In order to promote social distancing during the recent COVID-19 pandemic, physicians and healthcare systems have made efforts to replace in-person with virtual clinic visits when feasible. While these efforts have been well received and seem compatible with sound clinical practice, they do not perfectly replicate the experience of a face-to-face exchange between doctor and patient. This essay attempts to describe features of the virtual visit that distinguish it from its face-to-face analog and considers the phenomenological work of Emmanuel Levinas (...) in arguing that these differences may limit the force of the ethical summons a provider would otherwise experience before the face of a patient. The diminishment of this signal therapeutic experience may engender vocational as well as clinical consequences, which should be weighed against the practical benefits of the virtual visit as we consider whether our enthusiasm for this mode of practice should continue. The dominant model for bioethical inquiry taught in medical schools is that of principlism. The heritage of this methodology can be traced to the Enlightenment project of generating a universalizable justification for normative morality arising from within the individual, rational agent. This project has been criticized by Alasdair MacIntyre who suggests that its failure has resulted in a fragmented and incoherent contemporary ethical framework characterized by fundamental intractability in moral debate. This incoherence implicates principlist conceptions of bioethics. Medical ethics as (...) practiced, though, is partially in keeping with teleological alternatives to principlism. Nonetheless, the hegemony of principlism threatens to harm the practice of good medicine whenever it is used to provide justification for the sanction or prohibition of practices, despite not being equipped to grant moral authority to such justifications. An example of this failure and its resulting harm is expressed in the growing obsolescence of living donor liver transplantation. (shrink)

This is one of four interrelated action agenda papers resulting from the National Summit on Public Health Legal Preparedness convened in June 2007 by the Centers for Disease Control and Prevention and nineteen multi-disciplinary partner organizations. Each of the action agenda papers deals with one of the four core elements of public health legal preparedness: laws and legal authorities; competency in using those laws; coordination of law-based public health actions; and information. In this paper I describe the imaginary community of Gullible. Gulliblians are led by moral pressures to believe whatever they are told and, in the scenario that I sketch, this leads to them having widespread contradictory beliefs. This community is nevertheless intelligible to us given what we know about their situation and their moral code. Davidson, however, holds there to be what I call a logicist constraint on interpretation: thinkers can only be interpreted if a good proportion of their beliefs (...) are rational and, for Davidson, rationality entails logical consistency. The possibility of Gullible therefore forces us to reject this logicist aspect of Davidson’s account of interpretation and intelligibility. (shrink)

This article explores and defends the claim that addictive desires—for alcohol in particular—are partly explained by the motive of self-escape. We consider how this claim sits with the neurophysiological explanation of the strength of addictive desires in terms of the effect addictive substances have on the dopamine system. We argue that nothing in the neuroscientific framework rules out pluralism about the causes of addictive desire.

All communities have common resources that are vulnerable to selfish motives. The current paper explores this challenge in the specific case of the urban commons, defined as the public spaces and scenery of city neighborhoods. A theoretical model differentiates between individual incentives and social incentives for caring for the commons. The quality of a commons is defined as the level of physical (e.g., loose garbage) and social (e.g., public disturbances) disorder. A first study compared levels of disorder across the census (...) block groups of a single city; the second compared the disorder generated by individual addresses in two neighborhoods. Each study found that homeownership, an individual incentive, was the main predictor of disorder. Owner-occupied parcels generated less disorder than their renter-occupied neighbors, but both parcel types produced less disorder in a neighborhood with greater homeownership. The results emphasize the need for considering both individual and social incentives for group-beneficial behaviors. (shrink)

Information is the fourth core element of public health legal preparedness and of legal preparedness for public health emergencies specifically. Clearly, the creation, transmittal, and application of information are vital to all public health endeavors. The critical significance of information grows exponentially as the complexity and scale of public threats increase.Only a small body of organized information on public health law existed before the 21st century: a series of landmark books published beginning in 1926 by Tobey, Grad, and Wing ; (...) model public health laws published as early as 1907; systematic reviews of original research studies published in the 1990s; and a small but growing number of articles published in public health journals and law reviews.With the new century came new public health law programs and activities at the Centers for Disease Control and Prevention, in public health professional associations, and in numerous non-profit and academic organizations. In this paper I argue that the development of cubism by Picasso and Braque at the beginning of the twentieth century can be illuminated by consideration of long-running philosophical debates concerning perceptual realism, in particular by Locke’s distinction between primary and secondary properties, and Kant’s empirical realism. Daniel-Henry Kahnweiler, Picasso’s dealer and early authority on cubism, interpreted Picasso and Braque as Kantian in their approach. I reject his influential interpretation, but propose a more plausible, Kantian reading of cubism.

The Department of Health and Human Services, Office for Civil Rights enforces Section 504 of the 1973 Rehabilitation Act and Title II of the Americans with Disabilities Act. OCR works through complaint investigations and compliance reviews, as well as outreach, technical assistance, and public education to promote voluntary compliance. In the Olmstead decision of June 1999, the Supreme Court held that the ADA’s “integration regulation” requires state and local government to administer services, programs, and activities in the most integrated setting (...) appropriate to the needs of qualified individuals with disabilities. The decision changed the focus from whether a right to more integrated services exists, to under what circumstances and how services will be provided. The New Freedom Initiative announced by President Bush in February 2001 is a broadbased initiative to remove barriers to community living for people with disabilities and promote swift implementation of the Olmstead decision. Daniel, Michael E Review of: Martin Griver unearthed, by Odhran O'Brien, Strathfield, NSW: St Pauls, 2014, pp. 261, hardback, $39.95; paperback, $35.95.

_In his book_ The Yogasūtra of Patañjali: A New Introduction to the Buddhist Roots of the Yoga System_, Pradeep Gokhale reveals a new picture of the Yogasūtra. He shows us, verse after verse, Buddhist influences on this classical text, which is usually seen as rooted in the Sā__ṃ__khya tradition. Gokhale does not merely argue that Patañjali borrows from Buddhist sources; he substantiates his argument with numerous detailed examples, traveling back and forth between Patañjali and Buddhist thinkers such as Asa__ṅ__ga and (...) Vasubandhu. Gokhale further argues that Vyāsa, Patañjali’s most authoritative commentator, makes a __political move in his commentary by distancing Patañjali from the Buddhists and situating him on the “right side” of the philosophical map, namely the __ā__stika side, the side of the loyalists of the Veda. __The implications are __far-reaching. First, __Patañjali and Vyāsa cannot be one and the same person, as claimed by solid Yogasūtra scholars such as Philipp Maas. __Second, the Patañjali of the Yogasūtra cannot be identified with his namesake, the __author of the Mahābhā__ṣ__ya, “The Great Commentary” on some of the themes discussed by Pā__ṇ__ini, the forefather of Indian linguistics. Patañjali, the linguist, is dated to the 2nd or 3rd century BCE; Patañjali of the Yogasūtra would now have to be pushed forward to the 5th century CE as Gokhale implies. Like Daya Krishna before him, Gokhale highlights the contribution of Buddhist texts and thinkers, often undermined or marginalized in the narrative of the history of Indian philosophy, at least as __it is __sketched in India. In this respect, I briefly visit Daya Krishna’s essay “Was Ācārya Śa__ṅ__kara responsible for the disappearance of Buddhist Philosophy from India?” (1999). Finally, I mention Karen O’Brien-Kop’s research. Like Gokhale, she makes an attempt to join the dots between Pātañjala-yoga and the Buddhist Yogācāra._. (shrink)

According to the traditional view of Empedocles' cosmic cycle, there are two creations of plants and animals, one under the dominion of increasing Strife and one under the dominion of increasing Love. At the point at which Strife holds complete sway the four elements are completely separated and all life is destroyed; at the point at which Love is completely dominant there is also a destruction of the biological world, this time because the elements are blended into a perfectly homogeneous (...) mixture. This interpretation of the cosmic cycle, which has prevailed almost since it was developed by Friedrich Panzerbieter and seconded by authority of Eduard Zeller was challenged by Paul Tannery and then by H. von Arnim . Long after these essentially programmatic critiques, three independent studies published in 1965 by Jean Bollack, Uvo Hölscher and Friedrich Solmsen mounted a vigorous challenge to the received view. However, in a detailed monograph devoted to Empedocles' cosmic cycle, Denis O'Brien brought to bear an impressive array of scholarly evidence and critical acumen in support of the traditional view . Several challenges to the traditional view have appeared since O'Brien's book, of which the most significant is that of A. A. Long, who, while criticizing attempts of some opponents of the traditional view, produced some novel and interesting arguments against it. Although the traditional view continues to enjoy the support of authorities such as Jonathan Barnes and M. R. Wright, there is a decided shift in favour of revisionary views. Nevertheless recent advocates of a revisionary interpretation do not provide detailed refutations of the traditional view; Long's arguments remain the strongest objections to the traditional view, and they have never been refuted. In this paper I want to propose that we see solipsism as arising from certain problems we have about identifying ourselves as subjects in an objective world. The discussion will centre on Wittgenstein’s treatment of solipsism in his Tractatus Logico- Philosophicus. In that work Wittgenstein can be seen to express an unusually profound understanding of the problems faced in trying to give an account of how we, who are subjects, identify ourselves as objects in the world. We have in his (...) compressed remarks, the kernels of a number of arguments which all come together to form what can be called the problem of self-identification. I want to argue that the solipsism of the Tractatus arises at least in part as a solution to, or – to put it less optimistically – as a symptom or articulation of this problem. In approaching Wittgenstein’s early discussion of solipsism in this way I will obviously be in disagreement with some other interpretations of the work. For example, there are those who think that there is no ‘solipsism of the Tractatus’.1 In fact, the Tractarian arguments presented below as motivating solipsism have been seen as fulfilling the quite opposite function of refuting it. I do not intend in this piece to engage with alternative interpretations. Let me say a little bit about why I have granted myself the licence not to do so. First, the focus of my concern with solipsism is on how it connects with what I have called the problem of self-identification. Lucy O'Brien argues that a satisfactory account of first-person reference and self-knowledge needs to concentrate on our nature as agents. Clearly written, with rigorous discussion of rival views, this book will be of interest to anyone working in the philosophy of mind and action.

The “New Natural Law” Theory (NNL) of Germain Grisez, John Finnis, Joseph Boyle, and their collaborators offers a distinctive account of intentional action, which underlies a moral theory that aims to justify many aspects of traditional morality and Catholic doctrine. -/- In fact, we show that the NNL is committed to premises that entail the permissibility of many actions that are irreconcilable with traditional morality and Catholic doctrine, such as elective abortions. These consequences follow principally from two aspects of the (...) NNL. The first aspect is its distinctive version of the planning theory of intention, in which adopting the 'first-person perspective' of an agent is a sufficient, and not merely necessary, condition for determining the nature of his intentional action; this planning theory rests upon an implicitly Cartesian conception of human behavior, in which behavior chosen by an agent has no intrinsic “intentionalness” apart from what he confers upon it as part of his plan. The second aspect is the NNL's distinctive account of basic human goods' incommensurability, according to which there is no common factor shared by basic human goods that allows them to be comparatively ranked in any way that directs practical deliberation. -/- The entailments of these two aspects of the NNL, we argue, amount to a reductio ad absurdum. Pace the proponents of the NNL account, we sketch an alternative hylomorphic conception of intentional action that avoids untoward moral implications by grounding human agency in the exercise of basic powers that are either (a) essential constituents of human nature or (b) acquired through participation in social practices. This conception of intentional action provides a stronger foundation for natural law theory. (shrink)

O'Brien provides a critical assessment of Ernest Mandel's 1975 monograph Late Capitalism. In so doing, he offers a historical narrative that puts into question Mandel's framing of 'waves' of capitalist development as a process of capital accumulation that was dependent upon uneven development in the Third World. O'Brien starts by problematising Mandel's argument that an initial concentration of money, capital and bullion in the hands of Europeans explains combined and uneven development. He goes on to demonstrate that Mandel's notion of (...) imperialism as a necessary conduit for the flow of surplus capital from industrialising Europe does not stand up to the historical evidence. In fact, O'Brien maintains an alternative thesis, namely that these marginalised regions were insuffciently penetrated by European capital. (shrink)

How is it that we think and refer in the first-person way? For most philosophers in the analytic tradition, the problem is essentially this: how two apparently conflicting kinds of properties can be reconciled and united as properties of the same entity. What is special about the first person has to be reconciled with what is ordinary about it. The range of responses reduces to four basic options. The orthodox view is optimistic: there really is a way of reconciling these (...) apparently contradictory properties as contained within the same thing. The heretical views are pessimistic and content to be so: there is no such way, and that is because there is simply nothing to reconcile – because there is really nothing special about what is in question; or there is really nothing ordinary about it; or there is really nothing …. The twelve specially written essays in this volume investigate the neglected topic of mental action, and show its importance for the metaphysics, epistemology, and phenomenology of mind. The essays investigate what mental actions are, how we are aware of them, and what is the relationship between mental and physical action.

In chapter 3 of Wild Animal Ethics Johannsen argues for a collective obligation based on beneficence to intervene in nature in order to reduce the suffering of wild animals. In the same chapter he claims that the non-identity problem is merely a “theoretical puzzle” which doesn’t affect our reasons for intervention. In this paper I argue that the non-identity problem affects both the strength and the nature of our reasons to intervene. By intervening in nature on a large scale we (...) change which animals come into existence. In doing so, we enable harmful animals to inflict harms on other animals, and we put other animals in harm’s way. The harms that these animals will inflict and endure are foreseeable. Furthermore, since non-human animals aren’t moral agents, harmful animals cannot be morally responsible for their harmful actions. I argue therefore that by causing animals to exist, knowing that they will inflict and suffer harms, we become morally responsible for those harms. By engaging in identity-affecting actions then we take on secondary moral duties towards the animals we have thereby caused to exist, and these secondary moral duties may be extremely demanding, even more so than the initial costs of intervention. Finally, these duties are duties of justice rather than duties of beneficence, and as such are more stringent than purely beneficence-based moral reasons. Furthermore, this conclusion flows naturally from several plausible principles which Johannsen explicitly endorses. (shrink)

John Rawls’s political liberalism and its ideal of public reason are tremendously influential in contemporary political philosophy and in constitutional law as well. Many, perhaps even most, liberals are Rawlsians of one stripe or another. This is problematic, because most liberals also support the redefinition of civil marriage to include same-sex unions, and as I show, Rawls’s political liberalism actually prohibits same- sex marriage. Recently in Perry v. Schwarzenegger, however, California’s northern federal district court reinterpreted the traditional rational basis review (...) in terms of liberal neutrality akin to Rawls’s “public reason,” and overturned Proposition 8 and established same-sex marriage. (This reinterpretation was amplified in the 9th Circuit Court’s decision upholding the district court on appeal in Perry v. Brown.) But on its own grounds Perry should have drawn the opposite conclusion. This is because all the available arguments for recognizing same-sex unions as civil marriages stem from controversial comprehensive doctrines about the good, and this violates the ideal of public reason; yet there remains a publicly reasonable argument for traditional marriage, which I sketch here. In the course of my argument I develop Rawls’s politically liberal account of the family by drawing upon work by J. David Velleman and H. L. A. Hart, and discuss the implications of this account for political theory and constitutional law. (shrink)

In our contemporary post-modern context, it has become increasingly awkward to talk about a good that is shared by all. This is particularly true in the context of mammoth multi-national corporations operating in global markets. Nevertheless, it is precisely some of these same enormous, aggrandizing forces that have given rise to recent corporate scandals. These, in turn, raise questions about ethical systems that are focused too myopically on self-interest, or the interest of specific groups, locations or cultures. The obvious traditional (...) alternative to moral bellybutton gazing is the common good, which challenges the modern business enterprise to realize non-instrumental values that can only be attained in our life together. The common good dictates that leadership should be judged, first of all, according to moral criteria rather than professional competence. It helps correct the distorted prioritization of the maximization of profit in every business decision, recognizing that businesses have a multitude of rights and responsibilities, and the common good reminds us that the first of these is not always profit-making. On the face of it, these patients lack the kind of control and self-awareness we ordinarily take ourselves to have when acting intentionally. Questions raised by this phenomenon include: What is involved in being aware of an action as one's own? What is the nature of the control these patients are lacking and which characterizes normal intentional actions? What is the relation between a priori explanations of consciousness and self-consciousness, on the one hand, and empirical work on the information-processing mechanisms involved in action control, on the other? Questions of action control and self-awareness tend to be treated separately in both philosophy and psychology. The central idea behind this volume is that outstanding unresolved issues on both topics, and in both disciplines, can only be resolved by an interdisciplinary examination of the relations between them. My aim in this paper is to articulate further what may be called an agency theory of self-knowledge. Many theorists have stressed how important agency is to self- knowledge, and much work has been done drawing connections between the two notions.² However, it has not always been clear what _epistemic_ advantage agency gives us in this area and why it does so. I take it as a constraint on an adequate account of how a subject knows her own mental states (...) and acts, that it construe the known mental states and acts realistically and as independent of their self-ascription, and that it deliver genuine epistemic standing to the knower. The main task of the paper will, then, be to explore how our having rational agency with respect to our mental states may be able to secure genuine epistemic warrant for our self-ascriptions of states or acts independent of the ascriptions. This task will be carried out by focussing on the question of what account we should give of our knowledge of what I call our acts of judging. In the remainder of this section, I will do a little to clarify what is meant by that question. Section 2 will attempt to introduce us to elements of the best way to approach the question by considering some alternative strategies. Section 3 is devoted to forming some idea of what _kind_ of warrant we are looking for when considering how agency might give us self-knowledge. Section 4 aims to present a suggestion as to how agency gives us the kind of warrant identified over our acts of judging. Section 5 deals with some objections. (shrink)

Doctors have an ethical and legal duty to respect patient confidentiality. We consider the basis for this duty, looking particularly at the meaning and value of autonomy in health care. Enabling patients to decide how information about them is disclosed is an important element in autonomy and helps patients engage as active partners in their care.Good quality data is, however, essential for research, education, public health monitoring, and for many other activities essential to provision of health care. We discuss whether (...) it is necessary to choose between individual rights and the wider public interest and conclude that this should only rarely be necessary. The paper makes some recommendations on practical steps which could help ensure that good quality information is available for work which benefits society and the public health, while still enabling patients’ autonomy to be respected. In this paper I want to examine a claim made about the kind of immunity through misidentification relative to the first person (IEM) that attaches to action self-ascriptions. In particular, I want to consider whether we have reason to think a stronger kind of immunity attaches to action self-ascriptions, than attaches to self-ascriptions of bodily movement. I assume we have an awareness of our actions – agent’s awareness – and that agent’s awareness is not a form of perceptual bodily awareness. (...) The issue here is whether agents’ awareness grounds a kind of immunity to error that bodily awareness does not. However, perhaps more importantly, I want to argue that we only get a secure difference in immunity claims if have already decided whether a source of information is essentially first personal or not and made certain, not obviously warranted assumptions, about the transparency of content and about knowledge. If we hold that a subject’s knowledge of her actions is essentially first personal, in a way that a subject’s knowledge of her body through bodily awareness may not be, then we are better off arguing for that claim directly. Hitherto reconstructions of Empedocles' cosmic cycle have usually been offered as part of a larger work, a complete history of Presocratic thought, or a complete study of Empedocles. Consequently there has perhaps been a lack of thoroughness in collecting and sifting evidence that relates exclusively to the main features of the cosmic cycle.

Proponents of ecological restoration view the practice as a means of both repairing damage done to ecosystems by humans and creating an avenue to re-establish respectful and cooperative human-environment relationships. One debate affecting ecological restoration focuses on the place of 'exotic' species in restored ecosystems. Though popular, campaigns against exotics have been criticized for their troubling rhetorical parallels with nativism aimed at human immigrants. I point to some of the reasons why this critique of nativism persists, despite protests that no (...) xenophobic intent is evident, emphasizing the intimacy between social metaphors and claims about exotic nature. Language is but one facet of an entanglement of nature and society that ecological restoration strives to take seriously; however, restoration practice remains ambivalent toward this dichotomy permitting a longing for lost community purity that is embraced in nativism. Regarding defenses of nativism, I point out limitations of attempts to reframe the issue from a reactionary rejection of the foreign Other toward an argument for protecting communities from a process akin to 'cultural imperialism'.
