The present paper has two aims. First, we reconstruct the core of molecular genetics (MOLGEN) i.e. the array of theoretical assumptions which underly all or most applications of molecular genetics. Second, we define a reduction relation p reducing character-factor genetics (CFG) to MOLGEN. That p is a reduction relation is proved by establishing that p satisfies the two major conditions which are discussed in the literature as necessary or ‘essential’ for reduction. This substantiates the claim that molecular genetics is ‘better (...) than’ or ‘more progressive-than’ character-factor genetics-which is commonly held true today. The paper continues, and relies heavily on the definitions given in part 1 (Balzer and Dawe [1985]). The enumeration of the definitions and sections in the present paper continues that of part 1. It is shown that the criteria of T-theoreticity proposed by Balzer and Gähde lead to strongly counterintuitive and in this sense paradoxical results: most of the obviously empirical or at least nontheoretical terms come out as theoretical. This is demonstrated for a lot of theories in different areas. On the way, some improved and some new structuralist theory-reconstructions are given. The conclusion is drawn that the T-theoreticity of a term cannot possibly be proved on the basis of the mathematical (...) structure of theory T alone (as Gähde and Balzer suggest). Rather, an independent notion of pre-T-theoreticity and-more importantly-of empiricity is needed; i.e., not empirical and not pre-T-theoretical are independent, necessary but not sufficient conditions for T-theoretical (this is also a necessary complement of Sneed's original criterion). Finally it is asked whether the structuralist criterion of T-theoreticity complemented by such independent conditions would be a satisfactory answer to Putnam's challenge, and the answer again is negative: the criterion is not able to distinguish between empirically contentful and completely contentless (superfluous) theoretical terms. Genetic modification leads to several important moral issues. Up until now they have mainly been discussed from the viewpoint that only individual living beings, above all animals, are morally considerable. The standpoint that also collective entities such as species belong to the moral sphere have seldom been taken into account in a more thorough way, although it is advocated by several important environmental ethicists. The main purpose of this article is to analyze in more detail than often has been done (...) what the practical consequences of this ethical position would be for the use of genetic engineering on animals and plants. The practical consequences of the holistic standpoint (focused on collective entities) of Holmes Rolston, III, is compared with the practical consequences of the individualistic standpoints (focused on individual living beings) of Bernard E. Rollin and Philipp Balzer, Klaus Peter Rippe, and Peter Schaber, respectively. The article also discusses whether the claim that species are morally considerable is tenable as a foundation for policy decisions on genetic engineering. (shrink)

Fifty years after the death of Edmund Husserl, the main founder of the phenomenological current of thought, we present to the public a four book collection showing in an unprecedented way how Husserl's aspiration to inspire the entire universe of knowledge and scholarship has now been realized. These volumes display for the first time the astounding expansion of phenomenological philosophy throughout the world and the enormous wealth and variety of ideas, insights, and approaches it has inspired. En la concepción estructuralista de teoría científica se afirma que sus tesis son neutrales respecto a compromisos epistemológicos, puesto que su análisis es estructural (Diederich, 1996). En el presente texto nos proponemos mostrar que no existe tal neutralidad epistemológica en una de las piezas clave del estructuralismo metateórico, nos referimos a la noción “aplicaciones intencionales”, y que de lo anterior se deriva un compromiso epistémico relacionado con la justificación de teorías científicas, según el cual, la ciencia es una “red” de (...) relaciones lógicas entre teorías. Para lograr lo anterior nos proponemos analizar las implicaciones semánticas y epistemológicas de esa noción y el rol que juega en la contrastación teórica. Una de las consecuencias más radicales del análisis propuesto es que la noción anterior (aplicaciones intencionales) implica que unas teorías están justificadas por otras; en otras palabras, la justificación de teorías científicas caería en un coherentismo interteórico, que precisaremos más adelante. Naturalmente, es importante advertir que esta tesis y esta implicación coherentista la aceptan los defensores del estructuralismo metateórico (Balzer, Moulines & Sneed, 1987) y (Díez & Moulines, 1997). Sin embargo, el punto realmente problemático, y lo novedoso del presente artículo, es que el coherentismo compromete la justificación de las teorías en cuanto implica un regressus ad infinitum en la reconstrucción formal. Además, este defecto del estructuralismo conlleva a otras dos réplicas adicionales, una desde el punto de vista pragmático y otra desde el punto de vista semántico. El primero consiste en que, si aceptamos la tesis del regressus la reconstrucción puede ser infructuosa para efectos pragmáticos, i.e. la corrección formal de una teoría nos obliga a corregir el conjunto de teorías ya presupuestas que intervienen en ella. De la misma manera, la dependencia semántica de una teoría respecto a sus antecesoras implica que si uno de sus conceptos fundamentales es corregido o modificado, entonces habría que hacer una revisión general de todas las teorías relacionadas en las que el concepto en cuestión es relevante. There has been longstanding interest in the consistency of decisions made by research ethics committees in the UK, but most of the evidence has come from single studies submitted to multiple committees. A systematic comparison was carried out of the decisions made on 18 purposively selected applications, each of which was reviewed independently by three different RECs in a single strategic health authority. Decisions on 11 applications were consistent, but disparities were found among RECs on decisions on seven applications. An (...) analysis of the agreement between decisions of RECs yielded an overall measure of agreement of κ = 0.286 , indicating a level of agreement that, although probably better than chance, may be described as “slight”. The small sample size limits the robustness of these findings. Further research on reasons for inconsistencies in decision making between RECs, and on the importance of such inconsistencies for a range of arguments, is needed. (shrink)

Background: Despite the expansion of ethics consultation services, questions remain about the aims of clinical ethics consultation, its methods and the expertise of those who provide such services.Objective: To describe physicians’ expectations regarding the training and skills necessary for ethics consultants to contribute effectively to the care of patients in intensive care unit .Design: Mailed survey.Participants: Physicians responsible for the care of at least 10 patients in ICU over a 6-month period at a 921-bed private teaching hospital with an established (...) ethics consultation service. 69 of 92 eligible physicians responded.Measurements: Importance of specialised knowledge and skills for ethics consultants contributing to the care of patients in ICU; need for advanced disciplinary training; expectations regarding formal-training programmes for ethics consultants.Results: Expertise in ethics was described most often as important for ethics consultants taking part in the care of patients in ICU, compared with expertise in law , religious traditions , medicine and conflict-mediation techniques . When asked about the formal training consultants should possess, however, physicians involved in the care of patients in ICU most often identified advanced medical training as important.Conclusions: Although many physicians caring for patients in ICU believe ethics consultants must possess non-medical expertise in ethics and law if they are to contribute effectively to patient care, these physicians place a very high value on medical training as well, suggesting a “medicine plus one” view of the training of an ideal ethics consultant. As ethics consultation services expand, clear expectations regarding the training of ethics consultants should be established. (shrink)

Complementary and alternative medicine has become an important section of healthcare. Its high level of acceptance among the general population represents a challenge to healthcare professionals of all disciplines and raises a host of ethical issues. This article is an attempt to explore some of the more obvious or practical ethical aspects of complementary and alternative medicine.

Interpretation of the classics in political theory seems to go in waves. For a while we had John Locke, the bourgeois thinker. Now we seem to be in a Locke-as-radical-democrat phase. Locke-the-bourgeois had problems of its own, but a radically democratic Locke -- not just the old Locke as liberal democrat but Locke as quasi-Leveller -- strains the interpretative imagination more than most; yet in recent years, several different kinds of argument have been advanced in support of it, both textual (...) and contextual. The most effective argument has proceeded by situating Locke in the context of radical Whig politics in the 1670s and '80s, the struggles over religious toleration and the royal succession, in particular the �Exclusion Crisis� of 1679-81. This contextual argument has been accompanied by various textual interpretations having to do with Locke's conceptions of property, consent, representation, the right of revolution and natural law. Among other things, these are supposed to show that while Locke had nothing explicit to say about the extent of the franchise, the weight of evidence suggests that he would have supported a fairly wide franchise, perhaps even something like the (almost) manhood suffrage advocated by the Levellers (at least according to some, and probably the most convincing, interpretations of their ideas). Most recently, in these pages, Martin Hughes, building on the work of James Tully and Richard Ashcraft in particular, has pushed the argument as far as it can probably go. His argument on taxation and suffrage has provided a motivation here for a wider exploration of Locke's views on representation, consent and the franchise. (shrink)

Background: Since the passage of the Patient Self-Determination Act, numerous policy mandates and institutional measures have been implemented. It is unknown to what extent those measures have affected end-of-life care, particularly with regard to the do-not-resuscitate order.Methods: Retrospective cohort study to assess associations of the frequency and timing of DNR orders with advance directive status, patient demographics, physician’s specialty and extent of documentation of discussion on end-of-life care.Results: DNR orders were more frequent for patients on a medical service than on (...) a surgical service and were made earlier in the hospital stay for medicine than for surgical patients . 22.18% of all patients had some form of an advance directive in their chart, yet this variable had no impact on the frequency or timing of DNR ordering. Documentation of DNR discussion was significantly associated with the frequency of DNR orders and the time from DNR to death .Conclusions: The physician’s specialty continues to have a significant impact on the frequency and timing of DNR orders, while advance directive status still has no measurable impact. Additionally, documentation of end-of-life discussions is significantly associated with varying DNR ordering rates and timing. (shrink)

In this article I seek to address some misunderstandings in arguments about same sex-marriage. I do this by evaluating several views on homosexuality and marriage. My central aim is to show that a rejection of same-sex marriage does not depend upon the view that homosexual acts are immoral or disordered. Rather, one must examine sexual acts in light of public goods that are at stake. I also argue that the Christian understanding of marriage and sexuality offers more than a set (...) of prohibitions against certain sexual acts. Rather, it offers reasonable principles by which to evaluate the relationship between sexual acts and the public good. (shrink)

Background and objective: Assuming the hypothesis that the general practitioner can and should be a key player in making end-of-life decisions for hospitalised patients, perceptions of GPs’ role assigned to them by hospital doctors in making withdrawal decisions for such patients were surveyed.Design: Questionnaire survey.Setting: Urban and rural areas.Participants: GPs.Results: The response rate was 32.2% , and it was observed that 70.8% of respondents believed that their participation in withdrawal decisions for their hospitalised patients was essential, whereas 42.1% believed that (...) the hospital doctors were sufficiently skilled to make withdrawal decisions without input from the GPs. Most respondents were found to believe that they had the necessary skills and enough time to participate in withdrawal decisions. The last case of treatment withdrawal in hospital for one of their patients was described by 40% of respondents, of whom only 40.0% believed that they had participated actively in the decision process. The major factors in the multivariate analysis were the GP’s strong belief that his or her participation was essential , information on admission of the patient given to the GP by the hospital department , rural practice , visit to the patient dying in hospital and a request by the family to be kept informed about the patient .Conclusion: Strong interest was evinced among GPs regarding end-of-life issues, as well as considerable experience of patients dying at home. As GPs are more closely corrected to patients’ families, they may be a good choice for third-party intervention in making end-of-life decisions for hospitalised patients. (shrink)

This book brings together papers given at a symposium which took place in Melbourne, Australia in 2001. Like any such collection, the chapters vary in quality and in substance. Some authors have chosen to analyse one issue in considerable depth, while others attempt a broad overview of regulations in different regions of the world. Julian Savulescu, for example, confines himself to the complex question of whether gamete providers’ freedom to dispose of their unwanted embryos should take priority over infertile couples’ (...) interests in using these surplus embryos in treatment. In contrast, Jothi Kumar surveys the regulation of assisted reproductive technology throughout Asia in a mere four pages of text. In general, contributions of the first type tend to be more successful; attempts to summarise something as complex as the regulation of assisted reproductive technology across a whole continent can be difficult for the reader to digest, and inevitably offer little by way of analysis.A further problem bedevils any new publication in this fast moving area of medical law and ethics. Although providing a “snapshot” of regulation in 2001 is undoubtedly an interesting and worthwhile project, a book such as this risks being out of date before it is even published. As a result, the more discursive chapters which concentrate on especially novel or controversial ethical dilemmas are likely to be of use and interest for longer than those which describe the regulatory status quo. Although removed from immediate clinical practice, decisions about the design of hospitals eventually impact on patient care and treatment. Any decision which affects a patient’s treatment is an ethical decision and should be guided by the principles of medical ethics. If we apply these principles to healthcare facilities, it would seem that providers have a duty to design hospitals which best reduce the possibility that a patient may come to unnecessary harm during their treatment and improve a patient’s experience, privacy (...) and dignity. Evidence suggests that hospitals designed with 100% single-occupancy rooms are best equipped to achieve these aims.The prevalence of hospital acquired infections is still increasing. Currently, they are thought to affect around 9% of hospital patients in the UK and contribute to around 90 000 deaths per year in Europe.1 A hospital design which is able to decrease the prevalence of hospital acquired infection would help to reduce the amount of harm a patient may experience in hospital. Despite global and local attempts to end female genital mutilation , the practice persists in some parts of the world and has spread to non-traditional countries through immigration. FGM is of varying degrees of invasiveness, but all forms raise health-related concerns that can be of considerable physical or psychological severity. FGM is becoming increasingly prohibited by law, both in countries where it is traditionally practised and in countries of immigration. Medical practice prohibits FGM. The Italian parliament passed a law prohibiting (...) FGM, which has put in place a set of measures to prevent, to oppose and to suppress the practice of FGM as a violation of a person’s fundamental rights to physical and mental integrity and to the health of women and girls. The Italian law not only treats new offences but also wants to deal with the problem in its entirety, providing important intervention in all the sectors. Different kinds of interventions are considered, starting with the development of informative campaigns, training of health workers, institution of a tollfree number, international cooperation programmes and the responsibility of the institution where the crime is committed. Particularly, the law recognises that doctors have a role in eliminating FGM by educating patients and communities. (shrink)
