What defines family law? Is it an area of law with clean boundaries and unified distinguishing characteristics, or an untidy grouping of disparate rules and doctrines? What values or principles should guide it – and how could it be improved? Indeed, even the scope of family law is contested. Whilst some law schools and textbooks separate family law from children’s law, this is invariably effected without asking what might be gained or lost from treating them together or separately. Should family (...) law and children’s law be distinguished or treated together? One would expect disagreement on these questions in any context. In bringing together theorists from multiple jurisdictions and at least two primary disciplines, we should not be surprised to find deep differences in approach reflecting different methodologies and foundational questions. The tension between them, we hope, can illuminate and enrich discussion on all sides. (shrink)

Summary The purpose of this study was to examine the effectiveness of contingent teacher praise, as specified by Canter's Assertive Discipline programme, on children's on?task behaviour. In Western Australian primary schools (and in an increasing number of British schools) Canter's programme is widely used. However, while there are many anecdotal reports of its effectiveness there is a relative absence of well controlled research studies reporting objective data. In the present study, three teachers from three separate primary schools and eight randomly (...) selected children from each of their classes were systematically observed. Continuous data collection indicated that following training in the appropriate use of praise, as specified by Canter, all three teachers successfully increased their rates of praising. Of the 24 children, all but one evidenced increases in levels of on?task behaviour. However, observations conducted during a follow?up phase revealed reductions in the use of praise by the teachers and in some levels of on?task behaviour. (shrink)

We examined two potential correlates of hypnotic suggestibility: dissociation and cognitive inhibition. Dissociation is the foundation of two of the major theories of hypnosis and other theories commonly postulate that hypnotic responding is a result of attentional abilities . Participants were administered the Waterloo-Stanford Group Scale of Hypnotic Susceptibility, Form C. Under the guise of an unrelated study, 180 of these participants also completed: a version of the Dissociative Experiences Scale that is normally distributed in non-clinical populations; a latent inhibition (...) task, a spatial negative priming task, and a memory task designed to measure negative priming. The data ruled out even moderate correlations between hypnotic suggestibility and all the measures of dissociation and cognitive inhibition overall, though they also indicated gender differences. The results are a challenge for existing theories of hypnosis. (shrink)

Individuals with chronic pain often experience co-existing sleep problems and depression-related states. Chronic pain, sleep problems, and depression interrelate, and have been shown to exacerbate one another, which negatively impacts quality of life. This study explored the relationships between pain severity, pain interference, sleep quality, and depression among individuals with chronic pain. Secondly, we tested whether sleep quality may moderate the relationship between pain and depression. A cross-sectional survey was completed by 1,059 adults with non-malignant chronic pain conditions and collected (...) measures related to pain severity, pain interference, sleep quality, and depression. Multiple regression analyses found that pain severity, pain interference, and sleep quality are all significantly associated with depression. Secondly, moderated regression analyses revealed that sleep quality moderates the relationship between pain interference and depression among individuals with chronic pain such that good sleep quality attenuates the effect of pain interference on depression, and poor sleep quality amplifies the effect of pain interference on depression. These findings suggest that sleep quality may be a relevant therapeutic target for individuals with chronic pain and co-existing depression. (shrink)

This is a book in feminist theory and social and political philosophy. Many of the chapters are versions of earlier papers published as journal articles and as book chapters. It presents a multi-systems theory of social domination, discussing three main ones: economic class, gender and (social) race. It presents a maerialist feminist theory of gender and sexuality and discusses lesbian identity as well as issues of motherhood.

The extent to which normative cognition varies across cultures has implications for a number of important philosophical questions. This chapter examines several striking commonalities and differences in normative cognition across cultures. We focus on cross-cultural commonality and difference in norm typologies (especially the moral-conventional distinction); the externalization of norms; which aspects of life are normativized; and some of the concepts and principles associated with the normative domain. We argue that the distinction between moral and conventional norms is probably not universal (...) and that several concepts and principles that have been suggested as candidate universals may in fact be culturally local. We nevertheless isolate two possible universals: the phenomenon of externalizing norms and the normativization of a preferred class of subject matters. (shrink)

One of Chicago's great cultural achievements, the Institute of Design was among the most important schools of photography in twentieth-century America. It began as an outpost of experimental Bauhaus education and was home to an astonishing group of influential teachers and students, including Lázló Moholy-Nagy, Harry Callahan, and Aaron Siskind. To date, however, the ID's enormous contributions to the art and practice of photography have gone largely unexplored. Taken by Design is the first publication to examine thoroughly this remarkable institution (...) and its lasting impact. With nearly 300 illustrations, including many never-before published photographs, Taken by Design examines the changing nature of photography over this critical period in America's midcentury. It starts by documenting the experimental nature of Moholy's Bauhaus approach and photography's new and enhanced role in training the "complete designer." Exploitation: Perspectives from Philosophy, Politics, and Economics brings together recent work on the topic of exploitation from philosophy, political science, and economics in one volume, organized around three main questions: What is exploitation? Why is exploitation wrong? What should we do about it? These questions are increasingly relevant in public policy discussions. The past decade has witnessed the rise of populism and an increasing sense that politics is a game rigged to benefit certain classes of persons at the expense of (...) others. Interestingly, this sense of unfairness has been shared across the political spectrum though, of course, the left and right differ in both their moral diagnosis and their political prescription. Current debates over minimum wage laws, immigration reform, and undue corporate influence on politics can all be understood as drawing on and developing these concerns over exploitative political treatment. At the same time, the literature on exploitation has blossomed. What was once a topic of relatively narrow interest to philosophers working in the tradition of analytical Marxism has been reinvigorated and diversified. The essays in this book both represent and extend that diversity. While the condition of labor remains an important and central topic, the current volume extends the analysis to such neglected topics as the relationship between children and parents, interactions between states, and interactions between generations. Although international law and the Charter of the United Nations define a doctrine of just war, some critics have argued that the U.S. has become an empire that can no longer be bound by such doctrine. On the contrary, I maintain that we must retain just war doctrine as a normative base from which to critique the U.S. and its preemptive wars against terrorism. Neither the Afghanistan nor the Iraq war has been a just war. By its imperialist intentions and (...) barbarous actions, the U.S. government has shown itself no longer to be a legitimate authority with the moral justification to begin or conduct a war. Such subversion of democratic deliberation requires a moral force to mobilize resistance from below. Since no war initiated by the undemocratic elite of the U.S. Empire could possibly be just, we have a conscientious obligation to become revolutionary pacifists against any wars called by such an illegitimate government. In contrast to universal pacifism, a context-justified revolutionary pacifism can be defended as a coherent moral and political position. (shrink)
