With his contribution on "The Natural Law in the American Tradition," Judge Diarmuid O'Scannlain has begun the indispensable task of laying the groundwork for sound jurisprudential reasoning in the natural law tradition. It is on the basis of this groundwork that we can begin to appreciate what natural law reasoning might mean, and what it does not mean, for contemporary American legal thinking. More specifically, it is on the basis of this groundwork that one can begin to articulate (...) what might be called a "third way" of jurisprudential reasoning. This "third way" would steer clear of two opposed and equally problematic jurisprudential views; that is, it would steer clear of what we might call "standard legal positivism" (on the one hand), and (on the other hand) what Judge O'Scannlain calls the "aggressive" natural law jurisprudence of some contemporary theorists. _Rediscovering Aesthetics_ brings together prominent international voices from art history, philosophy, and artistic practice to discuss the current role of aesthetics within and across their disciplines. Following a period in which theories and histories of art, art criticism, and artistic practice seemed to focus exclusively on political, social, or empirical interpretations of art, aesthetics is being rediscovered both as a vital arena for discussion and a valid interpretive approach outside its traditional philosophical domain. This book discusses Thomistic commentary on the topics of physical premotion, grace, and the permission of sin, especially as these relate to the mysteries of predestination and reprobation. The author examines the fundamental tenets of the classical Thomistic account, and on this basis critiques the 20th century revisionist theories of Domingo Banez, Reginald Garrigou-Lagrange, Francisco Marin-Sola, Jacques Maritain, Bernard Lonergan, and Jean-Herve Nicolas. In conclusion, the implications of the traditional view are considered in light of the spiritual life.

Reconciling the many “faces” of Peirce – the Scientist, Philosopher, and Metaphysician - helps to make sense of the open-endedness and versatility of semiotics. Semiosis, for Peirce, knows no rigid hermeneutic or disciplinary bounds. It thus forces us to be open to interdisciplinary and holistic inquiries. The pragmatic maxim sets limits on metaphysical speculation, but it also legitimates the extension of the experimentalist method into cosmological, metaphysical, and even religious domains. Although Peirce's religious speculations are ultimately unsatisfactory, understanding why Peirce (...) expanded his thinking to such domains reveals the expansionist logic of Peircean semiotics beyond the mere idiosyncracies of the man. The triadic, dynamic logic of pragmatist inquiry seeks to expand to all social processes of fixing belief and forming habits, however quixotic; but it remains dubious whether such expansion can fully comport to the scientific, experimentalist method that Peirce preferred. Pessimists hold that human life is fundamentally a condition of suffering which cannot attain transcendent meaning. According to pessimistic nihilism, life’s lack of transcendent meaning gives us reason to regret our existence. Life-affirming nihilism insists that we can and should affirm life in the absence of transcendent meaning. Yet both of these strains struggle to articulate what practical reasons might compel us to regret or affirm our inability to transcend the immanent conditions of the human predicament in the first place. I suggest that we catch sight of these practical reasons when we shift our attention from the value of transcendent meaning to the desire for temporal transcendence expressed by strong attachments such aslove and devotion. In short, we want the things we love to last forever, and they can’t. This makes human life tragic, but it does not settle the question of what sort of meaning it might have or lack. (shrink)

O mirosozert︠s︡anii sovremennogo buddizma na Dalʹnem Vostoke -- Problemy buddiĭskoĭ filosofii (p. [43]-[210]).

In this paper I want to examine a claim made about the kind of immunity through misidentification relative to the first person (IEM) that attaches to action self-ascriptions. In particular, I want to consider whether we have reason to think a stronger kind of immunity attaches to action self-ascriptions, than attaches to self-ascriptions of bodily movement. I assume we have an awareness of our actions – agent’s awareness – and that agent’s awareness is not a form of perceptual bodily awareness. (...) The issue here is whether agents’ awareness grounds a kind of immunity to error that bodily awareness does not. However, perhaps more importantly, I want to argue that we only get a secure difference in immunity claims if have already decided whether a source of information is essentially first personal or not and made certain, not obviously warranted assumptions, about the transparency of content and about knowledge. If we hold that a subject’s knowledge of her actions is essentially first personal, in a way that a subject’s knowledge of her body through bodily awareness may not be, then we are better off arguing for that claim directly. I argue in §1 that there is a clear distinction between predicate negation and sentential negation and that sentential negation is a special case of predicate negation operating on the predicate ‘is true’. In §2 I reply to Richard’s objections to negative properties on the basis of the conception of properties as identity conditions presented in Chapter 12 of Logical Forms.

The World abounds with infinite crimes, technogenic accidents, acts of nature, etc. And very often, speaking about infringement of laws, use a word "anarchy". In consciousness of one people this concept associates with fear, personifies something mad, uncontrollable, and not giving in to the control. In consciousness ofothers - it means permissiveness, impunity for any acts and even crimes. The philosopher, in my opinion, is the avocate of a historical value and validity. And consequently it is necessary to observe these (...) principles in relation to any concept or the theory. The philosophical, political doctrine of anarchism sets as the purpose clearing of the person of pressure of any authorities and any forms of economic, political and spiritual authority. Aspiration to anarchy as thementality, meets already at cinics and in early christianity, and also in chiliastic sects of the Middle Ages. Occurrence of the philosophical theory of anarchism connect with names of German thinker Max Shtirner (Caspar Shmidt's pseudonym, 1806–1856), French philosopher Pierre-Joseph Prudon (1809 – 1865) and the largest theorists of this doctrine of Michail Bakunin and Peter Kropotkin. Humanistic value as a red string passes through all political doctrine of anarchism and, in my opinion, should be presented fairly in order to prevent substitution of concepts and with the purpose of observance of historical honesty. In this article, the author analyzes the concept of religious foundations of culture and power as a problem of Russian political consciousness. The paper reveals the patterns of interaction between the religious and political traditions of the Russian Empire in the early 20th century. The author provides Bargradsky project case as a unique example of such influence, identifying its mean in the later Russian Empire’s political history. Philosophical-political case that is analyzed in the article makes it possible to trace the (...) inner links between religious attitudes and political imagination of Russian monarchical circles and to identify the peculiarities of religious and political self-awareness of Russian power, its mechanisms for the selecting the ideas, symbols, images of the national political, religious and artistic culture in the last period of the Russian Empire. From our point of view, it would be most effective to combine the cultural-historical and the philosophical and historical approaches both in the reconstruction of Bargradsky project and in studies of Russian political culture. The article examines both the political conditions of activities and spiritual-cultural goals of Bargradsky Committee on Bargradsky project in Italian Bari as well as in Saint Petersburg in the 1910s. The author discusses the religious concept of Russian political culture, applying philosophical-historical method for the analyses Bargradsky Committee activity and its attempt to slow down the degradation of the Russian autocracy. The major emphasis is placed on the political and philosophical way of analysis as well as on the possibility of introducing the results of philosophical-historical research into current debates on the issue of alternatives to Russian history. The case of Kafka stands at the very centre of Adorno’s articulation of modernist mimesis. His main study of Kafka is the long and complex essay “Notes on Kafka” (1953), which he republished in the collection Prisms (1955). But numerous references to Kafka are found throughout his unfinished masterpiece, Aesthetic Theory (first published in 1970) and in the four part collection of essays, Notes to Literature.

Many egalitarians believe that there is a pro tanto reason to remedy inequalities of opportunity in access to higher education. This consensus, I argue, masks practical disagreement among egalitarians: in many real-world choice contexts, egalitarians will disagree about which policies are to be endorsed, both from the point of view of equality and all things considered. I focus my discussion on a real-world case (the ‘big squeeze’ – so-called because the children of welloff families ‘squeeze out’ the children of less (...) well-off families from access to highly selective US universities) that has recently been discussed by Amy Gutmann. I argue that while (a) the ‘big squeeze’ is condemned by the ideal of equal opportunity, nevertheless (b) different egalitarians will favor different policies in response to the ‘big squeeze’, and (c) one intuitive, and apparently egalitarian, response lacks support from most plausible egalitarian views. This case note discusses the case of Baczkowski v. Poland in the European Court of Human Rights. The Court ruled that, where an elected mayor makes comments disapproving of homosexuality, and officials subsequently ban a Gay Pride march, then courts may be able to infer that the ban was discriminatory under Article 14 ECHR.
