The diagnostic category of borderline personality disorder (BPD) has come under increasing criticism in recent years. In this paper, we analyze the role and impact of epistemic injustice, specifically testimonial injustice, in relation to the diagnosis of BPD. We first offer a critical sociological and historical account, detailing and expanding a range of arguments that BPD is problematic nosologically. We then turn to explore the epistemic injustices that can result from a BPD diagnosis, showing how they can lead to experiences (...) of testimonial injustice which impede patient engagement in meaning-making activities, thereby undermining standard therapeutic goals. We conclude by showing how our arguments bolster ongoing efforts to replace the diagnostic category of BPD with alternatives such as complex post-traumatic stress disorder. (shrink)

The online dating application has in recent years become a major avenue for meeting potential partners. But while the digital public sphere has gained the attention of political philosophers, a systematic normative evaluation of issues arising in the ‘digital sexual sphere’ is lacking. I provide a philosophical framework for assessing dating app corporation conduct, capturing why people use these apps and their experience so often is unsatisfactory. Identifying dating apps as agents intervening in a social institution necessary for the reproduction (...) of society, with immense power over people's lives, I ask if they exercise their power in line with individuals’ interests. Acknowledging that people have claims to non-interference, equal standing, and choice improvement relating to intimacy, I find that the traditional, non-digital, sexual sphere poses problems to their realisation, especially for sexual minorities. In this context, apps’ potential for justice in the sexual sphere is immense, but unfulfilled. (shrink)

Over recent decades, developments in network governance have seen governments around the world cede considerable authority and responsibility to commercial migration intermediaries for recruiting and managing temporary migrant labour. Correspondingly, a by-product of network governance has been the emergence of soft employment regulation in which voluntary codes of conduct supplement hard legal employment standards. This paper explores these developments in the context of temporary migrant workers employed in Australian horticulture. First the paper analyses the growing use of temporary migrant labour (...) in this industry. It then describes how different types of intermediaries interact with this workforce. The paper then outlines both hard and soft employment regulations, and contrasts them with actual employment conditions, questioning how a network governance approach has affected this vulnerable workforce. The paper concludes that changes in network governance of migration and employment relations have emasculated formal legal regulation, leaving market forces to operate without effective or ethical constraints at the expense of the public good. John and Curran have convincingly shown that Scanlonian contractualism is a valuable resource for evaluating pandemic response policies, and that we should reject cost–benefit analysis in favour of a contractualist framework. However, they fail to consider the part of contractualism that Scanlon constructed precisely to deal with the question of when the state can restrict individuals from making choices that are harmful to themselves and others: the value of choice view. In doing so, they leave it open for opponents of (...) lockdowns to misuse contractualism to justify mistaken policies. This is because the most powerful contractualist objections to locking down are likely to be based on the VoC. When we apply the value of choice view, we see that a lockdown policy’s justifiability depends on the extent to which particular values of choice are found to be threatened by the policy in question, and what safeguards policy-makers have put in place to increase the value of choice and protect people from the harmful consequences of lockdown. Without the VoC, it is harder to explain why lockdowns, to be non-rejectable, must have certain features. With the VoC, the case for contractualism over cost benefit analysis can be made even stronger. (shrink)

Evaluating the sounds of life in urban neighborhoods can be one method of determining the health and vibrancy of an area. A silent neighborhood, one not devoid of sound or noise, but rather missing the sounds of human and animal life, can be detrimental to the community and its residents. (...) The stakeholder approach offers the opportunity to consider corporate responsibility in a wider sense than that afforded by the stockholder or shareholder approaches. Having said that, this article aims to show that this theory does not offer a normative corporate responsibility concept that can be our response to two basic questions. On the one hand, for what is the company morally responsible and, on the other hand, why is the corporation morally responsible in terms of conventional and post-conventional perspectives? The (...) reason why the stakeholder approach does not offer such a definition, as we shall see, is because the normative stakeholder approaches tend to confuse the social validity with the moral validity or legitimacy. It leads us to a conventional definition of corporate moral responsibility (CMR) that is not relevant to the pluralistic and global framework of our societies and economies. Based on therapeutic meetings with individuals who have experienced sexual violence and abuse, the challenge is how do we help these couples to establish sexual relationships on their own terms, without interference of defence or coping strategies they have used to protect themselves against the overwhelming experiences of violence or abuse in the past? This article will focus on therapeutic work with such couples and how to interact with them and support their efforts to establish satisfying sexual relationships, based on (...) sexological experience as well as experience from work with traumatisation. The basis for our treatment is a modified version of William Masters and Virginia Johnson’s approach. The technique of sensate focus is central, modified by trauma theory, including the understanding of dissociation, and the need to integrate memories from different levels: somatic, emotional, and cognitive. The traumatised client needs special attention to the experiences of predictability and safety and respect due to their history of being transgressed against. The therapists must be aware of the issue of dissociation; different dissociated inner parts can play different roles in the interaction between client and therapist. While couples therapy is a necessary frame for this therapy, the therapist often needs to work with issues unique to each individual. Each partner must be able to identify their own responses and their own sexual needs and preferences. It may therefore be valuable to have a co-therapist. The central goal is for the clients to identify responses to stimulation as a here and now experience in a setting that feels safe and welcome. (shrink)

The prevalence of dementia is increasing with the ever-growing population of older adults. Non-pharmacological, music-based interventions, including sensory stimulation, were reported by the Lancet Commission in 2020 to be the first-choice approach for managing the behavioural and psychological symptoms of dementia. Low frequency sinusoidal vibration interventions, related to music interventions through their core characteristics, may offer relief for these symptoms. Despite increasing attention on the effectiveness of auditory music interventions and music therapy for managing dementia, this has not included low (...) frequency vibration. This scoping review, following the JBI methodology guidelines, was conducted to investigate participants’ responses to both sound and mechanical vibration, the characteristics of the delivered interventions, methodological challenges, and the specifics of the research experiments reported. An extensive search was conducted in BMC, CINAHL, Cochrane Central Register of Controlled Trials, EMBASE, ERIC, MEDLINE, Pedro, ProQuest Central, PsycINFO, Scopus, and Web of Science. Current Controlled Trials, Clinical Trials, and Google Scholar were also searched as well as a hand search in relevant journals. Studies on adults with all types of dementia, investigating tactile low frequency sound or mechanical vibration in any context were considered. Data from eight full-length studies were extracted using the data extraction table developed by the authors and were included in the analysis and critical appraisal. Issues in quality related to, for example, control groups and blinding. Few studies addressed participants’ subjective responses to the interventions. Reporting on the intervention characteristics was unclear. It appeared more frequent sessions led to better outcomes and home-based interventions potentially addressing the issue of access and feasibility. Future research should include neuroimaging to measure and confirm the hypothesised mechanism of cerebral coherence. Standardised reporting of intervention characteristics is also needed to ensure replicability of the experiments. Higher quality research is needed to investigate the impact and effect of low frequency vibration for the symptoms of dementia and compare outcomes in meta-syntheses. (shrink)

Questions about when to limit unhelpful treatments are often raised in general medicine but are less commonly considered in psychiatry. Here we describe a survey of U.S. psychiatrists intended to characterize their attitudes about the management of suicidal ideation in patients with severely treatment-refractory illness. Respondents (n = 212) received one of two cases describing a patient with suicidal ideation due to either borderline personality disorder or major depressive disorder. Both patients were described as receiving all guideline-based and plausible emerging (...) treatments. Respondents rated the expected helpfulness and likelihood of recommending each of four types of intervention: hospitalization, additional medication changes, additional neurostimulation, and additional psychotherapy. Across both cases, most respondents said they were likely to provide each intervention, except for additional neurostimulation in borderline personality disorder, while fewer thought each intervention would be helpful. Substantial minorities of respondents indicated that they would provide an intervention they did not think was likely to be helpful. Our results suggest that while most psychiatrists recognize the possibility that some patients are unlikely to be helped by available treatments, many would continue to offer such treatments. Among various case studies addressing the reception of relativity, very few deal with Portugal at either the international or the national level. The national literature on the topic has mainly concentrated on the reactions to relativity of the Portuguese mathematical community. The absence of Portuguese astronomers alongside Eddington during the 1919 expedition to Principe, then a Portuguese island, has been implicitly equated with the astronomical community's lack of interest in the event. In reception studies dealing with general relativity, analysis has (...) tended to focus on the physics and mathematics communities, less on the astronomers. Given that relativity was born at the interface of physics, mathematics and astronomy, reactions of members of these scientific communities depended on differences in shared traditions, values, problems and expectations, as well as on individual practitioners' idiosyncrasies. This paper addresses the contributions of the overlooked Portuguese astronomical community, evaluates the actions and reactions of its members to the expedition and assesses their role in the process of appropriation of relativity. Now that the usage and meaning of urban spaces have been dramatically challenged by the global pandemic, several debates and reflections are going on around the manner in which cities – both as concerns the public and the private spaces – have been designed. The article observes how “urban-human face” representations have served different models of urbanity across times and cultures. Using a framework deriving from semiotics of culture, according to which the city represents a model of the world, the (...) article attempts to interpret how portraits of faces have been modelling the city through different urban faciality mechanisms. The focus is on a sample of what we call ‘urban-human faces’, ranging from Soviet propaganda posters to the digital #selfiecity project. The expression refers to series of representations that bring together the city and the face. It can be argued that both the city and the face, produced at a specific historical and cultural moment, with their figurative and plastic elements, deploy the struggle for the city ownership and authorship. Nonetheless, the commensurability of the city and the face can be just based on the fact that both semiotic configurations represent an excess with the help of cartographic reproduction (the city) and the portrait (the face), respectively. A city can be represented by a face to the extent to which it is also multifaceted as a polylogue. On the basis of such instable commensurability, the article will ultimately attempt to bring together the semiotics of the face and the semiotics of the city. (shrink)

Este libro aborda la relación entre arquitectura y mentalidades educativas. Muestra cómo los imaginarios dominantes son materializados en los espacios arquitectónicos de los colegios oficiales de Bogotá, al captar los movimientos sociales y culturales que los impulsan. Se parte del hecho de que los espacios arquitectónicos nos rodean y nos en-vuelven, y están presentes en cada detalle de nuestras vidas; así, un espacio particular, un rincón, una esquina, un salón o una habitación, que por momentos son o fueron parte de (...) lo vivido, al evocarlos hacen recordar lo ocurrido en su interior, e ir más allá y soñar con lo que pudo haber sido, con lo que fue, con lo que es o con lo que será. Es aquí donde el\' orden imaginario desempeña un papel clave en la vivencia y percepción de los espacios ya que estos se inscriben como "una nueva antropología del deseo", que nos permite determinar las formas de actuación socialmente construidas. Se combinan, entonces, el frío y el calor; lo frío del objeto arquitectónico que adquiere sentido cuando se encuentra con el calor de la vida. Es así como se pueden determinar las condiciones de posibilidad de una institución, un con-cepto: despojándolas de las explicaciones tradicionales, para de esta manera re-conocer que el objeto arquitectónico llamado "escuela" no es solo una construcción física, sino que adquiere múltiples interpretaciones producto de su intención de uso y de las proyecciones ideológicas y saberes sobre la educación. Habitar un territorio es tomarlo, marcarlo con nuestras emociones, sentimientos e ilusiones; en otras palabras, es construirlo, y re-construirlo, de manera permanente, a partir de nuestros imaginarios. Why it is that the principle of freedom of religion, rather than a more general principle such as liberty or liberty of conscience, figures so prominently in our lived experience and, in particular, in the constitutional commitment to the free exercise of religion? The Paper argues, negatively, that the most prominent answers offered thus far fall short; and positively, that the principle of freedom of religion arises out of a thicker understanding of the much neglected relationship between religious liberty and (...) democracy. Indeed, a proper account of the legitimacy of the democratic process. I argue, dissolves the mystery surrounding freedom of religion, and thus allows for an adequate justification of this principle. The thesis of this paper is that freedom of religion is a remedy that redresses the exclusion of certain religious arguments from the democratic process. The redress is grounded in a republican concern for political self-determination while exclusion is prescribed by a liberal ideal of political legitimation. (shrink)

In a series of works published over a period of twenty five years, C.W. Huntington, Jr. has developed a provocative and radical reading of Madhyamaka inspired by ‘the insights of post- Wittgensteinian pragmatism and deconstruction’. This article examines the body of Huntington’s work through the filter of his seminal 2007 publication, ‘The Nature of the M?dhyamika Trick’, a polemic aimed at a quartet of other recent commentators on Madhyamaka who attempt ‘to read N?g?rjuna through the lens of modern symbolic logic’, (...) a project which is the ‘end result of a long and complex scholastic enterprise … [which] can be traced backwards from contemporary academic discourse to fifteenth century Tibet, and from there into India’ and which Huntington sees as distorting the Madhyamaka project which was not aimed at ‘command[ing] assent to a set of rationally grounded doctrines, tenets, or true conclusions’. This article begins by explicating some disparate strands found in Huntington’s work, which I connect under a radicalized notion of ‘context’. These strands consist of a contextualist/pragmatic theory of truth, a contextualist epistemology, and a contextualist ontology where entities are viewed as necessarily relational I then use these linked theories to find fault with Huntington’s own readings of Candrak?rti and N?g?rjuna, arguing that Huntington misreads the semantic context of certain key terms and fails to follow the implications of N?g?rjuna and Candrak?rti’s reliance on the role of the pram??as in constituting conventional reality. Thus, I find that Huntington’s imputation of a rejection of logic and rational argumentation to N?g?rjuna and Candrak?rti is unwarranted. Finally, I offer alternate readings of the four contemporary commentators selected by Huntington, using the conceptual apparatus developed earlier to dismiss Robinson’s and Hayes’s view of N?g?rjuna as a charlatan relying on logical fallacies, and to find common ground between Huntington’s project and the view of N?g?rjuna developed by Tillemans and Garfield as a thinker committed using reason to reach, through rational analysis, ‘the limits of thought.’. The Theatetus and the Sophist present in succession two “battles” regarding ousia. In so doing, ousia is placed at the heart of what is essential to both dialogues : in fact, ousia interconnects with the conditions of possibility, both physical and metaphysical, of logos and epistèmè.However, each dialogue brings differing conceptions of discourse and science into play, and both articulate a different train of thought regarding being. Ousia appears differently in the two dialogues and it is not the same thing (...) as the notion of ousia, usually considered to be truly Platonic, presented in the central books of the Republic, which neither the Socrates of the Theatetus nor the Stranger of the Sophist put forward.Both present ways out of the battles, each has its own middle course. Against the thesis of the non‑immutability of ousia, the Theatetus establishes that there is not only motion. And, unlike the doctrine that reduces ousia to Forms excluding all motion, the Sophist shows that while there is not only motion, there is not only rest either. Such different orientations in the treatment of ousia, just below and just above doctrinal Platonism as it were, adjust to distinctions in the epistemological stakes : even if the Theatetus emphasizes that science proceeds from an activity of the soul bringing together “commons”, it is not yet a question, as it will be the following day, of systematically getting epistèmè to intellectually grasp a set of eidetic relationships, nor of making logos itself the elaboration of relationships. One needs to have left the field where those in favour of motion are challenged on their own ground, and in an albeit transformed field marked out by the partisans of eide which is not the field hierarchical metaphysics either, it will become possible to analyse the discourse itself as a relational framework that is consistent with the framework of ousia. Social norms regulating carework and social reproduction tend to be inegalitarian. At the same time, such norms often play a crucial role when we plan our lives. How can we criticise objectionable practices while ensuring that people can organise their lives around meaningful and predictable rules? Gerald Gaus argues that only ‘publicly justified’ rules, rules that everyone would prefer over ‘blameless liberty,’ should be followed. In this paper, we uncover the inegalitarian implications of this feature of Gaus's framework. We show (...) that because a society without clear social norms for how social reproduction and care work ought to be organised would be so unattractive, inegalitarian rules would pass Gaus's test. They would pass this test since they would nevertheless be better than ‘blameless liberty.’ Those who are disproportionately burdened by a rule are faced with the daunting task of showing that they would be better off under no rule, instead of merely having to show that they would be better off with a different rule. For private property to be legitimately recognized as a universal human right, its meaning should pass the test of self-imposability by an end. In this Essay, we argue, negatively, that the prevailing understanding of private property cannot plausibly meet this demanding standard; and develop, affirmatively, a liberal conception which has a much better prospect of meeting property’s justificatory challenge. Private property, on our account, is an empowering device, which is crucial both to people’s personal autonomy and to their relational equality. (...) The liberal conception of the human right to property has both vertical and horizontal significance — it implies respect from both the public authority and other individuals — which means that it is thoroughly political but not necessarily statist. Our account generates important implications, both domestic and transnational. Domestically, it implies that whereas some property rights should be subject to strong constitutional protection, state law should facilitate other types of private and non-private property institutions, and these property institutions may well be subject to non-owners’ claims to access and, more broadly, to being treated respectfully. Furthermore, our conception of the human right to property requires that everyone have the unusual authority typical of full-blown private ownership. Transnationally, our analysis highlights a freestanding dimension of relational justice, which is relevant across borders even given that our distributive obligations are statist. This injunction of relational justice in transnational interactions brings into question the adequacy of the current state of the law, according to which these interactions are mainly governed by choice-of-law rules that conceptualize them as wholly subsumed under the capacities of the parties as citizens of their respective polities. Au xixe siècle, en Algérie, l'État colonial français interdisait les armes aux indigènes, tout en accordant aux colons le droit de s'armer. Aujourd'hui, certaines vies comptent si peu que l'on peut tirer dans le dos d'un adolescent tout en prétendant qu'il était agressif, armé et menaçant. Une ligne de partage oppose historiquement les corps « dignes d'être défendus (...) » et ceux qui, désarmés ou rendus indéfendables, sont laissés sans défense. Ce « désarmement » organisé des subalternes et des opprimés au profit d'une minorité jouissant d'un droit permanent à porter des armes et à en user impunément pose directement, pour tout élan de libération, la question du recours à la violence pour sa propre défense. Du jiu-jitsu des suffragettes aux pratiques insurrectionnelles du ghetto de Varsovie, des fusils des Black Panthers aux patrouilles queer, Elsa Dorlin retrace une généalogie philosophique de l'autodéfense politique. Derrière l'histoire officielle de la légitime défense, il est ici question du récit des « éthiques martiales de soi », ces histoires ensevelies où le Sujet ne préexiste pas à sa propre défense, où le fait de se défendre en attaquant apparaît à la fois comme la condition de possibilité d'un soi et la matière des mythologies politiques. Cette histoire – une histoire de la violence – conditionne la définition même de la subjectivité moderne. IntroductionDeep brain stimulation (DBS) is utilized to treat pediatric refractory dystonia and its use in pediatric patients is expected to grow. One important question concerns the impact of hope and unrealistic optimism on decision-making, especially in “last resort” intervention scenarios such as DBS for refractory conditions.ObjectiveThis study examined stakeholder experiences and perspectives on hope and unrealistic optimism in the context of decision-making about DBS for childhood dystonia and provides insights for clinicians seeking to implement effective communication strategies.Materials and MethodsSemi-structured interviews (...) with clinicians (n = 29) and caregivers (n = 44) were conducted, transcribed, and coded.ResultsUsing thematic content analysis, four major themes from clinician interviews and five major themes from caregiver interviews related to hopes and expectations were identified. Clinicians expressed concerns about caregiver false hopes (86%, 25/29) and desperation (68.9%, 20/29) in light of DBS being a last resort. As a result, 68.9% of clinicians (20/29) expressed that they intentionally tried to lower caregiver expectations about DBS outcomes. Clinicians also expressed concern that, on the flip side, unrealistic pessimism drives away some patients who might otherwise benefit from DBS (34.5%, 10/29). Caregivers viewed DBS as the last option that they had to try (61.3%, 27/44), and 73% of caregivers (32/44) viewed themselves as having high hopes but reasonable expectations. Fewer than half (43%, 19/44) expressed that they struggled setting outcome expectations due to the uncertainty of DBS, and 50% of post-DBS caregivers (14/28) expressed some negative feelings post treatment due to unmet expectations. 43% of caregivers (19/44) had experiences with clinicians who tried to set low expectations about the potential benefits of DBS.ConclusionThoughtful clinician-stakeholder discussion is needed to ensure realistic outcome expectations.
