BackgroundThe biopharmaceutical industry operates at the intersection of life sciences, clinical research, clinical care, public health, and business, which presents distinct operational and ethical challenges. This setting merits focused bioethics consideration to complement legal compliance and business ethics efforts. However, bioethics as applied to a biopharmaceutical industry setting often is construed either too broadly or too narrowly with little examination of its proper scope.Main textAny institution with a scientific or healthcare mission should engage bioethics norms to navigate ethical issues that (...) arise from the conduct of biomedical research, delivery of clinical care, or implementation of public health programs. It is reasonable to assume that while bioethics norms must remain constant, their application will vary depending on the characteristics of a given setting. Context “specification” substantively refines ethics norms for a particular discipline or setting and is an expected, needed and progressive ethical activity. In order for this activity to be meaningful, the scope for bioethics application and the relevant contextual factors of the setting need to be delineated and appreciated. This paper defines biopharmaceutical bioethics as: the application of bioethics norms (concepts, principles, and rules) to the research, development, supply, commercialization, and clinical use of biopharmaceutical healthcare products. It provides commentary on this definition, and presents five contextual factors that need to be considered when applying bioethics norms to a biopharmaceutical industry setting: (1) dual missions; (2) timely and pragmatic guidance; (3) resource stewardship; (4) multiple stakeholders; and (5) operational complexity.ConclusionUnderstanding the scope of the biopharmaceutical enterprise and contextual factors of a biopharmaceutical industry setting is foundational for the application of bioethics norms. Establishing a common language and approach for biopharmaceutical bioethics will facilitate breadth and depth of discussion and subsequent implementation to benefit patients, the healthcare system and society. Relevant to philosophy, law, management, and artificial intelligence, these papers explore the applicability of nonmonotonic or defeasible logic to normative reasoning. The resulting systems purport to solve well-known deontic paradoxes and to provide a better treatment than classical deontic logic does of prima facie obligation, conditional obligation, and priorities of normative principles.

Teny Pinkard's discussion of explanation in science and history raises some issues important for social science generally, as well as for history. I would like to focus on his analysis of the relationship between explanation and understanding, with the aim of reopening an issue which his treatment appears to have closed. In doing so, I hope to encourage further analysis of the problem of how we ‘understand’. My own discussion of this issue will be brief, moving only a little beyond (...) Pinkard's. Primarily. This article contrasts a secular definition of “academic freedom” with a Catholic model, where freedom of discussion and investigation is one component of a wider process that leads to the Church’s judgment about a particular teaching. Three questions arise about academic freedom: (1) its purpose and goal, (2) its limits, and (3) its relationship to the Church. While there is sometimes tension between some people and the teaching office, fruitful doctrinal development usually takes place within the—sometimes heated—world of theological discussion. (...) Frank Tipler's The Physics of Immortality provides abundant cause for intellectual offense—including challenges to physics, to theology, and, seemingly, to common sense. Few philosophical conundrums remain unaddressed. Still, the book is stimulating and well presented.

This paper sets out to give sufficient detail to the notion of mental simulation to allow an appraisal of its contribution to ‘mindreading’ in the context of the ‘false-belief tasks’ used in developmental psychology. We first describe the reasoning strategy of ‘modified derivation’, which supports counterfactual reasoning. We then give an analysis of the logical structure of the standard false-belief tasks. We then show how modified derivation can be used in a hybrid strategy for mindreading in these tasks. We then (...) formulate the hypothesis that children become able (around the age of 4 years) to pass these tasks when they acquire the counterfactual reasoning ability required in this strategy. We find this to be consistent with various empirical findings. We then discuss the implications for the theory/simulation debate, meta-representation and pretence. (shrink)

This article explores the use of intoxicants by a community of Kulina Indians in western Brazil. I suggest that Kulina intoxication through alcohol, tobacco, and ayahuasca is best understood as a form of semiotic appropriation of the identity of cosmological “others,” including animal spirits, creator beings, other Indian groups, and Brazilians. I consider how embodying practices, such as song and physical movement, enhance the experience of being an “alter,” facilitated by the alterations in consciousness produced by intoxicants.

This article analogises political representation to legal interpretation. It then applies the analogy to the hitherto neglected question of what political representation means for deliberative constitutionalism. The upshot is a conception of deliberative constitutionalism that, while uncompromisingly grounded in the reasoned expression of the preferences of a polity's constituents through deliberative democratic institutional innovations, mandates representatives to translate those preferences into general and abstract constitutional law. I would like to respond to each of the papers one at (...) a time from a Christian point of view by making certain comparisons with the connection between Christian ethics and ritual practice. Let me begin by raising a comparative five points concerning Stephanie Kaza's wonderful description [End Page 84] and insightful analysis of the function of ritual in nurturing authentic personhood in Zen.First, it seems that the practice of ritual in Zen demands a degree of self-sacrifice which in turn aids in the cultivation of the virtue of selflessness. For example, Kaza says that through the participation in ritual practice, "the student is freed from his or her own individual designs and preferences... not asking any questions but just trying to do it better and more fully each time." Or elsewhere Kaza concludes, "Zen ritual is a training ground for intensive practice in giving up the small ego-bound self." In a similar way for the Christian, the self-sacrifice demanded in ritual performance can be seen as nurturing selflessness in the context of community--as aiding one in giving up one's ego in order to participate more fully in the communal life of agape. But more than this, the value of selfless participation in the Christian community that is reinforced by the ritual is connected to a call for future action: It calls one to contribute selflessly together with others to building the reign of God. In Christianity, the performing of ritual with others sensitizes one to the fact that he or she is part of the church working for a collective love and unity that manifests in human community the very holiness of the unity and love of the Trinity. One is thus called within the sacred ritual environment to bring this love and unity into one's everyday environment through ethical behavior.Second, besides selflessness, another positive quality that is cultivated through ritual practice is mindful awareness. As Kaza states in regard to the meal ritual, this practice "cultivates mindful awareness... if one merges wholeheartedly with the process, the meal itself becomes a lesson in co-dependent arising." In other words, the ritual performance brings to mind an awareness of fundamental reality according to Buddhism, namely, dependent arising. Being aware of mutual interdependence brings a deeper sense of compassion for all beings, and a more focused inspiration to act morally on their behalf. So, too, in Christianity, ritual is seen to be a "social drama" that brings to awareness the reality of the mystical body of Christ, the church, being the social form of Jesus Christ in the world. Ritual, as a sacred and dramatic social manifestation of the church, brings this communal reality of Christ to the Christian's mindful awareness by breaking into the secular structures of ordinary consciousness. Furthermore, the ritual also guides, forms, inspires, strengthens, and encourages the participants to re-enter that ordinary life committed to living the values and ideals expressed in the ritual. The formative power of the ritual performance lies, in part, in the fact that ritual ties ideas, values, and ideals to sensual and emotional stimuli in a way that, in the words of Victor Turner, "connects the obligatory into the desirable" (The Forest of Symbols, 1967).Third, Kaza shows how ritual in Zen helps to convey the tradition and promote solidarity within the community. At the end of that first dialogue, the participants expressed the desire to [End Page 187] meet again in a Christian monastery in order to contribute to the deepening of the modern encounter between Buddhism and Christianity.2. The agenda of the meeting included four major topics: Buddhist Enlightenment and Christian Revelation, Sacred Texts in the Buddhist and Christian Traditions, Meditation and Contemplation in Buddhism and Christianity, and Anatta/ Sunyata and Kenosis. The papers were presented on these four topics in a way that fostered the dialogue process itself. In this process, all participants shared and explored their views of the place of word and silence in their respective traditions leading to a greater sense of mutual understanding and appreciation. This meeting proceeded by each side expressing what its own traditions believe, teach, and celebrate. The following points indicate some of the areas that were explored in the dialogue.3. The authority of the early sacred Buddhist texts was decided during the six great Buddhist Councils called for at different periods of time by the Buddha’s disciples after passing into Parinirvana. Theravada Buddhism accepts only the teachings of the Buddha that were declared authoritative during these councils. This early canon includes the discourses of the Buddha (Sutta), the rules for the monastic order (Vinaya), and the higher philosophical teachings (Abhidhamma). While Mahayana Buddhism accepts this early canon, it also accepts and emphasizes other sacred texts, called Sutras, which they believe were also taught by the Buddha. Within Mahayana there arose another tradition called Vajrayana that accepts the canons of both Theravada and Mahayana and adds a new literature called the Tantras, which present Buddhist esoteric teachings. Common to these traditions are the precepts for living the teachings of the Buddha and the authoritative commentaries of the particular traditions. These sacred texts describe the path that leads to the liberation from suffering and the nature and qualities of that supreme condition.In the Catholic tradition of Christianity, it is the teaching authority of the Church that has faithfully received the revealed and inspired texts and has determined their canonicity. This is, of course, a philosophical question, but it is one that I hope to undercut in this paper, by directing attention away from it to what I think is the more basic question, what are the conditions of order, whether the latter be something that arises in a mind by reason of its habits of analysis and synthesis, or whether it be something inherent in nature and discovered directly? It is, however, necessary to assume that order can be recognized, (...) whatever its origin, and while there is much evidence to suggest that men can be made more sensitive to order through training, I think it must be admitted that even the untrained can recognize order in many situations. I shall therefore make use of the phrases "intuitive order," and "the intuitive recognition of order," to apply to those cases in which order is recognized without the presence in consciousness of explicit principles of order. In other words, I assume that order reveals itself. If it did not, it would be difficult to understand how principles of order ever came to be recognized, for it is only on analysis of a given order that they come to consciousness. (shrink)

In "Amazing Grace," the best-loved of all hymns, John Newton's allusions to the drama of his life tell the story of a youth who was a virtual slave in Sierra Leone before ironically becoming a slave trader himself. Liverpool, his home port, was the center of the most colossal, lucrative, and inhumane slave trade the world has ever known. A gradual spiritual awakening transformed Newton into an ardent evangelist and anti-slavery activist. Influenced by Methodists George Whitefield and John Wesley, Newton (...) became prominent among those favoring a Methodist-style revival in the Church of England. This movement stressed personal conversion, simple worship, emotional enthusiasm, and social justice. While pastoring a poor flock in Olney, he and poet William Cowper produced a hymnal containing such perennial favorites as "Glorious Things of Thee Are Spoken" and "God Moves in a Mysterious Way." Later, while serving a church in London, Newton raised British consciousness on the immorality of the slave trade. The account he gave to Parliament on the atrocities he had witnessed helped William Wilberforce obtain legislation to abolish the slave trade in England. Newton's life story convinced many who are "found" after being "lost" to sing Gospel hymns as they lobbied for civil rights legislation. His close involvement with both capitalism and evangelicalism, the main economic and religious forces of his era, provide a fascinating case study of the relationship of Christians to their social environment. In an afterword on Newtonian Christianity, Phipps explains Newton's critique of Karl Marx's thesis that religious ideals are always the effect of what produces the most profit. Phipps relies on accounts Newton gives in his ship journal, diary, letters, and sermons for this most readable scholarly narrative. (shrink)

The question of causality has haunted the history of Western metaphysics since the time of the Pre-Socratic philosophy. Hand-in-hand with attempts to address this question is the promise of unlocking larger and more complicated questions pertaining to human freedom. But what of novelty? In this brilliant extended essay Donald A. Crosby contends that, though novelty can't be comprehended without efficient causality, causality requires a concept of novelty; without it cause and effect relations are unintelligible and, indeed, impossible.

When citizens call the police to report a problem with another, they need to not only characterize the problematic action/event, but they must position themselves in relation to the complained-about person. This conversational work of positioning self, and describing the other's actions, is delicate business when the complained-about person is connected to the caller. Different constructions of the other and the problem affect whether callers get the help they are seeking. At the same time, alternate constructions offer different pictures of (...) the other's blameworthiness and self's contribution to the problem. In this study we analyze citizen calls to the police in which callers have a dilemma: they have a problem with another that they want remedied but the problem occurs in a situation where involving the police is regarded as unreasonable. Past research on calls to the police, and studies about how people position their own and others' actions in sensitive situations are described. Then the materials and interpretive method are explained. The heart of the article is a description of four relational positioning strategies. Strategies include: generic reference terms; `friend' to imply a non-sexual relationship; ex-prefaces; and agent-less problems. The conclusion considers where else the dilemma will be found and highlights distinctive features of the rhetorical discursive perspective developed in the article. (shrink)

U.S. corporations have long tried to enact a favorable business environment via political activities such as lobbying and campaign contributions. This particular strategy is receiving increased attention due to the recent Supreme Court decision, Citizens United v. Federal Election Commission, which establishes that corporations have the same rights with regard to political activities as individuals. In this work, we examine the nature of corporate political activity and the need for accountability; define transparency in the context of corporate political activity; and (...) examine the antecedents for corporate political disclosure. We then test our model on the S&P 100 using an index of corporate political disclosure that we developed. We find that opportunities to participate in political activities, dependence on government contracts and prior disclosure on other topics such as the environment lead to more disclosure. The intensity of the regulatory environment appears to have no influence. (shrink)
