We propose an approach reconciling the ultimate-level explanations proposed by Savage et al. and Mehr et al. as to why music evolved. We also question the current adaptationist view of culture, which too often fails to disentangle distinct fitness benefits.

The conception of property is usually moulded upon diverting historical and political-philosophical frameworks. The current interest on the commons illustrates these divergences when they come up between a ‘pure’ public and a ‘pure’ private form of ownership. This conceptual triad misleads by conflating private property with an absolute property right while equating public property with a centralised political regime. This article traces the republican conception of property in order to show how it draws a legal and philosophical continuum around different (...) forms of ownership, based on a fiduciary principle underlying the relationship between the sovereign or principal and its agent. Despite modern socialism apparently left aside the question of the commons, the republican-fiduciary rationale was reformulated according to the modern industrial capitalist society. (shrink)

El artículo revisa las aportaciones más trascendentes que Jordi Ferrer ha hecho a la tradición racionalista de la prueba jurídica y evalúa críticamente el limitado papel que, desde su óptica, le corresponde desempeñar a la epistemología en la discusión general sobre los estándares de prueba apropiados para las distintas ramas del derecho. Más específicamente, se analiza la irrelevancia que Ferrer parece atribuir a dicha disciplina –o el silencio que debe guardar–, respecto del establecimiento del estándar de prueba deseable en materia (...) penal. Se concede que, en efecto, le corresponde al pueblo tomar la decisión de qué estándar implementar. No obstante, se sostiene, ello no impide que la epistemología incida en el proceso de formación de dicha decisión mediante la realización de observaciones, el ofrecimiento de argumentos y la propuesta de metodologías adecuadas, con miras a que aquella se tome en un contexto mejor informado y sea lo más racional posible. This principle contrasts sharply with the principle that children are non‐transferable. Consideration of where to place the line between transferable embryos and non‐transferable fetuses, or children, yields a conception of surrogacy that would set it apart from adoption. The paper offers an account of integrity as the capacity to deliberate and reflect usefully in the light of context, knowledge, experience, and information (that of self and others) on complex and conflicting factors bearing on action or potential action. Such an account of integrity seeks to encompass the moral complexity and conflict of the professional environment, and the need for compromises in professional practice. In addition, it accepts that humans are social beings who must respect and engage with the (...) moral position of others. This account is contrasted with a more traditional view of integrity as the rigid maintenance of consistency between professional practice and deeply held, but inflexible, moral principles. While this strong sense of moral conviction may be valuable as a source of moral motivation, e.g. in the case of whistle‐blowers, it is equally likely to lead to dogmatism and hubris. Professionals and their organizations are encouraged to foster the more complex and reflective form of integrity. (shrink)

The purpose of this research paper is to identify which types of corporate philanthropy (CP): cause-related marketing (CRM) or sponsorship, create higher moralcapital under two conditions: proactive or reactive (following a scandal). Results showed that CP created higher moral capital for a proactive company than for a reactive company. Both CRM and sponsorship were perceived as more sincere in the proactive company than the reactive company. However, CRM was seen as self-serving in the reactive company, but not the proactive company. (...) The study demonstrated that companies need to take into account the different types of CP, as it has an effect on their moral capital. Socially proactive firms should engage in both CRM and sponsorship philanthropy, as both types can generate high moral capital, which creates better company reputation. However, CP may not be the most effective or appropriate strategy for creating moral capital following negative publicity. (shrink)

The problem of public consultation over the allocation of health care resources is addressed by considering the role that quality of life measures, such as QALYs and the Nottingham Health Profile, could play. Such measures are typically grounded in social surveys, and as such may reflect public preferences for health care priorities. Using Charles Taylor's concepts of “weak” and “strong” evaluation, it is suggested that current quality of life measures are inadequate, insofar as they typically presuppose that survey respondents are (...) mere “weak evaluators”, who express only inarticulate preferences. Respondents may, conversely, be understood as strong evaluators, with deeper visions of human nature and the good life informing their health preferences. Space is then created for such respondents to be asked to defend their preferences, and so be encouraged to reflect critically and publicly on the beliefs and prejudices that ground their view of health care priorities. La constatación de un proceso de transnacionalización del grupo criminal brasileño de base penitenciaria autodenominado Primer Comando de la Capital solo puede entenderse como un efecto de las formas de operación, prácticas, actividades y configuraciones asumidas por las redes criminales en medio de los cambios estructurales asociadas con la globalización, considerando, principalmente, las dinámicas de los mercados ilícitos de cocaína y marihuana. Entender el proceso de transnacionalización del PCC implica considerar especificidades que presenta un grupo que tiene su origen en (...) las cárceles y particularidades de la dinámica criminal brasileña en cuyo centro la prisión ocupa cada vez un lugar más importante. Aunque el PCC participe y amplíe su presencia internacional, y de hecho ingresó y opera en esas redes globales, lo hace de forma aún muy volcada para su actuación en Brasil. Hay, sin embargo, elementos indicativos de que el grupo evoluciona para nuevas conformaciones en ese mercado criminal global, especialmente aquél del tráfico de drogas. (shrink)

The COVID-19 pandemic has had an impact on every aspect of our social, cultural and commercial lives, including the world of sport. This book examines the ethical and philosophical dimensions of the intersection of COVID-19 and sport. The book goes beyond simple description of the impact of the pandemic on sport to offer normative judgments about how the sporting world responded to challenges posed by COVID-19, as well as philosophical speculation as to how COVID-19 will change our understanding and appreciation (...) of sport in the long term. It examines the considerations that either influenced - or arguably should have influenced - decisions to continue or to resume the playing of organized sport in the midst of a pandemic. As a part of this analysis, a spotlight is shone on how sport intersected with political issues surrounding COVID-19. It also explores the configuration and meaning of sport in the COVID-19 era, touching on themes such as the nature of sport, and its integrity, and sport's relationship to technology. Other themes include the changed nature of spectatorship, suffering in sport during pandemic times, and the impact of COVID-19 on the Olympic and Paralympic Games. A final chapter looks ahead and asks what sport might look like in a post-COVID world. This paper intends to explore the topic of consciousness in relation to the domain of the contemporary dream, its narration and interpretation. "Consciousness" involves the experience and interplay of dream, fantasy and "reality." Hence an ethnography of the dreaming subject involves several interlinked domains: the cultural construction of dream symbolism, dream narration, and dream interpretation within and through a group setting. The paper is based on findings from a recent ethnographic study of dreamwork groups in the U.K. Examples from the (...) study will explore how personal identity and consciousness is represented and invented through the production of socially informed imaginative contents in both dreamwork and guided fantasy. This paper falls into three parts. In the first part I will briefly review the current process of reform that the United Kingdom National Health Service is undergoing. Two fundamental motivations for reform, the desire for increased efficiency and for an increased responsiveness to patients' needs and preferences will be discussed in greater detail. The second part attempts to provide a perspective on the moral debate concerning health care reform by introducing the distinction between ‘civil association’ and ‘enterprise association’ as (...) proposed by the political philosopher Michael Oakeshott. In the final part, this distinction will be used to analyze the moral and political constitution of the National Health Service, in order to establish the relevance and scope of concerns with efficiency and patient and public accountability. A framework within which the current reforms can be assessed is thereby outlined. El objetivo de este trabajo es dar cuenta de los conceptos de sujeto, subjetivación y ontología histórica de nosotros mismos. Estas categorías son esenciales en las pesquisas de Foucault de los años 80-84. De igual manera, desde estos conceptos, Foucault pudo pensar al sujeto de forma alterna al modo como este fue configurado en Occidente. En efecto, en sus intensas búsquedas encuentra en la tradición moderna, Baudelaire y Kant, pistas para considerar al sujeto no como un dato estático, sino como (...) alguien que se gestiona a través de procesos históricos que lo van delineando y que lo habilitan en la empresa de construirse, de elaborarse a sí mismo, esto es, mediante procesos de subjetivación. Finalmente, la tradición antigua, es decir, la tradición greco-latina, le ofrece elementos teóricos sustanciales para reflexionar sobre las condiciones en las que se pueden configurar modos de vida, estilos de existencia que operen como ejes de resistencia a las formas que se nos han impuesto. Resumen:Por un lado, el trabajo pretende mostrar de qué modo el “tono” de Arendt en sus trabajos académicos, tal y como lo señalara Scholem en una de sus misivas críticas a la autora, lejos de ser frívolo o burlón (como se apuntaba en esa crítica) produce una brecha perturbadora, por la cual los lectores y las lectoras de Hannah Arendt pueden desvelar hipocresías y actuar con una nueva responsabilidad. Por otro lado, el artículo señala diversos conceptos filosóficos, algunos ya sometidos (...) a investigación por Arendt, que en sí mismos presentan la fuerza de crear un mundo y unos seres humanos, con la energía teórica y real necesaria como para transformarlos: “pensar”, “actuar”, “amar”, son algunos de ellos. Circadian rhythms in the sleep/wake cycle, along with a range of physiological measures, are severely disrupted in individuals with major depressive disorder (MDD). Moreover, several central circadian genes have been implicated as potential genetic factors underlying the illness through candidate gene studies and some genome wide association studies. However, investigations into the molecular underpinnings of circadian disturbances in the human brain have been quite challenging. In their recent publication, Li and colleagues have used a novel approach to determine the rhythmic (...) patterns of circadian gene expression in several regions of the human brain, and how these patterns are disrupted in MDD. Their findings demonstrate that in healthy subjects, several brain regions outside the suprachiasmatic nucleus (the master clock) exhibit diurnal gene expression patterns that are disrupted in the brains of MDD subjects. These findings will provide the foundation for future studies of gene‐specific drug targets, and biomarkers for the disease. (shrink)

Dennett defiende que el aprecio de las ventajas predictivas y los compromisos ontológicos con ciertas pautas de las perspectivas funcional e intencional impide el reduccionismo y, por tanto, el fisicismo con respecto a funciones e intenciones. Die stratigraphischen Einheiten, durch welche heute die Erdgeschichte untergliedert wird, haben eine unterschiedliche und zum Teil recht komplexe Entstehungsgeschichte, wie hier am Beispiel des Keupers gezeigt werden soll. Das Wort ‘Keuper’ geht auf einen volkstümlichen Namen für bunte Tongesteine im Raum Coburg zurück. In den geologischen Sprachgebrauch wird es 1822 durch Leopold von Buch eingeführt, der es noch als Gesteinsnamen verwendet und die entsprechenden Schichten dem Buntsandstein zuweist. Die richtige Einstufung dieser Schichten über dem Muschelkalk gelang erstmals Ludwig Hausmann und (...) Peter Merian um 1820. Doch erst nachdem in den nachfolgenden Jahren deren Ergebnisse durch die Arbeit etlicher anderer Forscher bestätigt wurden, fand die neue, bis dahin unbenannte Formation aus bunten Mergeln und Sandsteinen breite Anerkennung. Als stratigraphischer Begriff, der auch Sandsteine und Gips umfaßt, wird die Bezeichnung Keuper erstmals von Friedrich Hoffmann im Jahre 1823 verwendet und von Christian Keferstein 1824 in die Literatur eingeführt. Eine wichtige Rolle spielten die Arbeit an den ersten geologischen Übersichtskarten Deutschlands und die Aufnahme der neuen Formation in die erste internationale Formationstabelle durch Keferstein . Mit der Integration des Keupers in die neue Formation ‘Trias’ durch Friedrich August von Alberti 1834 bekommt diese Einheit ihren seither festen Platz in der Stratigraphie.Geologic time is commonly subdivided by a set of stratigraphic terms, which all have their individual and sometimes complex histories. ‘Keuper’, now used as a stratigraphical term for the Upper Triassic, originated from a popular rock name of the Coburg area in southern Germany. The term ‘Keuper’, though still as a rock name, was first introduced into geological usage by Leopold von Buch in 1822, when he designated varicoloured marls and claystones, of what he thought to be Bunter Sandstein, as ‘Keuper’. In a stratigraphical sense, the term ‘Keuper-Formation’ was coined by Friedrich Hoffmann in 1823, who was the first to include sandstones and gypsum rocks with this notion. A year later it was introduced into the literature by Christian Keferstein. At this time, the existence of a distinct formation between Muschelkalk and Lias was already accepted by a number of geologists, though it had not yet been named. This ‘new’ formation has formerly been confused with Buntsandstein and even Carboniferous deposits by various authors until it was set into its right position by Ludwig Hausmann and Peter Merian in 1820. In the following years, the work of several geologists confirmed their results and led to general acceptance of the Keuper Formation as a separate entity. An important impetus came from the compilation of the first small-scale geological maps of Germany edited by Keferstein in the early 1820s, and from his international stratigraphical table , which already included the ‘Keuper-Formation’ as an integral part. In 1834, Friedrich August von Alberti included the ‘Keuper’ as part of the new Formation ‘Trias’ and thus defined its place in modern stratigraphy. (shrink)

The purpose of this paper is to provide a normative model for the assessment of the exercise of power by Big Pharma. By drawing on the work of Steven Lukes, it will be argued that while Big Pharma is overtly highly regulated, so that its power is indeed restricted in the interests of patients and the general public, the industry is still able to exercise what Lukes describes as a third dimension of power. This entails concealing the conflicts of interest (...) and grievances that Big Pharma may have with the health care system, physicians and patients, crucially through rhetorical engagements with Patient Advocacy Groups that seek to shape public opinion, and also by marginalising certain groups, excluding them from debates over health care resource allocation. Three issues will be examined: the construction of a conception of the patient as expert patient or consumer; the phenomenon of disease mongering; the suppression or distortion of debates over resource allocation.
