Background: Ethical and legal issues are increasingly being reported by health caregivers; however, little is known about the nature of these issues in geriatric care. These issues can improve work and care conditions in healthcare, and consequently, the health and welfare of older people. Aim: This literature review aims to identify research focusing on ethical and legal issues in geriatric care, in order to give nurses and other health care workers an overview of existing grievances and possible solutions to take (...) care of old patients in a both ethical and legally correct way. Methods: Using a systematic approach based on Aveyard, a search of the PubMed, CINAHL, and Ethicshare databases was conducted to find out the articles published on ethical and legal issues in geriatric care. Ethical considerations: The approval for the study was obtained from UMIT-The Health and Life Sciences University, Austria. Results: Only 50 articles were included for systematic analysis reporting ethical and legal issues in the geriatric care. The results presented in this article showed that the main ethical issues were related to the older people’s autonomy, respect for their needs, wishes and values, and respect for their decision-making. The main legal issues were related to patients’ rights, advance directives, elderly rights, treatment nutrition dilemma, and autonomy. Conclusion: Further education for professional caregivers, elderly people, and their families is needed on following topics: care planning, directive and living wills, and caregiver-family member relationships to guide and support the elderly people within their decision-making processes and during the end-of-life care. Emotional stimuli (e.g. words, images) are often remembered better than neutral stimuli. However, little is known about how memory is affected by an environmentally induced emotional state (without any overtly emotional occurrences) – the focus of this study. Participants were randomly assigned to discovery (n = 305) and replication (n = 306) subsamples and viewed a desktop virtual environment before rating their emotions and completing objective (i.e. item, temporal-order, duration) and subjective (e.g. vividness, sensory detail, coherence) memory measures. In both (...) samples, a Partial Least Squares Correlation analysis showed that an emotional state characterised by high negative emotion (i.e. threat, fear, anxiety) and arousal was reliably associated with better memory in both objective (i.e. item) and subjective (i.e. vividness and sensory detail) domains. No reliable associations were observed for any temporal memory measures (objective or subjective). Thus, an environmentally induced state of negative emotion corresponds with enhanced memory for indices of episodic memory pertaining to “what” happened, but not necessarily “when” it happened. Within Ajzen's Planned Behavior Theory framework, this article tests a model to estimate the predictors of entrepreneurial intention in academic scientists working in Chile. We adapted into Spanish the entrepreneurship intention questionnaire. We tested the entrepreneurship intention model on a sample of 1,027 scientists leading research projects funded by the Chilean Scientific and Technological Development Fund, the country's primary scientific research grant. The results show strong empirical support for the entrepreneurship intention model proposed while highlighting some critical issues specific to (...) entrepreneurial intention in scientists. In particular, we found an indirect effect of perceived subjective social support on entrepreneurial intention, which is mediated by entrepreneurial attitude and perceived behavioral control toward entrepreneurship. These results suggest that policies orientated toward promoting academic entrepreneurship should include developing a healthy social environment toward it, meaning that entrepreneurial intention is not only an individual but an organizational challenge. These policies should analyze the social norms guiding the scientists' reference groups to increase their effectiveness. (shrink)

The remember/know procedure is the most widely used method to investigate recollection and familiarity. It uses trial-by-trial reports to determine how much recollection and familiarity contribute to different kinds of recognition. Few other methods provide information about individual memory judgements and no alternative allows such direct indications of recollection and familiarity influences. Here we review how the RK procedure has been and should be used to help resolve theoretical disagreements about the processing and neural bases of components of recognition memory. (...) Emphasis is placed on procedural weaknesses and a possible confound of recollection and familiarity with recognition memory strength. Recommendations are made about how to minimise these problems including using modified versions of the procedure. Propósito: la adecuación del esfuerzo terapéutico es una decisión clínica basada en la evidencia que pretende evitar la futilidad médica. Se han señalado diferentes factores que pueden influir en esta toma de decisiones los cuales se relacionan con el paciente, el profesional médico que toma de las decisiones, barreras del sistema, cultura y economía, entre otros. El presente estudio pretende identificar aquellos factores que influyen en los médicos especialistas que laboran en la institución referente del cáncer en Colombia, a fin (...) de planear acciones que mejoren el abordaje de la toma de decisiones con respecto a la adecuación del esfuerzo terapéutico en pacientes con cáncer. Metodología: diseño cualitativo basado en 13 entrevistas en profundidad a médicos especialistas del Instituto Nacional de Cancerología de Colombia. Resultados: participaron 3 mujeres y 10 hombres, con un promedio de edad de 36 años, 7 pertenecientes a la especialidad de oncología de adultos, 2 a oncohematología pediátrica, 1 a cuidados intensivos de adultos y 3 a cuidados intensivos pediátricos. Los factores hallados se agruparon en cuatro categorías: 1) conocimiento, 2) aspectos relacionados con la toma de decisiones, 3) quién decide, 4) tipo de decisión que se toma; a su vez, estas categorías se agruparon en temas que hacen alusión a los factores que influyen en la toma de decisiones de los especialistas para adecuar los esfuerzos terapéuticos. Conclusión: la adecuación de los esfuerzos terapéuticos es importante para evitar procedimientos médicos fútiles que prolonguen el sufrimiento. Se evidenciaron algunos factores que influyen en la toma de decisiones de los especialistas: falta de preparación de los profesionales de salud en el tema de toma de decisiones al final de la vida, uso reducido de escalas que permitan mejorar la información del pronóstico y desconocimiento sobre voluntades anticipadas; estos son algunos de aquellos factores que deben fortalecerse para generar acciones que mejoren el abordaje de esta temática. A discussão por mudanças na educação brasileira é tema recorrente desde a “descoberta” do Brasil. Com o advento da pandemia do novo Coronavírus, percebeu-se, por exemplo, a intensificação da tentativa de regulamentar o homeschooling no Brasil como um modal educacional, justificando, assim, a necessidade de discussão a respeito de uma propositiva de educação escolar domiciliar. Nesse viés, o presente estudo teve por objetivo compreender os elementos constitutivos do homeschooling no Brasil. Com base em pressupostos críticos e fazendo uso de estudo (...) bibliográfico e análise documental, o corpus teórico utilizado foi de Lubienski (2007), Roldão (2007), Saviani (2003; 2008), entre outros, tendo como referência o levantamento nas bases de dados ANPEd, CAPES e BDTD. Como recorte temporal no período 2019-2021, concluiu-se que o ensino domiciliar seria um retrocesso para a educação brasileira, aumentando a desigualdade social outrora existente, além de acarretar perdas irreparáveis para os estudantes. Preterm discharge effects: Relationship between the maternal experience and newborn's psychobiological regulation The purpose of this study is to investigate how the past experiences of mothers and their potentially traumatic events during pregnancy may have influenced the processes of psychobiological self-regulation and cognitive development in a child born preterm. Eighty children who had a gestational age of < 32 weeks were examined at the 9th month of the corrected age. The mothers and children were divided in two groups: multipara mothers (...) and their children and the primipara mothers and their children. These children were examined on the basis of sleep disorders, nutritional problems and mental development. Perinatal data from clinical observations and data from standardized developmental tests were used to describe the differences. The children of primipara mothers who had unexpected preterm delivery presented major incidences of sleep disorders while the children of primipara mothers, who programmed preterm delivery, presented a major incidences of nutrition problems. The predictability of preterm delivery has a major influence on the capacity of newborns for self-regulation in the case of primipara mothers. (shrink)

Parental substance use is a major risk factor for child development, heightening the risk of drug problems in adolescence and young adulthood, and exposing offspring to several types of traumatic event. First, prenatal drug exposure can be considered a form of trauma itself, with subtle but long-lasting sequalae at the neuro-behavioural level. Second, parents’ addiction often entails a childrearing environment characterised by poor parenting skills, disadvantaged contexts and adverse childhood experiences, leading to dysfunctional outcomes. Young adults born from/raised by parents (...) with drug problems and who develop a Substance Used Disorder (SUD) themselves might display a particularly severe condition in terms of cognitive deficits and impaired personality function. This preliminary study aims to investigate the role of early exposure to drugs as a traumatic event, capable of affecting the psychological status of young drug addicts. In particular, it intends to examine the neuropsychological functioning and personality profile of young adults with severe SUDs who were exposed to drugs early in their family context. The research involved 3 groups each consisting of 15 young adults (aged 18-24): a group of inpatients diagnosed with SUDs and exposed to drugs early, a comparison group of non-exposed inpatients and a group of non-exposed youth without SUDs. A neuropsychological battery (Esame Neuropsicologico Breve-2), an assessment procedure for personality disorders (Shedler-Westen Assessment Procedure-200) and the Symptom CheckList-90-Revised were administered. According to present preliminary results, young drug addicts exposed to drugs during their developmental age were characterised by elevated rates of neuropsychological impairments, especially at the expense of attentive and executive functions; personality disorders were also common but did not differentiate them from non-exposed young people with SUDs. Alternative multi-focused prevention and intervention programs are needed for children of drug-misusing parents, addressing executive functions and adopting a trauma-focused approach. (shrink)

Se caracteriza las estrategias de afrontamiento que presentan 278 estudiantes, de 10 a 15 años, víctimas de acoso escolar y cyberbullying. La investigación es cuantitativa, con alcance descriptivo-relacional, haciendo uso de la escala Brief COPE. La data reportó que los estudiantes víctimas usaron pocas veces estrategias de primera dimensión, centradas en la resolución del problema y búsqueda de apoyo social.

Background: As a non–European Union member state, Albania is increasingly orienting itself on Western models regarding human rights, patient rights, and legal regulations for healthcare. Due to its limited fiscal and legal power, enforcing legal and ethical regulations poses a major problem. Aim: The aim of this study is to investigate nurse’s knowledge and experiences regarding ethical and legal issues in Albanian elder care in state-funded and privately run institutions. Research design: The study was conducted using an inductive and qualitative (...) design, utilizing a focused ethnographic approach, based on Roper and Shapira’s framework. Method: Data were collected between June 2017 and September 2018 using participant observation, field notes, and semi-structured interviews with 15 nurses in seven different elder care institutions. In total, 100 h of observation and 15 interviews were performed. Data analysis was based on Mayring’s qualitative content analysis. Ethical consideration: The approval for the study was obtained from UMIT—The Health and Life Sciences University, Austria. Findings: The findings of the study fell into the following main categories: “Everyday care issues,” “End-of-life issues,” “Legal issues,” and “Ethical-legal education and conflicts.” Discussion: The participants reported many ethical and legal issues when describing their everyday challenges and displayed a strong lack of ethical and legal education. Despite a wide spectrum in the quality of care between private and state-funded nursing homes, older people mostly do not know their own diagnosis. Conclusion: This study indicates that further ethical and legal education is needed. Furthermore, nurses need to be better prepared for ethical conflicts with families, as strengthening patient rights could come into conflict with traditional rights of the Albanian family. (shrink)

En este trabajo se indaga en el comportamiento de la atenuación en los verbos que expresan duda, presentes en el corpus AMERESCO de conversaciones coloquiales de Santiago de Chile. Se describen las funciones de la atenuación de estos verbos de acuerdo con (1) el tipo de acto de habla, (2) la actividad de imagen y (3) algunas características sintáctico-discursivas. Los principales hallazgos demuestran que la atenuación se manifiesta a través de verbos doxásticos (_creer_, _parecer_, _cachar_, etc.), verbos modales (_poder_, _deber_) (...) y el verbo “saber” con polaridad negativa (“_no sé_”). Esta surge cuando se presenta lo dicho como una duda, bien para suavizar una opinión contraria o crítica, en cuyo caso su significado es de opinión, bien para informar sobre un estado de cosas, cuando su significado es epistémico. En el reconocimiento de su carácter atenuante, resultan clave el tipo de acto de habla en el que ocurren, el rol proyectado por el hablante en la conversación, la gestión de las imágenes y sus características sintáctico-discursivas, elementos que determinan si estas construcciones verbales expresan mayor o menor atenuación. IntroductionAfter three decades of the absolute prohibition of abortion, Chile enacted Law 21,030, which decriminalizes voluntary pregnancy termination when the person is at vital risk, when the embryo or fetus suffers from a congenital or genetic lethal pathology, and in pregnancy due to rape. The law incorporates conscientious objection as a broad right at the individual and institutional levels.ObjectivesThe aim of the study was to explore the exercise of conscientious objection in public health institutions, describing and analyzing its consequences and (...) proposals to prevent it from operating as structural violence.Materials and methodsThis study uses a qualitative, post-positivist design. At the national level, according to the chain technique, people who were identified as key actors due to their direct participation in implementing the law were included. Grounded theory was used to analyze the information obtained through a semi-structured interview. The methodological rigor criteria of transferability or applicability, dependability, credibility, auditability, and theoretical-methodological adequacy were met.ResultsData from 17 physicians, 5 midwives, 6 psychologists, 8 social workers, 2 nursing technicians, and 1 lawyer are included. From an inductive process through open coding, conscientious objection as structural violence and strategies to minimize the impact of objection emerge as meta-categories. The first meta-category emerges from the barriers linked to the implementation of the law, the infringement of the rights of the pregnant person, and pseudo conscientious objection, affecting timely and effective access to pregnancy termination. The second meta-category emerges as a response from the participants, proposing strategies to prevent conscientious objection from operating as structural violence.ConclusionConscientious objection acts as structural violence by infringing the exercise of sexual and reproductive rights. The State must fulfill its role as guarantor in implementing public policies, preventing conscientious objection from becoming hegemonic and institutionalized violence. (shrink)

El presente artículo aborda la estrategia escritural de Daniela Catrileo. Se propone revisar la elaboración del concepto de piñen examinando la relación entre lenguaje y colonialidad, para, de ese modo, subrayar el potencial político y reivindicativo que comporta en la novela del mismo nombre, Piñen (2019). Dicha hipótesis articulará el ejercicio de lectura aquí propuesto, atendiendo principalmente las estrategias narrativas empleadas –servirse de un polilingüismo que rompe estructuras gramaticales– para descentrar el lenguaje de su determinismo colonial. Así, interpretamos dicha (...) estrategia escritural en consonancia con las potencias micropolíticas y descolonizadoras del arte descritas por Suely Rolnik y, en consecuencia, apostando por la posibilidad de diagramar un devenir minoritario que dispute los imaginarios del inconsciente colonial-capital. "Theory of mind� describes the ability to impute mental states, such as beliefs, desires and intentions, to oneself and to other people. Usually we want to know why people did what they did and we wonder what they are going to do next. That is, everyday we try to predict and explain human behaviour. In order to do this we refer to a person"s beliefs, desires, emotions, intentions etc. Behaviour is the product of belief and desire: People do things because (...) they desire something and believe some act will achieve it. For adults it is clear that our assumptions about reality do not necessarily match the real world; but we know, regardless of whether our beliefs are true or not, our beliefs direct our actions. In contrast, it is not until the age of 4 years that children understand that one can be mistaken about the world and that actions can be based on this false belief. (shrink)

The article provides a historical and philosophical analysis of the deportation of many Russian intellectuals abroad in 1922. It is known that such a vicious deed on the part of the Soviet authorities, in fact, turned out to be an act that saved many Russian intellectuals either from starvation or from repression and death in the camps. It is also widely known that the cultural activities of Russian emigrants after their arrival in the West were varied and intense. The article (...) also emphasizes that expulsion and its significance for the destinies of the country and the emigrants themselves remained a "blank spot" for a long time. It was only in the 1990s that research into the events of the 1922 exile, both in Russia and abroad, started to change. The author draws attention to the fact that the very nature of examination of the expulsion of the Russian intelligentsia has also changed over the years. At the beginning of studies in the 1990s, it was purely archival works aimed at recovering emigrants' cultural heritage and returning "forgotten" names. Over the last decade, we may observe a more critical reading of this heritage, supposing a more precise reconstruction of facts and contexts and a broader analysis of the significance of events in the history of the early 1920s. The study of the various cultural activities of the Russian migr intelligentsia allows us to strike a conversation on Russian philosophy, its peculiarity and originality, the mutual influences of the Russian and European philosophical traditions, and the meaning and significance of Soviet philosophy relevant again. The present article is devoted to a logical treatment of some fundamental concepts involved in responsibility attribution. We specify a theoretical framework based on a language of temporal deontic logic with agent-relative operators for deliberate causal contribution. The framework is endowed with a procedure to solve normative conflicts which arise from the assessment of different normative sources. We provide a characterization result for a basic system within this framework and illustrate how the concepts formalized can be put at work in (...) the analysis of examples of legal reasoning. Deleuze's theory of time set out in Difference and Repetition is a complex structure of three different syntheses of time – the passive synthesis of the living present, the passive synthesis of the pure past and the static synthesis of the future. This article focuses on Deleuze's third synthesis of time, which seems to be the most obscure part of his tripartite theory, as Deleuze mixes different theoretical concepts drawn from philosophy, Greek drama theory and mathematics. Of central importance is (...) the notion of the cut, which is constitutive of the third synthesis of time defined as an a priori ordered temporal series separated unequally into a before and an after. This article argues that Deleuze develops his ordinal definition of time with recourse to Kant's definition of time as pure and empty form, Hölderlin's notion of ‘caesura’ drawn from his ‘Remarks on Oedipus’ (1803) and Dedekind's method of cuts as developed in his pioneering essay ‘Continuity and Irrational Numbers’ (1872). Deleuze then ties together the conceptions of the Kantian empty form of time and the Nietzschean eternal return, both of which are essentially related to a fractured I or dissolved self. This article aims to assemble the different heterogeneous elements that Deleuze picks up on and to show how the third synthesis of time emerges from this differential multiplicity. (shrink)

Estetica razionale ha rappresentato un momento cruciale del dibattito circa la natura di questa disciplina. Tornare a intendere l’estetica come teoria della percezione, anziché come filosofia dell’arte, significa occuparsi, sostanzialmente, di una triade di capacità, tra di esse fortemente connesse: non soltanto la percezione strictu sensu, ma anche la memoria e l’immaginazione – facoltà senza le quali la percezione, da sola, non offrirebbe alcuna possibilità di ragionamento. Soltanto grazie alla memoria, infatti, è possibile ritenere ciò che si è percepito, e (...) soltanto grazie all’immaginazione è possibile confrontare, distinguere e sussumere, prima ancora che inventare. Se “l’occhio ragiona a modo suo” – se l’estetica, insomma, può davvero essere un’ars analogi rationis – ciò è possibile grazie a queste tre facoltà. Gli sviluppi teorici successivi del pensiero di Ferraris potrebbero essere interpretati proprio come una lunga elaborazione del tema della memoria, sfociata dapprima nella teoria della traccia proposta in Documentalità, e successivamente nella considerazione delle sue conseguenze ontologiche, con il Nuovo Realismo. El presente trabajo tiene por objeto delinear aquellos conceptos centrales de la narración en Walter Benjamin que se despliegan en las lecturas de los cuentos y relatos que forman parte del corpus central del movimiento jasídico. Para ello se analiza la concepción de la experiencia, el uso de las palabras y las alusiones del narrador en ese instante en que, a través del consejo, el maestro transmite sabiduría. El consejo no es una respuesta cerrada ni un saber exclusivo sobre los (...) aspectos metafísicos, sino que es –ante todo– la transmisión del aspecto de unificación del mundo, donde lo cotidiano devela su carácter inexplicable y lo trascendental –en un instante fugaz– se aproxima a la vida misma. Lo que narra el maestro jasídico sucede entre el cielo y la tierra, entre la vida práctica y la mística. La narración no abrevia: se despliega, da cuenta de lo inacabado, del requerimiento de la tarea del hombre en el mundo, de la labor paciente, insistente, del constructo de una artesanía que sólo la convicción –aquello más allá del mero y puro intelecto– y el amor a la letra del texto sagrado puede reavivar. Leading philosophical models of curiosity represent it as a desiderative attitude whose content is a question, and which is satisfied by knowledge of the answer to that question. I argue that these models do not capture the distinctive character of a form of curiosity that I call 'erotic curiosity'. Erotic curiosity addresses itself not to a question but to an object whose significance for the inquirer is affective as well as epistemic. This form of curiosity is best understood by analogy (...) to erotic love as theorized by Plato in the Symposium. (shrink)

It is widely believed that we ought not to criticize others for wrongs that we ourselves have committed. The author draws out and challenges some of the background assumptions about the practice of criticism that underlie our attraction to this claim, such as the tendency to think of criticism either as a social sanction or as a didactic intervention. The author goes on to offer a taxonomy of cases in which the moral legitimacy of criticism is challenged on the grounds (...) that the critic him- or herself engages in the behavior that he or she criticizes in others. The author argues that, in each type of case, the would-be critics should not constrain their participation in moral discourse on the grounds that they are not themselves innocent of the wrongdoing they criticize in others. This paper explores a distinctive form of social interaction—interpersonal inquiry—in which two or more people attempt to understand one another by engaging in conversation. Like many modes of inquiry into human beings, interpersonal inquiry partly shapes its own objects. How we conduct it thus affects who we become. I present an ethical ideal of conversation to which, I argue, at least some of our interpersonal inquiry ought to aspire.
