In the article “Nudging and Informed Consent”, Cohen argues that the use of “nudging” by physicians in the clinical encounter may be ethically warranted because it results in an informed consent where obligations for beneficence and respect for autonomy are both met. However, the author's overenthusiastic support for nudging and his quick dismissal of shared decision-making leads him to assume that “soft” manipulation is un-problematic and that “wisdom” on the side of medical professionals will suffice to guard against abuse. Opposing (...) this view, we propose that: 1) patient preferences and values should not be boiled down to rational or irrational decisions based on cognitive reasoning alone, 2) potential threats to the physician-patient must be mitigated and could be minimized by employing alternative strategies that acknowledge the impact of cognitive heuristics in shaping decision-making but maintain transparency and trust, and 3) patient preferences and values can be legitimately influenced only under specific circumstances. The latter include: (1) exhaustion of other means; (2) evidence that nudging is effective in a specific context; (3) evidence of clear and active public misinformation (e.g., industry promoting smoking); (4) explicit pubic dialogue between various stakeholders including medical professional societies about nudging; (5) upholding shared decision-making as a preferred approach; and (6) a rich understanding of clinical reality beyond the simple dichotomy of beneficence-autonomy. I propose that the ‘post-truth condition’, i.e., the vulnerability of our institutions for establishing and negotiating what is true and worth knowing, is not primarily a pathology, a susceptibility to external manipulation or coercion, as tends to be stressed in the literature, but has first and foremost to do with the unraveling of certain epistemic assumptions. In analogy with T.S. Eliot’s modernist notion that the attempt to capture and concretize an experience or a state of mind requires ‘objective correlatives’ which (...) it conveys, I argue that the trope of post-truth to express the embattled status of expertise can be understood in terms of failed symbolization. In the second section, I spell out what this means in terms of Donald Davidson’s discussion of the problem of defining truth. In the last section, I propose a ‘poetics of political theory’ for understanding the post-truth condition. (shrink)

Predictivists use the no miracle argument to argue that “novel” predictions are decisive evidence for theories, while mere accommodation of “old” data cannot confirm to a significant degree. But deductivists claim that since confirmation is a logical theory-data relationship, predicted data cannot confirm more than merely deduced data, and cite historical cases in which known data confirmed theories quite strongly. On the other hand, the advantage of prediction over accommodation is needed by scientific realists to resist Laudan’s criticisms of the (...) no miracle argument. So, if the deductivists are right, the most powerful argument for realism collapses. There seems to be an inescapable contradiction between these prima facie plausible arguments of predictivists and deductivists; but this puzzle can be solved by understanding what exactly counts as novelty, if novel predictions must support the no miracle argument, i.e., if they must be explainable only by the truth of theories. Taking my cues from the use-novelty tradition, I argue that (1) the predicted data must not be used essentially in building the theory or choosing the auxiliary assumptions. This is possible if the theory and its auxiliary assumptions are plausible independently of the predicted data, and I analyze the consequences of this requirement in terms of best explanation of diverse bodies of data. Moreover, the predicted data must be (2) a priori improbable, and (3) heterogeneous to the essentially used data. My proposed notion of novelty, therefore, is not historical, but functional. Hence, deductivists are right that confirmation is independent of time and of historical contingencies such as if the theorist knew a datum, used it, or intended to accommodate it. Predictivists, however, are right that not all consequences confirm equally, and confirmation is not purely a logical theory-data relation, as it crucially involves background epistemic conditions and the notion of best explanation. Conditions (1)–(3) make the difference between prediction and accommodation, and account for the confirming power of theoretical virtues such as non ad-hocness, non-fudging, non-overfitting, independence and consilience. I thus show that functional novelty (a) avoids the deductivist objections to predictivism, (b) is a gradual notion, in accordance with the common intuition that confirmation comes in degrees, and (c) supports the no miracle argument, so vindicating scientific realism. The simple question, what is empirical success? turns out to have a surprisingly complicated answer. We need to distinguish between meritorious fit and ‘fudged fit', which is akin to the distinction between prediction and accommodation. The final proposal is that empirical success emerges in a theory dependent way from the agreement of independent measurements of theoretically postulated quantities. De Vries' mutation theory has not stood the test of time. The supposed mutations of Oenothera were in reality complex recombination phenomena, ultimately explicable in Mendelian terms, while instances of large-scale mutations were found wanting in other species. By 1915 the mutation theory had begun to lose its grip on the biological community; by de Vries' death in 1935 it was almost completely abandoned. Yet, as we have seen, during the first decade of the present century it achieved an enormous (...) popularity. As this paper has tried to suggest, one of the principal reasons for this was that de Vries' theory served as a banner around which a whole crowd of disaffected Darwinians or anti-Darwinians could rally. However, not all of those who favored de Vries did so for quite the same reasons. Underlying the multitude of views ran several common threads: a dissatisfaction with current Darwinian theory born out of misunderstanding natural selection, a general misunderstanding of the nature of species, and a prejudice against speculative, nontestable theories in biology.Supporters of de Vries were not the only opponents of Darwinism, nor was the mutation theory the only alternative to natural selection. In the early twentieth century a number of theories had been proposed to explain away the problems which Darwin had left unsolved. There was the idea of orthogenesis, championed by the American paleontologists Cope, Osborn and others; organic selection (or orthoplasy) was championed by M. M. Baldwin and C. Lloyd Morgan; there were the concepts of convergent evolution proposed by Hermann Friedmann, the theory of physiological selection by John George Romanes, and the concepts of reproductive divergence by H. M. Vernon. Virtually none of these men either accepted or were strong supporters of the de Vriesian theory, for each had his own particular ‘ism” to advocate as the major factor in evolution. The existence of a large number of such theories, each purporting to be the explanation, was characteristic of evolutionary theory at the turn of the century. It is to a large extent the emphasis on such fragmentary concepts that retarded development of the comprehensive theory of evolution which emerged in the 1920's and 1930's. For the historian, however, a study of these alternative theories is instructive in trying to understand the inherent difficulties which Dawwinian theory posed to biologists at the time. De Vries' mutation theory serves historically as a mirror to reflect the critical mood of a generation hostile to the theory of natural selection.It has often been claimed that it was impossible to understand the mechanism of natural selection until it could be placed in genetic and mathematical terms. It is certainly true that great strides have been made in population genetics and the treatment of evolutionary concepts with mathematical tools in the last forty years. But the very people who developed the genetical and mathematical approach to evolution were already convinced of the essential correctness of Darwinian theory before they started. Advances in an understanding of Mendelian heredity aided greatly in solving one important issue for evolutionists: the origin of variations. And the rigor with which selection acted could best be studied by observing changes in gene frequencies (calculated mathematically) over a number of generations. But as this paper has shown, two of the basic problems which biologists faced in evaluating Darwinian theory at the turn of the century-the nature of species, and the criteria of what constituted an acceptable explanation in biological science-could not be answered directly by mathematics. What mathematical and genetical theory did do was to help convince the skeptics of the validity of the Darwinian proposition.The change in explanatory criteria which many hailed as de Vries' most important contribution to evolutionary theory seems to have been part of a general emergence of twentieth-century biology from the domination of theorizers in the nineteenth. It also marked the emergence of America from the domination of biological, and particularly evolutionary, influence of Europeans. The change occurred in three areas: in the kinds of questions asked: testable versus non-testable; in the kind of data sought: quantitative versus qualitative; and in the kinds of theories proposed: analytical and reductive—the attempt to see complex processes in terms of simpler components-as opposed to synthetic and speculative. Although ultimately wrong in his idea, de Vries and his theories rode high on the wave of “experimentalism” which was the harbinger of a new era in evolutionary theory. (shrink)

Clinical diagnostic medicine is an experimental science based on observation, hypothesis making, and testing. It is an use dynamic process that involves observation and summary, diagnostic conjectures, testing, review, observation and summary, new or revised conjectures, i.e. it is an iterative process. It can then be said that diagnostic hypotheses are also ‘observation-laden’. My aim is to enlarge on the strategies of medical diagnosis as these are meshed in training and clinical experience—that is, to describe the patterns of reasoning used (...) by experienced clinicians under different diagnostic circumstances and how these patterns of inquiry allow further insight into the evaluation and treatment of patients. I do not aim to present a theory and illustrate it with examples; I wish rather am to let a realistic example, similar to actual clinical scenarios, direct the exposition. To this end, I introduce an account of medical diagnosis—briefly comparing and contrasting it to other accounts—in order to focus on discussing the process of diagnosis through a detailed clinical case. We investigate the way physical laws objectively refer to the entities they are about. Laws of mathematical physics do not refer directly to the “real world” but to an ideal specific domain of objects, which we term “scope”. In order to find out which real objects physical laws deal with, reference to the scope is not sufficient. We need in addition the search for domains to which laws apply — i. e. “empirical domains”— in order to establish their reference to (...) the “real world”. It is just in such empirical domains that we are able to discover the real entities physical laws objectively refer to. “Physical reality” turns out to be not something “given” but rather something “to come out” of the very process of scientific inquiry. Daley, S.J.One of the central questions Christian theologians continue to ask themselves, as they confront the mystery of the person of Christ, is, what is the significance for us today of the Council of Chalcedon? For generations of modern scholars, especially those in the West, the dense and rather technical phrases forged at that fifth-century gathering of Christian bishops (...) and appended to a restatement of what we know as the “Nicene creed” represented a major milestone in the Churches’ ongoing clarification of how disciples are to understand the person of Jesus the Savior.In J. N. D. Kelly’s widely used survey, Early Christian Doctrines,1 for instance, Chalcedon’s “settlement” of the twenty-four-year dispute between Nestorius and his Antiochene supporters and Cyril of Alexandria and the Church of Alexandria was the culmination of “the decisive period for Christology”2 in the early Church, an attempt to define an understanding of Christ that could be accepted by all Christians throughout the Empire, but which nevertheless—surprisingly, perhaps—“failed to bring permanent peace.”3 Aloys Grillmeier, in his foundational study of the growth of early Christian understandings of Jesus, speaks of the years up to Chalcedon as [End Page 165] temporally defining “the development of belief in Christ from its beginning to its first climax in a council of the Church.”4 In an influential study of the theology of the seventh-century monk and theologian Maximus the Confessor, Hans Urs von Balthasar emphasizes the centrality of Chalcedon’s formulaic, classically dialectical picture of the person of Christ as central to Maximus’s whole approach to God, the world, and the human spirit. The reason, Balthasar argues, lies in Chalcedon’s ability to affirm both unity and abiding difference in Christ as the dominant pattern of God’s relationship to creation:From the moment that Chalcedon, in its sober and holy wisdom, elevated the adverbs ‘indivisibly’ (ἀδαιρέτως) and ‘unconfusedly’ (ἀσυγχύτως) to a dogmatic formula, the image of a reciprocal indwelling of two distinct poles of being replaced the image of mixture. This mutual ontological presence (περιχώρησις) not only preserves the being particular to each element, to the divine and the human natures, but also brings each of them to its perfection in their very difference, even enhancing that difference. Love, which is the highest level of union, only takes root in the growing independence of the lovers; the union between God and the world reveals, in the very nearness it creates between these two poles of being, the ever-greater difference between created being and the essentially incomparable God.5With a little help from German Romantic philosophy, and perhaps from his Jesuit confrère Erich Przywara, Balthasar here sees in the Chalcedonian picture of Christ not only Maximus’s central inspiration, but the early Church’s final paradigm for conceiving how the transcendent God can be present and crucially active in the world.One might multiply examples. O artigo sugere que essas duas formas de enxergar a filosofia não são mutuamente excludentes e que é possível adotar uma visão da filosofia como arte de viver na atualidade, embora essa visão extrapole os limites da prática acadêmica.

The article analyzes the influence of Kantian philosophy on the problems and development of Russian empiriocriticism. It is shown that the critical pathos of Kant’s philosophy, as well as his call for intellectual honesty in philosophy, was appreciated first of all. Relying on Kant, Russian empiriocritics proved the inconsistency of metaphysics in both its religious and materialistic forms. In addition, the teachings of the founders of empiriocriticism, E. Mach and R. Avenarius, were also criticized because some dogmatic assumptions were found (...) in them. Attempts to eliminate these assumptions resulted in a dynamic concept of experience, based on which the concepts of empiriomonism (A. Bogdanov), empiriosymbolism (P. Yushkevich), scientific philosophy (V. Lesevich), positive philosophy of life (S. Suvorov), positive aesthetics (A. Lunacharsky), ethics of mutual joy (A. Bogdanov) and many others were developed. Special attention was paid to the analysis of the “thing-in-itself” since this very concept of Kantian philosophy was used by G. Plekhanov to justify “orthodox” Marxism. Russian empiriocritics opposed Plekhanov’s identification of the “thing in itself” and the material object, arguing that the concept of matter is a metaphysical assumption and, for this reason, cannot contribute to refuting dualism and Kantian “agnosticism.” From the monistic point of view, the “thing-in-itself” should be understood on the basis of experience as a necessary form of its organization. According to Bogdanov, there is nothing a priori in the “thing-in-itself”; this idea appeared as a result of substituting the known for the unknown and expressed a process rather than essence. Kant’s aesthetics and moral philosophy were also actively discussed in Russian empiriocriticism. The interpretation of beauty as “expediency without purpose” was extended to the fundamental principle of the “aesthetic worldview,” which gave credibility to the doctrine of the ideal, the practice of social construction, etc. As a result of the polemic with the ethics of compassion, of which Kant was considered the most authoritative defender, an alternative ethic of mutual joy was created. Thus, the influence of Kantian philosophy on Russian empiriocritics was complex and contributed to the development of new ideas. (shrink)
