In this paper I examine Nancey Murphy’s claim that human persons are distinct on account of the degree to which they exercise functional capacities. I contend that these capacities, which Murphy says are important to God, not only constitute human distinctiveness but also constitute the intrinsic moral value of humans. As such, her position implies that because human moral value is had by virtue of functional capacities and, because such capacities admit of degrees, human moral value admits of degrees. My dissertation asks how we affect conversational context and how it affects us when we participate in any conversation—including philosophical conversations. Chapter 1 argues that speakers make pragmatic presuppositions when they use proper names. I appeal to these presuppositions in giving a treatment of Frege’s puzzle that is consistent with the claim that coreferential proper names have the same semantic value. I outline an explanation of the way presupposition carrying expressions in general behave in belief ascriptions, and suggest that substitutivity (...) failure is a special case of this behavior. Chapter 2 develops a compositional probabilistic semantics for the language of subjective uncertainty, including epistemic adjectives scoped under quantifiers. I argue that we should distinguish sharply between the effects that epistemically hedged statements have on conversational context, and the effects that they have on belief states. I also suggest that epistemically hedged statements are a kind of doxastic advice, and explain how this hypothesis illuminates some otherwise puzzling phenomena. Chapter 3 argues that ordinary causal talk is deeply sensitive to conversational context. The principle that I formulate to characterize that context sensitivity explains at least some of the oddness of ‘systematic causal overdetermination,’ and explains why some putative overgenerated causes are never felicitously counted, in conversation, as causes. But the principle also makes metaphysical theorizing about causation rather indirectly constrained by ordinary language judgments. (shrink)

The CPT theorem states that any causal, Lorentz-invariant, thermodynamically well-behaved quantum field theory must also be invariant under a reflection symmetry that reverses the direction of time, flips spatial parity, and conjugates charge. Although its physical basis remains obscure, CPT symmetry appears to be necessary in order to unify quantum mechanics with relativity. This paper attempts to decipher the physical reasoning behind proofs of the CPT theorem in algebraic quantum field theory. Ultimately, CPT symmetry is linked to a systematic reversal (...) of the C*-algebraic Lie product that encodes the generating relationship between observables and symmetries. In any physically reasonable relativistic quantum field theory it is always possible to systematically reverse this generating relationship while preserving the dynamics, spectra, and localization properties of physical systems. Rather than the product of three separate reflections, CPT symmetry is revealed to be a single global reflection of the theory’s state space. (shrink)

One potentially ethically relevant feature of an utterance is that utterance's influence on the likelihoods that our future discourses wind up with one Stalnakerian ‘common ground’ or body of shared information rather than another. Such likelihoods matter ethically, so the ways our utterances influence them can matter ethically, despite the fact that such influences are often unintended, and often hard to see. By offering a relatively neutral descriptive framework that can enhance our collective sensitivity to and discussion of ethically, socially, (...) and politically important features of language use, this paper contributes to the ethics of language use. It discusses ways in which utterances can influence the likelihoods of future common grounds by deploying one system of categorization rather than another, and argues that language’s effects on the evolution of discourse can affect the paths to and probabilities of different sorts of consensus. The curriculum of medical education has paralleled and reflected this general Interest in medical ethics. Most medical schools now offer, and frequently require, course work in ethics. The Norman Rockwell image of the American physician who fixed the broken arm of a child, treated the father for hypertension, and brought an unborn child into this world is now almost nonexistent. Since the time of the Rockwell portrait, a highly technical medical industry has evolved. Now two-thirds of physicians are board certified in subspecialties, and patients visit an average of 3–4 different physicians per year. Today's physicians see themselves less as “benevolent and wise counselors overseeing the patient's welfare (...) and more as objective scientists applying the latest technical methods to bring about the desired end.” The intimate patient-physician relationship that was once the norm in our society is rapidly disappearing. This paper develops a compositional, type-driven constraint semantic theory for a fragment of the language of subjective uncertainty. In the particular application explored here, the interpretation function of constraint semantics yields not propositions but constraints on credal states as the semantic values of declarative sentences. Constraints are richer than propositions in that constraints can straightforwardly represent assessments of the probability that the world is one way rather than another. The richness of constraints helps us model communicative acts in essentially the (...) same way that we model agents’ credences. Moreover, supplementing familiar truth-conditional theories of epistemic modals with constraint semantics helps capture contrasts between strong necessity and possibility modals, on the one hand, and weak necessity modals, on the other. In some contexts, not saying S generates a conversational implicature: that the speaker didn’t have sufficient reason, all things considered, to say S. I call this an omissive implicature. Standard ways of thinking about conversational implicature make the importance and even the existence of omissive implicatures somewhat surprising. But I argue that there is no principled reason to deny that there are such implicatures, and that they help explain a range of important phenomena. This paper focuses on the roles omissive (...) implicatures play in Quantity implicatures—in particular, in solving the symmetry problem for scalar implicatures—and on the political and social importance of omissions where apologies, objections, or other communicative acts are expected or warranted. The most important distinction in value theory is the subjective-objective distinction which determines the epistemological status of value judgments about medical intervention. Ethical decisions in medical intervention presuppose one of three structures of justification — namely, an inductive approach, a deductive approach which can be either consequentialist or non-consequentialist, and a uniquely ethical approach. Inductivism and deductivism have been discussed extensively in the literature and are only briefly described here. The uniquely ethical approach which presupposes value objectivism is analyzed in (...) detail. This method involves a purely ethical inference which moves from facts to values directly with an emphasis on reason which involves a non-logical justification (as opposed to illogical). It involves the use of natural practical arguments which have an imperative conclusion but no imperative premise and exhibit a value-requiredness between two states of affairs. (shrink)

A study of physicians and medical students was conducted to determine the various philosophical positions they hold with respect to ethical decision-making in medicine and their epistemological presuppositions in relationship to the subjective-objective controversy in value theory. The study revealed that most physicians and medical students tend to be objectivists in value theory, i.e., believe that value judgements are knowledge claims capable of being true or false and are expressions of moral requirements and normative imperatives emanating from an external value (...) structure or moral order in the world, but that most physicians and medical students are inconsistent in the philosophical foundations of their medical ethical decision-making, i.e., in decision-making regarding values they tend to hold beliefs which are incompatible with other beliefs they hold about values. The study also revealed that most physicians and medical students think more emphasis should be placed upon medical ethics in medical education. (shrink)

This experimental study sets out to determine whether people detect click sounds in American English. Recent research has documented the use of non-phonemic clicks in a variety of languages to fulfill a range of functions such as sequence management or signaling searches and different types of attitudinal stance. While these clicks are acoustically salient and have been reported to occur with a frequency of up to 14 per minute in British English, they have not been widely investigated until relatively recently. (...) For this experiment, we designed video stimuli consisting of A and B pairs of approximately 10 seconds of speech, one with a click and the other with the click edited out. We gave 118 participants a questionnaire and asked if they could detect a difference between the pairs of videos. The results indicate that the majority of participants, between 79% and 86%, do not detect click sounds. (shrink)

This paper presents and discusses a range of counterexamples to the common view that quantifiers cannot take scope over epistemic modals. Some of the counterexamples raise problems for ‘force modifier’ theories of epistemic modals. Some of the counterexamples raise problems for Robert Stalnaker’s theory of counterfactuals, according to which a special kind of epistemic modal must be able to scope over a whole counterfactual. Finally, some of the counterexamples suggest that David Lewis must countenance ‘would’ counterfactuals in which a covert (...) ‘would’ scopes over the whole consequent of the counterfactual, including an overt ‘might.’. A major obstacle facing interpreters of quantum field theory is a proliferation of different theoretical frameworks. This article surveys three of the main available options—Lagrangian, Wightman, and algebraic QFT—and examines how they are related. Although each framework emphasizes different aspects of QFT, leading to distinct strengths and weaknesses, there is less tension between them than commonly assumed. Given the limitations of our current knowledge and the need for creative new ideas, I urge philosophers to explore puzzles, tools, and techniques from (...) all three approaches. (shrink)

The past two decades have been a time of heightened interest in the moral aspects of the practice of medicine. This interest has been reflected in medical education by the establishment of medical humanities programs in both preclinical and clinical education in many medical schools. It has also been reflected in the literature with a dramatic increase in journal articles on medical ethics as well as the development of medical ethics in textbooks. A number of journals have developed that are (...) specifically devoted to medical ethics, including The Journal of Medical Ethics, The Journal of Medicine and Philosophy, The Journal of Medical Humanities, Theoretical Medicine, Cambridge Quarterly of Healthcare Ethics, just to name a few. The literature includes both theoretical foundations and conceptual analyses of particular issues as well as practical advice and general suggestions for how to implement programs in medical humanities. This study investigates the three major educational philosophies behind the medical humanities programs in the United States. It summarizes the characteristics of the Cultural Transmission Approach, the Affective Developmental Approach, and the Cognitive Developmental Approach. A questionnaire was sent to 415 teachers of medical humanities asking for their perceptions of the amount of time and effort devoted by their programs to these three philosophical approaches. The 234 responses constituted a 54.6% return. The approximately 80:20 gender ratio of males to females (...) and other demographic data on age and educational background were consistent with other studies of the field of medical humanities.Reflections on the results in Table II indicate that some changes need to take place in the teaching of the medical humanities if the perceived ideal is to be achieved. In order for the current teachers of the medical humanities to think that the appropriate philosophies behind the teaching of the medical humanities are being implemented as they should be, much less time and effort need to be devoted to the Cultural Transmission Approach. With no other published reports on the educational philosophies behind the medical humanities programs, this study created a new knowledge base about this relatively young and rapidly emerging field. Following a brief consideration of two contrasting purposes for teaching the medical humanities, a description is given of a film discussion elective course. In contrast to the usual teaching of medical ethics which is primarily a cognitive activity emphasizing the development of a code of principles such as justice, autonomy, and beneficence, the film discussion elective was primarily an affective activity emphasizing the development of an ethical ideal of caring, relatedness, and sensitivity to others. The pass/fail elective, offered for one (...) credit each quarter for two quarters, met once a week for one hour for twenty-four weeks. Each week a film was shown followed by a group discussion. A wide variety of social issues were covered. The objective of the course was to increase the ethical sensitivity of the medical students through promotion of introspection and reflection on social issues. A brief discussion is given of the importance and appropriateness of using film to promote the affective focus of medicine on the relief of suffering. Examples are given of how the course achieved its objective. A detailed description of the resource materials is provided. (shrink)

Conventional wisdom has it that many intriguing features of indicative conditionals aren’t shared by subjunctive conditionals. Subjunctive morphology is common in discussions of wishes and wants, however, and conditionals are commonly used in such discussions as well. As a result such discussions are a good place to look for subjunctive conditionals that exhibit features usually associated with indicatives alone. Here I offer subjunctive versions of J. L. Austin’s ‘biscuit’ conditionals—e.g., “There are biscuits on the sideboard if you want them”—and subjunctive (...) versions of Allan Gibbard’s ‘stand-off’ or ‘Sly Pete’ conditionals, in which speakers with no relevant false beliefs can in the same context felicitously assert conditionals with the same antecedents and contradictory consequents. My cases undercut views according to which the indicative/subjunctive divide marks a great difference in the meaning of conditionals. They also make trouble for treatments of indicative conditionals that cannot readily be generalized to subjunctives. (shrink)

In recent years, the theoretical work of Gilligan in women's psychological development has led to the development of the concept of moral orientation or moral voice in contrast to the concept of moral reasoning or moral judgment developed by Kohlberg. These concepts have been of particular interest in gender studies, especially as applied to adolescence. These concepts of moral orientation and moral reasoning are being increasingly employed in healthcare ethics studies in a wide variety of settings. The recent work has (...) included studies of physicians, nurses, dentists, veterinarians, social workers, teachers of medical ethics, and hospital ethics committees. However, the study of moral development in healthcare providers has been hampered because collecting the necessary data from healthcare workers has been labor intensive and extremely time consuming. I argue that there are some causal relata for which it is indeterminate whether one caused the other. Positing indeterminacy in causation helps us defend contested principles in the logic of causation and makes possible new ways of thinking about the theoretical impact of symmetric causal overdetermination. I close by discussing amendments of current theories of causation that would help explain causal indeterminacy.

This essay contends that Marx sought to destroy privacy, analyzes his conception of it, and explains why he thought privacy impedes the full development of human beings. Central to his argument is a critique of constitutional states and modern liberalism, which, he maintains, by protecting and justifying individual rights, fail to recognize citizens as species beings.

Bertrand Russell boldly declared that all religions were “both untrue and harmful.” His concerns went beyond the historical inaccuracies of particular scriptures; he regarded even the fundamental beliefs, in God or eternal souls, as unfounded and implausible. And the church, he thought, had no final authority over morals, especially with its superstitious taboos. But apart from questioning its tenets, Russell wished to further expose religion as a dangerous social force – one that fostered anti‐intellectual thinking and discriminated against its dissenters. But beneath that scorn, oddly, he had an ardent admiration of religious feelings or sentiments – a seriousness about life and a concern for universal good. Relativistic quantum field theory (QFT) is ostensibly a quantum mechanical theory of fields, but determining exactly what these are is a thorny metaphysical task in the face of no-go arguments given by Baker (2009). This paper explores three possible answers according to which quantum fields are (I) superpositions of classical fields, (II) fields of expectation values for local observables, or (III) fields of local quantum states. I argue that each of these ontologies has resources available to respond to Baker’s challenge, (...) though all three face residual puzzles. (shrink)

In contrast to theoretical discussions about potential professional liability of clinical ethicists, this report gives the results of empirical data gathered in a national survey of clinical medical ethicists. The report assesses the types of activities of clinical ethicists, the extent and types of their professional liability coverage, and the influence that concerns about legal liability has on how they function as clinical ethicists. In addition demographic data on age, sex, educational background, etc. are reported. The results show that while (...) nearly one third (28.9%) of the ethicists regularly make recommendations about patient care, only 10.8% of them regularly make entries in the medical record; only approximately half (53.0%) of them are covered by professional liability (malpractice) insurance; and the vast majority (84.3%) of them say that concerns about legal liability do not influence the way they function as clinical ethicists. High moral standards and adherence to a moral code have long been strong tenets of the profession of medicine, even though there have been occasional lapses that have led to renewed calls for a revitalization of moral integrity in medicine. Certainly, a moral component has generally been held to be an important aspect of the concept of a physician.

While contractualism seems to solve some of the more pressing concerns of other moral theories, it does not conclusively address the moral status of non-human animals. Peter Carruthers claims that contractualism excludes animals from having full moral status. I argue that Carruthers’ arguments are fatally flawed due to his reliance on contradictory claims, unlikely assumptions, and flagrant violations of the contractualist method. However, Carruthers also claims that we can treat animals wrongly and that it deserves moral criticism. This claim is (...) based in indirect moral significance. However, this position makes it impossible for Carruthers to avoid endorsing two extremely counter-intuitive claims. The work of C. Tucker and C. MacDonald allows us to demonstrate that contractualism does give animals full moral standing. They ground the criteria for a contracting agent in three characteristics that animals possess. A look at some possible objections reveals nothing devastating to their proposal. (shrink)

The medical ethicist is a fairly recent addition to the clinical setting. The following four potential roles of the clinical ethicist are identified and discussed: consultant in difficult cases, educator of health care providers, counselor for health care providers and finally patient advocate to protect the interests of patients. While the various roles may sometimes overlap, the roles of educator and counselor are viewed as being more congruent with the education and training of medical ethicists than are the roles of (...) consultant and patient advocate.
