Genetic testing is currently subject to little oversight, despite the significant ethical issues involved. Repeated recommendations for increased regulation of the genetic testing market have led to little progress in the policy arena. A 2005 Internet search identified 13 websites offering health-related genetic testing for direct purchase by the consumer. Further examination of these sites showed that overall, biotech companies are not providing enough information for consumers to make well-informed decisions; they are not consistently offering genetic counseling services; and some (...) sites even offer tests with little evidence of clinical value. This article aims to raise company and consumer awareness about the ethical concerns surrounding the direct-to-consumer marketing of health-related genetic tests. It also suggests ways that biotech companies can bring their services to the public in an ethically responsible manner, without increased regulatory oversight. (shrink)

What drives us to do good things, and to avoid doing bad? This book offers an integrative examination of the role of motivation in shaping moral cognition, judgement, and behavior.

ABSTRACT: Can virtue ethics say anything worthwhile about laws? What would a virtue-ethical account of good laws look like? I argue that a plausible answer to that question can be found in Plato’s parent analogies in the Crito and the Menexenus. I go on to show that the Menexenus gives us a philosophical argument to the effect that laws are just only if they enable citizens to flourish. I then argue that the resulting virtue-ethical account ofjust laws is not viciously (...) paternalistic. Finally, I refute the objection that the virtue-ethical account I am proposing is not distinct from a consequentialist account.RÉSUMÉ: Peut-on construire une théorie de la loi à partir de l’éthique de la vertu? I write here about how the visible and the invisible intertwine in painting: in theory and in praxis – primarily the praxis of my own painting. Philosophers are rarely asked to discuss, much less to show in public, what they do avocationally rather than professionally. I was drawn to the invitation of the Merleau-Ponty Circle to exhibit my painting and to talk about what I do when I am not writing or teaching philosophy. It has offered a rare chance to (...) catch up with myself – with the painter in me. I started in art long before I turned to philosophy. It was my first love and is still my intermittent passion. I have not hidden it from others altogether – I have shown my work in various group shows– but it would be more accurate to say that I have hidden it from myself. Talking about my art work in the context of this Circle comes at a very welcome moment in which I am in the process of determining where I shall go with the rest of my life as it shortens down: ars longa, vita brevis.J’écris ici à propos de la manière dont le visible et l’invisible s’entrelacent dans la peinture : en théorie et en pratique, prioritairement dans ma propre pratique de la peinture. En revanche, on a peu exploré les liens entre ces deux idées. À cette fin, cet article aborde les écrits tantôt convergents, tantôt divergents de Charles Taylor et Martin Heidegger pour prolonger leurs réflexions respectives sur l'authenticité et montrer en quoi elles peuvent servir defondement à une nouvelle forme de diversité culturelle. Pour tous deux, l'être-au-monde authentique nous permet d'accider au (...) tréfonds du matériel culturel dont nous devons disposer pour que se nouent des rapports fructueux avec les autres cultures. This article is the product of a critical engagement that I have orchestrated between Husserl’s phenomenology and Stoic epistemology. I argue that the Stoic theory of knowledge, which is based upon the idea that the individual human being is a logos spermatikos, or “rational seed” of God, precludes any authentic doctrine of freedom, insofar as it enslaves the individual to a constant reference back toward God, as the source of “fundanlent” of all knowledge. However, the similarities between the Stoic theory (...) and the phenomenology of Husserl call us toward a deeper reading, and an asking of the important question: what constitutes freedom? This question can only be answered by thinking beyond both Stoic epistemological schemas and Husserlian intentionality, toward a doctrine of freedom that is best described as demiurgic.Cet article est le produit d’une enterprise critique organisée autour de la phénoménologie husserlienne et de I’épistémologie stoïcienne. Je soutiens que la théorie stoïcienne de la connaissance, fondée sur I’idée qui veut que I’être humain individuel soit un logos spermatikos, un “germe rationnel” de Dieu, exclut toute doctrine authentique de la liberté, dans la mesure où elle contrait I’individu à référer constamment à Dieu en tant que source ou “fondement” de toute connaissance. Toutefois, les similarités entre la théorie stoïcienne et la phénoménologie husserlienne nous poussent à une interprétation plus profonde et à poser I’importante question: qu’est la liberté? Cette question ne peut être répondue qu’en dépassant et les schémes épistémologiques stoïciens, et I’intentionalité husserlienne, vers une doctrine de la liberté qui pourrait être qualtfiée de démiurgique. Les théories de la mécanique quantique et de la gravité quantique exigent-elles que l’espace-temps soit un trait fondamental de bas niveau, ou l’espace-temps peut-il être conçu comme un élément émergent de ces théories? Tandis que plusieurs commentateurs ont émis de sérieux doutes sur l’idée de se dispenser de l’arrière-plan d’un espace-temps standard, nous ferons valoir qu’une défense de ces interprétations de l’espace-temps émergeant des hypothèses de la mécanique et de la gravité quantiques peut être conduite soit par inférence à la (...) meilleure explication, soit en mobilisant une autre stratégie. De plus, on montrera que l’idée que l’espace et le temps peuvent émerger d’un niveau du réel tout à fait différent et non spatiotemporel a des précédents historiques variés, en particulier aux xviie et xviiie siècles. Cette prise de conscience peut aider à dissiper une partie du mystère associé à ces types d’hypothèses. (shrink)

Les tests d’imagerie diagnostique médicale qui produisent des rayonnements ionisants utilisent désormais une technologie qui permet de connaître la dose de rayonnement cumulée d’un patient. Cela soulève la question de savoir s’il est impératif que les autorités sanitaires régionales divulguent ces informations aux médecins, qui peuvent alors faire participer leurs patients à la décision de savoir si les inconvénients potentiels valent les avantages de l’imagerie diagnostique ultérieure. Actuellement, les organismes professionnels qui fournissent des normes de pratique pour l’imagerie diagnostique médicale (...) conseillent de ne pas divulguer ces informations aux médecins. Ils craignent que les informations sur les doses cumulées soient difficiles à évaluer en termes de risque pour les patients individuels, qu’elles ne soient pas facilement applicables à la prise de décision clinique sur l’opportunité d’un examen d’imagerie ultérieur, et que les cliniciens référents se sentent obligés de proposer à un patient un test non ionisant moins efficace, ce qui pourrait avoir un impact négatif sur les soins prodigués au patient. Nous présentons une analyse critique de plusieurs hypothèses qui sous-tendent la position de non-divulgation. Travaillant à l’intersection de la physique médicale, de l’anthropologie médicale et de l’éthique clinique, nous proposons une autre formulation du discours sur le risque qui a façonné le récent débat scientifique sur la divulgation de la dose de rayonnement cumulée individuelle. Nous postulons qu’il est possible de présenter un argument convaincant contre la position des organismes professionnels et en faveur d’une politique de divulgation – à condition qu’une telle politique donne la priorité à la décision partagée centrée sur le patient. His thought is to be understood in the context of Protestant theology : he endeavours to give a metaphysical interpretation of the major principles of Calvinistic theology. Through the notion of the « spiritual idea », he is working out an epistemology where the reformulation of intellectual knowledge thanks to ethical and esthetical considerations, leads towards a theory of the compossibility. As far as his doctrine of the will is concerned, he is bracketing the very question of all external determination. The scientific search for extraterrestrial intelligent life is probably one of the most ambitious projects ever taken in biology. The article discusses methodological problems associated with the search. It is emphasized that investigators of extraterrestrial intelligence, in contrast to investigators of terrestrial matters, have no valid pre-understanding of their subject matter. In this barren setting, utilization of semiotic knowledge is shown to be a prerequisite for achievement of valid data. Owing to methodological shortcomings, it is concluded that the NASA funded (...) project SETI (Search for Extraterrestrial Intelligence) has little if any relevance for the detection of intelligent life in other worlds. The article maintains that chronic fatigue syndrome can be properly understood only by taking an integrated perspective in which evolutionary, developmental and ecological aspects are considered. The integrative approach, supplemented by a complexity theory and psychoneuroimmunological research, is capable of explaining why there are so few structural aberrations to be found in chronic fatigue syndrome and why specific treatment is so difficult to establish. A major outcome of the investigation, that all individuals with chronic fatigue syndrome are diseased in their (...) own way, emphasises the need to study the development of personalised life histories. It also highlights an ethical dimension; personalised disease defies essentialist thinking on patient management. Another major outcome, which follows from the developmental systems perspective, is the dissolution of ontological mind-body dualism. This in turn allows for a methodological complementation of the biological and phenomenological approaches to knowledge. New research strategies that may help to resolve chronic fatigue syndrome, grounded in the revised perspective on individual development, are suggested. (shrink)

Is the purpose of political philosophy to articulate the moral values that political regimes would realize in a virtually perfect world and show what that implies for the way we should behave toward one another? That model of political philosophy, driven by an effort to draw a picture of an ideal political society, is familiar from the approach of John Rawls and others. Or is political philosophy more useful if it takes the world as it is, acknowledging the existence of (...) various morally non-ideal political realities, and asks how people can live together nonetheless? The latter approach is advocated by “realist” thinkers in contemporary political philosophy. In Value, Conflict, and Order, Edward Hall builds on the work of Isaiah Berlin, Stuart Hampshire, and Bernard Williams in order to establish a political realist’s theory of politics for the twenty-first century. The realist approach, Hall argues, helps us make sense of the nature of moral and political conflict, the ethics of compromising with adversaries and opponents, and the character of political legitimacy. In an era when democratic political systems all over the world are riven by conflict over values and interests, Hall’s conception is bracing and timely. (shrink)

The foregoing set of theorems forms an effective foundation for the theory of situations and worlds. All twenty-five theorems seem to be basic, reasonable principles that structure the domains of properties, relations, states of affairs, situations, and worlds in true and philosophically interesting ways. They resolve 15 of the 19 choice points defined in Barwise (1989) (see Notes 22, 27, 31, 32, 35, 36, 39, 43, and 45). Moreover, important axioms and principles stipulated by situation theorists are derived (see Notes (...) 33, 37, and 38). This is convincing evidence that the foregoing constitutes a theory of situations. Note that worlds are just a special kind of situation, and that the basic theorems of world theory, which were derived in previous work, can still be derived in this situation-theoretic setting. So there seems to be no fundamental incompatibility between situations and worlds — they may peacably coexist in the foundations of metaphysics. The theory may therefore reconcile two research programs that appeared to be heading off in different directions. And we must remind the reader that the general metaphysical principles underlying our theory were not designed with the application to situation theory in mind. This suggests that the general theory and the underlying distinction have explanatory power, for they seem to relate and systematize apparently unrelated phenomena. (shrink)

The concept of epistemic injustice is the latest philosophical tool with which to try to theorise what goes wrong when mental health service users are not listened to by clinicians, and what goes right when they are. Is the tool adequate to the task? It is argued that, to be applicable at all, the concept needs some adjustment so that being disbelieved as a result of prejudice is one of a family of alternative necessary conditions for its application, rather than (...) a necessary condition all on its own. It is then argued that even once adjusted in this way, the concept does not fit well in the area where the biggest efforts have been made to apply it so far, namely the highly sensitive case of adult patients suffering from delusions. Indeed it does not serve the interests of service users struggling for recognition to try to apply it in this context, because there is so much more to being listened to than simply being believed. However, the concept is found to apply smoothly in many cases where the service users are children, for example, in relation to children’s testimony on the efficacy of treatment. It is suggested that further research would demonstrate the usefulness of the concept in adult cases of a similar kind. There are no data in this work. (shrink)

In the course of his long development, Kant's concept of matter changed somewhat, while his concept of scientific explanation changed considerably. Both developments achieved a coherent integration in Kant's Metaphysical Foundations of Natural Science. Using this developmental background, the present paper argues that the Foundations should be interpreted as an attempted rational reconstruction of the mechanics of Newton and Euler. Kant attempted to do this by constructing a concept of matter that would confer a Leibnizian intelligibility on Newtonian mechanics, and (...) also accord with Kant's theories on the nature of concepts and their role in scientific explanation. This original book brings together some of the world's leading critics of economics orthodoxy to debate Lawson's contribution to the economics literature.

This book is a treatise on time and on background independence in physics. It first considers how time is conceived of in each accepted paradigm of physics: Newtonian, special relativity, quantum mechanics (QM) and general relativity (GR). Substantial differences are moreover uncovered between what is meant by time in QM and in GR. These differences jointly source the Problem of Time: Nine interlinked facets which arise upon attempting concurrent treatment of the QM and GR paradigms, as is required in particular (...) for a background independent theory of quantum gravity. A sizeable proportion of current quantum gravity programs - e.g. geometrodynamical and loop quantum gravity approaches to quantum GR, quantum cosmology, supergravity and M-theory - are background independent in this sense. This book's foundational topic is thus furthermore of practical relevance in the ongoing development of quantum gravity programs. This book shows moreover that eight of the nine facets of the Problem of Time already occur upon entertaining background independence in classical (rather than quantum) physics. By this development, and interpreting shape theory as modelling background independence, this book further establishes background independence as a field of study. Background independent mechanics, as well as minisuperspace (spatially homogeneous) models of GR and perturbations thereabout are used to illustrate these points. As hitherto formulated, the different facets of the Problem of Time greatly interfere with each others' attempted resolutions. This book explains how, none the less, a local resolution of the Problem of Time can be arrived at after various reconceptualizations of the facets and reformulations of their mathematical implementation. Self-contained appendices on mathematical methods for basic and foundational quantum gravity are included. Finally, this book outlines how supergravity is refreshingly different from GR as a realization of background independence, and what background independence entails at the topological level and beyond. The author examines the differences between the general intensional logic defined in his recent book and Montague's intensional logic. Whereas Montague assigned extensions and intensions to expressions (and employed set theory to construct these values as certain sets), the author assigns denotations to terms and relies upon an axiomatic theory of intensional entities that covers properties, relations, propositions, worlds, and other abstract objects. It is then shown that the puzzles for Montague's analyses of modality and descriptions, propositional attitudes, and directedness (...) towards nonexistents can be solved using the author's logic. A. Plantinga develops a challenging critique of Castañeda's guise theory, by identifying fundamental intuitions that guise theory gives up and by developing several objections to the guise-theoretic world view as a whole. In this paper, I examine whether Plantinga's criticisms apply to the theory of abstract objects. The theory of abstract objects and guise theory can be fruitfully compared because they share a common intellectual heritage---both follow Ernst Mally [1912] in postulating a special realm of objects distinguished by their "internal" (...) or "encoded" properties. Despite this common heritage, however, the theories organize, develop, and apply these special objects in distinctive ways. The two metaphysical systems, therefore, differ significantly, and these differences become important when one considers Plantinga's critique of guise theory. In this essay, the author shows that the theory of abstract objects anticipates and addresses most of Plantinga's concerns about guise theory, by preserving intuitions guise theory has abandoned. We applaud the ambition of Veissière et al.'s account of cultural learning, and the attempt to ground higher order thinking in embodied theory. However, the account is limited by loose terminology, and by its commitment to a view of the child learner as inference-maker. Vygotsky offers a more powerful view of cultural learning, one that is fully compatible with embodiment.

The modal object calculus is the system of logic which houses the (proper) axiomatic theory of abstract objects. The calculus has some rather interesting features in and of itself, independent of the proper theory. The most sophisticated, type-theoretic incarnation of the calculus can be used to analyze the intensional contexts of natural language and so constitutes an intensional logic. However, the simpler second-order version of the calculus couches a theory of fine-grained properties, relations and propositions and serves as a framework (...) for defining situations, possible worlds, stories, and fictional characters, among other things. In the present paper, we focus on the second-order calculus. The second-order modal object calculus is so-called to distinguish it from the second-order modal predicate calculus. Though the differences are slight, the extra expressive power of the object calculus significantly enhances its ability to resolve logical and philosophical concepts and problems. (shrink)

Beginning from the scientist-philosopher Michael Polanyi's theory of tacit knowing, and drawing upon a remarkably original model of the mind and its workings, Edward Moss develops the thesis that all consciousness is grammatically structured. Comparison is made in detail with the theories of Daniel Dennett, based on the computer analogy, and with the neurophysiological theories of Gerald Edelman. It is suggested that Moss's top-down psychological model can be integrated with Edelman's bottom-up analysis. Two final chapters explore the philosophical implications (...) of this discussion.
