Este artigo discute se o recurso ao povo ou ao legislador, como instrumento de resolução dos conflitos entre os poderes, viola a separação de poderes e a independência do poder judiciário ou se, antes disso, dá fiel execução à separação de poderes. Para alcançar esse objetivo, esse artigo investiga se existe relação entre o recurso ao legislador e os regimes autoritários; se a Constituição Federal de 1988 proíbe outro guardião constitucional, que não o Supremo Tribunal Federal, e quais as consequências (...) e inconsistências teóricas em se recorrer ao povo como árbitro do conflito constitucional. As Helen Longino's overview of Hypatia's engagement with feminist epistemology suggests, the last twenty-five years’ contributions to this field reveal a strong focus on the topic of knowledge. In her short outline, Longino questions this narrow focus on knowledge in epistemological inquiry. The main purpose of this article is to provide a framework for systematically taking up the questions raised by Longino, one that prevents us from running the risk of becoming unreflectively involved in sexist, racist, or otherwise problematic inquiry. I argue that a specific form of the method of Reflective Equilibrium, as it is widely discussed in moral epistemology, logic, and theories of rationality, enables us to cope with the problems of traditional epistemology, which feminist theorizers such as Sally Haslanger have pointed to. With the account of Reflective Equilibrium I am offering—drawing in many respects on the model provided by Catherine Z. Elgin—we have an ameliorative method that allows us to rethink epistemological values, goals, and standards in a systematic way, and that largely avoids implicit and explicit biases in epistemology. A portrait of Australian flying fox life in the Anthropocene illuminates startlingly familiar stories. These animals are participants in most of the major catastrophic events, as well as contestations about rescue, of contemporary life on Earth: warfare, man-made mass death, famine, urbanisation, emerging diseases, climate change, biosecurity, conservation, and local/international NGO aid. They are endangered, and are involved in all four of the major factors causing extinctions: habitat loss, overexploitation, introduced species, and extinction cascades. My account of flying foxes in (...) Australia rests on the understanding of species articulated both vigorously and eloquently by Donna Haraway : we and others are entangled in knots of species who are co-shaping each other in layers of reciprocating complexity. I seek to engage both the living, warm-blooded beings whose lives are threatened, and the excruciatingly dynamic deathscape that is surrounding them/us. Positioned, like much of life on Earth today, in zones of increasing conflict and terror, the lives and deaths of flying foxes tell us that in the Anthropocene there is no way out of entanglements within multispecies communities. Rather than seeking to erect more impenetrable barriers against others, relational ethics for living and dying in the Anthropocene urge us to assume ever greater mutuality and accountability as intradependent members of the suffering family of life on Earth. This guide leads readers systematically through the arguments of Mary Shepherd's two books. Chapters 1-4 cover the arguments in the Essay Upon the Relation of Cause and Effect (1824), where Shepherd argues that causal principles can be known by reason to be necessary truths and that causal inferences can be rationally justified. Shepherd's primary target in this work is Hume, but she also addresses the views of Thomas Brown and William Lawrence. Shepherd considered her second book, Essays on the Perception (...) of an External Universe, and Other Subjects Connected with the Doctrine of Causation (1827), to be an extension of the earlier project on causation; here she appeals to the causal principles established in the first book to argue that we can know through reason that an external world of continually-existing objects must exist independently of us, as the causes of our sensations. Chapter 5 of this Guide addresses Shepherd's accounts of sensation and reasoning; Chapters 6-9 lead the reader through the arguments of the Essays, as well laying out Shepherd's views on skepticism and Berkeleyan idealism, her accounts of mind and body, her philosophy of religion, and the solutions she offers to two puzzles about vision. Adorno and Foucault are among the 20th century’s most renowned social critics but little work has been done to compare their ideas about the activity of critique. ‘Adorno, Foucault and Critique’ attempts to fill this lacuna. It takes as its starting point the Kantian legacy that informs Adorno’s and Foucault’s notions of critique, or their ‘ontologies of the present’, as Foucault calls them. Exploring the ontological foundations of critique, the article then addresses the principal objects of critique: domination and fascism. (...) This paper discusses the character of medical ethics and suggests that there are significant gaps that warrant greater attention. It describes ways in which the content and form of medical ethics may exclude or marginalise perspectives and contributions, thereby reducing its influence and its potential impact on, and value to, patients, students, carers and society. Trust is frequently discussed with reference to the professional–patient relationship. However, trust is less explored in relation to the ways in which understanding of, and responses to, questions of ethics are discussed by both the “public” and “experts.” Public engagement activity in healthcare ethics may invoke “trust” in analysing a moral question or problem but less frequently conceives of trust as integral to “public engagement” itself. This paper explores the relationship between trust and the ways in which questions of healthcare (...) ethics are identified and negotiated by both “experts” and the public. Drawing on two examples from the author’s “public engagement” work—a radio programme for the British Broadcasting Corporation and work with a playwright and theatre—the paper interrogates the ways in which “public engagement” is often characterized. The author argues that the common approach to public engagement in questions of ethics is unhelpfully constrained by a systemic disposition which continues to privilege the professional or expert voice at the expense of meaningful exchange and dialogue. By creating space for novel interactions between the “expert” and the “public,” authentic engagement is achieved that enables not only the participants to flourish but also contributes to trust itself. As described in Benjamin Hale’s Introduction to “Philosophy Looks at Chess”: -/- “Deb Vossen asks whether chess can rightly be considered a game in the first place. She concludes, much to the surprise of many readers, that chess is not a game. Her evocative claim turns on a distinction between a game and the idea of a game, which evolved out of Bernard Suits’s phenomenally underappreciated work The Grasshopper: Games, Life and Utopia. She advances this position by way of a (...) technical argument that employs Suits’s discussion of “prelusory” goals and “lusory” attitudes. The word “lusory” generally means sporty or playful; and in Suits’s sense, it means that when we engage in the play of chess, we must enter the lusory attitude. She uses the notion of a prelusory goal to argue that such goals exist in a game (in this case, a game of chess) but not at all in the idea of the game (in the idea of chess).”. (shrink)

Lady Mary Shepherd argued for distinctive accounts of causation, perception, and knowledge of an external world and God. However, her work, engaging with Berkeley and Hume but written after Kant, does not fit the standard periodisation of early modern philosophy presupposed by many philosophy courses, textbooks, and conferences. This paper argues that Shepherd should be added to the canon as a Scottish philosopher. The practical reason for doing so is that it would give Shepherd a disciplinary home, opening up additional (...) possibilities for research and teaching. The philosophical reason is that her views share certain features characteristic of canonical Scottish philosophers. (shrink)

In this article, the sociocultural meanings and social relations and expectations that cohere around `road rage' and serve to invest it with its particular resonance in contemporary Western societies are examined. It is argued that the combination of car and driver in the driving experience produces a cyborg body, which influences the ways in which people experience, perceive and respond to driving and other cars/drivers. But in contemporary societies the expression of such `negative' emotions is problematic and complex. It is considered the right of children to have their pain managed effectively. Yet, despite extensive research findings, policy guidelines and practice standard recommendations for the optimal management of paediatric pain, clinical practices remain inadequate. Empirical evidence definitively shows that unrelieved pain in children has only harmful consequences, with no benefits. Contributing factors identified in this undermanaged pain include the significant role of nurses. Nursing attitudes and beliefs about children’s pain experiences, the relationships nurses share with children who are suffering, (...) and knowledge deficits in pain management practices are all shown to impact unresolved pain in children. In this article, a relational ethics perspective is used to explore the need for nurses to engage in authentic relationships with children who are experiencing pain, and to use evidence-based practices to manage that pain in order for this indefensible suffering of children to end. The idea of public or stakeholder engagement in governance of science and technology is widely accepted in many policy and academic research settings. However, this enthusiasm for stakeholder engagement has not necessarily resulted in changes of attitudes toward the role of stakeholders in the dialogue nor to the value of public knowledge, practical experience, and other inputs (like salient questions) vis-à-vis expert knowledge. The formal systems of evaluation of the stakeholder engagement activities are often focused on showing that the method (...) is efficient and works. In this article, we argue that every stakeholder engagement process should be evaluated beyond a simple assessment of the methodology and that the wider context of the stakeholder engagement activity should also be addressed. We evaluate two different stakeholder engagement activities against the existing method evaluation criteria and demonstrate their limitations for assessing the quality of a stakeholder engagement. We argue that these criteria need to be extended so that engagement processes will have a chance to improve not only policies but also their democratic legitimacy. (shrink)

Discussions of non-ideal theory as philosophical methodology have recently entered the philosophy of language. In this chapter, the authors take stock of the academic movement that has begun to gather under the banner of ‘non-ideal philosophy of language,’ exploring what it means to idealize discursive phenomena, and how such idealizations impede our inquiry into politically significant speech. In doing so, they aim to draw attention to a certain pernicious ideal that distorts the theorist’s own relationship, qua theorist, to the discursive (...) practices they seek to theorize. This is the methodological ideal of normative neutrality, which ties the rigor of the theorist’s conceptual toolkit to its impartiality in the face of a non-ideal world full of non-neutral speech. The authors make the case that non-ideal philosophers of language ought to reject this ideal, lest they deprive themselves of the resources to register the political significance of their target phenomena. To acknowledge our need for normatively non-neutral methods, the authors argue, is to imagine a philosophy of language that might itself take the shape of discursive resistance against our target phenomena. They conclude by considering how philosophers could do such things with their words. (shrink)

An analysis of the project Intersectorial actions in early stimulation of the language was carried out with the purpose of favoring a social study of knowledge negotiation and technological innovation in the direction of programs to stimulate the development of children in preschool age at the vision of science, technology and society. Concepts related with the topic and necessary to comprehend the idea of reorganizing the services related with the stimulation and early attention of the language development starting in the community and with the participation of professionals from different institutions are shown. The need of comprehend the studies of science, technology and society as a field of action nowadays in Cuba is also demonstrated. (shrink)

To address this problem the Ethical Force Program, a collaborative effort to create quality improvement tools for ethics in health care, has developed five content areas specifying ethical criteria for fair health care benefits design and administration. Each content area includes concrete recommendations and measurable expectations for performance improvement, which can be used by (...) those organizations involved in the design and administration of health benefits packages, such as purchasers, health plans, benefits consultants, and practitioner groups. Originally published in 1992. This book discusses the possibilities of developing the research process in social science so that it benefits the subjects as well as the researcher. The authors distinguish between 'ethical', 'advocate' and 'empowering' approaches to the relationship between researcher and researched, linking these to different ideas about the nature of knowledge, action, language, and social relations. They then use a series of empirical case studies to explore the possibilities for 'empowering research'. The book is the product of (...) dialogue between researchers from a range of disciplines and is for those working across the social sciences. SummaryThe hiddenness of God in relation to opus alienum reflects, in Luther, a particular theological anthropology: one based on the limits of humanity and the futility of human action; and one that ascribes a certain role to suffering. One aspect of this account of the hiddenness of God is a figure whose terror remains unmitigated even by the light of salvation. In their discussions of the hiddenness of God, Karl Barth and Eberhard Jüngel reject this particular hiddenness of God. However, (...) their theologies draw on the opus alienum, and in doing so, they examine and analyse the despair and anxiety that characterise it in their own discussions of evil as nothingness. These accounts of nothingness engage with philosophical accounts of nothingness as being that which prompts self-assertion and actualisation as authentic existence. However, this use of the opus alienum opens their theologies up to the figure that they rejected in their prior accounts of hiddenness: the hidden, alien, and terrifying God. (shrink)

Debates concerning mask wearing continue in Japan. Here we critically examine the reasons for relaxing these regulations from a public health ethics perspective. We focus on three issues: government responsibility, political motivation, and cultural orientation, also discussing how these issues might have broader application in other parts of the world.

The product rule has been used to calculate the risk of a research study, in which the risk of harm is calculated as the product of the degree of harm multiplied by the likelihood that the harm will occur. This article challenges the product rule, especially when used to calculate "minimal risk" studies.

Work in the last decade in the history of philosophy has been characterized by the effort to reclaim texts and make available in English translations and commentaries the full range of philosophical writings of major figures and schools. The focal point of this article is the work of the Theophrastus Project, which has produced over the last fifteen years, eight biennial conferences with published proceedings and a truly comprehensive collection of fragments and testimonia, "Theophrastus of Eresus Sources for his Life, (...) Writings, Thought and Influence". The question is: How should philosophers approach an author who played a significant role in the history of philosophy but where relatively few texts are extant? In classical Arabic philosophy, the topic of consciousness is commonly associated with Avicenna's ‘Flying Man’ thought experiment. But Avicenna's explorations of the nature of consciousness are not confined to the Flying Man, and he is by no means the only classical Islamic thinker to deem consciousness an important feature of our experience. Consciousness also plays a important role in the epistemology and moral psychology of Avicenna's intellectual rivals, the theologians (mutakallumūn), who represent important sources for Avicenna's own theorizing about consciousness. And while Avicenna's philosophical successor and critic, Averroes, seems to banish consciousness from the core of his cognitive psychology, in doing so he seems to anticipate contemporary efforts to expand the scope of consciousness through the notion of the ‘extended’ mind. This paper examines the varieties of consciousness recognized by Avicenna and several other classical Islamic thinkers with a view to understanding the extent to which their accounts can be mapped on to some of the concepts of consciousness delineated by contemporary philosophers of mind. This study identifies citizen journalists' role conceptions regarding their news contributing activities and their perceptions of professional journalists' roles. Specifically, the ethical criterion of media credibility was assessed to identify predictors on their perceptions of roles. Analyses reveal citizen journalists perceive their roles to be generally similar to professional journalists and even rated certain roles more prominently for themselves. Further, their perceptions of media credibility were found to function as a core belief in how they assessed their roles and also (...) those of professional journalists, which has implications for a system of open ethics. In his medical and scientific works John Wesley provided an interpretation of the universe that was structured, though not pre-ordained, by God. The empirical method he adopted was measured in terms of efficacy and judged according to rationalistic standards. Its practical success, however, was used by Wesley to underpin his vocation of practical piety, which developed out of a holistic view of nature inspired by the spiritualism of Primitive Christianity. Accordingly, the providential ordering of Man and nature meant that safeguarding (...) physical health became a spiritual act, though Wesley separated the discourse of religion and terminology of medicine. This distinction was essential because it ensured intellectual integrity whilst leaving a protective space for religious faith. He made this move on the one hand but saw no contradiction in bringing the discourses of religion and medicine together to serve his mission. For Wesley, social and personal improvement did not rely exclusively on enlightened thinking or religious faith. Rather it depended on showing how rationalism and faith could display separate strengths within an overall framework of holism. (shrink)

A view of inequality as a relationship between the advantaged and the disadvantaged has gained considerable currency in psychological research. However, the implications of this view for theories and interventions designed to reduce inequality remain largely unexplored. Drawing on the literature on close relationships, we identify several key features that a relational theory of social change should include.

Discussion of the closing lines of Pindar¿s seventh Nemean has concentrated almost exclusively on the lines¿ relevance to the larger question that hangs over the poem: does the ode serve as an apologia for the poet¿s uncomplimentary treatment of Neoptolemus in an earlier Paean, and is Pindar here most plainly gainsaying the vilification in which he supposedly previously engaged. The reading that I offer suggests that a very different concern frames the conclusion to the work. Rather than seeking to exculpate (...) himself, the poet announces instead that in the song that the audience has just heard, the composer has adhered to two prime virtues that the encomiastic genre should embrace: variatio and an ability to counter the language of blame. By reorienting the debate in this way, I aim to elucidate the striking metaphors and other rhetorical devices that fill the final lines, and most particularly to make sense of the canine imagery that seems so recurrent a motif. As my reading seeks to show, the dog is chosen as master trope both for his relation to the practice of invective and for his relevance to that stale act of repetition that the poet here rejects. By giving his audience a sample of the mode of speech that the calumnist practises, and that the praise poet may appropriate when combating the opposite genre, Pindar makes the merits of his own poetry shine the brighter, and invites the cognoscenti to appreciate his sophia. More broadly, the encomiastic singer¿s brief deployment of the weapons of the abuse poet allows us to understand something of the overlapping and symbiotic relations between the different genres in archaic Greek poetry. This article offers a fresh reading of Pindar’s Pythian 12, an ode composed for a victorious aulete, which demonstrates its engagement in current musicological debates concerning innovations in instrumentation, relations between the musical and vocal elements in choreia, and the status of the pipes. In ways that intersect with these issues, Pindar anticipates a motif that resurfaces in later Attic drama and other texts concerning the origins of choral lyric and that identifies women’s lament as the prototypical form of song.

El objetivo de este artículo es describir y analizar el funcionamiento de un programa de política cultural de Estado, la Usina Cultural de la Unidad Penal N° 4 Santiago Vázquez, ex Comcar, a través de las prácticas y representaciones de los funcionarios que trabajan en el espacio físico donde se desarrolla y de las experiencias de algunas personas que han participado. Partiendo de trabajos anteriores que reflexionan acerca de la política en tanto proceso, proponemos comprender los sentidos atribuidos a este (...) programa de política cultural como una mediación o reelaboración de los significados propuestos por las autoridades que lo concibieron, donde se negocian y se producen nuevas significaciones. El diseño metodológico combinó entrevistas en profundidad a técnicos y personas privadas de libertad que concurrieron a la Usina y observación participantes en sus actividades y en la comunidad educativa del Comcar. Concluimos que el contexto de encierro es fundamental para entender las tensiones propias de la cotidianidad laboral y la producción de sentido de los participantes. En las políticas no solo hay ejecutores y beneficiarios sino sujetos con agencia que participan de entornos sociales que los condicionan. Sus apropiaciones del espacio que abre la política, configuradas por y en las características de la vida social en la que se desenvuelven (el encierro, en nuestro caso), son la política encarnada y constituyen un objeto fundamental de investigación para comprender su funcionamiento y posibles contribuciones. In this study, we conducted a pseudosign repetition task with 22 children acquiring American Sign Language as a first language from deaf parents. Thirty-nine pseudosigns with varying complexity were developed and organized into eight categories depending on number of hands, number of simultaneous movement types, and number of movement sequences. Pseudosigns also varied in handshape complexity. The children’s performance on the ASL pseudosign task improved with age, displaying relatively accurate production of location and orientation, but much less accurate handshape and (...) movement, a finding in line with real sign productions for both L1 and L2 signers. Handshapes with higher complexity were correlated with lower accuracy in the handshape parameter. We found main effects of sequential and simultaneous movement combinations on overall performance. Items with no movement sequence were produced with higher overall accuracy than those with a movement sequence. Items with two simultaneous movement types or a single movement type were produced with higher overall accuracy than those with three simultaneous movement types. Finally, number of hands did not affect the overall accuracy. Remarkably, movement sequences impose processing constraints on signing children whereas complex hands and two simultaneous movement types do not significantly lower accuracy, indicating a capacity for processing multiple simultaneous components in signs. Spoken languages, in contrast, manifest greater complexity in temporal length. Hearing children’s pseudoword repetition still displays high levels of accuracy on disyllabic words, with complexity effects affecting only longer multisyllabic words. We conclude that the pseudosign repetition task is an informative tool for studies of signing children’s phonological development and that sheds light on potential modality effects for phonological development.
