Until recently, few people would have doubted that the idea of distributive justice is old, indeed ancient. Several authors have now challenged this assumption. Most prominently, Samuel Fleischacker argued that distributive justice originates in the eighteenth century. If accurate, this would upset much of what we have taken for granted about an important part of the history of Western political thought. However, the thesis is manifestly flawed; and since it has already proven influential, it is important to set the record (...) straight. We will focus on the principle of extreme necessity, developed in twelfth- and thirteenth-century canon law, and subsequently adopted in civil law. Despite its immense importance for the history of political thought, the principle is barely known, and much less discussed. We briefly characterize the main tenets of the principle and show that it meets all the criteria to count as a principle of distributive justice. (shrink)

(Merging frameworks for interaction: DEL and ETL, 2007) provides a framework for generating the models of Epistemic Temporal Logic ( ETL : Fagin et al., Reasoning about knowledge, 1995; Parikh and Ramanujam, Journal of Logic, Language, and Information, 2003) from the models of Dynamic Epistemic Logic ( DEL : Baltag et al., in: Gilboa (ed.) Tark 1998, 1998; Gerbrandy, Bisimulations on Planet Kripke, 1999). We consider the logic TDEL on the merged semantic framework, and its extension (...) with the labeled past-operator “ P ϵ ” (“The event ϵ has happened before which. . .”). To axiomatize the extension, we introduce a method for transforming a given model into a normal form in a suitable sense. Historically, the Vienna Circle and the Dessau Bauhaus were related, with members of each group familiar with the ideas of the other. Peter Galison argues that their projects are related as well, through shared political views and methodological approach. The two main figures that connect the Vienna Circle to the Bauhaus—and the figures upon which Galison focuses—are Rudolf Carnap and Otto Neurath. Yet the connections that Galison develops do not properly capture the common themes between the Bauhaus and Neurath’s philosophical (...) projects. We demonstrate this by considering Neurath’s philosophical commitments. We suggest different connections between Neurath’s projects and the Bauhaus, connections that are both substantive and philosophically interesting. (shrink)

In a world of limited resources, competition between the young and old prompt difficult questions of justice. In countries with public pension and health care systems, or with aging populations, there is often a concern that members of different generations are not always treated fairly. Dennis McKerlie's monograph examines justice between age-groups with the ultimate goal of a new theory of justice that effectively grapples with those questions. In the realm of public policy and medical ethics this is an (...) important and timely topic, but surprisingly one that has received relatively little attention from moral philosophers. McKerlie develops a comprehensive view of fairness between age groups that applies the egalitarian values of equality, or priority for the badly off, to temporal parts of lives -- not just to complete lives. I describe how relativistic field theory generalizes the paradigm property of material systems, the possession of mass, to the requirement that they have a mass–energy–momentum density tensor T µ associated with them. I argue that T µ does not represent an intrinsic property of matter. For it will become evident that the definition of T µ depends on the metric field g µ in a variety of ways. Accordingly, since g µ represents the geometry of spacetime itself, the properties of (...) mass, stress, energy, and momentum should not be seen as intrinsic properties of matter, but as relational properties that material systems have only in virtue of their relation to spacetime structure. An ad hominem fallacy is committed when an individual employs an irrelevant personal attack against an opponent instead of addressing that opponent’s argument. Many discussions of such fallacies discuss judgments of relevance about such personal attacks, and consider how we might distinguish those that are relevant from those that are not. This paper will argue that the literature on bias and testimony can helpfully contribute to that analysis. This will highlight ways in which biases, particularly unconscious biases, can make ad (...) hominem fallacies seem effective, even when the irrelevance is recognized. (shrink)

In some sense, bioethics was built on conflicts. Abortion, physician‐assisted suicide, patients’ demand for autonomy all are staple and contentious issues. And the controversies continue to proliferate. What forum best serves such debates? A look at political theories of democracy can help answer that question. The most promising for bioethics debates are theories that ask citizens and officials to justify any demands for collective action by giving reasons that can be accepted by those who are bound by the action. In his general theory of relativity (GR) Einstein sought to generalize the special-relativistic equivalence of inertial frames to a principle according to which all frames of reference are equivalent. He claimed to have achieved this aim through the general covariance of the equations of GR. There is broad consensus among philosophers of relativity that Einstein was mistaken in this. That equations can be made to look the same in different frames certainly does not imply in general that such frames are (...) physically equivalent. We shall argue, however, that Einstein's position is tenable. The equivalence of arbitrary frames in GR should not be equated with relativity of arbitrary motion, though. There certainly are observable differences between reference frames in GR (differences in the way particles move and fields evolve). The core of our defense of Einstein's position will be to argue that such differences should be seen as fact-like rather than law-like in GR. By contrast, in classical mechanics and in special relativity (SR) the differences between inertial systems and accelerated systems have a law-like status. The fact-like character of the differences between frames in GR justifies regarding them as equivalent in the same sense as inertial frames in SR. (shrink)

Biomedical research on humans is an important part of medical progress. But, when lives are at risk, safety and ethical practices need to be the top priority. The need for the committees that regulate and oversee such research -- institutional review boards, or IRBs -- is growing. IRB members face difficult decisions every day. Evaluating the Science and Ethics of Research on Humans is a guide for new and veteran members of IRBs that will help them better understand the issues (...) involved and the tasks they will be required to perform. Existing ethical guidelines that aim to guide the development of mental health apps tend to overemphasize the role of Western conceptual frameworks. While such frameworks have proved to be a useful first step in introducing ethics to a previously unregulated industry, the rapid global uptake of mental health apps requires thinking more deeply about the diverse populations these apps seek to serve. One way to do this is to introduce more intercultural ethical perspectives into app design and the guidelines that (...) aim to encourage best practices. In addition to this, existing ethical guidelines can also benefit from the ethical scholarship from the feminist and disability traditions, both of which highlight specific ethical considerations for vulnerable users. Rethinking the ethical responsibilities of mental health app designers through the prisms of feminism, disability studies, and intercultural philosophy leads us to a more global and inclusive set of ethical considerations in app design. This white paper explores what existing guidelines for the regulation of mental health apps are missing. It also explores how these guidelines could be improved for users who inhabit an increasingly diverse and globalized world. (shrink)

Janice Moulton's “The Adversary Method: A Philosophical Paradigm” articulated several criticisms of the popular idea of philosophy as adversarial debate. Moulton criticizes it on epistemic grounds, arguing that philosophy's overreliance on adversarial debate is to the detriment of its goals. Some, notably Trudy Govier, have argued in favor of at least a minimal adversariality, governed by norms of respectful argumentation. This paper suggests that Govier's faith in these norms is misplaced, because it neglects the social circumstances of the arguers. While (...) some authors have argued that politeness and aggression apply differently to those of different genders, this paper extends that analysis to social identities other than gender. In fact, given certain assumptions about the philosophy of language, engagement in polite adversarial debate may not even be possible for people occupying certain social locations. (shrink)

Recent philosophy features remarkably little work on the nature of wisdom. The following is a bibliography of that work, or at least the important-seeming parts of it that I’ve managed to uncover. I’ve also included some work from the history of philosophy, and from a few neighboring fields. Suggested additions would be very appreciated.

Are new democracies with divided government and volatile parties politically ill fated? The literature suggests so, but cases of emergent democracies such as Taiwan and Brazil that face both conditions defy the prediction. This paper explains why: party volatility follows from pursuing distinct executive and legislature agendas under divided government; the political ambition that underlies these conditions sustains democratic and even political performance. We evaluate the argument through government spending in Taiwan. The results corroborate our expectations: they show more parties (...) composing the legislature as government spending favors an executive agenda and neglects a legislative welfare-spending agenda. The findings make three contributions to the literature: first, they reveal a political divide between executive and legislature rather than ideological parties to undercut concerns regarding performance. Second, they demonstrate that the strategic use of government spending to institutionalize party development along an executive agenda fuels party fragmentation. Third, they show that legislators split, switch, or create alternative routes to office in reaction to strategic spending to underscore that ambition underlies party volatility and divided government. While trying to avoid a singular point of view for this compilation, Patterson has carefully chosen articles which highlight common themes, problems, and questions.

The central task of this dissertation is to develop a new interpretation of Leibniz's famous claim that there are no purely extrinsic denominations . Though Leibniz regarded NPE as one of his most important doctrines, he nowhere offers an explicit statement as to what he meant by it. One interpretation of NPE, which enjoys a modest consensus among interpreters, is that all extrinsic denominations reduce to intrinsic denominations. According to the reductionist view, things only have intrinsic denominations as properties; extrinsic (...) denominations are not genuine properties of things. Critics of reductionism have argued that the textual case for it is inconclusive at best, and I share this assessment with them. However, in my opinion, a satisfactory non-reductionist understanding of NPE has not been offered. The goal of my dissertation is to provide such a non-reductionist account. I contend that NPE, far from being a claim of the reducibility of extrinsic denominations, is actually an assertion that extrinsic denominations are genuine properties of the things they denominate. ;To establish my reading of NPE, I examine a line of textual evidence to which interpreters have paid little attention: the way Leibniz argues for NPE. In some passages Leibniz derives NPE from his predicate-in-subject principle of truth. In others, he employs his doctrine of the interconnection of all things to reach NPE. Elsewhere, he bases NPE on the principle of the identity of indiscernibles. Though, as mentioned, Leibniz never explicitly defines NPE, he does have much to say by way of explicit definition of each of these three principles. A consideration of what version of NPE could plausibly be drawn from them is thus a revealing way to proceed. In the case of each argument, I show that my interpretation of NPE is the conclusion naturally suggested by the given principle, while the reductionist version of NPE forms only an awkward, textually implausible fit with it. The result of the examination is an original and serious critique of the reductionist reading of NPE, as well as the development of a far more plausible understanding of that claim. (shrink)

Timothy Williamson has a marvelously precise account of epistemic justification in terms of knowledge and probability. I argue that the account runs aground on certain cases involving the probability values 0 and 1.

The aim of Ethics and Self-Cultivation is to establish and explore a new 'cultivation of the self' strand within contemporary moral philosophy. Although the revival of virtue ethics has helped reintroduce the eudaimonic tradition into mainstream philosophical debates, it has by and large been a revival of Aristotelian ethics combined with a modern preoccupation with standards for the moral rightness of actions. The essays comprising this volume offer a fresh approach to the eudaimonic tradition: instead of conditions for rightness of (...) actions, it focuses on conceptions of human life that are best for the one living it. The first section of essays looks at the Hellenistic schools and the way they influenced modern thinkers like Spinoza, Kant, Nietzsche, Hadot, and Foucault in their thinking about self-cultivation. The second section offers contemporary perspectives on ethical self-cultivation by drawing on work in moral psychology, epistemology of self-knowledge, philosophy of mind, and meta-ethics. (shrink)

Continuing on the value of givenness, Dennis Vanden Auweele argues that a modern project for absolutized autonomy cannot do but dread silence, which signals a hiccup or momentary lapse in the project of logos. And yet, Vanden Auweele shows that silence can be a convalescence that renders human beings receptive to something in excess of finite determination, which can in turn inspire self-determination to new heights.

This study aimed at determining B.S. Biology students’ comprehension of the Bioethics principles and conviction schemas towards bioethical issues; as well as at identifying predictors for comprehension of bioethical principles and convictions and creating model constructs of predictors which are fit for the data. One-hundred sixteen Filipino Biology majors were pre and post-tested for comprehension of bioethics principles and convictions towards bioethical issues. Predictors for comprehension and convictions among personal and family background factors, global and primary personality factors, and mental (...) ability were identified through step-wise multiple regression. Constructed path models were tested for goodness of fit using Structural Equation Modeling. Results showed that case study discussion and the bioethics course had positive effects on comprehension of the bioethics principles and on convictions towards bioethical issues. Predictors for comprehension of Bioethics principles before intervention were verbal ability, warmth, and exposure to media. Sex and openness to change were predictors for pre-convictions. Post-conviction predictors were anxiety, self-control, extraversion, liveliness, and perfectionism. Four out of five model constructs were accepted based on model fit criteria. In conclusion, personal factors, i.e., sex and personality factors are contributors in bioethical convictions; not cognitive factors like mental ability or comprehension of Bioethics principles; implying that bioethical convictions are already pre-conceived and that empathy-based experiences may strengthen convictions towards bioethical issues. Arguments for the importance of neuroscience reach across many disciplines. Advocates of neuroscience have made wide-ranging claims for neuroscience in the realms of ethics, value, and law. In law, for example, many scholars have argued for an increased role for neuroscientific evidence in the assessment of criminal responsibility. In this article, we take up claims for the explanatory role of neuroscience in matters of morals and law. Drawing on our previous work together, we assess the cogency of neuroscientific explanations of (...) three issues that arise in these domains: rule-following, interpretation, and knowledge. We critique these explanations and in general challenge claims as to the efficacy of the neuroscientific accounts. (shrink)

The question What makes a promise binding? has received much attention both from philosophers and lawyers. One argument is that promises are binding because the act of making a promise creates expectations in the promisee, which expectations it would be morally wrong to disappoint. Another argument is grounded in the effects engendered by the making of a promise, specifically actions taken in reliance upon the promise. These two positions, the so-called expectation and reliance theories, have traditionally been thought to be (...) incommensurable. In a recent article, Promises and Practices, Thomas Scanlon advances a theory of promising developed out of both of these positions. This article argues that Scanlon 's argument fails because it cannot avoid the incommensurability of the expectation and reliance principles. (shrink)

In this paper, I reflect on the idea, hinted at by Kant in a footnote to §16 of the B- Deduction that is not often discussed (KrV B 134n.), that transcendental logic is the ground of logic as a whole. This has important repercussions for the way we should see the role of transcendental logic with respect to the question of truth as well as the nature and scope of transcendental logic in relation to cognition, and in relation to general (...) or formal logic as such. To illustrate one of the ways in which transcendental logic is fundamental to our way of thinking, I address an issue that is brought up by Kant’’s counterfactual claim at B 132 that if a representation is not accompanied by an ‘‘I’’ thought, it is ‘‘either impossible’’ or at least ‘‘nothing for me’’, suggesting to some recent commentators that by the former Kant means the impossibility of thinking contradictory thoughts. Unlike these commentators, I do not think Kant is saying here that we cannot think contradictory thoughts. To believe he is betrays a misunderstanding of the metaphysical nature of transcendental logic, or so I shall argue. It is because transcen- dental logic is a metaphysical logic that Kant can claim that transcendental logic grounds even the whole of logic, including the possibility of thinking contradictory thoughts. In this paper, I consider Ripstein and Dan-Cohen's critiques of the 'harm principle'. Ripstein and Dan-Cohen have asserted that the harm principle should be jettisoned, because it allegedly fails to provide a rationale for criminalising certain harmless wrongs that ought to be criminalised. They argue that Kant's second formulation of the categorical imperative and his concept of 'external freedom' are better equipped for ensuring that criminalisation decisions meet the requirements of fairness. Per contra, I assert that Kant's deontological theory is (...) about identifying morally wrongful and rightful conduct: it does not tell the legislature which of those wrongs justify a criminal law response in accordance with the requirements of fairness and justice. Some wrongdoers deserve censure and the stigma that results from criminalisation, but others do not. Kant's deontological theory does not limit the scope of the criminal law merely to those wrongs that deserve a criminal law response. Fair and principled criminalisation requires more than mere wrongdoing. I assert that it is only fair to criminalise wrongs when further normative reasons can be invoked to justify the use of the criminal law as a means for deterring the unwanted conduct. While 'harm to others' is not the only normative reason that can be used to demonstrate that it is fair to criminalise a given act, it is the justification that has the greatest reach. It would not be fair to criminalise mere wrongdoing (that is, every violation of freedom: trespass to goods etc. or every violation of the categorical imperative: every false promise etc.). Nor is it possible to distinguish one violation of freedom from the next, as freedom is not measurable. Thus, murder and trespass to goods would be equally wrong and equally criminalisable in Kant's scheme. A further problem with Dan-Cohen's use of the second formulation of Kant's categorical imperative is that it aims to be an inclusive criterion for identifying conduct that is prima facie criminalisable, but this inclusive approach does not explain the wrongfulness (or in Dan-Cohen's use of the categorical imperative the criminalisableness) of harming animals. In this paper, I demonstrate that the harm principle is able to meet the challenges raised by Ripstein and Dan-Cohen. I also demonstrate that it offers superior criteria for ensuring that criminalisation decisions are fair, just and principled than is offered by Kant's deontological theory. (shrink)

Ethnomethodology is in trouble, its conceptual apparatus prone to indifference or misunderstanding both from "conventional" sociologists and from its own practitioners. This article describes some of these loci of confusion and suggests that they have a common root in the relationship between ethnomethodology and conventional sociology. Ethnomethodologists' desire to find a principled theoretical framework for dealing with this relationship is shown to be the common basis for subsequent confusion, and some of the corollaries of their putative solution(s) are elaborated with (...) regard to their philosophical and programmatic implications. As a Mahāyāna response to Nietzsche's critique of Buddhism, this article will explore Tanabe Hajime's philosophy of metanoetics in a way that addresses the Nietzschean dilemmas. Within his critique of Nietzsche, Tanabe contends that Nietzsche only advances principles of absolute being that lead to an affirmation of life indicative of self-power and thus forecloses any sense of an absolute critique that could awaken a surrendering to Other-power. According to Tanabe, upon letting go of one's clinging to the logic of non-contradiction (...) expressed within self-power is an emerging unshakable faith to Other-power through which the negated self is transformed into an affirmation of life realized as "being as upāya " ( hōben sonzai 方便存在). The transformation of the heart that comes from Tanabe's philosophy of metanoetics therefore converts the hidden inclination to dominate oneself and the other in cycles of ressentiment into a world of love and compassion for the other. The "will-to-power" that lies at the basis of Nietzschean subjectivity is thereby amended by Tanabe's standpoint of metanoetics that is a "philosophy that is not a philosophy.". (shrink)
