This chapter provides an analysis of the long process of introducing an electronic identity for online authentication in Germany. This process is described as a multi-facet innovation, involving actors from different policy fields shifting over time. The eID process started in the late ‘90s in the context of eGovernment and eCommerce with the legislation on e-signatures, which were supposed to allow for online authentication of citizens. When after 5 years it was recognized that this was not the case, a (...) new digital ID card, which had meanwhile been announced, was chosen as token for the eID. This process was dominated by the concerns for visual inspection and border control, including the storage of digital fingerprints. Under the leadership of the Ministry of the Interior (BMI) and technical guidance of the Federal Agency for Information Security (BSI), technical specifications have to a large extent been adopted from the electronic passport, which had been smoothly introduced 2 years before. However, in the legislative process some concern regarding digital fingerprints on the eID card was raised and led to an opt-in solution. In 2009, a bill on the new ID card was passed which regulates the eID function for online authentication as well. This is characterized as a radical innovation by introducing a double-sided, mutual authentication of the citizen and the service provider and implementing the principle of proportionality regarding the access of service providers to data on the chip. At the time of writing, field tests are conducted. Roll-out of the new eID card is to start in November 2010. Therefore no figures about adoption can be provided here. (shrink)

The present paper summarizes the development of the national electronic Identity Management System (eIDMS) in Estonia according to a conceptual framework developed in an European comparative research project outlined in the first chapter of this special issue. Its main function is to amend the picture of the European eIDMS landscape by presenting a case with high involvement of the private sector and thereby checking the generalizations from the comparisons of Austria, Belgium, Germany and Spain, presented by Kubicek and Noack (...) in the previous chapter of this special issue. Starting with a short introduction into the historical background of identity documents in Estonia the national population register, the passport as well as the bank ID are described as the main pillars of the Estonian eIDMS, on which the national ID card builds on, which has been introduced in 2002. The technical features of the eID and the ID card are described in Section two as well as the areas of application and the processes for production and distribution. Section three presents the actors constellation, Section four the time line of the development process, starting from 1997. Section five deals with the diffusion and promotion of the ID card and the eID authentication function. After a very low and slow take up during the first 5 years due to a cooperation agreement between major banks, telecom operators and the government usage has increased. But still the authentication by Internet banks, which provides authentication services to third parties, including government, is the biggest competitor for the eID function on the national eID card. Only recently the major banks have announced to slowly fade out the password cards and PIN calculators as alternative modes of bank authentication. (shrink)

This chapter describes the introduction and diffusion of the Finnish Electronic Identity Card (FINEID card). FINEID establishes an electronic identity (eID), based on the civil registry and placed on an identity chip card issued by Finnish government to Finnish citizens and permanent residents from age 18 and older. It is a non-mandatory electronic identity card introduced in 1999 in order to replace the older citizen ID card. It serves as a travel document and is intended to facilitate (...) access to eGovernment services as well as offering a possibility to sign electronically. Therefore the chip contains two certificates: one for authentication purposes, and one for qualified signatures. The eID function had to compete with the already existing PIN/TAN based TUPAS standard for online authentication for eBanking, eCommerce and eGovernment applications, and has lost this battle by reaching less than one percent of all online authentications. The history, actor constellation, time line and barriers will be described and a few communalities and differences to other countries under study in this special issue will be highlighted. (shrink)

In Romania, the debate on the electronic passports has raised controversies having ethical, religious, ideological implications, as well as consequences for the political practice. The debate has as premise the general background of the crisis that modernity brings in the reception of values in Christian communities. The discussions on the consequences of secularization, the metaphor of “cultural wars” and the new perspective brought by modernity to the state and the public policies it requests – all these oblige us to (...) formulate a novel type of humanism that should be found out at the end of this debate. By drawing on a natural concern regarding human freedom, individual security, respect for private life, the debate around passports finally fails into the field of superstitions, radical ideologies, and the gratuitous critique of the implementation of the new technologies in the practice of modernity. For avoiding such sideslips, an important role can be played by the researchers from social and humanist disciplines, who can enter the debate and offer answers that are consonant with their own disciplines. Radio Frequency Identification, or RFID, is a technology which has been receiving considerable attention as of late. It is a fairly simple technology involving radio wave communication between a microchip and an electronic reader, in which an identification number stored on the chip is transmitted and processed; it can frequently be found in inventory tracking and access control systems. In this paper, we examine the current uses of RFID, as well as identifying potential future uses of the technology, including (...) item-level tagging, human implants and RFID-chipped passports, while discussing the impacts that each of these uses could potentially have on personal privacy. Possible guidelines for RFID’s use, including Fair Information Principles and the RFID Bill of Rights are then presented, as well as technological solutions to personal privacy problems, such as tag killing and blocker tags, as well as simple aluminum foil shields for passports. It is then claimed, though, that guidelines and technological solutions will be ineffective for privacy protection, and that legislation will be necessary to guard against the threats posed by the RFID. We take for granted that only certain kind of things exist - electrons but not angels, passports but not nymphs. This is what we understand as `reality'. But in fact, `reality' varies with each era of the world, in turn shaping the field of what is possible to do, think and imagine. Our contemporary age has embraced a troubling and painful form of reality: Technic. Under Technic, the foundations of reality begin to crumble, shrinking the field of the possible and (...) freezing our lives in an anguished state of paralysis. Technic and Magic shows that the way out of the present deadlock lies much deeper than debates on politics or economics. By drawing from an array of Northern and Southern sources - spanning from Heidegger, Junger and Stirner's philosophies, through Pessoa's poetry, to Advaita Vedanta, Bhartrhari, Ibn Arabi, Suhrawardi and Mulla Sadra's theosophies - Magic is presented as an alternative system of reality to Technic. While Technic attempts to capture the world through an `absolute language', Magic centres its reconstruction of the world around the notion of the `ineffable' that lies at the heart of existence. Technic and Magic is an original philosophical work, and a timely cultural intervention. It disturbs our understanding of the structure of reality, while restoring it in a new form. This is possibly the most radical act: if we wish to change our world, first we have to change the idea of `reality' that defines it. (shrink)

The COVID-19 pandemic has led a number of countries to introduce restrictive ‘lockdown’ policies on their citizens in order to control infection spread. Immunity passports have been proposed as a way of easing the harms of such policies, and could be used in conjunction with other strategies for infection control. These passports would permit those who test positive for COVID-19 antibodies to return to some of their normal behaviours, such as travelling more freely and returning to work. The introduction of (...) immunity passports raises a number of practical and ethical challenges. In this paper, we seek to review the challenges relating to various practical considerations, fairness issues, the risk to social cooperation and the impact on people’s civil liberties. We make tentative recommendations for the ethical introduction of immunity passports. (shrink)

As the COVID-19 pandemic continues to evolve, taking its toll on people’s lives around the world, vaccine passports remain a contentious topic of debate in most liberal democracies. While a small literature on vaccine passports has sprung up over the past few years that considers their ethical pros and cons, in this paper we focus on the question of when vaccine passports are politically legitimate. Specifically, we put forward a ‘public reason ethics framework’ for resolving ethical disputes and use the (...) case of vaccine passports to demonstrate how it works. The framework walks users through a structured analysis of a vaccine passport proposal to determine whether the proposal can be publicly justified and is therefore legitimate. Use of this framework may also help policymakers to design more effective vaccine passports, by incorporating structured input from the public, and thereby better taking the public’s interests and values into account. In short, a public reason ethics framework is meant to encourage better, more legitimate decision-making, resulting in policies that are ethically justifiable, legitimate and effective. (shrink)

This paper raises health equity concerns about the use of passports for domestic and international travel to certify COVID-19 vaccination. Part I argues that for international travel, health equity objections undercut arguments defending vaccine passports, which are based on tholding people responsible, protecting global health, safeguarding individual liberty and continuing current practice. Part II entertains a proposal for a scaled down vaccine passport for domestic use in countries where vaccines are widely and equitably available. It raises health equity concerns (...) related to racial profiling and fairness to people who are vaccine cautious. Part III sets forth a proposal for a flexible pass that certifies people who have been vaccinated, tested, previously infected or granted a conscientious objection. It sets ethical guidelines for the timing and use of flexible passes that promote equity, public health education, antidiscrimination, privacy and flexibility. (shrink)

In their recent article, Brownet alanalyse several ethical aspects around immunity passports and put forward some recommendations for implementing them. Although they offer a comprehensive perspective, they overlook two essential aspects. First, while the authors consider the possibility that immunological passports may appear to discriminate against those who do not possess them, the opposite viewpoint of immune people is underdeveloped. We argue that if a person has been tested positive for and recovered from COVID-19, becoming immune to it, she cannot (...) be considered a hazard to public health and, therefore, the curtailment of her fundamental rights (eg, the right to freedom of movement) is not legitimate. Second, they omit that vaccine distribution will create similar problems related to immunity-based licenses. Vaccine certificates will de facto generate a sort of immunity passport. In the next phases of the pandemic, different immunity statuses will be at stake, because the need to identify who can spread COVID-19 is unavoidable. If a person does not pose a threat to public health because she cannot spread the infection, then her right to freedom of movement should be respected, regardless of how she acquired that immunity. The aim of this paper is to determine whether the present generation should preserve non-human living things for future generations, even if in the future all the contributions these organisms currently make to human survival in decent conditions were performed by adequate technology and future people's preferences were satisfied by this state of affairs. The paper argues it would be wrong to leave a world without non-human living plants, animals and other organisms to future generations, because such a world would (...) fail to secure one of the conditions of future people’s autonomy, that is, availability of adequate options. Building upon Joseph Raz’s account of autonomy, the paper shows that the presence of non-human living organisms is part of an adequate range of options insofar as, to be adequate, options must meet a test of variety. According to Raz, options pass this test if they enable human agents to exercise a set of physical, affective, imaginative and cognitive capacities humans normally have an innate drive to exercise. The paper discusses empirical findings as well as psychological theories that provide support to the hypothesis that interactions with non-human living organisms enable human beings to develop and exercise these capacities by shaping these capacities in a special way, different from the way interactions with other environments do. Debates about the moral permissibility of mass electronic surveillance often turn on whether consequentialist considerations legitimately trump relevant deontological rights and principles. In order to establish such overriding consequences, many proponents of mass surveillance employ a modern analogue of Pascal’s wager: they contend that the consequences of no surveillance are so severe that any probability of such outcomes legitimates the abrogation of the relevant rights. In this paper, I briefly review Pascal’s original wager about whether to live a pious (...) life, including two classes of objections that were almost immediately leveled against his argument. I then show that analogues of those objections apply straightforwardly to the modern versions of Pascal’s wager. Mass electronic surveillance might be ethically permissible or even obligatory in some circumstances, but the details matter in ways that are systematically ignored or assumed away in a Pascal’s wager-type argument. Careful consideration of the complexities of our modern situation is required to decide whether consequentialist considerations override deontological principles in this domain. (shrink)

– Pharmacy sales of over‐the‐counter medicines in the UK represent an economically significant and important mechanism by which customers self‐medicate. Sales are supervised in pharmacies, but this paper seeks to question whether patients' electronic health records – due to be introduced nationally – could be used, ethically, by pharmacists to ensure safe medicines sales., – Using theoretical arguments, three areas of ethical concern are identified and explored in relation to pharmacists' access to EHRs‐consequentialsim, analogies and confidentiality/privacy., – Consequentialist arguments (...) include positive benefits to customer's welfare and control of medicine of abuse, but negative economic healthcare burdens and consequences due to potentially increased or paradoxically, decreased presentation of patients to doctors. Socially accepted analogous practices – credit checks, existing pharmacy access to information and hospital treatment – are then argued to be ethically relevant and supportive of access. Privacy and confidentiality are then considered as reasons not to allow EHR access. A contrasting view is that pharmacy access to EHRs is another form of surveillance and hence the question of pharmacists' assess to EHRs may be answered negatively by empirical research that locates pharmacy customers as expert users and identifies confidentiality and privacy concerns about information technology in healthcare more generally., – This paper offers a unique and valuable contribution to the debate about healthcare professionals' role‐based access to patients' medical records and offers a reflection on the ethical concerns surrounding patient information and the rival concerns of patient qua customer autonomy and safety. Referent Tracking (RT) advocates the use of instance unique identifiers to refer to the entities comprising the subject matter of patient health records. RT promises many benefits to those who use health record data to improve patient care. To further the adoption of the paradigm we provide an illustration of how data from an EHR application needs to be decomposed in order to make it accord with the tenets of RT. We describe the ontological principles on which this decomposition is (...) based in order to allow integration efforts to be applied in similar ways to other EHR applications. We find that an ordinary statement from an EHR contains a surprising amount of “hidden” data that are only revealed by its decomposition according to these principles. (shrink)

Discussions about biotechnology tend to assume that it is something to do with genetics or manipulating biological processes in some way. However, the field of biometrics––the measurement of physical characteristics––is also biotechnology and is likely to affect the lives of more people more quickly than any other form. The possibility of social exclusion resulting from the use of biometrics data for such uses as identity cards has not yet been fully explored. This book presents the first detailed history of the modern passport and why it became so important for controlling movement in the modern world. It explores the history of passport laws, the parliamentary debates about those laws, and the social responses to their implementation. The author argues that modern nation-states and the international state system have 'monopolized the 'legitimate means of movement',' rendering persons dependent on states' authority to move about - especially, though not exclusively, across international boundaries. When information is transformed from what has traditionally been a paper-based format into digitized elements with meaning associated to them, new and intriguing discussions begin surrounding proper and improper uses of this codified and easily transmittable information. As these discussions continue, some health care providers, insurers, laboratories, pharmacies, and other healthcare stakeholders are creating and retroactively digitizing our medical information with the unambiguous endorsement of the federal government.Some argue that these enormous databases of medical information offer improved access to timely (...) information, evidence-based treatments, and complete records from which to provide care. To the extent that these claims are true, it would seem that this is a valuable asset that offers immeasurable benefit to all. Others believe this digitization to be an egregious invasion of privacy. In this article, I investigate the broad research questions of whether the public good aspect of capturing private health information outweighs individual interests and whether it is ethical to mandate participation in health information exchanges by all individuals who use the U.S. health system. Taxonomy Based modeling was applied to describe drivers’ mental models of variable message signs (VMS’s) displayed on expressways. Progress in road telematics has made it possible to introduce variable message signs (VMS’s). Sensors embedded in the carriageway every 500m record certain variables (speed, flow rate, etc.) that are transformed in real time into “driving times” to a given destination if road conditions do not change.VMS systems are auto-regulative Man-Machine (AMMI) systems which incorporate a model of the user: if the traffic (...) flow is too high, then drivers should choose alternative routes. In so doing, the traffic flow should decrease. The model of the user is based on suppositions such as: people do not like to waste time, they fully understand the displayed messages, they trust the displayed values, they know of alternative routes. However, people also have a model of the way the system functions. And if they do not believe the contents of the message, they will not act as expected.We collected data through interviews with drivers using the critical incidents technique (Flanagan, 1985). Results show that the mental models that drivers have of the way the VMS system works are various but not numerous and that most of them differ from the“ideal expert” mental model. It is clear that users don’t have an adequate model of how the VMS system works and that VMS planners have a model of user behaviour that does not correspond to the behaviour of the drivers we interviewed. Finally, Taxonomy Based Modeling is discussed as a tool for mental model remediation. (shrink)

We hypothesize that recent uses of the Internet as a public-participation mechanism in the United States fail to overcome the adversarial culture that characterizes the American regulatory process. Although the Internet has the potential to facilitate deliberative processes that could result in more widespread public involvement, greater transparency in government processes, and a more satisfied citizenry, we argue that efforts to implement Internet-based public participation have overlaid existing problematic government processes without fully harnessing the transformative power of information technologies. Public (...) comments submitted in two United States Department of Agriculture rulemaking processes—the National Organic Program’s organic standard and the Forest Service’s Roadless Area Conservation Rule—compose our data. We conclude that the Internet provides an arena for playing out three types of conflicts that have long plagued environmental decision-making processes: conflicts over trust of federal agencies, the use of science, and the role of public values. The extant clinical literature indicates profound problems in the assessment, monitoring, and documentation of care in long-term care facilities. The lack of adequate resources to accommodate higher staff-to-resident ratios adds additional urgency to the goal of identifying more costeffective mechanisms to provide care oversight. The ever expanding array of electronic monitoring technologies in the clinical research arena demands a conceptual and pragmatic framework for the resolution of ethical tensions inherent in the use of such innovative tools. CareMedia is a (...) project that explores the utility of video, audio and sensor technologies as a continuous real-time assessment and outcomes measurement tool. In this paper, the authors describe the seminal ethical challenges encountered during the implementation phase of this project, namely privacy and confidentiality protection, and the strategies employed to resolve the ethical tensions by applying principles of the interest theory of rights. Cet article présente les solutions utilisées pour le Corpus électronique des textes polonais des 17e et 18e siècles afin d’adapter son jeu de balises grammaticales à l’évolution du système morphologique qui a eu lieu au cours de la période. Les 17e et 18e siècles ont été marqués en effet par la formation d’une nouvelle catégorie grammaticale, appelée « masculine-personality » (Pl. *męskoosobowość*). Cette époque marque une transition de l’état ancien à l’état moderne et se caractérise par une variation significative des (...) terminaisons des formes plurielles N, A et V des noms masculins animés à cette époque. Par conséquent, le jeu de balises utilisé pour annoter le corpus, qui a été créé à l’origine pour le polonais moderne, a dû être légèrement modifié à cet égard. La deuxième partie de l’article décrit les recherches menées à l’aide de ce système d’annotation, qui ont montré que la différenciation des terminaisons flexionnelles des noms masculins personnels et impersonnels en polonais était déjà avancée au 17e siècle et presque achevée à la fin du 18e siècle.
