John Rawls’s political liberalism demands that reasonable citizens comply with the duty of civility, which limits the justification of state action to public reasons. However, many religious citizens in liberal democratic societies reject the exclusion of religious reasons from public debate. What can be done to encourage these citizens to endorse public reason? Rawls proposes the idea of reasoning from conjecture (RC), i.e. directly engaging with someone’s comprehensive doctrine and showing them that such a doctrine actually supports public reason. In (...) this article, we argue that reasoning from conjecture faces serious objections and that interfaith dialogue (ID) provides a better and more effective tool to encourage religious citizens to endorse public reason. More specifically, ID provides support to public reason by (i) relying on the principles of equality, sincerity and self-criticism, which are also central to public reason; (ii) leading participants to de-parochialize religion; and (iii) promoting tolerance. Moreover, ID avoids the main objections faced by RC, which undermine the latter’s morality and effectiveness. (shrink)

When generally applicable rules clash with one’s cultural, religious or moral commitments, should exemptions be granted? The debate on exemptions raises the question both of what it means to treat people equally and of what it means to protect diversity adequately. The objective of this paper is to defend the no-exemption argument and to make it a more attractive position for liberals. I first argue that exemptions violate the principle of equal treatment because they rely on distinctions that cannot be (...) neutrally justified. I then argue that diversity can be adequately accommodated if we use a more demanding interpretation of the justification of generally applicable rules. There should be no exemption to fully justified rules, but rules are only fully justified when the particular demands that they impose on individuals are justified, i.e. when they are either neutral or pass both a Necessity Test and a Sufficiency Test. When rules are not fully justified, they should be repealed or modified. Based on this focus on the demands of rules, equality can be reconciled with an adequate accommodation of diversity. (shrink)

The responses to the questions of why? when?, how?, where?, and in what ways? business ethics should be taught in the BusinessEthics classroom inundate the scholarly literature. Yet, to date, despite some very interesting ideas, with respect to the answers givento the above question, not only has nothing even close to consensus been reached, but this particular area of pedagogy is instagnation—authors still challenge both the very idea of teaching business ethics as well as the practical value of such courses (...) for ourstudents once they graduate to the corporate world.In this paper I will suggest that the reason for this lack of pedagogical progress is that there has been a serious oversight regarding the most important teaching question of all: Who? I will show that the pedagogical issue of whom should be teaching Business Ethics has been largely ignored, skirted or answered incorrectly. I will then boldly argue that the only necessary condition for successful courses inBusiness Ethics is that they be taught by experts in ethics, i.e., Ph.D.s in philosophy. (shrink)

I. Introduction Two kinds of remedies have traditionally been employed for breach of contract: legal relief and equitable relief. Legal relief normally takes the form of money damages. Equitable relief normally consists either of specific performance or an injunction – that is, the party in breach may be ordered to perform an act or to refrain from performing an act. In this article I will use a “consent theory of contract” to assess the choice between money damages and specific performance. (...) According to such a theory, contractual obligation is dependent on more fundamental entitlements of the parties and arises as a result of the parties' consent to transfer alienable rights. My thesis will be that the normal rule favoring money damages should be replaced with one that presumptively favors specific performance unless the parties have consented to money damages instead. The principal obstacle to such an approach is the reluctance of courts to specifically enforce contracts for personal services. The philosophical distinction between alienable and inalienable rights bolsters this historical reticence, since a right to personal services may be seen as inalienable. I will then explain why, if the subject matter of a contract for personal services is properly confined to an alienable right to money damages for failure to perform, specific enforcement of such contracts is no longer problematic. Finally, I shall consider whether the subject matter of contracts for corporate services is properly confined to money damages like contracts for personal services, or whether performance of corporate services can be made the subject of a valid rights transfer and judicially compelled in the same manner as contracts for external resources. Ancient moral philosophers, especially Aristotle and his followers, typically shared the assumption that ethics is primarily concerned with how to achieve the final end for human beings, a life of “happiness” or “human flourishing.” This final end was not a subjective condition, such as contentment or the satisfaction of our preferences, but a life that could be objectively determined to be appropriate to our nature as human beings. Character traits were treated as moral virtues because they contributed well toward this (...) ideal life, either as means to it or as constitutive aspects of it. Traits that tended to prevent a “happy” life were considered vices, even if they contributed to a life that was pleasant and what a person most wanted. The idea of “happiness” was central, then, in philosophical efforts to specify what we ought to do, what sort of persons we should try to become, and what sort of life a wise person would hope for. Four models of forgiveness are identified; the health model, the philosophical model, the Christian model and the prosocial model. All define the term ‘forgiveness’ in a way which is consistent with their particular perspective. The authors offer a definition of forgiveness and propose an integrated model of forgiveness which seeks to incorporate contributions from all four areas, but is not biased towards any one model. Four levels of transgression are identified and categorized according to the degree of perceived damage. Apology-automatic (...) and apology-dependent responses are distinguished from a forgiveness response which is restricted to Levels 3 and 4. The advantages of adopting a forgiveness strategy for both the forgiver and forgiven as opposed to other responses, i.e., revenge, denial, and condoning are discussed. Imagine a society of fisherfolk, who, in the state of nature, fish on a lake of finite size. Fishing on the lake is characterized by decreasing returns to scale in labor, because the lake's finite size imply that each successive hour of fishing labor is less effective than the previous one, as the remaining fish become less dense in the lake. In the state of nature, the lake is commonly owned: each fishes as much as he pleases, and, we might (...) suppose, calculates his fishing plan by taking the labor of the others as given, as he sees it. Each knows that the distribution of fish will be proportional to labor expended among the fisherfolk: if I fish twice as long as you, I will end up with twice as much fish as you. This is not due to some kind of concern with equity among the fisherfolk; it is a technological fact, implied by the assumption that fishing labor is homogeneous, and all are equally likely to catch a fish in a unit of time. An equilibrium under common ownership can be thought of as a Nash equilibrium of the game where each computes his optimal fishing plan, given the labor of the others and knowing what the consequent distribution of fish would be. The article examines Husserl's work On the Phenomenology of the Consciousness of Internal Time. Firstly, it seeks to show the surplus of cosmic time with regard to the temporality of consciousness. Secondly, an attempt is made to establish whether the Husserlian description of the form of the flow of consciousness is circular, i.e., whether it does not presupposes the objective time that it purports to constitute. Thirdly, a critical analysis of the self-manifestation of the absolute flow of consciousness is advanced. (...) Butterworth, and thereby to introduce students to Medieval islamic political philosophy, of which Butterworth is one of the world's most prominent scholars. In a wider sense, the Festschrift introduces its readers to the current debates on Medieval islamic political philosophy, related as they are to the questions of the relationship between islam and Christianity, the Medieval to the Modern world, and reason and revelation. Butterworth's scholarship spans six decades, (...) primarily translating, editing, and interpreting the works of the Muslim political philosopher Alfarabi (d. 950) and Averroes (Ibn Rushd, d. 1198). He began his studies of Muslim political philosophy at a time when the Middle East and islam did not have the political salience they have acquired in more recent years. instead, Butterworth's reason for engaging with islam was rooted in the question of the relationship between reason and revelation. While one possible answer was pursued in the Christian, latin West, the islamic borderlands of Greek, Roman, and Muslim civilization offered another. By exploring Averroes, who provides the possibility of an Aristotelian-Islamic political philosophy, and Alfarabi, who pursues a Platonic-islamic political philosophy, Butterworth showed how islamic civilization provided a viable alternative to the theologico-political question reason v revelation, as well as serving as an inspiration to the latin West. Se diserta sobre “RESISTENCIA TRIBUTARIA” JUSTIFICADA EN EL ECUADOR. Ello, porque gobierno del presidente Daniel Noboa estableció todo un “paquete” de “impuestos de guerra”, como la Contribución Temporal de Seguridad (CTS); un incremento del IVA, a discreción del presidente de la República, el pechaje del sector construcción, transferencias al exterior y otros impuestos. Ley Orgánica para Enfrentar el Conflicto Armado Interno, la Crisis Social y Económica (en adelante, la Ley), publicada en el Registro Oficial, Suplemento No. 516 del 12 de (...) marzo de 2024, trayendo a discusión los aspectos jurídicos que vician de posible inconstitucionalidad dicha Ley, con fundamento en la normativa constitucional y tributaria de Ecuador. Con la Ley, dado el contexto de su aprobación, el gobierno creó un ´impuesto de guerra´, para financiar una guerra inexistente, partiendo del hecho que la Corte Constitucional del Ecuador estableció que en el país no existe un “Conflicto Armado Interno” (CAI). Así lo estableció en sus Dictámenes 5-24-EE/24 del 9 de mayo de 2024 y 6-24-EE/24 del 13 de junio de 2024, en los que declaró inconstitucionales los decretos ejecutivos No. 250 de 30 de abril de 2024 y 275 del 22 de mayo de 2024, relacionados con el Estado de Excepción que ha regido en Ecuador desde el 10 de enero de 2024, soportado éste en la presunta existencia de un CAI, “decertado” y reconocido sin fundamento jurídico, pese a que no cumple con los supuestos fácticos y normativos fijados, con fuerza ius cogens, por el Derecho Internacional Humanitario (DIH)7 para ser calificado como tal. El ´impuesto de guerra´, fijado en la Ley, por inconstitucional, es confiscatorio. Los Dictámenes, en el plano de la reflexión tributaria, reflejan la patética violación al principio de la constitucionalidad y de la legalidad fiscal, resultando viciada de nulidad absoluta la Ley y, con ella, la configuración del tributo, porque el hecho imponible (CAI) es inexistente, implicando que el presupuesto establecido por la Ley para configurar cada `impuesto de guerra´ jamás tendrá materialización práctica (por inexistente) y nunca tendrá validez jurídica (por inconstitucional), resultando en un tributo confiscatorio, surgido contra la Carta Fundamental y evidente fraude a la legalidad tributaria del país, en perjucio del patrimonio personal o corporativo de los contribuyentes, residentes fiscales o establecimientos permanentes en el país a los que somete a un pago indebido sancionado en el artículo 122 10 , concordado con los artículo 306 al 307 del Código Tributario del Ecuador. La nulidad absoluta e ineficacia del hecho imponible, por inconstitucional, deriva en la invalidez plena y la irrelevancia constitucional del inexistente hecho generador del tributo -proveniente de un acto de naturaleza jurídica - por la no realización fáctica, tangible y concreta del presupuesto generatriz establecido (CAI) en la Ley para su configuración. Como consecuencia, nunca jamás surge válidamente la obligación tributaria, cuya exigencia resulta ineficaz, por ilegal e ilusoria. La obligación tributaria, tiene que calificarse, en tal sentido, como no nacida lícitamente en el ámbito fiscal. Con ello, habría de resultar confiscatorio el pago de la alicuota del `impuesto de guerra´ fijado por el gobierno ecuatoriano de modo inconstitucional abusando del ejercicio del poder tributario relacionado con la urgencia en materia económica. Ante las hondas repercusiones económicas que genera en la población y el sector productivo del país, se describen las posibles vías institucionales disponibles en la regulación ecuatoriana para impugnar la Ley ante la Corte Constitucional del Ecuador -o en la jurisdicción constitucional- sin menoscabo de la eventual activación de la competencia derogatoria de la Asamblea Nacional frente a la misma. Se reafirma el principio de justicia tributaria y la vigencia del Estado social de derechos y de justicia consagrado en la República del Ecuador y la plena efectividad de los derechos y garantías fundamentales de los hermanos ecuatorianos ubicados en la posición de destinatarios de un "impuesto de guerra" tan arbitrario como inconstitucional, que riñe con el enunciado constitucional y convencional del respeto a la dignidad humana y la incolumidad de la propiedad privada frente a actuaciones del Estado que representan un claro abuso en el ejercicio del poder público en desmedro de la legalidad fiscal, generador de un supuesto de patética injusticia tributaria adoptada a contracorriente de toda regulación en materia de impositiva con la publicación de la Ley Orgánica para Enfrentar el Conflicto Armado Interno, la Crisis Social y Económica. En la lucha contra conductas gubernamentales transgresoras de la dignidad humana y frente a leyes inconstitucionales que afectan los derechos fundamentales, la libertad económica y la propiedad privada de los hermanos contribuyentes ecuatorianos y sus empresas afectadas. Este esfuerzo intelectual, realizado por nuestra familia de abogados, es una reverencia a la gesta de nuestros libertadores y un llamado al pueblo ecuatoriano económicamente afectado a resistir, por medios institucionales, frente al pago de impuestos arbitrarios e ilegales que atentan contra los principios fundamentales del orden público económico previsto en la Ley Fundamental. Lo anterior, como una singular expresión reglada, lícita y avanzada de dar al traste con una ley orgánica fiscal tan arbitraria como injusta, activando los mecanismos de protección de los derechos fundamentales constitucionalmente establecidos en el Ecuador. La pretensión judicial traduciría, mutatis mutandis, en la activación institucional de la añeja figura de la "resistencia tributaria" (objeción fiscal, desobediencia tributaria), que, en sus orígenes, nació como expresión de la desobediencia civil frente a leyes impositivas injustas, con el precedente del escritor estadounidense Henry David Thoreau, encarcelado por negarse a pagar un tributo electoral, reticente a contribuir con la continuidad de la esclavitud y la financiación de la Guerra entre México y EEUU, basado en la idea de que las personas deben priorizar su conciencia sobre la obediencia a leyes injustas. -/- . Este artigo questiona a dimensão crítica da democracia analisada por Sheldon S. Wolin. A partir da década de 1980, o impulso de Wolin de diagnosticar as falhas da democracia americana ao conectar o liberalismo ao totalitarismo se manifesta de uma nova maneira. Ele observa que, no processo de lutar ostensiva- mente contra o totalitarismo durante a Guerra Fria, o próprio governo americano passou a incorporar uma forma totalizante de poder. Essa crítica culmina em seu diagnóstico de uma crise do século (...) XXI: a condição neoliberal de “totalitarismo invertido”. Aqui Wolin argumenta não apenas que o sistema político americano compartilha algumas características com o totalitarismo, mas também que está começando a constituir uma nova versão do totalitarismo emergindo de dentro, e não em reação ao liberalismo. Elsewhere I have defended utilitarianism as a philosophy peculiarly well suited to the conduct of public affairs, on grounds of the peculiar tasks and instruments confronting public officials. Here I add another plank to that defence of ‘utilitarianism as a public philosophy’, focusing on the peculiar role responsibilities of people serving in public capacities. Such ‘public service utilitarianism’ is incumbent not only upon public officials but also upon individuals in their capacities as citizens and voters. What, if anything, are we morally required to do on behalf of others besides respecting their rights? And why is such regard for others a reasonable moral requirement? These two questions have long been major concerns of ethical theory, but the answers that philosophers give tend to vary with their beliefs about human nature. More specifically, their answers typically depend on the position they take on a third-question: To what extent, if any, is it possible for us to act altruistically?

Mill's discussion of ‘the internal sanction’ in chapter III of Utilitarianism does not do justice to his understanding of internal sanctions; it omits some important points and obscures others. I offer an account of this portion of his moral psychology of motivation which brings out its subtleties and complexities. I show that he recognizes the importance of internal sanctions as sources of motives to develop and perfect our characters, as well as of motives to do our duty, and I examine (...) in some detail the various ways in which these sanctions give rise to motivating desires and aversions. A hipótese que gostaria de defender é a de que a alteração da compreensão das paixões humanas possibilitou a formulação de uma nova antropologia segundo a qual a busca por prazer é entendida como legítima moral e politicamente.

All advanced societies maintain a commitment to equal educational opportunity, which they claim to implement through a public school system that is charged toprovide all children with an education up to a state-enforced standard. Indeed, what public schools do, even in the best of circumstances, is to provide all children with a more or less equal exposure to educational inputs, rather than to guarantee them equal educational attainment. Children, as the schools receive them, differ markedly in their docility — due (...) in part to innate ability, but perhaps due more to the economic status and cultural practices of their families. Many, including myself, believe that the task of schools should be to provide some measure of equal educational attainment among students of heterogeneous talent and background. Schools should devote more educational resources to students who require them in order that they be educated to an acceptable standard. (shrink)

Suppose you are on a commercial airplane that is flying at 35,000 feet. Next to you sits a man who appears to be sleeping. In fact, this man has been drugged and put upon the plane without his knowledge or consent. He has never flown on a plane before and, indeed, has no idea what an airplane is. Suddenly the man awakes and looks around him. Terrified by the alien environment in which he finds himself, he searches for a door (...) or window from which to make an escape. As luck would have it, he is seated right next to a window exit and he begins to pull the handle that will open the window. You are aware that opening the window exit at this altitude will cause the cabin to quickly depressurize and that this man, you, and probably several other passengers will be sucked out the window to your deaths. You desperately want to stop him from opening the window. Now assume that for some reason it is impossible to prevent him physically from performing the deadly act. Your only option is to rationally persuade him to leave the window exit alone. You cry out to him and, with both hands on the handles, he turns to face you and waits to hear what you have to say. What sort of argument would you make? (shrink)

A small puzzle: the terms ‘capitalism’ and ‘socialism’ initially present themselves as contraries, the one affirming what the other rejects. However, once removed from the dictionary, they function otherwise. The theory of capitalism is very much contained within the science of economics. The positive theory of capitalistic institutions, but also its normative superstructure, rest most easily within the language and methodology of the economist. What distinguishes the free market? It is efficient ; allocation of factors of production are optimized ; (...) individuals maximize their utility ; and so on. These are the terms with which justifications of capitalistic production typically begin – begin, and often end. (shrink)

In 1954 H. L. A. Hart wrote that Austin's work has ‘never, since his death … been ignored’. If it never has been completely ignored, interest in it has periodically waxed and waned. The interest definitely waxed in the 1980s. More books were published about Austin in this period than in any other decade since his death in 1859. Although this literature contains discussions of some of the nineteenth-century responses to his work, they are not the focus of it. Certain (...) of the responses remain completely in the dark, while there is more light to shed on at least some of the others. In short, our knowledge of nineteenth-century interpretations of Austin's legal philosophy is very incomplete. (shrink)

Some decades ago in his intriguing book on Jonathan Edwards, Perry Miller used to great effect the device of supposing a two-fold biography of Edwards, an external one consisting of the historical record embracing the major events of his life and times, and an internal one aimed at an interpretation of the mind of Edwards and the development of his thought.

Abstract: Alienation and slavery from Precious or what we don't want to see. It is our purpose to establish, in a parallel reading, these two films (highly rewarded), namely The Fence and Precious, that apparently being so different, are an illustration of the reality of life and the modern democratic world: the social uprooting and slavery. If in the movie of Phillip Noyce and Christone Olsen The Fence, is told a story of three young Aboriginal girls who are forcibly taken (...) to be transformed into domestic slaves, in the movie of Lee Daniels Precious, the young woman is already a servant in her own home and seeks the transformation of her life. Uniting these two stories, we find fundamental elements: illiteracy, ill-treatment, the idea of a migration (real or metaphysical), among others, but whose fundamental notion is the journey. If the film The Fence, the fence itself is used to conduct the three young Aboriginal to a real reunion with the family, in Precious, the metaphorical ‘fence’ is the limit of her world. From this interpretation, we will undertake our reflection about what we consider to be the alienation of the modern world and the silence we produce about them. (shrink)
