in a number of articles in recent years, principally with regard to the trend towards empirical studies. However, what is meant by empirical studies in this context and how it is to be used concretely have been subject to varying interpretations. The purpose of this article is to develop what we term the microethical approach as a concrete method for an empirically driven bioethics. By adopting a microethical perspective, we will illustrate (...) an analytical concept for describing and demonstrating how, as a result of contextual circumstances and forms of understanding, different individuals in their everyday life adopt different coping strategies and behavior patterns in relation to ethical values. From a deepened perspective, the complexity of human behavior becomes apparent, and knowledge is gained about how moral problems are perceived and construed by those whom they in fact affect. We intend first and foremost to develop the microethical methodology by elucidating the methods and approaches that can help in clarifying moral dilemmas on a microethical level, and how the relationship between the empirical material and the ethical analysis evolves over the course of the analysis. This is exemplified by a study of caregivers’ entrance into patients’ private lives through the provision of care and assistance in the home. (shrink)

:Recent behavioral economics studies have shown that third parties compensate players in Dictator, Ultimatum, and Trust games. However, there are almost no studies about what drives third parties to compensate victims in such games. It can be argued that compensation is a form of helping; and helping behavior, in a variety of forms, has been widely researched, especially with regard to motivators. Previous work on helping behavior has focused on empathic concern as a primary driver. In sharp contrast, anger is (...) often seen as an antisocial motivator resulting in aggression. However, other research has shown that moral outrage, anger evoked by the violation of a moral rule or a social norm, can lead to the punishment of a perpetrator, often described as altruistic or pro-social punishment. Some of the motivations for pro-social punishment, namely a concern for justice or the restoration of community values, can also be realized through victim compensation. We therefore propose the hypothesis that moral outrage leads to compensating behavior above and beyond what is predicted by empathic concern, but only when a social norm has been violated. We test this hypothesis in two studies, both of which use modified trust games in which the investor experiences a loss due either to a social norm violation or some other cause. Study 1 shows that trait moral outrage predicts third-party compensatory behavior above and beyond empathic concern, but only when a social norm is violated. To better understand the causal mechanism, Study 2 directly manipulated moral outrage, showing again that moral outrage leads to compensation, but only when a social norm is violated. In the Lambek calculus of order 2 we allow only sequents in which the depth of nesting of implications is limited to 2. We prove that the decision problem of provability in the calculus can be solved in time polynomial in the length of the sequent. A normal form for proofs of second order sequents is defined. It is shown that for every proof there is a normal form proof with the same axioms. With this normal form we can give (...) an algorithm that decides provability of sequents in polynomial time. Therefore we can either discard it as generally irrelevant for the understanding of the cultural functions of texts, or use it as a point of departure for the formulation of both general and basic aspects of such functions. The position taken in this essay will opt for the (...) last possibility, although I know full well that already the term "metafiction" itself inevitably triggers a variety of skeptical reactions. Does it not just refer to some author's self-centered ruminations in the ivory tower? Or a topic for the nerds of literary studies with a taste for theoretical acrobatics? If so, in both cases following metafictional inclinations results in complete isolation from both the context of literature and its readers.However, one may also adopt the opposite position. The metafictional features of literature constitute one of the means by which literature reaches out to its context and also engages its readers. And critical endeavors are not necessarily devoid of anything but their own concepts. They may instead pave the way for methodological and didactic considerations that ultimately make difficult literature more accessible as a cultural phenomenon. Rather than dwelling upon subtle theoretical differences in the definition of what metafiction is, I will therefore engage in a methodological approach: what kind of questions can we put to the texts, and what kind of answers can we reasonably come up with when using metafiction in a methodological and didactic framework?I shall begin by proposing a set of definitions broader than metafiction that will allow me to zoom in on it as a relevant methodological concept that opens for didactic reflections. The notion of metalevel will constitute my starting point. In its broadest sense, a metalevel indicates a position outside a given field of objects or meanings and in relation to it. This is the role of, for example, the theory of science or of epistemology in relation to the particular knowledge of various sciences. We may call it an epistemological metalevel.In a more restricted sense, a metalevel comprises a level in relation to a given sign system — rather than to a given field of objects — from which we can observe and evaluate the basic principles defining the function, range and validity of the sign system. This is the role of, for example, musicology in relationto the acoustic arts, art criticism in relation to the visual arts, medicine in relation to bodily symptoms. We may call it an inter-semiotic metalevel.Finally, in its most restricted sense, a metalevel points toward a level inside a given sign system from which we can refer to this sign system itself,but not in relation to a given field of objects or in relation to another sign system. The focus of this dissertation is the debate over classification and species realism/anti-realism in the new science of mechanism. I argue that Michael Ayers's Interpretation of Robert Boyle as a Lockean on species is incorrect. Boyle is more realist than Locke, indeed, Boyle's theory of classification was more similar to Leibniz's than to Locke's. This realist account of Boyle helps to diagnose an important connection between Leibniz and Boyle, and show Locke as a much more novel philosopher of science. ;I (...) then argue that this account of Boyle's realism reveals a new argument strain in Leibniz that allows him a better reply against Locke's species anti-realism. I thus argue against Susana Goodin's view that Leibniz's reply to Locke's anti-realist arguments in the New Essays are stronger than they appear to be. According to Goodin, Leibniz cannot refute Locke without either changing the subject or appealing to his own deep metaphysics. I argue that Leibniz can reply in a dialectically adequate, non-question begging way to Locke's argument without appealing to anything deeper than the science of mechanism. ;Finally, I show that, contra Ayers, one of Locke's motivations for his anti-realism stems from his theological heterodoxy, not from the corpuscularian hypothesis. This theological strain appears most strikingly within the context of the debate over the status of persons and the human species. In the Essay, Locke denies each of Leibniz's orthodox theses regarding the human species. Locke's denials of the orthodox theses appear to be motivated by his heterodox theological commitments. The paper places the trendy notion of virtuality and virtual reality in a conceptual and historical context that makes it useful in a semiotic perspective. Virtuality is connected with the classical notion of fictionality, in its meaning of both invention and deception. Historically an active, a passive, and a neutral version of the concept can be distinguished. The notion is reinterpreted as a variant of the semiotic processes of deixis. In relation to nature - scenarios, prognoses, hypotheses, etc. - virtuality (...) is seen as a means of anchoring the human subject in nature instead of constructing a nonreal universe separated from it. In the July 2001 issue of the JournalofBiosocialScience Tina Moffat presents an interesting study from Nepal (Moffat, 2001). She refers to several studies, among them our study from Nepal’s neighbouring country Bhutan (Bøhler & Ingstad, 1996), to show that weaning practices are determined by different aspects of the environment, and thus cannot be made universal. However, she goes on to conclude that the recommendation of exclusive breast-feeding for 6 months may not be appropriate for the population she studied.
