Background In earlier work, we found important selection biases when we tried to obtain consent for participation in a national stroke registry. Recognizing that not all registries will be exempt from requiring consent for participation, we examine here in greater depth the reasons for the poor accrual of patients from a systems perspective with a view to obtaining as representative sample as possible. Methods We determined the percent of eligible patients who were approached to participate and, among those approached, the (...) percent who actually consented to participate. In addition we examined the reasons why people were not approached or did not consent and the variation across sites in the percent of patients approached and consented. We also considered site variation in restrictions on the accrual and data collection process imposed by either the local research ethics board or the hospital. Results Seventy percent of stroke patients were approached, with wide variations in approach rates across sites (from: 41% to 86%), and considerable inter-site variation in hospital policies governing patient accrual. Chief reasons for not approaching were discharge or death before being approached for consent. Seventeen percent of those approached refused to participate (range: 5% to 75%). Finally, 11% of those approached did not participate due to language or communication difficulties. Conclusion We found wide variation in approach and agree rates across sites that were accounted for, in part, by different approaches to accrual and idiosyncratic policies of the hospitals. This wide variation in approach and agree rates raises important challenges for research ethics boards and data protection authorities in determining when to waive consent requirements, when to press for increased quality control, when to permit local adaptation of the consent process, and when to permit alternatives to individual express consent. We offer several suggestions for those registries that require consent for participation. (shrink)

When the late Heinz Kohut defined psychoanalysis as the science of empathy and introspection, he sparked a debate that has animated psychoanalytic discourse ever since. What is the relationship of empathy to psychoanalysis? Is it a constituent of analytical technique, an integral aspect of the therapeutic action of analysis, or simply a metaphor for a mode of observation better understood via ‘classical’ theory and terminology? The dialogue about empathy, which is really a dialogue about the nature of the analytic process, (...) continues in this two-volume set, originally published in 1984. In Volume I, several illuminating attempts to define empathy are followed by Kohut’s essay, ‘Introspection, Empathy, and the Semicircle of Mental Health.’ Kohut’s paper, in turn, ushers in a series of original contributions on ‘Empathy as a Perspective in Psychoanalysis.’ The volume ends with five papers which strive to demarcate an empathic approach to various areas of artistic endeavour, including the appreciation of visual art. Volume II continues the dialogue with a series of developmental studies which explore the role of empathy in early child care at the same time as they chart the emergence of the young child’s capacity to empathize. In the concluding section, ‘Empathy in Psychoanalytic Work,’ contributors and discussants return to the arena of technique. They not only theorize about empathy in relation to analytic understanding and communication, but address issues of nosology, considering how the empathic vantage point may be utilized in the treatment of patients with borderline and schizophrenic pathology. In their critical attention to the many dimensions of empathy – philosophical, developmental, therapeutic, artistic – the contributors collectively bear witness to the fact that Kohut has helped to shape new questions, but not set limits to the search for answers. The product of their efforts is an anatomical exploration of a topic whose relevance for psychoanalysis and psychotherapy is only beginning to be understood. (shrink)

We take ourselves to be able to omit to perform certain actions and to be at times responsible for these omissions. Moreover, omissions seem to have effects and to be manifestations of our agency. So, it is natural to think that omissions must be events. However, very few people writing on this topic have been willing to argue that omissions are events. Such a view is taken to face three significant challenges: (i) omissions are thought to be somehow problematically negative, (...) (ii) it is unclear where the event of an omission would be located, and (iii) if we accept any omissions as events, it seems like there would be far too much causation involving them. In this paper, I develop a novel view of omissions as events and as actions that provides answers to these challenges. (shrink)

The concepts of contradiction and dialogue are crucial to Hermann Goldschmidt’s Contradiction Set Free. In this paper, I place Goldschmidt into dialogue with two social thinkers for whom similar ideas were equally crucial: Georg Simmel and Donald Levine. In the case of Simmel, I highlight his theory of conflict specifically, but more generally his commitment to duality and ambiguity. In the case of Levine, I feature his attempt to articulate what he calls a “dialogic” narrative of the sociological tradition. (...) I seek to evaluate Goldschmidt’s own thinking by his own criteria, by asking whether the sociological and the philosophical approaches to these questions are parallel, in opposition, or an instance of a contradiction in Goldschmidt’s sense. This Commentary investigates ethical issues surrounding the US government’s attempt to partner with a private company to produce a new low-cost ventilator as part of its pandemic preparation plans. I argue that firms have distinct duties with respect to such public-private partnerships. In contrast to approaches that analyze these duties in terms of an “implicit morality” of the market, I analyze them in terms of democratically authorized plans regarding how to structure the market.

Research Ethics Boards (REBs) at universities are chaired and staffed by researchers who serve to enforce codes of ethics by scrutinizing research proposals. Yet there is widespread dissatisfaction with the REB approval process. This article examines the sources of that dissatisfaction, the place for codes of ethics in the conducting of research, the evidence for risk to research participants as the basis for those codes, and the effectiveness of REBs in protecting research participants. We offer suggestions for how REB chairs, (...) members, and researchers can improve the REB approval process so that it is fair and responsive. (shrink)

Faced with the liability of newness, a scarcity of resources, and concerns of survival, new firms frequently encounter difficult ethical decisions and might be pressured to make choices that run counter to the tenets of more developed ethical and moral reasoning. This study explores the impact of newness and entrepreneurial orientation on the ethical climate of firms. Data collected from 304 individuals across 37 firms indicated that firm newness was more strongly related to ethical climate than was an entrepreneurial orientation. (...) Results also revealed that firm newness may be usefully conceptualized in both continuous and categorical terms, with each operationalization holding a somewhat different relationship with climate. David Lewis has recently developed the notion of conversational scorekeeping as a way of explaining the acceptability of utterances in various contexts and the manner in which this acceptability changes in a rule-governed manner. I will expand Lewis's discussion by showing how the acceptibility of conditionals is linked to conversational score. In particular, I will argue that at least one controversial issue concerning the logic of conditionals, the interpretation and use of conditionals with disjunctive antecedents, may be resolved by applying (...) The sense of interconnectedness is perhaps one of the most celebrated features of African thought. It has been theorized under different philosophical idioms among African philosophers. It has appeared variously as African metaphysics, ontology, socialism and even religion—all in a bid to underline the basic idea that aspects of reality are inextricably interconnected and mutually impact one another in a seemingly universal web of interaction. While each of the idioms used to express this idea has some merits, the article privileges (...) the epistemic idiom. To support this move, I make two mutually reinforcing arguments. First, it is appropriate to describe the sense of interconnectedness in epistemic terms because it is primarily a mode of knowing/perceiving the world. Second, and more importantly, the epistemic idiom is useful for the formulation of emancipatory demands and formation of epistemic alliances against the subjugation of African and non-Western knowledges by mechanisms of coloniality. Adaptive mutation is defined as a process that, during nonlethal selections, produces mutations that relieve the selective pressure whether or not other, nonselected mutations are also produced. Examples of adaptive mutation or related phenomena have been reported in bacteria and yeast but not yet outside of microorganisms. A decade of research on adaptive mutation has revealed mechanisms that may increase mutation rates under adverse conditions. This article focuses on mechanisms that produce adaptive mutations in one strain of Escherichia coli, FC40. (...) These mechanisms include recombination-induced DNA replication, the placement of genes on a conjugal plasmid, and a transient mutator state. Gerald Dworkin has argued that it is inconsistent with the proper ends of medicine for a physician to participate in an execution by lethal injection. He does this by proposing a principle by which we are to judge whether an action is consistent with the proper ends of medicine. I argue: (a) that this principle, if valid, does not show that it is inconsistent with the proper ends of medicine for a physician to participate in an execution by lethal injection; (...) and (b) that this principle is not valid, and this is because it mistakenly views the promotion of patient autonomy as one of the proper ends of medicine. Rather, I propose, we should view respect for a patient's autonomy as a constraint on the pursuit of the proper ends of medicine, rather than as one of the proper ends itself. With this revised understanding of the proper ends of medicine, we can conclude that it is inconsistent with the proper ends of medicine for a physician to participate in an execution by lethal injection. I would like to focus on his analysis of the relationship between explanation and understanding, with the aim of reopening an issue which his treatment appears to have closed. In doing so, I hope to encourage further analysis of the problem of how we ‘understand’. My own discussion of this issue will be brief, moving only a little beyond (...) Pinkard's. Primarily. Three questions arise about academic freedom: (1) its purpose and goal, (2) its limits, and (3) its relationship to the Church. While there is sometimes tension between some people and the teaching office, fruitful doctrinal development usually takes place within the—sometimes heated—world of theological discussion. (...) This paper begins with a brief review of evidence for migration to the relatively affluent city of Rome during the earlier Empire. Then it is suggested that most slaves coming to Rome at this time originated in the Greek East and that these slaves were volunteers not forcible captives. Slavery by contract made it possible for individuals to overcome credit constraints limiting their ability to borrow to finance training and migration. This view is tested by examining literary, epigraphic and archaeological (...) evidence to decide whether slave markets in the Greek East (at Acmonia, Ephesus, Magnesia on Meander, Thyatira and Delos) and in Rome itself were suitable for processing „dangerous merchandise“ (= forcible captives). The totality of the evidence suggests they were not. Near Easterners conveyed through local and Roman slave markets were probably willing self-sellers seeking economic advancement. A new, positive, light is cast on the role of slave dealers who profited from reallocating labor power from less to more productive uses. (shrink)

The sociological literature on race operates under the progressive ideological assumption that systemic racism is the predominant cause of racial disparities. This assumption has become “paradigmatic,” shaping the selection of research questions and the interpretation of research results. Consequently, the literature offers a rather narrow “Overton window” concerning what we, as sociologists, know about: (1) the causes of racial disparities, (2) the accuracy and motivation behind the public’s views on race-related issues, and (3) race-related policy preferences. A paradigm shift is (...) needed to improve our understanding of racial disparities and devise more effective ways to address them. To achieve this end, sociologists should broaden their perspectives beyond attributing all racial disparities to systemic racism and consider additional hypotheses. From a policy perspective, to reduce racial disparities we should reconsider addressing social class and related factors early in life. (shrink)

Questions concerning the moral status of embryos, the validity of new technologies for human reproduction, ownership of one's own genes, gene patenting, privacy and discrimination have all been raised and debated. Although debate is healthy, it is only useful if all participants understand the fundamental biological principles underlying human life, human genes and human parenthood. Many people believe that science can play no role in determining when human life begins. I argue that this false assumption is based on a failure (...) to separate different contradictory meanings of the term ‘human life’. In actuality, science has provided great insight into when and how human life and human beings come into existence. I argue as well that, contrary to our intuitive feelings, there is no physical connection between any father and his son; shared genes represent shared information and nothing more. Nevertheless, the feeling of a physical connection between parent and child is very real and instinctive, no matter how false it may be. These new understandings have profound ramifications for the way we treat issues surrounding human reproduction, including both abortion and assisted reproductive technologies. (shrink)

I would like to respond to each of the papers one at (...) a time from a Christian point of view by making certain comparisons with the connection between Christian ethics and ritual practice. Let me begin by raising a comparative five points concerning Stephanie Kaza's wonderful description [End Page 84] and insightful analysis of the function of ritual in nurturing authentic personhood in Zen.First, it seems that the practice of ritual in Zen demands a degree of self-sacrifice which in turn aids in the cultivation of the virtue of selflessness. For example, Kaza says that through the participation in ritual practice, "the student is freed from his or her own individual designs and preferences... not asking any questions but just trying to do it better and more fully each time." Or elsewhere Kaza concludes, "Zen ritual is a training ground for intensive practice in giving up the small ego-bound self." In a similar way for the Christian, the self-sacrifice demanded in ritual performance can be seen as nurturing selflessness in the context of community--as aiding one in giving up one's ego in order to participate more fully in the communal life of agape. But more than this, the value of selfless participation in the Christian community that is reinforced by the ritual is connected to a call for future action: It calls one to contribute selflessly together with others to building the reign of God. In Christianity, the performing of ritual with others sensitizes one to the fact that he or she is part of the church working for a collective love and unity that manifests in human community the very holiness of the unity and love of the Trinity. One is thus called within the sacred ritual environment to bring this love and unity into one's everyday environment through ethical behavior.Second, besides selflessness, another positive quality that is cultivated through ritual practice is mindful awareness. As Kaza states in regard to the meal ritual, this practice "cultivates mindful awareness... if one merges wholeheartedly with the process, the meal itself becomes a lesson in co-dependent arising." In other words, the ritual performance brings to mind an awareness of fundamental reality according to Buddhism, namely, dependent arising. Being aware of mutual interdependence brings a deeper sense of compassion for all beings, and a more focused inspiration to act morally on their behalf. So, too, in Christianity, ritual is seen to be a "social drama" that brings to awareness the reality of the mystical body of Christ, the church, being the social form of Jesus Christ in the world. Ritual, as a sacred and dramatic social manifestation of the church, brings this communal reality of Christ to the Christian's mindful awareness by breaking into the secular structures of ordinary consciousness. Furthermore, the ritual also guides, forms, inspires, strengthens, and encourages the participants to re-enter that ordinary life committed to living the values and ideals expressed in the ritual. The formative power of the ritual performance lies, in part, in the fact that ritual ties ideas, values, and ideals to sensual and emotional stimuli in a way that, in the words of Victor Turner, "connects the obligatory into the desirable" (The Forest of Symbols, 1967).Third, Kaza shows how ritual in Zen helps to convey the tradition and promote solidarity within the community.
