Currently the focus of a heated debate among indigenous peoples, human rights advocates, crop breeders, pharmaceutical companies, conservationists, social scientists, and lawyers, the proposal would allow impoverished people in biologically rich areas to realize an economic return from resources under their care. Monetary compensation could both validate their knowledge and provide them with an equitable reward for sharing it, thereby compensating biological stewardship and encouraging conservation.

The new concept of embodied cognition theories has been enthusiastically studied by the cognitive sciences, by as well as such disparate disciplines as philosophy, anthropology, neuroscience, and robotics. Embodiment theory provides the framework for ongoing discussions on the linkage between “low” cognitive processes as perception and “high” cognition as language processing and comprehension, respectively. This review gives an overview along the lines of argumentation in the ongoing debate on the embodiment of language and employs an ALE meta-analysis to illustrate and (...) weigh previous findings. The collected evidence on the somatotopic activation of motor areas, abstract and concrete word processing, as well as from reported patient and timing studies emphasizes the important role of sensorimotor areas in language processing and supports the hypothesis that the motor system is activated during language comprehension. BackgroundInstitutions of higher learning are persistently struggling with issues of academic dishonesty such as plagiarism, despite the availability of university policies and guidelines for upholding academic integrity.MethodologyThis was a descriptive qualitative study conducted on 37 students of a Healthcare Ethics course at an Australian tertiary institution from February 2016 to October 2018. The purpose of the study was to explore the reasons for plagiarism detected the TurnitinR plagiarism checking software and extensive review of manuscripts. The interviews were conducted in private (...) rooms and in strict confidence. Thematic analysis was manually done.ResultsFour major themes namely, lack of interest; pressure of time with competing priorities; lack of understanding of the policy on academic honesty, and “the determined students” were identified. Sub themes under lack of interest were lack of preparation and effort, low self-efficacy, poor studying techniques, and convenience of internet sources. Under pressure of time, the subthemes were, misplaced priorities, procrastination, high workloads, poor planning, competing interests, and the perception of availability of time at the start of the semester. Regarding lack of understanding of the policy on academic honesty, the subthemes identified were, lake of awareness of plagiarism, lack of awareness of acceptable similarity, conflicting messages from tutors and confusion with high school learning. The determined students were those that either made all effort to reduce plagiarism but still remained high, used the another language at home other than English, had poor paraphrasing techniques or lacked resources for English language editing.ConclusionThere are varied and diverse reasons for plagiarism. There is a need to systematically reinforce and educate students on issues pertaining to academic dishonesty and their associated implications. (shrink)

This paper explores the consequences of transhumanism on free will based on the metaphysical aspect of the Botho perspective. Botho is an indigenous philosophy, prominent in Botswana, that expresses the essence of being a person. A human person from the Botho metaphysical point of view embodies material and immaterial aspects. This study seeks to answer the question: “Would certain transhuman changes to the material body affect the human person’s ability to judge and choose and hence the capacity for free will?” (...) According to the Botho perspective, determinism and free will would be compatible in unenhanced human beings. From this viewpoint, human beings are free insofar as they can act in accordance with reason, which is a determined process. This framework will be applied to hypothetically enhanced human beings and argue that transhumanism does not necessarily undermine free will. This study will also show that some forms of biotechnological enhancement could in fact improve free will, while other forms could limit free will without eliminating it. New knowledge will be gained by applying a prominent metaphysical orientation in the Botho worldview, particularly its discussion of determinism and free will, to the debate about enhancements. It will be demonstrated that most Africans, including Batswana, are soft determinists who embrace both determinism and free will so that they are not incompatible and can co-exist. (shrink)

Beauty is constantly lived and incorporated as a meaningful social category in Brazil and intersects with racialised and gendered ways of belonging to the Brazilian nation. In this article, I deploy ethnographic material to show how middle-class women self-identifying as black embody and experience beauty and how, through practices and discourses centred on physical appearance, they both reinforce and challenge broader social and racial inequalities in Brazil.

This paper reports on research that suggests a new view of assessment of the practicum in teacher education. By transcending the stereotypes of ?failing? student teachers who do not achieve traditional benchmarks, this new lens highlights the complexity, diversity and inequality of experiences through listening to the voices of the student teachers and their mentors. By valuing context and focusing on progress and development rather than absolute attainment, teacher educators are challenged to reflect on their own role as mentors and (...) educators through guiding principles of practicum learning. These guiding principles of practicum learning are the result of significant observation in the practicum classroom followed by critical analysis of data provided as narrative. In his essay, “Negative and Positive Positivism,” Jules L. Coleman extends in two important ways the Legal Positivism of H. L. A. Hart. First, he shows that the “separability thesis”—the claim that no necessary or constitutive relationship exists between law and morality—to which Positivists are wedded does not entail the view, attributed by Ronald Dworkin to Legal Positivists, that law consists in “hard facts.” Instead, the separability thesis requires only the possibility of deciding the truth of propositions of law. This (...) weaker requirement can be met by rules of recognition that are semantically adequate but that fail to set out tests by means of which the legal status of rules and norms may be verified. Second, Coleman argues that one can subscribe to the separability thesis and still maintain that judges may have a legal duty to couch decisions in moral terms whenever the “content or proper formulation of [a] rule of recognition” is in dispute. Federal funding for abortion was eliminated; no permanent offices that would have advocated for women’s issues were created; and bills supporting domestic violence shelters, support for “displaced homemakers,” and quotas for female-owned businesses were defeated or extremely diluted. In addition, no additional states ratified the Equal Rights Amendment (ERA) and several states rescinded earlier ratification votes. Some of these failures can be attributed to the general loss of feminist momentum and the emergence of a conservative backlash in the late 1970s. Anti-ERA organizing fueled the rise of a conservative “family values” movement that would shape social policies for more than a generation, and neoliberal economic conservatives were challenging the welfare-state programs that feminists sought to expand. But in Washington, there was an addition challenge —the unreliable support of Carter himself. Despite his promises, Carter felt that by appointing women he had met his commitment to feminists and did little to support feminist policy goals that went beyond eliminating discrimination. This paper makes an important contribution to the history of feminist action by looking in detail at the efforts of Jimmy Carter’s feminist appointees to influence policy. In particular, it discusses the actions of the most visible feminist in the White House, Margaret “Midge” Costanza. Carter named Costanza director of the Office of Public Liaison, a department that was created to manage relations between the White House and citizens’ groups. Her position as the first woman to serve as Assistant to the President, in concert with her gregarious nature and strong support for women’s issues, made Costanza a very visible symbol of affirmative action for Carter. Yet Costanza, like many other high-level feminist appointees, met opposition within the White House when she tried to advance women’s issues. Her persistent advocacy contributed to her marginalization within the White House. Groups behave in a variety of ways. To show that this behavior amounts to action, it would be best to fit it into a general account of action. However, nearly every account from the philosophy of action requires the agent to have mental states such as beliefs, desires, and intentions. Unfortunately, theorists are divided over whether groups can instantiate these states—typically depending on whether or not they are willing to accept functionalism about the mind. But we can avoid this debate. (...) I show how a more general view of action captures what is central to action without mentioning mental states, and I argue that a group’s members can fulfill the role in group action that mental states play in our actions. Group behavior is explicable in terms of reasons, regardless of whether the group itself cognizes those reasons. After discussing the kind of reasons at issue and arguing that groups can act in light of them without minds, I assess how this account bears on the question of group responsibility. (shrink)

Most business ethicists maintain that corporate actors are subject to a variety of moral obligations. However, there is a persistent and underappreciated concern that the competitive pressures of the market somehow provide corporate actors with a far-reaching excuse from meeting these obligations. Here, we assess this concern. Blending resources from the history of philosophy and strategic management, we demonstrate the assumptions required for and limits of this excuse. Applying the idea of ‘the state of nature’ from Thomas Hobbes, we suggest (...) that corporate actors would be excused from duties if complying with them threatened their vital interests. We show how this excuse is not available for most individuals within firms; instead, it is an excuse perhaps available to firms themselves, but only given substantive assumptions about corporate personhood. For those willing to make these assumptions, we apply the competitive advantage construct to delimit the scope of this excuse. We suggest that firms are excused from fulfilling an obligation when complying leads to a competitive disadvantage, as this imperils the firm’s vital interests. After revealing why this excuse does not generalize, we conclude by considering when we should reform the market to avoid the legitimacy of this excuse. (shrink)

Beginning in 2002, Wells Fargo began opening fraudulent accounts for unsuspecting customers. Stakeholders at every level either participated in, ignored, or tolerated the bank’s behavior that defrauded consumers on a massive scale. These unethical and well-documented schemes spanned more than a decade. Using public sources, this case recounts the events and ethical lapses that unfolded over the multiyear investigation of the Wells Fargo fraudulent accounts scandal and illuminates the general systemic failures of corporate culture and governance, public regulation, and market (...) responses to promote ethical business practices. This case provides the opportunity to consider what means for fostering ethical conduct might exist if a corporation can be big enough and rich enough that civil, criminal, regulatory, and market forces cannot deter unethical corporate practices, and if the market does not punish the corporation for a culture that promotes fraud. Whereas many philosophers take backwards causation to be impossible, the few who maintain its possibility either take it to be absent from the actual world or else confined to theoretical physics. Here, however, I argue that backwards causation is not only actual, but common, though occurring in the context of our social institutions. After juxtaposing my cases with a few others in the literature and arguing that we should take seriously the reality of causal cases in these contexts, I consider (...) several objections. These objections involve whether the cases should be reinterpreted, whether they are properly within the institution, whether they involve necessitation or else Cambridge changes, whether and how they involve changing the past, and whether this should call us to question institutional reality. I end by suggesting that it is a virtue of our institutions that they allow backwards causation, that this is a kind of technology that they are often built to incorporate. (shrink)

Arguments by Sorkin (Impossible measurements on quantum fields. In: Directions in general relativity: proceedings of the 1993 International Symposium, Maryland, vol 2, pp 293–305, 1993) and Borsten et al. (Phys Rev D 104(2), 2021. https://doi.org/10.1103/PhysRevD.104.025012 ) establish that a natural extension of quantum measurement theory from non-relativistic quantum mechanics to relativistic quantum theory leads to the unacceptable consequence that expectation values in one region depend on which unitary operation is performed in a spacelike separated region. Sorkin [ 1 ] labels (...) such scenarios ‘impossible measurements’. We explicitly present these arguments as a no-go result with the logical form of a reductio argument and investigate the consequences for measurement in quantum field theory (QFT). Sorkin-type impossible measurement scenarios clearly illustrate the moral that Microcausality is not by itself sufficient to rule out superluminal signalling in relativistic quantum theories that use Lüders’ rule. We review three different approaches to formulating an account of measurement for QFT and analyze their responses to the ‘impossible measurements’ problem. Two of the approaches are: a measurement theory based on detector models proposed in Polo-Gómez et al. (Phys Rev D, 2022. https://doi.org/10.1103/physrevd.105.065003 ) and a measurement framework for algebraic QFT proposed in Fewster and Verch (Commun Math Phys 378(2):851–889, 2020). Of particular interest for foundations of QFT is that they share common features that may hold general morals about how to represent measurement in QFT. These morals are about the role that dynamics plays in eliminating ‘impossible measurements’, the abandonment of the operational interpretation of local algebras \({\mathcal {A}}(O)\) as representing possible operations carried out in region _O_, and the interpretation of state update rules. Finally, we examine the form that the ‘impossible measurements’ problem takes in histories-based approaches and we discuss the remaining challenges. (shrink)

This paper argues that Wittgenstein opposed theories of meaning, and did so for good reasons. Theories of meaning, in the sense discussed here, are attempts to explain what makes it the case that certain sounds, shapes, or movements are meaningful linguistic expressions. It is widely believed that Wittgenstein made fundamental contributions to this explanatory project. I argue, by contrast, that in both his early and later works, Wittgenstein endorsed a disjunctivist conception of language which rejects the assumption underlying the question (...) that such theories seek to answer—namely, the assumption that the notion of a meaningful linguistic expression admits of non-circular analysis. Moreover, I give two arguments in favor of the view I ascribe to Wittgenstein: one based on later Wittgenstein's discussion of meaning skepticism and one based on considerations concerning the identity of linguistic expressions. Respondeat superior is a legal doctrine conferring liability from one party onto another because the latter stands in some relationship of authority over the former. Though originally a doctrine of tort law, for the past century it has been used within the criminal law, especially to the end of securing criminal liability for corporations. Here, I argue that on at least one prominent conception of criminal responsibility, we are not justified in using this doctrine in this way. Firms are not (...) answerable for the crimes committed by their employees, because firms cannot answer as to why the crime was committed; they lack the authority to offer the employee’s reasons for action. Though this rules out respondeat superior as a general principle, I show contexts in which vicarious liability is still appropriate in the criminal law, and I respond to a number of other concerns raised by this picture. ObjectivesTo investigate the views of Human Research Ethics Committee (HREC) members and of researchers concerning the human research ethics review process in Australia.To examine whether there are differences between views of researchers and HREC members.Design and settingRegistrants at the NHMRC Ethics in Human Research Conference held in Canberra in May 2005 were surveyed by anonymous questionnaire comprising 14 questionnaire items and background demographic questions.ResultsOf the 407 registrants, 252 completed the questionnaire (62% response rate). Respondents comprised 219 (87%) HREC members or (...) administrators, and 33 (13%) researchers who were not HREC members. Researchers generally had a less positive attitude to the HREC process than did HREC members. Researchers were less likely to believe that HRECs: make clear and reasonable decisions in an acceptable timeframe; provide informal guidance to researchers; and have the necessary expertise to make appropriate decisions. The largest difference related to relations between researchers and HRECs: 82.5% of HREC members thought relations were good, but only 59.3% of researchers held this view. Despite these differences, both HREC members and researchers held the view that the ethics review process in Australia is working well.ConclusionAlthough our study suggests that both HREC members and researchers are satisfied with the process of human research ethics review in Australia, there are areas of concern that merit further investigation. These include the timeliness and clarity of HREC decisions, the methodological expertise available to HRECs and the basis for HREC decisions. (shrink)

Dissatisfied with the effects of schooling on children from low-income families, Doreen Grant left her post as head of a secondary school in Liverpool and turned to research for solutions to this perennial social problem. This is a popular account of her involvement with under-privileged Glaswegian parents and children, and her attempt to address the problem of underachievement from the perspective of the home rather than the educational establishment. Combining the theory of international scholars such as Brofenbrenner, Bruner, Donaldson (...) and Freire with practical experience, Doreen Grant indicates the improvements in children’s active learning when parents participate fully in the process of education. Learning Relations, first published in 1989,_ _describes the creation of a coherent learning environment in the inner city: as parents gain confidence in their personal vocation as natural educators, it becomes clear that they are not only willing but fully capable of improving their children’s chances of success. Most philosophical discussion of the particle concept that is afforded by quantum field theory has focused on free systems. This paper is devoted to a systematic investigation of whether the particle concept for free systems can be extended to interacting systems. The possible methods of accomplishing this are considered and all are found unsatisfactory. Therefore, an interacting system cannot be interpreted in terms of particles. As a consequence, quantum field theory does not support the inclusion of particles in our ontology. (...)
