The general mitigating and aggravating circumstances of criminal liability are elements attached to the crime that, when they occur, affect the punishment quantum. Cuban criminal legislation provides a catalog of such circumstances and some general conditions for their application. Such norms give judges broad discretion in assessing circumstances and adjusting punishment based on the intensity of those circumstances. In the interest of broad judicial discretion, the law does not establish specific ways for measuring circumstances’ intensity. This gives judges more freedom (...) and autonomy, but it also imposes on them more social responsibility and challenges them to manage the uncertainty and subjectivity inherent in this complex activity. This paper proposes a model to aid the linguistic assessment of circumstances’ intensity and to provide linguistic and numerical recommendations to determine an appropriate punishment interval. M-LAMAC determines the collective evaluation of circumstances of the same type, determines the prevalence of a type of circumstance by means of a compensation function, recommends the required modification in the input interval, and finally recommends a numerical interval adjusted to the judges’ initially expressed preferences. The model’s applicability is demonstrated by means of several experiments on a fictitious case of bank document forgery. (shrink)

The scientific novelty of the research consists in identifying and substantiating the interrelations in the process of social reproduction, which provides innovative educational and educational activities in a music college. As a result, the authors have developed a technology of social audit of the process of reproduction of the socio-cultural potential of youth in a music (...) college. The technologization of the process made it possible to develop a model for managing the reproductive processes of the socio-cultural potential of college youth based on the principles of a project-oriented approach. The purpose of the study is to reveal the genesis of the concept of digital reality and its connection with the millennial Pyphagorean tradition in European philosophy and culture, based on the logic and dialectic of the number as a metaphysical entity. The article implements an attempt to historically and philosophically consider the phenomenon of digital reality: the conclusions of modern researchers are confirmed about the key importance of this philosophical tradition as a special system of thought, which defined modern (...) ideological and scientific paradigms and contributed to the formation of the social model of post-industrial, information-digital society. Scientific novelty is to reveal a modern scientific understanding of the notion that numbers can materialize the world by reflecting reality and returning it to man through knowledge derived through the programming or construction of digital reality on the basis of symbolic-applied logic. As a result of the analysis of philosophical sources, it has been proved that information in our world can be considered as another kind of movement of matter, and the Internet is not only an "information technology" but a "social form", a "universal social space" that appeared not overnight – with the invention of "breakthrough" technology, but formed by centuries of cultivated scientific knowledge. According to Aristotelian essentialism, the nature of an organism is constituted of a particular goal-directed disposition to produce an organism typical of its kind. This paper argues—against the prevailing orthodoxy—that essentialism of this sort is indispensable to evolutionary biology. The most powerful anti-essentialist arguments purport to show that the natures of organisms play no explanatory role in modern synthesis biology. I argue that recent evolutionary developmental biology provides compelling evidence to the contrary. Developmental biology shows that one must appeal to (...) the capacities of organisms to explain what makes adaptive evolution adaptive. Moreover, the specific capacities in question are precisely those that, according to Aristotle, constitute the nature of an organism. The need to create art is found in every human society, manifest in many different ways across many different cultures. Is this universal need rooted in our evolutionary past? The Art Instinct reveals that it is, combining evolutionary psychology with aesthetics to shed new light on fascinating questions about the nature of art.

The Modern Synthesis has dominated biology for 80 years. It was formulated in 1942, a decade before the major achievements of molecular biology, including the Double Helix and the Central Dogma. When first formulated in the 1950s these discoveries and concepts seemed initially to completely justify the central genetic assumptions of the Modern Synthesis. The Double Helix provided the basis for highly accurate DNA replication, while the Central Dogma was viewed as supporting the Weismann Barrier, so excluding the inheritance of (...) acquired characteristics. This article examines the language of the Modern Synthesis and reveals that it is based on four important misinterpretations of what molecular biology had shown, so forming the basis of the four Illusions: 1. Natural Selection; 2. The Weismann Barrier; 3. The Rejection of Darwin’s Gemmules; 4. The Central Dogma. A multi-level organisation view of biology avoids these illusions through the principle of biological relativity. Molecular biology does not therefore confirm the assumptions of the Modern Synthesis. There are two general approaches to characterising biological functions. One originates with Cummins. According to this approach, the function of a part of a system is just its causal contribution to some specified activity of the system. Call this the ‘C-function’ concept. The other approach ties the function of a trait to some aspect of its evolutionary significance. Call this the ‘E-function’ concept. According to the latter view, a trait's function is determined by the forces of natural selection. The C-function (...) and E-function concepts are clearly quite different, but there is an important relation between them which heretofore has gone unnoticed. The purpose of this paper is to outline that relation.This is not the first paper to discuss the relation of C-function and E-function. Previous attempts all follow either one of two strategies. The first proposes that the two concepts are ‘unified.’ The other proposes that they are radically distinct and apply to wholly different fields within biology. (shrink)

Is an appropriate causal connection to the past experience it represents a necessary condition for a mental state to qualify as an episodic memory? For some years this issue has been the subject of an intense debate between the causalist theory of episodic memory (CTM) and the simulationist theory of episodic memory (STM). This paper aims at exploring the prospects for an embodied approach to episodic memory and assessing the potential case for causalism that could be founded on it. In (...) a critical section, it argues that the empirical data to which STM appeals are both incomplete and inconclusive, and on closer examination even provide support for a proceduralist version of CTM. In a constructive section, it elaborates on the notion of a necessary causal connection in terms of particular procedural patterns acquired at encoding and operative at retrieval, grounding this move on recent empirical data about eye movements in mnemonic mental imagery. In recent years, there has been an increasing interest among philosophers of memory in the questions of how to characterize and to account for the temporal phenomenology of episodic memory. One prominent suggestion has been that episodic memory involves a feeling of pastness, the elaboration of which has given rise to two main approaches. On the intentionalist approach, the feeling of pastness is explained in terms of what episodic memory represents. In particular, Fernández has argued that it can be explained (...) in terms of memory representing itself as being caused by a past perceptual experience. On the metacognitive approach, which we have recently developed in, the feeling of pastness results from the monitoring and interpretation of the processing features of episodic remembering. In this paper, we show that the metacognitive approach should be preferred over the intentionalist approach. We argue that intentionalism, and Fernández’ causal self-referential view in particular, ultimately fail as accounts of the feeling of pastness. The difficulties faced by intentionalism allows us to single out three constraints that any satisfactory account of the temporal phenomenology of episodic remembering needs to meet. We conclude by arguing that the metacognitive view satisfies those constraints in a neat way, and as such, that it should be preferred over intentionalism. (shrink)

According to a prominent view of evolutionary theory, natural selection and the processes of development compete for explanatory relevance. Natural selection theory explains the evolution of biological form insofar as it is adaptive. Development is relevant to the explanation of form only insofar as it constrains the adaptation-promoting effects of selection. I argue that this view of evolutionary theory is erroneous. I outline an alternative, according to which natural selection explains adaptive evolution by appeal to the statistical structure of populations, (...) and development explains the causes of adaptive evolution at the level of individuals. Only together can a statistical theory of selection and a mechanical theory of development explain why populations of organisms comprise individuals that are adapted to their conditions of existence. In Kant’s moral theory, we do not have duties to animals, though we have duties with regard to them. I reconstruct Kant’s arguments for several types of duties with regard to animals and show that Kant’s theory imposes far more robust requirements on our treatment of animals than one would expect. Kant’s duties regarding animals are perfect and imperfect; they are primarily but not exclusively duties to oneself; and they condemn not merely cruelty to animals for its own sake, but (...) also, such things as killing them for food when our health does not require it and ingratitude to service animals. Central to understanding these duties is appreciating Kant’s concern for our morally useful emotions, for it is primarily because of the effect that cruelty to animals has on our sympathetic emotions—which greatly help us treat other rational beings appropriately—that we have duties not to be cruel to animals. Yet cruelty and callousness toward animals are not problematic only because they may weaken some of our morally useful emotions. Cruelty and callousness toward animals are problematic also because they oppose our morally useful emotions; these emotions, as part of the perfection of our nature, should be honored, supported, and furthered, unless there are compelling reasons not to do so in particular cases. Cet article traite de la question méta-sémantique de ce qui permet au souvenir épisodique d’avoir le contenu sémantique qui est le sien. Il adopte une position singulariste quant au contenu du souvenir et critique la justification méta-sémantique relationnaliste de cette position. Selon celle-ci, le contenu du souvenir est singulier parce que le souvenir consiste en une relation d’accointance avec l’événement passé. L’article oppose un argument causal et un argument sémantique à cette analyse puis montre que les deux traits du souvenir (...) que l’idée d’accointance est censée expliquer – la phénoménologie et la singularité du souvenir – peuvent l’être au moyen de modèles singularistes non fondés sur l’accointance. Around sixty years ago, Martin and Deutscher (1966) published a paper about the conditions under which an occurring mental state qualifies as episodically remembering. Recent philosophy of memory has developed this ontological interrogation in depth. But while it has significantly contributed to the ontological characterisation of episodic memory, it has also left aside an important part of it. Our memories not only occur, they also reoccur: we re-remember. This raises the ontological issue of their identity over time, along with the (...) related issue of their individuation. In the present paper, I explore this as yet uncharted territory of the ontology of episodic memories. I show first that the notion of re-remembering refers to a genuine mnemic phenomenon, and as such requires a theoretical account. I then proceed to design candidate accounts of said phenomenon, two of which, I claim, are particularly promising. (shrink)

Paul Boghossian has pointed out a ’circularity problem’ for dispositionalist theories of meaning: as a result of the holistic character of belief fixation, one cannot identify someone’s meaning such and such with facts of the form S is disposed to utter P under conditions C, without C involving the semantic and intentional notions that such a theory was to explain. Alex Miller has recently suggested an ’ultra‐sophisticated dispositionalism’ (modelled on David Lewis’s well known version of functionlism) and has argued that (...) this version of dispositionalism escapes Boghossian’s ’circularity problem’. Miller argues, nonetheless, that another of Boghossian’s criticisms of dispositionalism, ’the infinity problem’ still applies to this ’ultra‐sophisticated dispositionalism’: C will still draw upon a potential infinity of mediating background clusters of belief. The present paper argues that the feature that ’the infinity problem’ presents as problematic is a feature of a host of familiar explanations. Our fundamental difficulty in this area is not our inability to understand how a more general model can be applied to a particular domain (the intentional understood as dispositional) but our failure to understand that general model itself (dispositional explanation). The paper explores certain phenomena which arise in stories, conversations, and human activity in general when the plans of two individuals are formed and carried out in an interactive situation. A notation system for representing interacting plans is introduced and applied in the analysis of a small portion of “Hansel and Gretel.” The analysis illustrates how a single actor plan can be modified by the needs of cooperative interaction with others and how cooperative interactive episodes can be transformed and used (...) deceptively by one party in achieving his or her own covert goals. David Pietraszewski's theory of social groups offers a developmentally plausible account of how we reason about group membership, as it delineates clear boundaries to the hypothesis space that children must navigate. Merits notwithstanding, the account remains silent with respect to the arbitration problem: It does not explain how children can appropriately select among competing frames when interpreting social interactions.

Christina Lafont has argued that the early Heidegger's reflections on truth and understanding are incompatible with ‘the supposition of a single objective world’. This paper presents her argument, reviews some responses that the existing Heidegger literature suggests, and offers what I argue is a superior response. Building on a deeper exploration of just what the above ‘supposition’ demands, I argue that a crucial assumption that Lafont and Haugeland both accept must be rejected, namely, that different ‘understandings of Being’ can be (...) viewed as offering ‘rival perspectives’ on a common subject-matter. I develop this case by drawing on an alternative account of what a Heideggerian ‘understanding of Being’ might be like. (shrink)

Plotinus : a detailed study of Plotinus' theories on matter and the soul , in relation to select passages from his treatise Against the Gnostics.

During the last thirty years, most linguists and philosophers have assumed that meaning can be represented symbolically and that the mental processing of language involves the manipulation of symbols. Scholars have assembled strong evidence that there must be linguistic representations at several abstract levels--phonological, syntactic, and semantic--and that those representations are related by a describable system of rules. Because meaning is so complex, linguists often posit an equally complex relationship between semantic and other levels of grammar. The Semantics of Syntax (...) is an elegant and powerful analysis of the relationship between syntax and semantics. Noting that meaning is underdetermined by form even in simple cases, Denis Bouchard argues that it is impossible to build knowledge of the world into grammar and still have a describable grammar. He thus proposes simple semantic representations and simple rules to relate linguistic levels. Focusing on a class of French verbs, Bouchard shows how multiple senses can be accounted for by the assumption of a single abstract core meaning along with background information about how objects behave in the world. He demonstrates that this move simplifies the syntax at no cost to the descriptive power of the semantics. In two important final chapters, he examines the consequences of his approach for standard syntactic theories. (shrink)

In affective neuroscience, constructivist models are acutely influenced by the modern technological evolution, which underwrites an ongoing epistemological substitution of techne for episteme. Evidenced symptomatically in the influence of artificial intelligence (AI), affective artefacts, these models inform an ontological incursion of techne seen to coincide with posthumanist aspirations and anthropology. It is from the perspective of this neuroscientific techne that posthumanism views the human being as increasingly ill adapted to the modern technological civilization, which, conversely, is understood to require a (...) technical governance of the sort envisioned through AI. Among the projects thought necessary for implementing this framework is a recasting of the human emotional spectrum. Revealed through its techne recasting, however, are explanatory commitments to a metaphysic of extrinsic and contiguous causes, where malleability is ontologically constitutive. Aligned with posthumanist assertions malleability is invoked to argue for a rapid advance of the human form, normatively driven by enlightenment ideals. The ontological claim, however, dispenses with the stability of an a priori, intersubjective and interrelational metaphysical form that undergirds the emotions, leading to the collapse of a definitional anthropos. This paper will argue that techne models of the emotions selectively endorse philosophy of science commitments, thereby introducing a normative inversion that deconstructs the notion of anthropology pursued in posthumanist aspirations. Wide content and individualist approaches to the individuation of thoughts appear to be incompatible; I think they are not. I propose a criterion for the classification of thoughts which captures both. Thoughts, I claim, should be individuated by their teleological functions. Where teleological function is construed in the standard way - according to the aetiological theory - individuating thoughts by their function cannot produce a classification which is both individualistic and consistent with the principle that sameness of wide content is (...) sufficient for sameness of psychological state. There is, however, an alternative approach to function, the relational theory, which is preferable on independent grounds. A taxonomy of thoughts based on these functions reconciles wide content with individualism. One consequence of individuating thoughts in this way is that intentional content is context sensitive. I discuss some of the implications of context sensitive content. (shrink)

In 1999, the Journal of Business Ethics published its 1 500th article. This article commemorates the journal's quest "to improve the human condition" (Michalos, 1988, p. 1) with a summary and assessment of the first eighteen volumes. The first part provides an overview of JBE, highlighting the journal's growth, types of methodologies published, and the breadth of the field. The second part provides a detailed account of the quantitative research findings. Major research topics include (1) prevalence of ethical behavior, (2) (...) ethical sensitivities, (3) ethics codes and programs, (4) corporate social performance and policies, (5) human resource practices and policies, and (6) professions – accounting, marketing/sales, and finance/strategy. Given a class $$\mathcal {C}$$ of models, a binary relation $$\mathcal {R}$$ between models, and a model-theoretic language L, we consider the modal logic and the modal algebra of the theory of $$\mathcal {C}$$ in L where the modal operator is interpreted via $$\mathcal {R}$$. We discuss how modal theories of $$\mathcal {C}$$ and $$\mathcal {R}$$ depend on the model-theoretic language, their Kripke completeness, and expressibility of the modality inside L. We calculate such theories for the submodel and the quotient (...) relations. We prove a downward Löwenheim–Skolem theorem for first-order language expanded with the modal operator for the extension relation between models. (shrink)

Les pages qui suivent sont consacrées à un certain problème qui est au fondement de l’éthique de Franz Brentano. Je tâcherai de clarifier et de problématiser l’idée brentanienne d’une analogie entre logique et éthique, entre correction logique et justice éthique, entre l’existant et le bien. Après en avoir dégager la signification générale, j’en indiquerai les conséquences les plus importantes sur l’éthique brentanienne dans son ensemble. Une première conséquence, que je commenterai en détail, est l’« objectivisme » éthique de Brentano, dont (...) je montrerai qu’il n’est pas forcément synonyme de réalisme. Ensuite, j’expliquerai en quels termes Brentano s’efforce de transposer analogiquement à l’éthique sa théorie de la vérité-correspondance, y compris sa reformulation en termes d’évidence. Enfin, je donnerai quelques brèves indications sur l’influence marquée qu’a eue l’éthique brentanienne sur Husserl, en me limitant à la question de l’analogie logico-éthique. (shrink)

The first part of this paper deals with the relations between mechanistic explanation and reduction. It is argued that there is no insuperable conflict between the two, but that the mechanistic framework adds requirements that are not acknowledged in the model of property reduction. The second part concerns the relations between organization and environmental factors. Internal organization may be so tightly linked to external context that both have to be considered together.

Le présent article expose les réponses qui sont actuellement apportées à ce débat central en philosophie de la mémoire. Il introduit d’abord les conditions définitionnelles avancées par la théorie causale standard, avant d’examiner les critiques qui ont été formulées à leur encontre. This paper is about the pragmatic inferences in play as conversational implicatures (Grice, P. 1989. Studies in the way of words. Cambridge, MA: Harvard University Press) occur. First, it constructs the deductivism versus abductivism debate that transpires from the extant literature but is rarely elaborated. Against deductivism, the paper argues that implicating inferences in conversational implicatures can instantiate an abductive logical form, as abductivism suggests. Against abductivism, however, it grants to deductivism that implicating inferences can have a deductive form provided (...) the latter is of a defeasible type. In sum, it thus argues for pluralist defeasibilism. Second, it turns to the issue of the ontological nature of implicating inferences and advocates normative inferentialism, on which these inferences are not primarily real psychological processes but rules of the practice of implicating. While this allows for the possibility of their psychological instantiation, to be sure, the paper also insists that psychological inferring processes in implicatures are neither necessarily isomorphic to the aforementioned rules nor even necessarily occur as an implicature occurs. En ingénierie des connaissances, c'est la spécification de la conceptualisation d'un domaine de savoir. Ce domaine concerne ici la modélisation à base d'agents (ABM) pour les sciences de l'homme et de la société (SHS) en vue de la simulation par systèmes multi-agents (SMA). La modélisation SMA en SHS propose la formalisation d'une pluralité de points de vue dans un (...) cadre général qui permet de comparer et de combiner différents angles de réflexion. Agrémenté d'exemples issus de trois domaines (la géographie, l'économie et la sociologie), cet ouvrage utilise des formalismes principalement basés sur UML. L'exercice de description d'une ontologie est présenté comme un dialogue conceptuel interdisciplinaire et l'ontologie comme le médiateur de ce dialogue. (shrink)
