Adults who are incapacitated and alone, having no surrogates, may be known as “unbefriended.” Decision-making for these particularly vulnerable patients is a common and vexing concern for healthcare providers and hospital ethics committees. When all other avenues for resolving the need for surrogate decision-making fail, patients who are incapacitated and alone may be referred for “public guardianship” or guardianship of last resort. While an appropriate mechanism in theory, these programs are often under-staffed and under-funded, laying the consequences of inadequacies on (...) the healthcare system and the patient him or herself. We describe a qualitative study of professionals spanning clinical, court, and agency settings about the mechanisms for resolving surrogate consent for these patients and problems therein within the state of Massachusetts. Interviews found that all participants encountered adults who are incapacitated and without surrogates. Four approaches for addressing surrogate needs were: work to restore capacity; find previously unknown surrogates; work with agencies to obtain surrogates; and access the guardianship system. The use of guardianship was associated with procedural challenges and ethical concerns including delays in care, short term gains for long term costs, inabilities to meet a patient’s values and preferences, conflicts of interest, and ethical discomfort among interviewees. Findings are discussed in the context of resources to restore capacity, identify previously unknown surrogates, and establish improved surrogate mechanisms for this vulnerable population. (shrink)

Warfare is becoming increasingly automated, from automatic missile defense systems to micro-UAVs (WASPs) that can maneuver through urban environments with ease, and each advance brings with it ethical questions in need of resolving. Proponents of lethal autonomous weapons systems (LAWS) provide varied arguments in their favor; robots are capable of better identifying combatants and civilians, thus reducing "collateral damage"; robots need not protect themselves and so can incur more risks to protect innocents or gather more information before using deadly force; (...) robots can assess situations more quickly and do so without emotion, reducing the likelihood of fatal mistakes due to human error; and sending robots to war protects our own soldiers from harm. However, these arguments only point in favor of autonomous weapons systems, failing to demonstrate why such systems need be made *lethal*. In this paper I argue that if one grants all of the proponents' points in favor of LAWS, then, contrary to what might be expected, this leads to the conclusion that it would be both immoral and illegal to deploy *lethal* autonomous weapons, because the many features that speak in favor of them also undermine the need for them to be programmed to take lives. In particular, I argue that such systems, if lethal, would violate the moral and legal principle of necessity, which forbids the use of weapons that impose superfluous injury or unnecessary harm. I conclude by highlighting that the argument is not against autonomous weapons per se, but only against *lethal* autonomous weapons. (shrink)

The view that CSR performance can be improved most effectively through external pressures is shown to be invalid for most firms. In exploring why this is the case, the authors demonstrate that most small and medium enterprises are not exposed to the same pressures as large firms, and that this undermines many of the assumptions that underpin the externally driven business case (EDBC) for voluntary CSR practices. The analysis does this by looking at the external drivers of one of the (...) components of CSR; namely, the environmental behaviour of firms. This shows that the strength of the EDBC is largely determined by five factors. Importantly, the analysis provides the basis for the claim that -- and helps to explain why -- the EDBC for voluntary environmental behaviour is likely to remain a weak form of pressure for many small firms. Central to Thomas Sprat's History of the Royal Society was the description and justification of the method adopted and advocated by the Fellows of the Society, for it was thought that it was their method which distinguished them from ancients, dogmatists, sceptics, and contemporary natural philosophers such as Descartes. The Fellows saw themselves as furthering primarily a novel method, rather than a system, of philosophy, and the History gave expression to this corporate self-perception. However, the History's description of their method (...) was not necessarily accurate. Rather, as will be argued below, by a combination of subtle misrepresentation and selective exposition, Sprat portrayed a method which would further the aims of social and ecclesiastical stability and material prosperity, essential for the Royal Society since its continued existence depended upon the creation of a social basis for the institutionalized pursuit of natural philosophy. Some link had to be forged between the activities of the Society and the intellectual and social aspirations of the Restoration. To understand the intent and meaning of Sprat's History and the method there portrayed, we must therefore look to the institutional needs which it fulfilled. (shrink)

In some conflicts, sexual violence is widespread, yet in other conflicts—including some cases of ethnic conflict—it is quite limited. In some conflicts, sexual violence takes the form of sexual slavery; in others, torture in detention. I document this variation, particularly its absence in some conflicts and on the part of some groups. In the conclusion, I explore the relationship between strategic choices on the part of armed group leadership, the (...) norms of combatants, dynamics within small units, and the effectiveness of military discipline. Others suggest, on the basis of his argument against free will, that Hume takes no more than an illusory feature of action to distinguish the experience of performing an act from the experience of merely observing an act. This article explores a particular pattern of wartime violence, the relative absence of sexual violence on the part of many armed groups. This neglected fact has important policy implications: If some groups do not engage in sexual violence, then rape is not inevitable in war as is sometimes claimed, and there are stronger grounds for holding responsible those groups that do engage in sexual violence. After developing a theoretical framework for understanding the observed variation in wartime sexual violence, the article (...) analyzes the puzzling absence of sexual violence on the part of the secessionist Liberation Tigers of Tamil Eelam of Sri Lanka. This study explores the pathways from the aspiration to make a difference in the world to vision and action of social entrepreneurs. Based on the qualitative analysis of interviews with 23 individuals who have pioneered institutions and initiatives around corporate responsibility, we find two predominant pathways to vision. The deliberate path starts with aspiration and moves through purpose toward a relatively intentional vision that ultimately leads to, and is subsequently informed by, action. The emergent path also begins with aspiration then (...) moves directly to action and only retrospectively to a sense of a vision behind the actions taken. The emergent path, in which action precedes vision, is contrary to the dominant assumption that vision leads to action in an entrepreneurial context and may be further characterized as either inadvertent or developmental. In advancing a conceptual model of the vision–action or action–vision trajectories of social entrepreneurs, this study highlights the iterative nature of vision. This study also demonstrates the importance of considering formative experiences that contribute to the aspiration to make some kind of a difference in the world, a sense of purpose or intentions, and core values and beliefs in examining the ethicality of social entrepreneurship. The article explores the impact of civil regulation on the environmental behaviour of SMEs. It shows that although civil regulatory pressures are generally subdued, and that conventional regulation continues to be an important driver of behaviour, there are circumstances where civil pressures nevertheless produce a ‘regulatory’ stimulus. Where they do, it appears that civil regulatory pressures tend to derive from stakeholders pursuing relatively narrow self-interest (rather than public interest) mandates; and they normally target particular issues rather than ‘social responsibility’ in (...) any broad sense. SME responses typically take the form of compliance-reinforcing (rather than beyond compliance) measures. For SMEs, it is suggested that, in some circumstances, civil regulation provides a bespoke regulatory mechanism which is more likely to bring about changes in basic practices on narrow issues. It can also be seen as producing a particular type of consensual micro-social contract and public interest service. (shrink)

Contemporary proponents of republican political theory often focus on the concept of freedom as non-domination, and how best to promote it within a state. However, there is little attention paid to what the republican conception of freedom demands in the international realm. In this essay I examine what is required for an agent to enjoy freedom as non-domination, and argue that this might only be achieved for individuals if one of two possibilities is pursued internationally: either (1) all nations are (...) made equally powerful, such that none may arbitrarily impose its will on another without penalty, or (2) all nations are joined under a global sovereign which guarantees that the weaker states are not subject to the whims of the stronger. I further argue that the first condition cannot suffice for achieving true non-domination, and as a result, republicanism must prescribe working toward the establishment of a global state. This paper provides an important contribution to the literature by addressing the international implications of the republican conception of freedom. (shrink)

Machiavelli’s The Prince, which he refers to in a famous letter of 10 December 1513 to Francesco Vettori as a treatise On Principalities, is sometimes read as a “failed job application” to work as an adviser to the recently installed Medici rulers of his native Florence. This article argues that, without necessarily replacing this traditional interpretation, such a reading of the text can also be supplemented by a reading which takes Machiavelli’s intention as more comprehensive and as directed to a (...) theoretically-inclined posterity, especially if attention is paid to the utility of the treatise as intended by its author. In a recent article Duncan Purves, Ryan Jenkins, and B. J. Strawser argue that in order for a decision in war to be just, or indeed the decision to resort to war to be just, it must be the case that the decision is made for the right reasons. Furthermore, they argue that this requirement holds regardless of how much good is produced by said action. In this essay I argue that their argument is flawed, in that it mistakes what (...) makes an agent morally good for what makes an act morally good. I argue that the main thrust of Purves et al.’s argument in fact undermines the conclusion they wish to draw, and that the reasons for one’s action do not make an in principle difference to the morality of actions in war. I further argue that this position undermines the traditional ad bellum just war constraint of right intention, and that the morality of actions in war is, at core, only concerned with outcomes. I conclude by clarifying that one’s reasons for action do in fact matter when deciding to enter war or kill in war, but only because one’s reasons significantly impact the way in which one acts. The purpose of this paper is to clear the theoretical space by showing why intentions/reasons do not in principle matter when assessing the morality of war (or killing), but this should not be taken as an argument that we should ignore intentions/reasons altogether. As it is, Ols's treatment reminds us that Rahner's own writings, which overlooked the later Councils of Constantinople, presume that Chalcedon had been the end of a development in Christology; this inaccurate presumption (...) has dominated too much of the writing which has followed Rahner's essay. Ols returns to this problem of " latent monophysitism " in some classical christologies in the final chapters of his work (VIII-XI). With a careful examination of the christology of Aquinas, the author skillfully demonstrates the rich development of Christ's true humanity that is possible within the classical approach; he deals specifically with the topics of Christ's knowledge, his sinlessness, and the concept of person. (It is interesting to note that, like Rahner and others before and after, Ols thinks that the word "person" is not particularly felicitous and would prefer simply the word hypostasis or subsistence [p. 187]. His wish is likely to have no more success than previous suggestions in this regard.) Although limited in its intent, this hook is rich in many ways. Ols's knowledge of St. Thomas is deep, and he uses that knowledge well. His critique of Rahner and Schilleheeckx may he forceful in its negative assertions, hut I believe it is accurate in pointing out the philosophical idealism that underlies much of their christological writings. This idealism is too often overlooked and needs the corrective of what we might call "Mediterranean realism." Although his criticism may he incisive, it is never unfair or strident, and he is aware of the positive insights that these men have contributed to our continuing reflections on the Lord. By intent, Ols's work is essentially one of evaluation and criticism. Nevertheless, the chapters that reflect on (and develop) Aquinas's teaching and give a positive presentation of the real human· ity of the Lord lead one to hope that the author will follow this study with a fully elaborated christology. Several good hooks on Kant's political philosophy have appeared in the past decade, hut the literature on Kant's political philosophy is still both slimmer and weaker than on any other aspect of his thought. 536 BOOK REVIEWS Though we still await a definitive study of the topic, this book goes a long way toward filling some important gaps. Even the best books on Kant's political philosophy tend to treat only the broad outlines of Kant's position, shying away from detailed exposition of Kant's theories of individual right and external possession and of the political theory based on them. Mulholland's is not only the most detailed but also the most persuasive account of these matters which has yet been presented in English. The book's first four chapters attempt to lay the foundations for Kant's political philosophy through a general discussion of his ethical theory. The main function of these (somewhat overlong) introductory chapters is to argue for a tension between the law of nature formula (which Mulholland prefers as a guide to Kant's theory of right) and the formula of humanity as end in itself. According to Mulholland, the law of nature formula leads to a theory of rights and political obliga· tion which places Kant in the natural law tradition, whereas the formula of humanity commits him to what Mulholland calls the " deed principle ": that acquired rights can come about only through a deed on the part of those having the duties corresponding to the rights through which these duties have been assumed. Mulholland argues that if we take the deed principle strictly, then we must base political obligation on consent and thus on a social contract. The burden of Mulholland's argument throughout the book is that Kant cannot sustain the deed principle, and it is... (shrink)

When rape by an armed organization occurs frequently, it is often said to be a strategy of war. But some cases of conflict-related rape are better understood as a practice, violence that has not been explicitly adopted as organization policy but is nonetheless tolerated by commanders. The typology of conflict-related rape in this article emphasizes not only vertical relationships between commanders and combatants but also the horizontal social interactions among combatants. It analyzes when rape is likely to be prevalent as (...) a practice, emphasizing not only gendered norms and beliefs of the society from which combatants come but also how those might be transformed by the organization’s socialization processes. In the conclusion, I suggest that the typology is relevant for analysts of all forms of of political violence and also for prosecutors, policy advocates, and policymakers concerned with conflict-related rape. Rather than offering a sustained study of the question of authority and leadership in the Church, Rausch presents a collection of essays related to the topic. The format reflects the book's genesis: much of the material was developed for the 23rd Faith and Order Conference of the Texas Conference of Churches on the subject "Authority in the Body of Christ." Although the title does not reflect the hook's ecumenical focus, readers who want a general introduction to the present status of agreement in ecumenical discussion of authority and ministry may find Rausch's hook helpful. In " Authority in the Ecumenical Dialogue " Rausch reviews and summarizes the ARCIC Final Report, the Lutheran-Roman Catholic Dialogue, the WCC Baptism, Eucharist and Ministry text, and the Consultation on Church Union. The emerging consensus on the value of ordained ministry in these documents indicates that this ministry is permanent, although the threefold ministry of bishop, presbyter, and deacon stands in need of reform. Rausch notes that the documents do not limit " valid " ministry to ordained ministry in communion with the historic episcopate. As for the shape of ministry in the church of tomorrow, not surprisingly, he identifies shared responsibility and collegiality as the marks of the future exercise of authority. Among the important issues still unresolved by the churches are Petrine ministry and primacy and the problem of the " reception " of ecumenical documents. The chapter on authority and reception, originally published in Theological Studies, may well be the most original contribution of the book. It broadens the discussion of reception from its historical " classical " understanding as " the acceptance by local churches of particular ecclesiastical or conciliar decisions " to an ecumenical understanding of the concept as " the acceptance by one church of a theo- 166 BOOK REVIEWS logical consensus arrived at with another church, and ultimately, the recognition of the other church's faith and ecclesial life as authentically Christian (p. 103)." He concludes that (1) reception is more properly understood as a process rather than as a juridical determination, (2) it also involves formal decisions on the part of church authorities, (3) it cannot be reduced to the acceptance of doctrinal formulations, and (4) the norm for recognizing a common faith is not agreement with a particular ecclesial position but agreement with the apostolic tradition. Ultimately, reception involves the whole church and is not the sole product of theologians or church authorities. Ecumenical dialogues will only be effective when they enter into the practical life of the churches. In "Imaging Tomorrow's Church: Models of Christian Unity" Rausch summarizes four models of church unity: organic union, conciliar fellowship, reconciled diversity, and communion of Churches. He opts for the fourth model. The chapter does not offer any new information to someone familiar with ecumenical discussions, but it does serve as an introduction for the neophyte. Rausch's image of authority in the future lies somewhere between a strictly hierarchical or institutional model and a more egalitarian model. His final chapter, " Authority in Tomorrow's Church," predicts that the church of the future will be " ordered " in the sense that it will combine an authoritative ordained ministry (based on the church's apostolic office) with a recognition of multiple and diverse charismatic gifts. He retrieves Karl Rahner's suggestion that recognition of charism for leadership in an individual may result in that person's " relative" ordination for a particular local community. Authority of the future will be collegial with a more participatory style of decision-making. The renewed papacy will encourage not only a more participatory style of decision-making but also a broader participation in the formulation of church teaching. The current literature suggests that the use of Husserl’s and Heidegger’s approaches to phenomenology is still practiced. However, a clear gap exists on how these approaches are viewed in the context of constructivism, particularly with non-traditional female students’ study of mathematics. The dissertation attempts to clarify the constructivist role of phenomenology within a transcendental framework from the first-hand meanings associated with the expression of the relevancy as expressed by interviews of six nontraditional female students who have studied undergraduate mathematics. Comparisons (...) also illustrate how the views associated with Husserl’s stance on phenomenology inadvertently relate to the stances of the participants interviewed as part of the study. The research questions focus on the emotional association with studying mathematics and how pre-conceived opinions regarding the study of mathematics may have influenced the essences of the experiences of the participants who have studied collegiate-level mathematics. The essences of the experiences of the participants are analyzed using bracketing and epoché to ensure personal biases of the researcher do not affect the interpretation of the expressed essences of the participants. Data collection is accomplished through two series of qualitative interviews seeking the participants’ firsthand impressions of how they view the way instructional design is oriented with regard to mathematics. Additional questions seek to illuminate the participants’ point of view regarding their emotional association with mathematics as well as their opinions and theoretical perspectives on the study of mathematics. In particular, it examines how self-control was employed as a flexible criterion for membership of a civilised, Roman world. We see this both in the sense of non-Romans imitating the self-controlled example of Belisarius and of Romans losing their self-control through imitating the luxury and tyranny of their Vandal opponents. In addition, the article argues for the Christianised character of this ethnographic language, which embraced the equation between right (...) belief, divine favour and self-control seen in the ecclesiastical historians, even if Procopius' understanding of right belief emphasises religious tolerance and humility over issues of dogma. In its many interwoven traditions, continental philosophy has a distinctive focus on what escapes the concept—experience, change, agency, responsibility, the future, the Other. The challenges that face us in the future are many: reaffirming and renewing what has already been thought and needs repeating, responding to emergent questions. None could be more urgent than the question of the animal and the fate of the planet. Addressing each of these requires that we suspend our normal conceptual assurances and think anew.

A real but typical case of identity fraud is used to open up the complex web of identification systems in Brazil. It is argued that identification has two poles related to the nature of citizenship—repression and inclusion—and that reactions from citizens to new identification schemes can be attributed to how they view the purpose of the cards in these terms. In Brazil, a sense of inclusion and citizenship based on a fear of anonymity and exclusion predominates leading to widespread support (...) amongst even critics of state activities. Octavia Butler's 1979 novel Kindred is a hybrid text: part historical novel, part science fiction/fantasy and part slave narrative. The story transports a contemporary black heroine into 19th–century Maryland in order to explore, recreate and connect with African American narratives of identity. Providing two narrative strands, one in 19th–century Maryland and the other in 20th–century California, the text is able to juxtapose the realities of slavery with its legacy. Conflating these time–periods, Kindred aims to interrogate the marginalization of African American (...) history, but specifically the role black women played in that history, in America's bicentennial year. While Butler adapts what has been regarded as the quintessential African American literary mode of the slave narrative, her fiction consciously draws upon a literary heritage that foregrounds narratives written by black women. Consequently, Kindred highlights the issues and concerns that directly affect the construction of black femininity and its role in the community of slaves as well as examining the historical pressure brought to bear on the configuration of contemporary African American womanhood. In doing so, Butler's fiction articulates the right of black women to intervene in their own construction and to inscribe the existence of black women in stories of originary identity. What this article seeks to explore is how Butler's fiction develops and extends the traditional slave narrative, how this is utilized in order to interrogate the ‘realities’ of both slavery and contemporary US society, and how effective the text is in challenging stereotypical representation of white and black femininity.
