The Oregon Health Plan gained national attention by changing the focus of health care from who is covered to what is covered. This change was facilitated by insurance reforms in the areas of small market, employer mandates, high risk pooling and Medicaid. Most controversial of the reforms is the use by the legislature of a prioritized list of health services to determine benefit levels for the insurance programs. Significant debate has occured over whether the use of such a list is (...) rationing or reasoning. The Oregon Health Plan represents a thoughtful and deliberate blending of fact with public value for the purpose of responsible health policy. It is that unique blending of public values developed through community participation with fact that focused the attention of the world on Oregon. Genetic testing has become a vehicle through which basic constitutional relationships between citizens and the state are revisited, reaffirmed, or rearticulated. The interplay between the is of genetic knowledge and the ought of government unfolds in the context of diverse imaginaries of the forms of human well-being, freedom, and flourishing that states have a duty to support. This article examines how the United Kingdom, Germany, and the United States governed testing for Alzheimer’s disease, and how they diverged in defining potential (...) harms, benefits, and objects of regulation. Comparison before and after the arrival of direct-to-consumer genetic tests reveals differences in national understandings of what it means to protect life and citizenship: in the United Kingdom, ensuring physical wellness through clinical utility; in the United States, protecting both citizens’ physical well-being and freedom to choose through a framework of consumer protection; and in Germany, emphasizing individual flourishing and an unburdened sense of human development that is expressed in genetic testing law and policy as a commitment to the stewardship of personhood. Operating with their own visions of what it means to protect life and citizenship, these three states arrived at settlements that coproduced substantially different bioconstitutional regimes around Alzheimer’s testing. The three dialogues in this contribution concern 21st century application of life‐like robots in the care of older adults. They depict conversations set in the near future, involving a philosopher (Dr Phonius) and a nurse (Dr Myloss) who manages care at a large facility for assisted living. In their first dialogue, the speakers discover that their quite different attitudes towards human‐robot interaction parallel fundamental differences separating their respective concepts of consciousness. The second dialogue similarly uncovers deeply contrasting notions of personhood (...) that appear to be associated with respective communities of nursing and robotics. The additional key awareness that arises in their final dialogue links applications of life‐like robots in the care of older adults with potential transformations in our understandings of ourselves – indeed, in our understandings of the nature of our own humanity. This series of dialogues, therefore, appears to address a topic in nursing philosophy that merits our careful attention. (shrink)

Human embryos produced in labs since the 1970s have generated layers of uncertainty for law and policy: ontological, moral, and administrative. Ontologically, these lab-made entities fall into a gray zone between life and not-yet-life. Should in vitro embryos be treated as inanimate matter, like abandoned postsurgical tissue, or as private property? Morally, should they exist largely outside of state control in the zone of free reproductive choice or should they be regarded as autonomous human lives and thus entitled to constitutional (...) protection like full-fledged citizens? Administratively, if they deserve protection, what institutional and policy mechanisms are best suited to carrying out the necessary oversight? Using a method termed comparative problematization, this article traces divergent answers to these questions produced in three countries—the United States, United Kingdom, and Germany—across the last twenty-five years. Comparison reveals distinct bioconstitutional foundations that give rise to systematically different understandings of each state’s responsibilities toward human life and hence its particular treatment of claims on behalf of embryonic lives. Creating android and humanoid robots to furnish companionship in the nursing care of older people continues to attract substantial development capital and research. Some people object, though, that machines of this kind furnish human–robot interaction characterized by inauthentic relationships. In particular, robotic and artificial intelligence (AI) technologies have been charged with substituting mindless mimicry of human behaviour for the real presence of conscious caring offered by human nurses. When thus viewed as deceptive, the robots also have prompted corresponding concerns regarding (...) their potential psychological, moral, and spiritual implications for people who will be interacting socially with these machines. The foregoing objections and concerns can be assessed quite differently, depending upon ambient religious beliefs or metaphysical presuppositions. The complaints may be set aside as unnecessary, for example, within religious traditions for which even current robots can be viewed as presenting spiritual aspects. Elsewhere, technological cultures may reject the complaints as expression of outdated superstition, holding that the machines eventually will enjoy a consciousness described entirely in materialist and behaviourist terms. While recognizing such assessments, the authors of this essay propose that the heart of the foregoing objections and concerns may be evaluated, in part, scientifically – albeit with a conclusion recommending fundamental revisions in AI modelling of human mental life. Specifically, considerations now favour introduction of AI models using interactive classical and quantum computation. Without this change, the answer to the essay's title question arguably is ‘no’ – with it, the answer plausibly becomes ‘maybe’. Either outcome holds very interesting implications for nurses. Though largely unknown today, “Ned Buntline” (Edward Zane Carroll Judson) was one of the most influential authors of 19th-century America. He published over 170 novels, edited multiple popular and political publications, and helped pioneer the seafaring adventure, city mystery and Western genres. It was his pirate tales that Tom Sawyer constantly reenacted, his “Bowery B’hoys” that came to define the distinctive slang and swagger of urban American characters, and his novels and plays that turned an unknown scout into Buffalo Bill, (...) King of the Border Men. But before “Ned Buntline” became a mainstay of the popular press, he had been on his way to becoming one of the nation’s highbrow literary elites. He was praised by the leading critics, edited an important literary journal, and his stories appeared in the era’s most prestigious publications. This study examines how and why “Ned Buntline” moved from prestigious to popular authorship and argues that the transformation was precipitated by one very specific event: in 1846, Edward Z. C. Judson was lynched. A close examination of Judson’s life, writing, and the coverage of him in the newspapers of the day (including the remarkable story of how he survived a lynching) demonstrates that the same issues that led to his lynching also led to his rebirth as a new kind of American author. This volume brings together eighteen articles which examine erôs as an emotion in ancient Greek culture. Taking into account all important thinking about the nature of erôs from the eighth century BCE to the third century CE, it covers a very broad range of sources and theoretical approaches, both in the chronological and the generic sense.

In this chapter we shall examine the characteristic properties of a construction wide-spread in the world’s languages, the passive. In section 1 below we discuss defining characteristics of passives, contrasting them with other foregrounding and backgrounding constructions. In section 2 we present the common syntactic and semantic properties of the most wide-spread types of passives, and in section 3 we consider passives which differ in one or more ways from these. In section 4, we survey a variety of constructions that (...) resemble passive constructions in one way or another. In section 5, we briefly consider differences between languages with regard to the roles passives play in their grammars. This paper considers the status of both the natural real and thinking in transcendental or structural materialisms, and questions whether the relationship between thinking and being in such philosophies can really be considered dialectical or not. Looking at the recent work of Slavoj Žižek, but with an eye to work being done by thinkers such as Brassier, Johnston, and Meillassoux as well, I consider what is said about quantum physics in some of Žižek’s recent books, and argue that it is (...) difficult to see how any version of the natural real – quantum or not – can have a status in a dialectical philosophy that does not end up at least implicitly giving ordinary human experience and thought a de-realized or ontologically degraded status, in a manner that is in fact very un-dialectical. The sciences basically require a reductionist perspective, such that it is hard to argue that there is any vigorous relationship between thinking and being in them. There is much about human experience and thinking that does need to be de-realized, of course. Hegelian philosophy and Freudo-Lacanian psychoanalysis have always done an excellent job of that. The theory of life that Badiou proposes at the end of Logics of Worlds is considered in this paper as a retooling of the old idea that the human is an exception in the order of things. What distinguishes Badiou’s account of the human from others though is the fact that it posits the human not as an exception from other animals, nor as an exception to ordinary life, but an exception that is other to the individual as such. The (...) way in which Alexandre Kojève framed the human in his reading of Hegel is used to establish the basic philosophical grammar for Badiou’s thinking about the human. What Badiou calls “democratic materialism” – his philosophical nemesis – is also considered from the perspective of that grammar. (shrink)

Recent discussions of the notion of the act in Lacan and Žižek have made the act out to be something like a stand in for the old idea of freedom. And so, the debate tends to be about whether acts are spontaneous or not, whether they result from decisions coming from a conscious subject or not, and what relation acts have to the circumstances that precede them. But much of this debate may be a red herring. I will be taking (...) the view here that, despite important similarities, the major difference between Badiou and Žižek on this point can be traced back to their differing views on the subject. By thinking the subject as a void, or as negative, Žižek’s subject looks more like a decisionist, even Sartrean subject. Badiou’s subject seems more fully post-phenomenological, and this difference has an important effect on how the act is conceived in his work.How Badiou’s subject fits within a psychoanalytic perspective is something I will explore in my second part. Badiou’s theory seems to have taken a psychoanalytic and Lacanian perspective very much to heart when thinking about the act. I will explain how this is so by using two models for an act coming from two different artistic practices: the surrealist practice of automatic writing, which I will compare to psychoanalytic free association, and the practice that Marcel Duchamp dubbed “over-censorship,” which I will compare to “working-through”. Each gives us a different model for the production of truth, and, in line with Badiou’s call to become the “pitiless censors of ourselves,” I argue that Duchamp’s technique has quite a bit to teach us about the structure of an act. It also helps to shed light on some aspects of Žižek’s view. (shrink)

If, as the title of this book suggests, the state of Tractatus commentary has at times recently resembled something close to a state of war, then it has most of all resembled a war of attrition. Against this background, Roger White's "Throwing the Baby Out with the Ladder" makes for refreshing reading. To be sure, White repeats some of the familiar misconceptions of what resolute readers do or must claim that have marred the debate over the adequacies or inadequacies of (...) such an approach to the Tractatus (TLP). But he also introduces some novel and interesting lines of criticism that merit serious attention. Foremost among the latter is White's treatment (in Section III of his paper) of three engaging examples that he sees as making trouble for resolute readers, and for their opposition to the standard idea that the lesson of the Tractatrrs could consist in its communicating, and our grasping, ineffable insights by way of its nonsense-sentences. This book draws together the latest work from scholars around the world using subjective well-being data to understand and compare well-being across countries and cultures. Starting from many different vantage points, the authors reached a consensus that many measures of subjective well-being, ranging from life evaluations through emotional states, based on memories and current evaluations, merit broader collection and analysis. Using data from the Gallup World Poll, the World Values Survey, and other internationally comparable surveys, the authors document wide divergences (...) among countries in all measures of subjective well-being, The international differences are greater for life evaluations than for emotions. Despite the well-documented differences in the ways in which subjective evaluations change through time and across cultures, the bulk of the very large international differences in life evaluations are due to differences in life circumstances rather than differences in the way these differences are evaluated. This Element introduces the notion of curatorial composing to account for certain musical practices that emerged from the 1960s as the founding concepts of music as an art - instituted in the modern era - were systematically dismantled. It raises the key question of how musical value and authority might be produced without recourse to an external principle, origin, transcendental framework, or other foundation. It argues that these practices do not dismiss the issue of value or simply relativise it but (...) shift the paradigm to a curatorial concern for composing public encounters and staging events. The Element shows that Lydia Goehr's elaboration of the work-concept provides a framework that was transformed by John Cage in his work from 0'00" (1962) onwards. The Element then introduces Heiner Goebbels' practice and focus on his role as Artistic Director of the Ruhrtriennale (2012-14), which it argues was an extension of his curatorial composing. Can literature make it possible to represent histories that are otherwise ineffable? Making use of the Deleuzian concept of “the powers of the false,” Doro Wiese offers readings of three novels that deal with the Shoah, with colonialism, and with racialized identities. She argues that Jonathan Safran Foer’s _Everything Is Illuminated_, Richard Flanagan’s _Gould’s Book of Fish_, and Richard Powers’s _The Time of Our Singing _are novels in which a space for unvoiced, silent, or silenced difference is created. Seen through (...) the lens of Deleuze and his collaborators’ philosophy, literature is a means for mediating knowledge and affects about historical events. Going beyond any simple dichotomy between true and untrue accounts of what “really” happened in the past, literature’s powers of the false incite readers to long for a narrative space in which painful or shameful stories can be included.
