A standard framework for business ethics views the inquiry as an application of major ethical theories to specific issues in business. As these theories are largely presented as being principled, the exercise therefore becomes one of applying general principles to business situations. Many adopting this standard approach have thus resisted the implementation of the most prominent development in ethical theory in recent history: that of particularism. In this article, I argue that particularist thinking has much to offer to business ethics (...) and that standard resistance to particularist business ethics is based largely on misunderstandings. I do so by illustrating how the harbinger of particularism, W. D. Ross, countenances the practical wisdom of particularist ethics while being 1) invulnerable to standard objections to particularist business ethics and 2) compatible with the generalism of the standard approach. The Rossian business ethic is therefore one that the standard approach should be eager to include. (shrink)

Studies of protests against mobile phone masts typically concentrate on the potential health risks associated with mobile phones and their masts. Beck’s Risk Society has been particularly influential in informing this debate. This focus on health, however, has merely served to limit the discussion to those concerns legitimated by science conveniently ignoring other disputed issues. In contrast, this article contends that it is necessary to use a wider notion of risk to understand fully how the current political emphasis on active (...) citizenship may have contributed to the protests. It examines how neoliberal governmentality and the move to empower people are in contention with one another. The study draws upon case material from a small village protest group in United Kingdom and argues that much of the tension arises from the encouragement of the public on one hand to become active citizens but on the other to be passive consumers. The first attempted derivation by Galileo of the law relating space and time in free fall that has survived is preserved on an otherwise unidentified sheet bound among his manuscripts preserved at Florence. It is undoubtedly closely associated with a letter from Galileo to Paolo Sarpi, dated 16 October 1604, which somehow found its way into the Seminary of Pisa, where it is still preserved. Those two documents, together with the letter from Sarpi to Galileo which seems to have inspired (...) them, are translated in full below. Sarpi's letter, dated 9 October 1604, suggests that recent oral discussions of problems of motion had recently taken place between the two men. In this paper I give a novel argument for the view that epistemic normative reasons (or evidence) need not be facts. I first argue that the nature of normative reasons is uniform, such that our positions about the factivity of reasons should agree across normative realms –– whether epistemic, moral, practical, or otherwise. With that in mind, I proceed in a somewhat indirect way. I argue that if practical motivating reasons are not factive, then practical normative reasons are not factive. (...) If it is possible to act rationally in the light of a falsehood, as I will say, then some good reasons must be falsehoods. The implication of this argument is perhaps surprising: for one to firmly establish the view that epistemic normative reasons are factive, one must discredit the view that practical motivating reasons are not factive. This essay defends subjectivism about reasons of love. These are the normative reasons we have to treat those we love especially well, such as the reasons we have to treat our close friends or life partners better than strangers. Subjectivism about reasons of love is the view that every reason of love a person has is correctly explained by her desires. I formulate a version of subjectivism about reasons of love and defend it against three objections that have been made (...) to this kind of view. Firstly, it has been argued that the phenomenology of our focus when we have reasons of love does not fit with subjectivism about those reasons. Secondly, it has been argued that the phenomenology of our motivations when we have reasons of love does not fit with subjectivism about those reasons. Thirdly, it has been argued that subjectivism about reasons of love has deeply counterintuitive implications about what our reasons of love are. I argue that none of these objections succeeds. A survey of commentaries on Aristotle’s Poetics over the past century reflects a long-standing assumption that pleasure, rather than understanding, is to be seen as the real aim of tragedy, despite weak textual evidence to this end. This paper seeks to rehabilitatethe role of understanding in tragedy’s effect, as Aristotle sees it, to an equal status with that of its affective counterpart. Through an analysis of the essential inducement of wonder on the part of the viewer and its connection with (...) the organic unity of the plot—what Aristotle calls the “soul” of tragedy—I argue that the telos of tragedy in the Poetics is intended to accommodate both pleasure and incipient philosophical activity without necessarily privileging either. Cancer rates in men and women of reproductive age have continued to increase in recent years; however, therapy has dramatically decreased the mortality rates. Since 1990, the prevalence of cancer survivors in young adults increased from 1 in 1,000 to 1 in 250 patients due to more aggressive therapies. Current therapies may have profound toxic effects on gamete function with infertility as an expected consequence of cancer therapy. Depending on the site and stage of cancer, age of the patient, and (...) the type of treatment, approximately 90% of men and women diagnosed with cancer may be at risk of permanent infertility.Fertility preservation has emerged as a discipline dedicated to improving the future reproductive potential of cancer survivors. Significant progress in the advancement of fertility preservation therapies and a heightened awareness of the availability of therapies has occurred in the past 10 years. The American Society of Clinical Oncology and the American Society of Reproductive Medicine have advanced these efforts by formally recognizing the importance of fertility awareness. (shrink)

A closer look at the character of Odysseus in the opening passages of the Philoctetes reveals a more nuanced psychology of guilt and justification than commentators have thus far appreciated in the cunning hero's role. This paper examines the relations of sympathy between Odysseus, Neoptolemus, and Philoctetes as a way of entering into the complicated political drama of the work. Conceiving politics in the Philoctetes as a hybrid construction of the demands of nature and the demands of the gods, this (...) study provides a reading of Sophocles' play as an observation of the necessity for political regimes to efface the very conditions of sympathy that made them possible in the first place. On this reading, Sophocles' tragedy is to be seen as an explorarion of the damage incurred by individuals when such effacement takes place. (shrink)

Whereas the entrance of the monochrome into modern art has typically been understood in light of movements in contemporary art and aesthetic theory following in its wake, this essay seeks to understand the motivations for, and the effect of, the monochrome in the work of Aleksandr Rodchenko in 1921 in reference to Plato's analysis of pure pleasure and absolute beauty in the Philebus . I argue that Rodchenko and Plato were motivated by a shared project to contend with the aesthetic (...) and psychological effects of figurative semblance, or what Socrates calls the phantasm, in order to harmonize human perception with the world of sensuous material objects. It is in this shared project, I contend, that Rodchenko's strategy is to be understood as a kind of materialist Platonism that, when viewed phenomenologically, reveals Plato's objects of absolute beauty to be, in the context of industrial capitalism and the crisis of perception that Benjamin, among others, saw as its consequence, sites of loss and meaninglessness for modern consciousness, yet sites which nonetheless contain emancipatory potential for a social order that has been systematically alienated from itself and its environment. _The power and materiality of form. On studying the forms of knowledge in catechisms and ship’s logs._ The article argues that in the emerging field of the history of knowledge, with its focus on the production, circulation and exchange of knowledge, explorations of _ forms _ will represent a valuable addition. Form is related to genre. Yet, while the identification of genres is largely based on linguistic, literary or rhetorical criteria, form is also about structures and materiality as well as (...) about practical and institutional preconditions. Form often attracts less attention than contents, although the form makes this content recognizable _ as _ knowledge. Our argument builds on the exploration of two different early modern knowledge forms, the catechism and the ship's log respectively. Both demonstrate how form is decisive in defining contents as authoritative knowledge. They also illustrate how form is a prerequisite to enable knowledge to circulate and be part of cultural exchange, and thus to be socially efficient. The forms serve to codify existing knowledge, but also to the production and circulation of new insights. When forms like the log and the catechism are examined historically, however, they can also be seen to live their own lives in a tension between stability and change. The forms themselves become objects of negotiations, change and innovation. (shrink)

This essay seeks to understand Gorgias’ reflections upon language and perception in the Encomium of Helen through the threefold vocabularies of medicine, enchantment, and oratory that were often taken together in the fifth century. I demonstrate that the two modes of sorcery to which Gorgias refers have to do with language and its effect on opinion, on the one hand, and perception and its effect upon one’s affective bearing, on the other. Both effects, I claim, are grasped through their forceful (...) means of physically impressing and deforming the soul such that its reliance upon memory and habitual forms of dwelling in the world are subject to oblivion. Further, such conceptual and practical unmooring can be understood as forms of disease that rob an individual of her agency, either temporarily or permanently, and therefore reflect the problematic status of language in early democratic Greece. The metamorphosis of human beings into wolves is well known in mythology, legend, and scripture, and has been extensively surveyed in history, theology, and literature. Werewolf cases have attracted the attention of both ancient and modern physicians, particularly during the development of modern psychiatry and behavioral neurology. Some writers have suggested that lycanthropes suffered from schizophrenia or had intentionally or involuntarily ingested hallucinogens. Hysteria and affective disorder, either mania or intense depression, could also be invoked as causes. Lycanthropy has often (...) been linked with, and sometimes treated by, henbane and nightshade, and its manifestations could be explained in terms of atropinic delirium. Discoloration of teeth and urine, bizarre behavior, nocturnal wandering, and episodic skin and facial changes have suggested a role for porphyria in the werewolf transformation. Through many historical periods and cultures, persons believed to be werewolves have reportedly exhibited alterations in consciousness, depersonalization and derealization, acute anxiety and agitation, preoccupation with demonic possession, and compulsive or perseverative behavior, sometimes of a violent, sexually deviant or impulsive nature. Such features of werewolf behavior might also be explained by ictal and interictal manifestations of complex partial seizures, or as symptoms of the episodic dyscontrol syndrome associated with frontal lobe or limbic system disease or injury. Lycanthropy was often considered a manifestation of demonic possession or a consequence or indication of participation in necromancy. As such, self-proclaimed or suspected werewolves were often persecuted along with other practitioners of the black arts. It is generally believed that such persecution represented the last efflorescence of medieval demonology, but it has also been suggested that clinical description of illnesses of diabolical origin was part of the evolution of Renaissance medicine from the Galenic past toward the scientifically-based future. While a significant literature has appeared discussing theoretical ethical concerns regarding COVID-19, particularly regarding resource prioritization, as well as a number of personal reflections on providing patient care during the early stages of the pandemic, systematic analysis of the actual ethical issues involving patient care during this time is limited. This single-center retrospective cohort mixed methods study of ethics consultations during the first surge of the COVID 19 pandemic in Massachusetts between March 15, 2020 through June 15, 2020 aim to (...) fill this gap. Results indicate that there was no significant difference in the median number of monthly consultation cases during the first COVID-19 surge compared to the same period the year prior and that the characteristics of the ethics consults during the COVID-19 surge and same period the year prior were also similar. Through inductive analysis, we identified four themes related to ethics consults during the first COVID-19 surge including (1) prognostic difficulty for COVID-19 positive patients, (2) challenges related to visitor restrictions, (3) end of life scenarios, and (4) family members who were also positive for COVID-19. Cases were complex and often aligned with multiple themes. These patient case-related sources of ethical issues were managed against the backdrop of intense systemic ethical issues and a near lockdown of daily life. Healthcare ethics consultants can learn from this experience to enhance training to be ready for future disasters. (shrink)

International law evolved to end and prevent armed conflict as much as for any other reason. Yet, the law against war appears weaker today than ever in its long history, evidenced by raging armed conflicts in which people are killed, injured, and forcibly displaced. The environment is devastated, and the planet impoverished. These consequences can be traced to the dominant ideology of realism. In 1946, Hersch Lauterpacht challenged that ideology by contrasting it with the idea of international law, composed of (...) natural law, positive law, and process theory. The Art of Law in the International Community revives his vision, rebuilding the understanding of why international law binds, what its norms require, and how courts are the ideal substitutes for war. Confidentiality is a cornerstone of the physician-patient relationship. Breaches of confidentiality in the context of genetic testing are of particular concern for a number of reasons. First, genetic testing reveals information not only about a particular patient, but also about his or her family members. Second,genetic testing can label healthy people as “at risk,” subjecting them to possible stigmatization or discrimination by third parties. Third, as genetic testing becomes more widespread and is incorporated into primary care, breaches of confidentiality might (...) inadvertently occur more frequently because primary care providers may not be trained to understand the uniqueness of genetic information. Until now, genetic services have been provided primarily by medical geneticists and genetic counselors. However, with the proliferation of new genetic presymptomatic and carrier tests, primary care physicians are going to become increasingly involved in genetic testing. Currently, little is known about physicians’ attitudes toward disclosure of confidential genetic information to third parties. (shrink)

The question of a genealogy of race and gender is first and foremost a question of methodology. By bringing to bear the critical tools provided by Foucauldian methodology on the construction of race and gender in the specific historical case of Levittown, this chapter explores the manner in which the stories that inform our sense of “the way things are,” are shaped historically. Moreover, the chapter argues that the significance of the institutions and discourses becomes apparent only once they are (...) placed within the context of the play of relations of power and the deployment of bodies of knowledge. A genealogical analysis of Levittown reveals that the concepts of race and gender are not only essential to any conception of modern subjectivity, but also for the products of a network of relations of power.
