ABSTRACT:A wide range of research uses patterns of genetic variation to infer genetic similarity between individuals, typically referred to as genetic ancestry. This research includes inference of human demographic history, understanding the genetic architecture of traits, and predicting disease risk. Researchers are not just structuring an intellectual inquiry when using genetic ancestry, they are also creating analytical frameworks with broader societal ramifications. This essay presents an ethics framework in the spirit of virtue ethics for these researchers: rather than focus on (...) rule following, the framework is designed to build researchers’ capacities to react to the ethical dimensions of their work. The authors identify one overarching principle of intellectual freedom and responsibility, noting that freedom in all its guises comes with responsibility, and they identify and define four principles that collectively uphold researchers’ intellectual responsibility: truthfulness, justice and fairness, anti-racism, and public beneficence. Researchers should bring their practices into alignment with these principles, and to aid this, the authors name three common ways research practices infringe these principles, suggest a step-by-step process for aligning research choices with the principles, provide rules of thumb for achieving alignment, and give a worked case. Three decades of concern over consumption of potentially contaminated Great Lakes fish has led government agencies and public health proponents to implement risk assessment and management programs as a means of protecting the health of fishers and their families. While well-meaning in their intent, these programs––and much of the research conducted to support and evaluate them––were not designed to accommodate the understandings and concerns of the fish consumer. Results from a qualitative component of a multi-disciplinary, multi-year research project on frequent (...) (average 108 meals per year) consumers of Great Lakes fish tell the fishers’ side of the story. We present data from 87 tape recorded interviews conducted with Vietnamese, Chinese, and English-speaking participants that underscore the quality of freshly caught Great Lakes fish and the important social and cultural benefits of fish and fishing to the consumer. We also outline the participants’ understandings of risk from eating Great Lakes fish and the way in which fishers and their families manage this risk. The paper concludes with a discussion of these benefits, risks, and risk management strategies as ways that Great Lakes fish consumers “construct” rather than “perceive” risk. We advocate for risk assessment and management protocols that involve those who will be affected the most, such as frequent consumers of Great Lakes fish, from the initial “risk characterization” stage through to any necessary risk communication. This book offers a new interpretation of Hermann von Helmholtz's work on the epistemology of geometry. A detailed analysis of the philosophical arguments of Helmholtz's Erhaltung der Kraft shows that he took physical theories to be constrained by a regulative ideal. They must render nature "completely comprehensible", which implies that all physical magnitudes must be relations among empirically given phenomena. This conviction eventually forced Helmholtz to explain how geometry itself could be so construed. Hyder shows how Helmholtz answered this (...) question by drawing on the theory of magnitudes developed in his research on the colour-space. He argues against the dominant interpretation of Helmholtz's work by suggesting that for the latter, it is less the inductive character of geometry that makes it empirical, and rather the regulative requirement that the system of natural science be empirically closed. Regulierung ist ein Kennzeichen für Rationalität bei dem Versuch, Verhaltensweisen im Lichte von Normen zu leiten. Ihre Funktion ist es, sowohl das Verhalten der Individuen in einem bestimmten Bereich ihres Handelns zu koordinieren als auch dieses Verhalten auf wünschenswerte Ziele hin auszurichten. Nach Regulierung wird insbesondere auf neuartigen Feldern sozialen Verhaltens gerufen, so vor allem im Hinblick auf gentechnische Forschung und Praxis. Aber die Genetik ist deshalb ein schwieriger Fall, weil sie Ziele und Werte betrifft, die in hohem Maße kontrovers (...) sind. Darüberhinaus ist schon die Frage, ob und, wenn ja, in welchem Maße der Bereich der Genetik einer Regulierung unterworfen werden sollte, diskussionswürdig. Als ein wissenschaftliches Projekt verlangt die Genetik nach maximaler Freiheit; als eine potentiell gefährliche Praxis erfordert sie gesellschaftliche Eingrenzung. Im vorliegenden Artikel werden die vier Ebenen einer möglichen Regulierung von Genetik diskutiert: die institutionelle, die gouvernementale, die legislative und die internationale. Dabei wird Israel als Testfall für die komplexe Beziehung zwischen diesen Ebenen der Regulierung herangezogen. Aus einer philosophischen Perspektive wird die inhärente Spannung untersucht, die einerseits zwischen der Kraft der theoretischen Argumentation, die oftmals den Gedanken der Freiheit unterstützt, und andererseits dem Druck der praktischen und gesellschaftlichen Überlegungen besteht, die regelmäßig nach einer begrenzenden Regulierung rufen. Diese Spannung wird typischerweise in den verschiedensten Formen von nicht prinzipiengeleiteten Kompromissen aufgelöst, die aus teilweisen Regulierungen, ministeriellen Entscheidungen, zeitweiligen Richtlinien, institutionellen Selbstbeschränkungen und der Unterscheidung zwischen legitimer und illegitimer gentechnischer Praxis bestehen. Damit wird die Regulierung der gentechnischen Praxis zugleich zu einem erhellenden Beispiel für die prekäre Lage der "Angewandten Ethik" zwischen Theorie und gesellschaftlicher Praxis.Regulation is a hallmark of rationality in the attempt to guide behavior in the light of norms. Its function is both to coordinate individuals' behavior in a particular field of action and to subject it to desirable goals. Regulation is called for especially in new realms of social conduct, such as genetic research and practice. Yet genetics is a difficult case since it involves goals and values that are highly controversial. Furthermore, the question whether and to what extent the sphere of genetics should be at all regulated is debatable. As a scientific project it calls for maximal freedom; as a potentially harmful practice it calls for social restraint. The paper discusses the four levels of genetic regulation: the institutional, the governmental, the legislative, and the international. It takes Israel as a test case for the complex inter-relation between these regulative levels. On the philosophical level it demonstrates the inherent tension between the force of theoretical arguments and the pressure of practical and social considerations . This tension is typically resolved in various forms of unprincipled compromise, consisting of partial regulation, ministerial discretion, temporary guidelines, institutional self-restraint and distinctions between legitimate and illegitimate genetic practices. Thus, regulation of genetic practice is an illuminating case of the precarious position of "applied ethics" between philosophical theory and social practice. (shrink)

The article discusses the issue of the justification of experimenting on human subjects from the point of view of the individual participant. The discussion is conducted on three levels, which can be viewed as a hierarchy:I. Rationality: does one have good self-regarding reasons to subject oneself to medical experimentation?II. Justice: does one have a duty or an obligation to take part in medical research?III. Virtue: ought one contribute to the long-term attempt to promote medical knowledge and the overall health of (...) human beings?Rationality is shown to have only a limited force in such a justification, since many experiments cannot be shown to serve the interests of the participant in any way. Justice fares slightly better, since it is based on the idea of a social contract which goes beyond individual prudence. But, since many medical experiments promote the health only of future generations, the condition of mutuality, which is one of the bases of a social contract, is not satisfied. Thus, the ultimate reason to take part in medical research is associated with the supererogatory volunteering of people, who are motivated by the wish to contribute to a highly valuable enterprise with no expectation of return.The three types of reasons are complementary rather than exclusive, and the potential failure of all of them may lead to the undesirable commercialization of the field. Der Beitrag untersucht die Frage, ob und wie medizinische Versuche an Menschen aus der Sicht des einzelnen Teilnehmers gerechtfertigt werden können. Die Diskussion dieser Frage wird auf drei Ebenen geführt, die sich in einem Stufenverhältnis darstellen lassen,I. der Ebene der Zweckrationalität: Gibt es gute Gründe, und zwar durchaus des individuellen Eigennutzes, sich selbst für medizinische Versuche zur Verfügung zu stellen?II. der Ebene der Gerechtigkeit: Besteht eine Pflicht oder eine Verbindlichkeit zur Teilnahme an medizinischer Forschung?III. der Ebene der Tugend: Soll man zu dem auf lange Sicht angelegten Versuch beitragen, das medizinische Wissen und die Gesundheit der Menschen insgesamt zu fördern?Es wird gezeigt, daß das Argument der Zweckrationalität für eine mögliche Rechtfertigung nur von begrenzter Bedeutung ist. Denn viele Experimente dienen den Interessen des unmittelbaren Teilnehmers nachweislich in keiner Weise. Das Argument der Gerechtigkeit hat zwar eine etwas größere Kraft, weil Gerechtigkeit auf der Idee eines Gesellschaftsvertrags beruht, die über den Horizont individueller Klugheit hinausreicht. Da aber viele medizinische Experimente nur die Gesundheit zukünftiger Generationen fördern, ist die Bedingung der Gegenseitigkeit, die eine der Grundlagen des Gesellschaftsvertrags bildet, nicht erfüllt. Der dritte und letzte Grund für eine Teilnahme an medizinischer Forschung steht deshalb in enger Verbindung mit dem freiwilligen supererogatorischen Verhalten von Leuten, die durch den Wunsch motiviert sind, ohne Aussicht auf Gegenleistung zu einer höchst wertvollen Unternehmung etwas beizutragen.Die drei Arten von Gründen ergänzen sich mehr, als daß sie sich ausschließen. Dieser Aufsatz untersucht Malebranches Begriff von der Macht oder Kraft des Willens, die für Malebranche eine notwendige Bedingung der Freiheit ist. Mein Ziel ist, festzustellen, welcher Art genau die Macht des Willens ist, indem ich Malebranches Hauptdarstellungen zu Freiheit, Sünde und Tugend untersuche. Der problematischste Zug dieser Lehre zeigt sich in Verbindung mit Malebranches Okkasionalismus, einer Lehre, die die kausale Ohnmacht aller spirituellen und materiellen Schöpfung zu benötigen scheint und innerhalb derer Gott das einzige kausal wirkende Wesen ist. Wie (...) wirkt sich dieser Grundsatz auf Malebranches Lehre von der Kraft der Seele aus? Welche Art Kraft ist innerhalb des okkasionalistischen Systems zulässig? Malebranches Antworten auf diese Fragen, die ich in diesem Aufsatz kurz darstelle, enthalten eine wichtige Unterscheidung zwischen dem 'Realen' und dem 'Moralischen' oder dem Ontologischen und dem Deontologischen. Dieses Buch untersucht Humes revolutionäre Theorie des begrifflichen Denkens.Das begriffliche Denken ist eine wichtige Tätigkeit des Geistes. Was genau geschieht im Geist, wenn wir diese Tätigkeit ausüben? Im Vergleich zu anderen Philosophen der Frühen Neuzeit hat Hume bei der Beantwortung dieser Frage eine grössere Schwierigkeit: Humesche Ideen sind (anders als bei Descartes und Locke) rein phänomenaler Natur. Sie sind geistige "Bildchen" ohne begriffliche Struktur. Wie soll das begriffliche Denken mit Hilfe derartiger Ideen möglich sein? Hume reagierte auf diese Herausforderung mit (...) einem völlig neuartigen Ansatz und wurde zum Bahnbrecher einer moderneren Theorie des Denkens. Eine klare Einsicht in diesen Teil der Humeschen Philosophie ist zudem unentbehrlich für ein adäquates Verständnis seines Agnostizismus bezüglich der kausalen Kraft und seiner Metaphysik der Existenz. This book concerns the foundations of epistemic modality and hyperintensionality and their applications to the philosophy of mathematics. David Elohim examines the nature of epistemic modality, when the modal operator is interpreted as concerning both apriority and conceivability, as well as states of knowledge and belief. The book demonstrates how epistemic modality and hyperintensionality relate to the computational theory of mind; metaphysical modality and hyperintensionality; the types of mathematical modality and hyperintensionality; to the epistemic status of large cardinal axioms, (...) undecidable propositions, and abstraction principles in the philosophy of mathematics; to the modal and hyperintensional profiles of the logic of rational intuition; and to the types of intention, when the latter is interpreted as a hyperintensional mental state. Chapter \textbf{2} argues for a novel type of expressivism based on the duality between the categories of coalgebras and algebras, and argues that the duality permits of the reconciliation between modal and hyperintensional cognitivism and modal and hyperintensional expressivism. Elohim develops a novel, topic-sensitive truthmaker semantics for dynamic epistemic logic, and develops a novel, dynamic two-dimensional semantics grounded in two-dimensional hyperintensional Turing machines. Chapter \textbf{3} provides an abstraction principle for two-dimensional (hyper-)intensions. Chapter \textbf{4} advances a topic-sensitive two-dimensional truthmaker semantics, and provides three novel interpretations of the framework along with the epistemic and metasemantic. Chapter \textbf{5} applies the fixed points of the modal $\mu$-calculus in order to account for the iteration of epistemic states in a single agent, by contrast to availing of modal axiom 4 (i.e. the KK principle). The fixed point operators in the modal $\mu$-calculus are rendered hyperintensional, which yields the first hyperintensional construal of the modal $\mu$-calculus in the literature and the first application of the calculus to the iteration of epistemic states in a single agent instead of the common knowledge of a group of agents. Chapter \textbf{6} advances a solution to the Julius Caesar problem based on Fine's `criterial' identity conditions which incorporate conditions on essentiality and grounding. Chapter \textbf{7} provides a ground-theoretic regimentation of the proposals in the metaphysics of consciousness and examines its bearing on the two-dimensional conceivability argument against physicalism. The topic-sensitive epistemic two-dimensional truthmaker semantics developed in chapters \textbf{2} and \textbf{4} is availed of in order for epistemic states to be a guide to metaphysical states in the hyperintensional setting. -/- Chapters \textbf{8-12} provide cases demonstrating how the two-dimensional hyperintensions of hyperintensional, i.e. topic-sensitive epistemic two-dimensional truthmaker, semantics, solve the access problem in the epistemology of mathematics. Chapter \textbf{8} examines the interaction between Elohim's hyperintensional semantics and the axioms of epistemic set theory, large cardinal axioms, the Epistemic Church-Turing Thesis, the modal axioms governing the modal profile of $\Omega$-logic, Orey sentences such as the Generalized Continuum Hypothesis, and absolute decidability. These results yield inter alia the first hyperintensional Epistemic Church-Turing Thesis and hyperintensional epistemic set theories in the literature. Chapter \textbf{9} examines the modal and hyperintensional commitments of abstractionism, in particular necessitism, and epistemic hyperintensionality, epistemic utility theory, and the epistemology of abstraction. Elohim countenances a hyperintensional semantics for novel epistemic abstractionist modalities. Elohim suggests, too, that higher observational type theory can be applied to first-order abstraction principles in order to make first-order abstraction principles recursively enumerable, i.e. Turing machine computable, and that the truth of the first-order abstraction principle for two-dimensional hyperintensions is grounded in its being possibly recursively enumerable and the machine being physically implementable. Chapter \textbf{10} examines the philosophical significance of hyperintensional $\Omega$-logic in set theory and discusses the hyperintensionality of metamathematics. Chapter \textbf{11} provides a modal logic for rational intuition and provides a hyperintensional semantics. Chapter \textbf{12} avails of modal coalgebras to interpret the defining properties of indefinite extensibility, and avails of hyperintensional epistemic two-dimensional semantics in order to account for the interaction between interpretational and objective modalities and the truthmakers thereof. This yields the first hyperintensional category theory in the literature. Elohim invents a new mathematical trick in which first-order structures are treated as categories, and Vopenka's principle can be satisfied because of the elementary embeddings between the categories and generate Vopenka cardinals in the category of Set in category theory. Chapter \textbf{13} examines modal responses to the alethic paradoxes. Elohim provides a counter-example to epistemic closure for logical deduction. En este artículo critico una dicotomía con la que se zanjan muchos debates sobre la libertad de expresión y de estrategia político-cultural: reclamando la necesidad de “más expresión” porque su única alternativa es la censura. Propongo que tras este argumento se encuentra la intuición de que para contrarrestar la dominación hay que garantizar que se pueda “salir” de ella. Una razón del éxito de esta intuición en los ámbitos de la libertad de expresión y la cultura es que la mejora (...) tecnológica en las comunicaciones respalda un presupuesto de superabundancia que ignora la economía política de la esfera pública. Im Fokus dieses Artikels steht die Vorstellung einer neuen Normativitätstheorie. Ich nenne sie metaethischen Konativismus. Der Konativismus ist der Theorienfamilie des Humeanismus zuzuordnen – er stellt konative Einstellungen in den Mittelpunkt – und ähnelt in seinen Grundzügen den Theorien von Bernard Williams, Mark Schroeder, David Sobel oder Peter Stemmer. Da er sich jedoch, wie ich zeigen werde, in einigen Kernelementen stark von bereits bestehenden Positionen unterscheidet, darf er als eigenständige Theorie gelten. Mein Hauptziel besteht darin, zu zeigen, dass der (...) Konativismus vier zentrale und historisch einflussreiche Einwände gegen humeanische Theorien zurückweisen kann. Diese betreffen die Phänomenologie praktischer Überlegungen, die rationale Kritik konativer Einstellungen, die Verwechslung von motivationaler Kraft und normativem Gewicht, sowie die Frage nach der moralischen Adäquatheit. Mein Ergebnis ist, erstens, dass der Konativismus der Phänomenologie praktischer Überlegungen gerecht wird. Außerdem ergibt sich, zweitens, aus dem Konativismus ganz natürlich die Idee, dass es Gründe „hinter“ unseren konativen Einstellungen gibt, die als Grundlage für eine rationale Kritik selbiger dienen können. Darüber hinaus unterscheidet er, drittens, klar zwischen normativem Gewicht und motivationaler Kraft. Und schließlich, viertens, liefert er eine gute Grundlage dafür, robuste und gewichtige moralische Gründe zu generieren. Es zeigt sich also, dass vier der wichtigsten und einflussreichsten Einwände gegen Humeanische Positionen, die von zahlreichen namhaften AutorInnen immer wieder vorgebracht wurden, das theoretische Potential selbiger stark unterschätzt haben. Der Konativismus stellt eine neue Theorie praktischer Gründe dar, die sich dieses Potential zunutze macht und damit ihren Hut als attraktive Option in den Ring wirft. (shrink)

Bermúdez's case for rational framing effects, while original, is unconvincing and gives only parenthetical treatment to the problematic assumptions of extensional and semantic equivalence of alternative frames in framing experiments. If the assumptions are false, which they sometimes are, no valid inferences about “framing effects” follow and, then, neither do inferences about human rationality. This commentary recaps the central problem.

How compelling is radical normative pluralism, i.e. the view that contrary moral positions (deontological, consequentialist and so on) are all morally acceptable even in one given case? In ‘A Hostage Situation’ (2019), Saul Smilansky presents a thought experiment about moral decisions in life-and-death situations. According to Smilansky, the Hostage Situation (HS) reveals a rather puzzling and radical normative pluralistic picture, according to which even in life-and-death decisions, many moral choices that sometimes contradict each other are more or less equitable or (...) at least morally acceptable simultaneously. He argues that there is a paradigmatic difference between HS and Trolley-Problem-type cases (TP); according to him, the decision in TP is always single-valued, so one cannot be pluralistic in a plausible way—that is, one cannot rationally accept both options at the same time. TP, he claims, has been a misleading paradigmatic example; the radically pluralistic result of HS may be a better paradigm for much of morality. I argue that Smilansky should have gone further, and that a proper understanding of HS and TP reveals that, far from being in conflict, both thought experiments support a radical normative pluralism. Thus, building upon Smilansky’s work but offering a very different position, I present in this paper a radical, novel interpretation of Trolley-Problem-type cases, which, if convincing, should significantly affect the way we think about normative moral theory. Clinicians may increasingly find themselves practicing, by choice or necessity, in resource-poor or extreme environments. This often requires altering typical patterns of practice with a different set of medical and ethical considerations than are usually faced by clinicians practicing in hospitals in the United States and Europe. Practitioners may be required to alter their usual scope of practice or their standard ways of medically treating patients. Limited resources will also often place clinicians in the position of having to make decisions (...) about fairly allocating healthcare, which will alter the physician–patient relationship. This does not absolve physicians and other healthcare practitioners of providing the best quality of care that can be given under the circumstances. In addition, the lack of a well-developed healthcare infrastructure and limited resources will require working with established providers to determine the needs of the community, and what types of healthcare are feasible given these limitations. The essays in this issue of HEC Forum encourage readers to reflect on the unique ethical challenges faced in the extreme or austere environment. (shrink)

Dilthey’s moral writings have received scant attention over the years, perhaps due to his apparent tendency toward relativism. This essay offers a unified look at Dilthey’s moral writings in the context of his Kantian-styled “Critique of Historical Reason.” I present the Dilthey of the moral writings as an observer of reason in the spirit of Kant, watching practical reason devolve into error when it applies itself beyond the bounds of possible experience. Drawing on moral writings from across Dilthey’s corpus, I (...) retrace Dilthey’s argument that moral theories from Kantianism and utilitarianism to natural law theory suffer significant motivational problems because of the way they transcend the “synthesis” of moral perception. Dilthey’s argument suggests that abstract moral theory is always bound to seem unmotivating and unreal from the standpoint of lived experience, and perhaps that, to avoid this, moral philosophy should confine itself to more situated, case-specific judgments. This article analyzes the mark of terrorism in Basque underground music from 1980s to 2000s, paying special attention to the image of the “Basque conflict”, to ETA and to the militants of this terrorist organization. Later, it is examined what type of content has been maintained in the songs of this musical style, with special emphasis on the victims and the thematics have been promoted since the end of ETA.

Der Begriff des »Zombie Formalismus« beschreibt eine Form der Kunst, welche die Intention verfolgt, die Bedürfnisse des Marktes zu erfüllen. Gegenwärtige Entwicklungen des Kunstmarkts fordern die institutionelle Theorie von Kunst heraus, da es zunehmend fraglich erscheint, dass ›die Kunstwelt‹ – das Kernstück der institutionellen Theorie – noch von einem tiefgehenden Kunstverständnis anstatt von ökonomischen Interessen geleitet wird. Da die institutionelle Theorie ›die Kunstwelt‹ an sich sehr vage definiert, könnte diese auch wirtschaftlich orientierte Sammlerinnen und Galeristen einschließen. Wenn der monetäre Wert (...) von Kunst aber die treibende Kraft für die Erschaffung von Kunst ist, stellt sich die Frage, wie dies die Kunstwelt als Institution, die darüber entscheidet, ob etwas als Kunst gelten kann, beeinflusst. Um diese Frage zu beantworten, werde ich mich mit neuesten Entwicklungen der zeitgenössischen Kunstwelt auseinandersetzen, da diese es erfordern, die institutionelle Theorie so zu modifizieren, dass sie auf gegenwärtige Phänomene anwendbar ist. Als Ausblick werde ich vorschlagen, dass David Humes allgemeiner Maßstab für das Geschmacksurteil zur Entwicklung eines Maßstabs für das kuratorische Urteil beitragen könnte. Möglicherweise könnte dieser kuratorische Maßstab dazu dienen, dass Kuratorinnen als unabhängige Gatekeeper fungieren. (shrink)
