This paper describes a tool for assisting lawyers and paralegal teams during document review in eDiscovery. The tool combines a machine learning technology (CategoriX) and advanced multi-touch interface capable of not only addressing the usual cost, time and accuracy issues in document review, but also of facilitating the work of the review teams by capitalizing on the intelligence of the reviewers and enabling collaborative work.

The contract review process can be a costly and time-consuming task for lawyers and clients alike, requiring significant effort to identify and evaluate the legal implications of individual clauses. To address this challenge, we propose the use of natural language processing techniques, specifically text classification based on deontic tags, to streamline the process. Our research question is whether natural language processing techniques, specifically dense vector embeddings, can help semi-automate the contract review process and reduce time and costs for (...) legal professionals reviewing deontic modalities in contracts. In this study, we create a domain-specific dataset and train both baseline and neural network models for contract sentence classification. This approach offers a more efficient and cost-effective solution for contract review, mimicking the work of a lawyer. Here, a team of translators who are all very well known for their expert work in the field provide a series of selections from seven philosophers, each of whom is associated with the Kyoto School approach to comparative philosophical analysis.The seven thinkers include: (1) Nishida Kitarō, the founder of the Kyoto School, which is based on a synthesis of Western thought, particularly German Idealism, and the Mahāyāna Buddhist philosophy of emptiness or universal nothingness (Nishida remains by far the most important representative of the school, and he has had numerous works translated into English, often by Dilworth and/or Viglielmo); (2) Tanabe Hajime, Nishida's first and foremost disciple, who approached the notion of absolute nothingness from the standpoint of Pure Land Buddhist other-power and repentance; (3) Kuki Shūzō, who was known for his travels to Europe and his work on aesthetics and contingency; (4) Watsuji Tetsurō, who pioneered the field of cultural anthropological history in Japan; (5) Miki Kiyoshi, who criticized Nishida in light of Pascal and Kierkegaard as well as Hegelian dialectics; (6) Tosaka Jun, a sharp Marxist critic of Nishida, who during the 1930s attacked the apparent accommodations of his colleagues with the Imperialist authorities; and (7) Nishitani Keiji, who developed the Zen perspective implicit in Nishida's philosophy by emphasizing the religious-conversion experience that emerges from a contemplative awareness of the universality of absolute nothingness.The translators provide a substantial introductory essay discussing the biographical and conceptual issues in the development of the life and thought of each philosopher. This section is very useful, and generally goes into more depth and detail than other materials available in English. The translations themselves, which cover a wide variety of styles and methods of argumentation, are clear and readable, though at times a bit imprecise and inconsistent. A main issue involved in evaluating the book has to do with the selection of thinkers and passages translated. Unfortunately, there are no philosophers represented here who are not in the circle of the Kyoto School. There is no question of the dominance of Nishida and his followers (and critics) in the realm of Japanese philosophy, but other voices reflecting the positions of Marxism, phenomenology, logic, structuralism, and postmodernism could have had some representation. One problem is that the reader is given very little indication of current trends (since the writings of Nishitani, the last philosopher [End Page 311] on this list, are already several decades old). And there is certainly nothing in this volume to point to future concerns and tendencies in Japanese philosophy.On the other hand, given the book's content, a positive feature is that the translators have fulfilled an important goal of choosing selections that have not previously appeared in English but which are nevertheless representative and crucial for understanding the overall significance of each thinker's approach. Therefore, Sourcebook for Modern Japanese Philosophy will serve as a beneficial supplement or complement to existing sources. The philosophers at the University of Padua during the late Middle Ages and Renaissance arc attracting much renewed interest. This study makes accessible again the logical philosophy of Girolamo Balduino, professor at Padua during the second quarter (...) of the sixteenth century. Like other thinkers of his period, 13alduino follows the logic of Aristotle, and looks for progress within the ancient and mediaeval tradition, not for radically new doctrines. He continues the traditional interpretation of Aristotle by Averroes, for whom logic is only an instrumental habitus, a tool or method of demonstration. About the final contribution of the school of Padua to the improvement of Aristotelian logic was the doctrine of regressive demonstration, where demonstration terminates in or discloses the definition. Zabarella's well-known teaching on this point seems to be derived entirely from Balduino. Contrary to the interpretation of Cassirer, followed by Randall, this regressive demonstration is not a universal method of inquiry and is not at all like, and not the historical source of, the new method of Galileo. Papuli's book is solidly based on the original Latin texts, in notes, which are of great value in view of the fact that Balduino's works have been out of print since 1573. Not all of Papuli's interpretations are beyond criticism (e.g., p. 296), but he has done a service in enabling us to reestablish contact with one of the last significant commentators on Aristotle's logic. Pp. 196+22 facsimile illustrations) Giulio Cesare Vanini (1585-1619) ranks with Giordano Bruno as a modern hero of freedom of philosophical expression. He was tortured and then burned at the stake in Toulouse at the age of thirty-four, because of the unorthodoxy of his views. For this reason, he has drawn more attention than is perhaps deserved on the basis of his rather mediocre writings, which are little more than a tissue of plagiarisms culled from Pomponazzi, Cardano, J. C. Scaliger, and others. In this volume, Emile Namer has collected the scattered documents dealing with Vanini's life and activities. This is a valuable service, for it should enable scholars to disentangle fact from fiction and reality from myth. There has been so much heated discussion regarding Vanini that it is now time that someone should attempt to establish the precise facts and to reevaluate Vanini's place in intellectual history. In the past, writings about him have been governed more often by emotion than by reason. Namer prints documents from Naples, London, Paris, Simancas, and Toulouse. Some of these have been printed before in various journal articles, but it is valuable to have them all together in a single volume. In addition, he prints relevant excerpts concerning--as one of them put it--le douzi~me apostre de Satan, including material from Mersenne, Garasse, and others. He also includes a series of facsimiles of sample pages from the documents which he prints. All in all Namer's work is competently 250 HISTORY OF PHILOSOPHY done, though perhaps a bit more annotation to put the documents in historical perspective would have been desirable. In any case this little volume must be one of the bases for any future serious biographical or interpretative studies dealing with Vanini. Moreover, it shouM also be useful for scholars dealing with more general questions of seventeenth-century intellectual, religious, and social history. Unfortunately, there is no index, nor bibliography of earlier literature on Vanini, and the Introduction is perhaps too brief to orient the reader who has little previous knowledge of Vanini. Cloth, $134.95.This volume includes nearly everything contained in Cambridge Letters (Blackwell, 1995), supplemented by Wittgenstein’s exchanges with Sraffa (not available in 1995), by correspondence with many of his students, and by various documents pertaining to his status in the University and to the (...) Moral Sciences meetings. Throughout, there are notes by McGuinness that provide details about persons, places, and events mentioned in the texts. Altogether, the volume offers rich rewards for both students of Wittgenstein and those interested in the interplay of the times.Wittgenstein was Austrian to the core, as is evident in his admiration for such distinctly Viennese cultural icons as Nestroy, Grillparzer, Labor, Weininger, and Kraus—none of whom was familiar in the circles within which he moved in Cambridge. In his introduction, however, McGuinness makes clear that Cambridge, not Vienna, was the place where Wittgenstein could work. There were no roots in Cambridge, compared to those in Vienna, but growth, it seems, had to take place away from the roots. During his first stay in Cambridge (1912–14) Wittgenstein established connections with the giants of the time: Russell, Moore, and Keynes, all of whom had been active members of the Apostles, and who therefore put him in touch with the Bloomsbury-flavored younger elite of the University. Although none of these relationships was smooth, they all served in 1929 to ease Wittgenstein’s re-entry into Cambridge.Once back at Cambridge, and back at work in philosophy, Wittgenstein established his own circle, composed of younger scholars who attended his lectures. The only contact from the early period with whom he remained close through the 1930s and ’40s was Moore, although neither Russell nor Keynes disappeared entirely. Moore attended Wittgenstein’s lectures in 1930–33, and the two met regularly whenever Wittgenstein was in Cambridge. Among his peers, the big addition was Piero Sraffa, the Italian economist who was, as McGuinness puts it, first a protegé and then a successor of Keynes. It is difficult to reconstruct the content of the conversations between these two powerful intellects, but the letters and notes included here make it plain that the conversations were intense and had continuing themes. The Sraffa documents have been available elsewhere, but the chronological order of the documents in this volume means that we can now see them in the wider context of Wittgenstein’s ongoing activity.Wittgenstein and Sraffa were both equals and opposites—equal in genius, in honesty, in forthrightness, in stubbornness, and in commitment to dialogue, but opposite in opinions and convictions. Time and again, the letters and notes show evidence of tough, wrenching discussions, at times suspended because of exhaustion and weariness. Wittgenstein lists Sraffa last (chronologically, we presume) of ten people who influenced his thought. The letters and notes in this volume confirm a powerful influence, but offer scant clues as to the direction of the influence in Wittgenstein’s later thought.One of the younger scholars was the physicist W. H. Watson, who became Distinguished Professor at Queen’s University in Kingston, Ontario. His On Understanding Physics is, [End Page 115] McGuinness reports, a reliable guide of Wittgenstein’s thinking on these matters. In their correspondence we find many instances of what they both regarded as nonsense penned by the great scientists of the day (Jeans, Eddington, and Einstein). The nonsense appears to have presented grand pronouncements in everyday language, concerning mundane rather than distinctively philosophical matters. By providing new insight into how Wittgenstein relished nonsensical items, the correspondence with Watson helps us appreciate Wittgenstein’s nose for nonsense as part of his philosophical genius.For Wittgenstein, happiness depended on work. (Oxford Monographs on Classical Archaeology)Although long recognized as a distinct genre, the reliefs on documents have not been collected comprehensively and studied for their own sake. They are set above the texts (...) of honorary decrees, alliances and documents concerning [End Page 465] foreign affairs, decrees concerning cults, accounts and inventories, public dedications, and other inscriptions. Previous work on the subject (Binnebössel 1932; Meyer 1989) sought to relate the reliefs to other genres of art. Lawton notes that the document relief is “the only genre of Greek art that explicitly and consistently refers to contemporary events in the political sphere” (4). The style of the sculpture of the reliefs is shown to be conservative, “following rather than setting the sculptural trends of their own day” (73).The aim of illustrating documents with reliefs seems to be the desire to highlight certain relations to the text (deities as representative of cities; heroes, personifications of Demos, Boule, and Demokratia; individuals honored set amid the appropriate divinities, etc.). Expenses for inscribing were sometimes shared, as by cities of the empire or by individuals who received honorary decrees, but the cost of inscribing probably also included the reliefs (23–24). They would have been commissioned by authority of the secretaries of the assembly (or other political group such as deme or tribe) in consultation with sculptors and masons. Thus the relief contributes to the artistic display, just as certain features of the layout of the text on the stone (stoichedon style, intentional use of vacat, chequer pattern) serve to articulate the elements of the text and create an attractive monument. Lawton asserts that most of the document reliefs had a votive function, as they were set up in sanctuaries (29).Lawton presents a catalogue of 187 reliefs, arranged in two parts (dated and undated) and listed in chronological order within each part. Each item is accompanied by a lemma giving its most accessible publication, location, measurements, iconographical description, and bibliography. Thus 62 are classified as dated and 125 as undated. Although they range from the middle of the fifth to the second half of the second century B.C., the overwhelming preponderance fall in the fifth and fourth centuries. Statistics make the point effectively: fifth century, 28 total (12 dated, 16 undated); fourth century, 148 total (46 dated, 102 undated). Five are classified “late 5th-early 4th century,” bringing the grand total to 181. Of the dated group in the fourth century, only 9 can be put after 323 and only 4 after 318/17. One might justifiably conclude that the document relief is a phenomenon of the classical period, continued occasionally after it.Lawton offers excellent analyses, with concise discussion of relevant interpretations, in terms of type of inscription, iconography, style, and chronology. Where problems in interpretation still persist, she is careful to note the probabilities.Possibly the earliest surviving document with a relief is the Miletos decree (no. 63 = IG I3 21), which is put by Meritt and others about 450 because it uses the three-bar sigma, but in the 420s by H.B. Mattingly. Lawton summarizes fairly the arguments for both datings but does not insist on either. Rather, she notes the frequency of document reliefs from the 420s onward.IG I3 68 (no. 1), on the collection of tribute, is presented as the earliest securely dated inscription. Perhaps here the case is stated too positively, as the date 426/25 depends on the identification of the proposer Kleonymos with the man [End Page 466] who proposed a decree favoring Methone in the first prytany of that year (Meiggs and Lewis, no. 68, p. 188). Hence the date is probable, rather than certain. BackgroundScientific researchers are expected to follow the professional norms in their own domain. With a growing number of scientific publications retracted and research misconduct cases revealed in recent years, Chinese biomedical research integrity is questioned. As institutions educating and training future researchers, universities and the guidance they provide are important for the research quality and integrity of the country. Therefore, through a review of the guidance and policy documents on research integrity in Chinese universities, this work aims to investigate (...) how the professional norms are specified in these documents.MethodsAfter a stratified sampling, 53 universities were selected. Their guidance and policy documents on research integrity were collected via a web search of their official websites. The search was confirmed by these universities. Then the content of all the collected documents were analyzed using inductive content analysis.Results118 active university documents were collected and analyzed. Most of the Chinese universities we investigated had their own guidance or policy on research integrity. They listed principles or examples of desired and undesired academic practices, investigation procedures and punishments of academic misconduct, and put forward measures to promote research integrity. Differences on specific practices and principles were observed between university groups and with European university documents.ConclusionDespite the discrepancy they have, all these documents were designed to promote research integrity and cultivate a good research environment in Chinese biomedical domain. Researchers seeking to engage in projects related to Tribal communities and their citizens, lands, and non-human relatives are responsible for understanding and abiding by each Tribal nation’s research laws and review processes. Few studies, however, have described the many diverse forms of Tribal research review systems across the United States (US). This study provides one of the most comprehensive examinations of research review processes administered by Tribal Research Review Boards (TRRBs) in the US. Through a systematic (...) analysis, we consider TRRBs’ online presence, online documentation, and themes across documents, for five entity types: Tribal nations and Tribal consortiums, Tribal colleges and universities, Tribal health organizations, Indian Health Services, and other Tribal organizations. Results include an assessment of online presence for 98 potential TRRBs, identification of 118 publicly available online documents, and analysis of 41 themes across four document types: Tribal research codes and TRRBs’ guidelines, applications, and post-approval documents. Altogether, this research provides a macro-level analysis of the most common types of TRRBs in the US in an effort to increase researchers’ understanding of these important processes as they prepare to ethically engage Tribal communities in research. These results aim to empower Tribal decision makers as they align their TRRBs’ online visibility and documentation with community priorities and strengthen their protections for the rights and wellbeing of their citizens and community. Ultimately, by expanding our knowledge of TRRBs across the US, this contribution seeks to uphold Tribal sovereignty in research and promote ethical approaches to research with Indigenous communities. BackgroundDelirium is highly prevalent in the general hospital patient population, characterized by acute onset, fluctuating levels of consciousness, and global impairment of cognitive functioning. Mental capacity, its assessment and subsequent consent are therefore prominent within this cohort, yet under-explored.AimThis study of patients with delirium sought to determine the processes by which consent to medical treatment was attempted, how capacity was assessed, and any subsequent actions thereafter.MethodA retrospective documentation review of patients identified as having a delirium for the twelve months (...) February 2013 to January 2014 was undertaken. Inclusion and exclusion criteria were used; demographic and descriptive data collected. A total of n=1153 patients were identified with n=310 meeting inclusion criteria.ResultA random sample of one hundred patients were subsequently reviewed. One third of patients had documentation relating to consent, while four patients had documentation relating to capacity. Median delirium duration was three days, with treatment refusal occurring in twenty-two patients and “duty of care” being used as an apparent beneficent related treatment framework in twelve patients.ConclusionsWhile impaired decision-making was indicated, the review was unable to indicate what patient characteristics flag the need for capacity assessment. Documentation relating to consent processes appeared deficient for this cohort. (shrink)

(American Classical Studies, 35)Maureen Cavanaugh states (vii) that she aims “first, to present a new text with detailed commentary of two Eleusinian account (...) inventories (IG I3 386– 87); and second, to offer a new date for the Eleusinian First-fruits decree (IG I3 78).” Having produced her text from examination of the stone in the Eleusis Museum at various times in 1978–80, she reviews the scholarship on the board of the Epistatai at Eleusis, from the creation of the board in 460 B.C. through the fourth century. The understanding of the working of this board of officials justifies her search, in part 1 of this book, for a date for the elusive First-fruits decree. She concludes that it was passed ca. 435 B.C.In part 2 she presents a thorough study of the opisthographic inventories of the Epistatai of 408/7 and 407/6 B.C. (fourteen fragments reconstructed as a single stele). The texts of IG I3 386–87 are presented conveniently on four foldout pages at the end of the book, preceded by photographs. Though small in scale, the photographs are clear and help the reader to appreciate the layout of the texts of both inscriptions in three columns beneath a heading which runs over the entire width of space used. Her text improves that of IG I3 386–87 (published 1981) in several individual readings (letters read as certain, which are dotted by C.; letters read as certain by C. which had been restored by earlier editors), but the basic character of the text and layout is not changed. The most significant difference between Cavanaugh’s text and that of IG I3 is her restoration [End Page 637] of nineteen lines at the end of the last column of no. 387, based on the appearance of these items in no. 386.A conclusion summarizes the activities of the overseers of the sanctuary in this year, near the end of the Peloponnesian War. Students of Athenian history will now use Cavanaugh’s text as the definitive document and will need to consider the implications of her proposed dating of the first-fruits decree. Set in the years leading up to the Peloponnesian War, it may be seen as a text of the period of Pericles’ leadership, seeking to bring honor to an Athenian sanctuary, rather than as a document of the late 420s, as, e.g., in Meiggs-Lewis no. 73. Previous research has explored the intensity of dance class, rehearsal and performance, and attempted to document the body’s physiological adaptation to these activities. Dance activity is frequently described as: complex, diverse, non-steady state, intermittent, of moderate to high intensity, and with notable differences between training and performance intensities and durations. Many limitations are noted in the methodologies of previous studies creating barriers to consensual conclusion. The present study therefore aims to examine the previous body of literature and in doing (...) so, seeks to highlight important methodological considerations for future research in this area to strengthen our knowledge base. Four recommendations are made for future research. Firstly, research should continue to be dance genre specific, with detailed accounts of technical and stylistic elements of the movement vocabulary examined given wherever possible. Secondly, a greater breadth of performance repertoire, within and between genres, needs to be closely examined. Thirdly, a greater focus on threshold measurements is recommended due to the documented complex interplay between aerobic and anaerobic energy systems. Lastly, it is important for research to begin to combine temporal data relating to work and rest periods with real-time measurement of metabolic data in work and rest, in order to be able to quantify demand more accurately. According to Gromova, their relationship became an impulse that had a key influence on the formation of Shestov as an existential thinker, whose philosophy is not based on speculative contemplation, but is inextricably linked with life experience. On the basis of Shestov’s letters addressed to Malahieva-Mirovich, recently found in the family archive of Shik-Shakhovskie, the author of the book reconstructs the autobiographical events of the philosopher’s life, when for him “the time is out of joint” and he experienced an ideological and psychological crisis that marked the beginning of a new stage in his work. Gromova shows how the events of his life are reflected in Shestov’s writings: in his writings, the philosopher seeks answers to the questions that his relationship with Varvara Malahieva-Mirovich poses to him. Gromova introduces into scientific circulation the previously unpublished correspondence between Shestov and Malahieva-Mirovich, letters from Malahieva-Mirovich to her friend Leonilla N. Tarasova, as well as the memoirs of Malahieva-Mirovich about the actress of the Moscow Art Theater Nadezhda S. Butova. The book contains unique information about Shestov’s circle in Russia (for example, about the decadent poetess Anastasia Mirovich), including the so-called “shestovites”, a.i. the poetess and writer Varvara G. Malahieva-Mirovich, philosopher, lawyer and publisher Semyon M. Lurie, actress Nadezhda S. Butova, who is trying to find a philosophical and religious “justification” for the actor’s craft. (shrink)

Background Nursing documentation as a pivotal part of nursing care has many implications for patient care in terms of safety and ethics. Objectives To explore factors influencing nursing documentation from nurses’ perspectives in the Iranian nursing context. Methods This qualitative study was carried out using a qualitative content analysis of data collected from 2018 to 2019 in two urban areas of Iran. Semi-structured interviews (n = 15), observations, and reviews of patients’ medical files were used for data collection. Ethical considerations (...) This study was conducted in accordance with the ethical principles of research and regulations in terms of confidentiality of data, anonymity, and provision of informed consent. Findings The main theme of this study was “unsafe documentation.” Two categories, “types of errors in reporting” and “reasons of errors in reporting,” and 12 subcategories were developed indicating factors influencing nursing documentation in the Iranian nursing context. Conclusion In general, individual, organizational, and national factors affected nursing documentation in Iran. In this respect, hiring more nurses, application of reforms in the healthcare management structure, devising appropriate regulations regarding division of labor, constant education of healthcare staff, establishment of clinical governance, improvement of interpersonal relationships, development of hardware and software techniques for documentation, and provision of support should be done to improve the quality of nursing documentation. The above-mentioned suggestions can help nurses with a safe, ethical, lawful, and reliable documentation in nursing practice. (shrink)

U.S. law imposes strict recording and reporting requirements on all entities that manufacture and distribute controlled substances. As a result, the prescription opioid crisis has unfolded in a data-saturated environment. This article asks why the systematic documentation of opioid transactions failed to prevent or mitigate the crisis. Drawing on a recently disclosed trove of 1.4 million internal records from Mallinckrodt Pharmaceuticals, a leading manufacturer of prescription opioids, we highlight a phenomenon we propose to call data diversion, whereby data ostensibly generated (...) or collected for the purpose of regulating the distribution of controlled substances were repurposed by the industry for the opposite aim of increasing sales at all costs. Systematic data diversion, we argue, contributed substantially to the scale of drug diversion seen with opioids and should become a focus of policy intervention. (shrink)

The article at hand presents the results of a literature review on the ethical issues related to scientific authorship. These issues are understood as questions and/or concerns about obligations, values or virtues in relation to reporting, authorship and publication of research results. For this purpose, the Web of Science core collection was searched for English resources published between 1945 and 2018, and a total of 324 items were analyzed. Based on the review of the documents, ten ethical themes (...) have been identified, some of which entail several ethical issues. Ranked on the basis of their frequency of occurrence these themes are: 1) attribution, 2) violations of the norms of authorship, 3) bias, 4) responsibility and accountability, 5) authorship order, 6) citations and referencing, 7) definition of authorship, 8) publication strategy, 9) originality, and 10) sanctions. In mapping these themes, the current article explores major ethical issue and provides a critical discussion about the application of codes of conduct, various understandings of culture, and contributing factors to unethical behavior. Implantable cardioverter defibrillators (ICDs) reduce mortality in selected patients at risk for life-threatening heart arrhythmias, and their use is increasingly common. However, these devices also confer risk for delivery of unexpected painful shocks during the dying process, thus reducing the quality of palliative care at the end of life. This scenario can be avoided by ICD deactivation in appropriate circumstances but patients will remain unaware of this option if not informed about it. It is not known how often end-of-life implications (...) are discussed with patients prior to ICD implantation, when focus is primarily on the short-term potential complications of the device placement procedure itself. We conducted a retrospective chart review to determine how often end-of-life implications were discussed with patients as part of the informed consent process. We evaluated consent forms and related other chart documentation for 91 patients (ranging from age 60 to 89 years) undergoing first-time ICD placement at a mid-western academic medical center from 2006-2008. Only one chart documented any discussion of end-of-life implications, in a case where the issue was raised by a patient who noted that quality of life was their main focus. Consent was provided by a health care surrogate in only four of the 91 cases. In conclusion, patients giving consent for ICD implantation may be uninformed about the device's potential future impact on end-of-life care, the dying process, and the option for device deactivation. Truly informed consent requires that both short- and long-term potential implications be reviewed with patients. (shrink)

Healthcare ethics consultants in the Veterans Health Administration (VHA) document consults in an enterprise-wide web-based database entitled IEWeb, serving as a system of record for healthcare ethics documentation at 1300 VA facilities. The need arose to evolve the database from an ethics process training resource into a more streamlined documentation repository that captures essential consult elements. A VHA National Center for Ethics in Health Care (NCEHC) Improvement Team convened for three tasks: (1) Specify and prioritize IEWeb changes (occurred via (...) six focus groups composed of “new user” and “super user” cohorts with analysis of existing documentation patterns); (2) Pilot the changes regionally (via regional communication, training, and reviews of pre-post use patterns); and (3) Measure the impact of national change implementation on user perspectives (via pre-and post-change implementation polls). Focus groups identified six implementable priority areas for ethics consult documentation improvement, including the development of a usable consult summary note for ready conversion from IEWeb fields into the electronic health record. Post-IEWeb updates showed an increased number of consults documented, a reduction in “time to consult documentation closure” by a mean of 4.5 days, and a clinically-meaningful improvement in the quality of documentation (78% of ethics questions scored “above-bar” on the validation tool pre- vs. 89% scored “above-bar” post-IEWeb changes, n = 140). According to national survey findings, the number of consultants documenting “all” consults in IEWeb increased, satisfaction increased, and perception of documentation difficulty decreased. IEWeb simplification enabled ethics consultants to re-focus their documentation completion efforts by decreasing perception of documentation burden while improving documentation frequency and quality in a clinically-meaningful way. This study set out to investigate intellectual domains as well as the use of measurement and validation methods in language assessment research and second language acquisition (SLA) published in English in peer-reviewed journals. Using Scopus, we created two datasets: (i) a dataset of core journals consisting of 1,561 articles published in four language assessment journals, and (ii) a dataset of general journals consisting of 3,175 articles on language assessment published in the top journals of SLA and applied linguistics. We applied (...) document co-citation analysis to detect thematically distinct research clusters. Next, we coded citing papers in each cluster based on an analytical framework for measurement and validation. We found that the focus of the core journals was more exclusively on reading and listening comprehension assessment (primary), facets of speaking and writing performance such as raters and validation (secondary), as well as feedback, corpus linguistics, and washback (tertiary). By contrast, the primary focus of assessment research in the general journals was on vocabulary, oral proficiency, essay writing, grammar, and reading. The secondary focus was on affective schemata, awareness, memory, language proficiency, explicit vs. implicit language knowledge, language or semantic awareness, and semantic complexity. With the exception of language proficiency, this second area of focus was absent in the core journals. It was further found that the majority of citing publications in the two datasets did not carry out inference-based validation on their instruments before using them. More research is needed to determine what motivates authors to select and investigate a topic, how thoroughly they cite past research, and what internal (within a field) and external (between fields) factors lead to the sustainability of a Research Topic in language assessment. He tried to account for how man arrived, but he did not succeed in that the way he succeeded in The Origin of Species, which attempted to cover many kinds of entities and their way of origin. In order to make (...) the transition to man, he had to say, well, look at the monkey facing the rising sun and he takes an attitude as if it were a prayer. That is jumping a big distance. He has not made and shown the jump. Of course, if he could show that one is continuous with the other then this would conflict with the claim of the Bible about Adam and Eve. The Origin of Species, of course, was directed at Aristotle who had a doctrine of fixed species. The very title of Darwin’s book was like a punch in the nose. (shrink)

In this case study, I address the procedural ethics of conversation analysis (CA) and the collection of naturally occurring mundane interactions. I draw from the challenges that emerged from the institutional ethics review of the HIV, health and interaction study (the H2I Study), a CA project that sought to identify the practices through which normative assumptions of HIV and other health conditions are produced in conversations. Consistent with CA’s preference for naturally occurring interactions, the H2I Study collected and analysed (...) everyday telephone calls involving people living with HIV. This article offers practical strategies CA researchers might use to navigate two ethical concerns raised about the collection of naturally occurring mundane interactions. The first questions the merits of collecting naturally occurring mundane interactions. For those unfamiliar with CA, the specific advantages of analysing naturally occurring mundane interactions may not be self-evident. This places an evidentiary burden on CA researchers to warrant the collection of this type of data. To address this concern, I suggest demonstrating in ethics applications the analytic value of CA using publicly available interactions. The second concern questions the use of verbal consent necessary for the collection of naturally occurring mundane interactions. Like most CA research, the H2I Study required flexible informed consent protocols appropriate for spontaneous and unpredictable interactions. Drawing from within and outside the CA literature, I offer three rationales for the use of verbal consent. This article is written as a practical resource for conversation analysts seeking approval from their research ethics board (REB) and for REBs who might be unfamiliar with CA research. This article contributes to a small but growing body of literature that documents not only the kinds of challenges CA researchers encounter from institutional ethics review, but the specific procedural ethics they may employ to secure ethics approval. A formal Ethics Consultation Service (ECS) can provide significant help to patients, families and hospital staff. As with any other form of clinical consultation, documentation of the process and the advice rendered is very important. Upon review of the published consult documentation practices of other ECSs, we judged that none of them were sufficiently detailed or structured to meet the needs and purposes of a clinical ethics consultation. Thus, we decided to share our method in order to advance the (...) practice of ethics consultation. Here, we describe a method of ECS documentation practice, including use of a formal consult report template, as well as a log for maintaining a chronological record of the consultations performed. These two documents facilitate order and organisation of the ECS. They also enable the ECS to keep an account of professional time and experience, enable quick consult trend assessments (by consult theme or ward, for example) and establish a potential registry of consults for future research study. This method of documentation, we believe, not only contributes significantly to the primary purpose of the consultation—namely, the evincing and sharing of ethical opinion about a case—but also enables consultants to improve their practice and to pursue research on clinical ethics consultation. Between 2013 and 2016, West Africa experienced the largest ever outbreak of Ebola Virus Disease. In the absence of registered treatments or vaccines to control this lethal disease, the World Health Organization coordinated and supported research to expedite identification of interventions that could control the outbreak and improve future control efforts. Consequently, the World Health Organization Research Ethics Review Committee was heavily involved in reviews and ethics discussions. It reviewed 24 new and 22 amended protocols for research studies including (...) interventional and observational studies. WHO-ERC provided the reviews within on average 6 working days. The WHO-ERC often could not provide immediate approval of protocols for reasons which were not Ebola Virus Disease specific but related to protocol inconsistencies, missing information and complex informed consents. WHO-ERC considerations on Ebola Virus Disease specific issues are presented. To accelerate study approval in future public health emergencies, we recommend: internally consistent and complete submissions with information documents in language participants are likely to understand, close collaboration between local and international researchers from research inception, generation of template agreements for data and sample sharing and use during the ongoing global consultations on bio-banks, formation of Joint Scientific Advisory and Data Safety Review Committees for all studies linked to a particular intervention or group of interventions, formation of a Joint Ethics Review Committee with representatives of the Ethics Committees of all institutions and countries involved to strengthen reviews through the different perspectives provided without the ‘opportunity costs’ for time to final approval of multiple, independent reviews, direct information exchange between the chairs of advisory, safety review and ethics committees, more Ethics Committee support for investigators than is standard and a global consultation on criteria for inclusion of pregnant women and children in interventional studies for conditions which put them at particularly high risk of mortality or other irreversible adverse outcomes under standard-of-care. In recent years, the study of women entrepreneurship has experienced great growth, gaining a broad consensus among academics and contributing above all to understanding all those factors that explain the difficulty of women in undertaking an entrepreneurial career. This document tries to contribute to the field of study, thanks to a systematic analysis through the publications present in the topic. For this purpose, 2,848 peer-reviewed articles were analyzed, published between 1950 and 2019, using the Scopus database (SCImago Research Group). (...) Through the use of a series of bibliometric indicators it was possible to define the current state of research on the international scene. The analysis revealed that it is a multidisciplinary field of study and that has started to expand further since 2006, culminating in 2019, which makes it become a current and valid object of study. The analysis of the clusters allowed to isolate 6 different lines of research in which emerged, on the one hand, the importance of entrepreneurial education, social entrepreneurship and the socio-cultural context of reference (e.g. culture, family and institutional support) as tools to overcome the gender gap, on the other, the importance that women entrepreneurship assumes in the economic growth of the country (especially in developing economies), promoting social inclusion and combating poverty and discrimination. The study presents an important contribution to reflect on current policies and to outline future lines of investigation. (shrink)
