Faced with the choice between supporting industrial plant agriculture and hunting, Tom Regan’s rights view can be plausibly developed in a way that permits a form of hunting we call “dignitarian.” To motivate this claim, we begin by showing how the empirical literature on animal deaths in plant agriculture suggests that a non-trivial amount of hunting would not add to animal harm. We discuss how Tom Regan’s miniride principle appears to morally permit hunting in that case, and we (...) address recent objections by Jason Hanna to environmentally-based culling that may be seen to speak against this conclusion. We then turn to dignity, which is especially salient in scenarios where harm is necessary or justifiable. We situate “dignitarian” hunting within a larger framework of adversarial ethics, and argue that dignitarian hunting gives animals a more dignified death than the alternatives endemic to large-scale plant agriculture, and so is permissible based on the kinds of principles that Regan endorses. Indeed, dignitarian hunting may actually fit better with Regan’s widely endorsed animal rights framework than the practice of many vegans, and should only be rejected if we’re just as willing to condemn supporting conventional plant agriculture. Gallagher’s main claim can be enhanced neurophenomenologically. In his 1907 lectures Thing and Space, Husserl argued that perception in general is enactive. Moreover, the neuroscientific theory of predictive processing connects neatly to a future-oriented phenomenology.

A common objection to Humeanism about natural laws is that, given Humeanism, laws cannot help explain their instances, since, given the best Humean account of laws, facts about laws are explained by facts about their instances rather than vice versa. After rejecting a recent influential reply to this objection that appeals to the distinction between scientific and metaphysical explanation, I will argue that the objection fails by failing to distinguish between two types of facts, only one of which Humeans should (...) regard as laws. I will then conclude by rebutting a variant of this objection that appeals to a principle of metaphysical explanation recently put forward by Kit Fine. (shrink)

The dominant methodology in health policy for prioritizing and rationing health care resources is cost-effectiveness analysis, typically using quality adjusted life years (QALYs) or disability adjusted life years (DALYs) to measure health outcomes. The construction of these measures involves a number of moral or value choices, including: How should states of health and disability be evaluated, and whose preferences (e.g., the disabled or non-disabled) should be used? How should these evaluations reflect that prioritization will involve tradeoffs between health benefits for (...) different persons or groups? Do all QALYs count equally, no matter what age at which they are received? Should discount rates be applied to health benefits? I will show the nature of the moral issues at stake in answering these questions, and briefly argue how they should be answered. (shrink)

In these writings by one of our most creative legal philosophers, Meir Dan-Cohen explores the nature of the self and its response to legal commands and mounts a challenge to some prevailing tenets of legal theory and the neighboring moral, political, and economic thought. The result is an insider's critique of liberalism that extends contemporary liberalism's Kantian strand, combining it with postmodernist ideas about the contingent and socially constructed self to build a thoroughly original perspective on some of the most (...) vital concerns of legal and moral theory.Dan-Cohen looks first at the ubiquity of legal coercion and considers its decisive impact on the nature of legal discourse and communication, on law's normative aspirations and claim to obedience, and on the ideal of the rule of law. He moves on to discuss basic values, stressing the preeminence of individual identity and human dignity over the more traditional liberal preoccupations with preference-based choice and experiential harm. Dan-Cohen then focuses more directly on the normative ramifications of the socially constructed self. Fundamental concepts such as responsibility and ownership are reinterpreted to take account of the constitutive role that social practices--particularly law and morality--play in the formation of the self.Throughout, Dan-Cohen draws on a uniquely productive mix of philosophical traditions and subjects, blending the methods of analytic philosophy with the concerns of Continental philosophers to reconceive the self and its relation to ethics and the law. Philosophers of physics have long debated whether the Past State of low entropy of our universe calls for explanation. What is meant by “calls for explanation”? In this article we analyze this notion, distinguishing between several possible meanings that may be attached to it. Taking the debate around the Past State as a case study, we show how our analysis of what “calling for explanation” might mean can contribute to clarifying the debate and perhaps to settling it, thus demonstrating the (...) fruitfulness of this analysis. Applying our analysis, we show that two main opponents in this debate, Huw Price and Craig Callender, are, for the most part, talking past each other rather than disagreeing, as they employ different notions of “calling for explanation”. We then proceed to show how answering the different questions that arise out of the different meanings of “calling for explanation” can result in clarifying the problems at hand and thus, hopefully, to solving them. As the Mohist doctrine of inclusive care (jian ai 兼愛) is usually understood, it is an affront to both human nature and commonsense morality.1 We are told that the Mohists rejected all particularist ties, especially to family, in the interests of a radically universalist ethic.2 But love for those close to us is deeply rooted in our natures, and few would deny that this love has moral significance. If the Mohists did deny this, it would be easy to dismiss them, (...) regardless of the abstract weight of their arguments. But the Mohists did not deny this. Dan Marshall and Josh Parsons note, correctly. that the property of being either a cube or accompanied by a cube is incorrectly classified as intrinsic under the definition we have given unless it turns out to be disjunctive. Whether it is disjunctive, under the definition we gave, turns on certain judgements of the relative naturalness of properties. They doubt the judgements of relative naturalness that would classify their property as disjunctive. We disagree. They also suggest that the whole idea of (...) judging relative naturalness is a dubious business. We reply that, like them or not, such judgements cannot easily be avoided. (shrink)

While much ink has been spilt over the political importance of speech, much less has been dedicated to the political importance of silence. This article seeks to fill that gap. We propose the need for a robust, democratic right to silence in public life and argue that there are politically salient epistemic reasons for recognising that right. We begin by defining what silence is and what a robust right to silence entails. We then argue that the right to silence offers (...) two politically salient epistemic benefits. The first is that, if the right to silence is maintained, we can avoid the epistemic harm that may be caused when an individual is compelled to lie in public. The second is that the right to silence can protect marginalised individuals against the epistemic injustices that may arise when others are likely to misconstrue their speech. (shrink)

This article develops, illustrates, and defends a conception of immanent critique. Immanent critique is construed as a form of hermeneutical practice and second-order political and normative criticism. The common charge that immanent critique is a form of philosophical conventionalism necessarily committed to value relativism and to the rejection of transcultural and cosmopolitan norms is denied. But immanent critique insists that meaningful and potentially efficacious criticism must be connected to relevant criteria and understandings internal to the culture or social order at (...) which the criticism is directed. The complaint that this demand will likely limit political and moral criticism is also denied, and the ability of immanent critique to develop from convention unconventional thinking is defended and demonstrated. The leading account of intrinsicality over the last thirty years has arguably been David Lewis's account in terms of perfect naturalness. Lewis's account, however, has three serious problems: i) it cannot allow necessarily coextensive properties to differ in whether they are intrinsic; ii) it falsely classifies non-qualitative properties like being Obama as non-intrinsic; and iii) it is incompatible with a number of metaphysical theories that posit irreducibly non-categorical properties. I argue that, as a result of these problems, Lewis's account should (...) be rejected and replaced with an alternative account, which also analyses intrinsicality in terms of perfect naturalness, but which avoids these problems. I argue for the merits of studying historical moral revolutions to inform moral and political philosophy. Such a research program is not merely of empirical, historical interest but has normative implications. To explain why, I situate the proposal in the tradition of naturalized epistemology. As Alison M. Jaggar and other scholars have argued, a naturalistic approach is characteristic of much feminist philosophy. Accordingly, I argue that the study of moral revolutions would be especially fruitful for feminist moral and political philosophers.

This essay reconsiders Jean-Jacques Rousseau’s debt to Jean Bodin, on the basis of Daniel Lee’s recent revision of Bodin as a theorist of popular sovereignty. It argues that Rousseau took a key feature of his own theory of democratic sovereignty from Bodin—namely, the dual identity of political members as both citizens and subjects of the state. It further makes the case that this dual identity originates in medieval corporatist law, which Bodin was summarizing. Finally, it demonstrates the lasting impact of (...) corporatist law in eighteenth-century France, highlighting Rousseau’s direct borrowings from the corporatist language and logic of contemporary commercial societies. In this regard, the article revisits and updates Otto von Gierke’s classic argument about the origins of the state in corporatist thought. (shrink)

This paper addresses two questions: first, when making decisions about what to do, does the mere fact that we will feel regretful or guilty or proud afterward give us reason to act? I argue that these emotions of self-assessment give us little or no reason to act. The second question concerns emotional valence--how desirable or undesirable our emotions are. What is it that determines the valence of an emotion like regret? I argue that the valence of emotions, and indeed of (...) feelings like pain more broadly, is a function of the sensations they involve. As I suggest, understanding the point about emotional valence helps us answer the first question about anticipated emotions. The paper concludes with a discussion of death-bed regrets, and of whether teenagers should listen to their annoying parents. (shrink)

Several theorists have been attracted to the idea that in order to account for counterpossibles, i.e. counterfactuals with impossible antecedents, we must appeal to impossible worlds. However, few have attempted to provide a detailed impossible worlds account of counterpossibles. Berit Brogaard and Joe Salerno’s ‘Remarks on Counterpossibles’ is one of the few attempts to fill in this theoretical gap. In this article, I critically examine their account. I prove a number of unanticipated implications of their account that end up implying (...) a counterintuitive result. I then examine a suggested revision and point out a surprising implication of the revision. (shrink)

In a range of contexts, individuals arrive at collective decisions by sharing confidence in their judgements. This tendency to evaluate the reliability of information by the confidence with which it is expressed has been termed the ‘confidence heuristic’. We tested two ways of implementing the confidence heuristic in the context of a collective perceptual decision-making task: either directly, by opting for the judgement made with higher confidence, or indirectly, by opting for the faster judgement, exploiting an inverse correlation between confidence (...) and reaction time. We found that the success of these heuristics depends on how similar individuals are in terms of the reliability of their judgements and, more importantly, that for dissimilar individuals such heuristics are dramatically inferior to interaction. Interaction allows individuals to alleviate, but not fully resolve, differences in the reliability of their judgements. We discuss the implications of these findings for models of confidence and collective decision-making. (shrink)

If K is an index of relative voting power for simple voting games, the bicameral postulate requires that the distribution of K -power within a voting assembly, as measured by the ratios of the powers of the voters, be independent of whether the assembly is viewed as a separate legislature or as one chamber of a bicameral system, provided that there are no voters common to both chambers. We argue that a reasonable index – if it is to be used (...) as a tool for analysing abstract, ‘uninhabited’ decision rules – should satisfy this postulate. We show that, among known indices, only the Banzhaf measure does so. Moreover, the Shapley–Shubik, Deegan–Packel and Johnston indices sometimes witness a reversal under these circumstances, with voter x ‘less powerful’ than y when measured in the simple voting game G1 , but ‘more powerful’ than y when G1 is ‘bicamerally joined’ with a second chamber G2 . Thus these three indices violate a weaker, and correspondingly more compelling, form of the bicameral postulate. It is also shown that these indices are not always co-monotonic with the Banzhaf index and that as a result they infringe another intuitively plausible condition – the price monotonicity condition. We discuss implications of these findings, in light of recent work showing that only the Shapley–Shubik index, among known measures, satisfies another compelling principle known as the bloc postulate. We also propose a distinction between two separate aspects of voting power: power as share in a fixed purse (P-power) and power as influence (I-power). (shrink)

This paper presents a computational model that integrates a dynamically structured holographic memory system into the ACT-R cognitive architecture to explain how linguistic representations are encoded and accessed in memory. ACT-R currently serves as the most precise expression of the moment-by-moment working memory retrievals that support sentence comprehension. The ACT-R model of sentence comprehension is able to capture a range of linguistic phenomena, but there are cases where the model makes the wrong predictions, such as the over-prediction of retrieval interference (...) effects during sentence comprehension. Here, we investigate one such case involving the processing of sentences with negative polarity items and consider how a dynamically structured holographic memory system might provide a cognitively plausible and principled explanation of some previously unexplained effects. Specifically, we show that by replacing ACT-R's declarative memory with a dynamically structured memory, we can explain a wider range of behavioral data involving reading times and judgments of grammaticality. We show that our integrated model provides a better fit to human error rates and response latencies than the original ACT-R model. These results provide proof-of-concept for the unification of two independent computational cognitive frameworks. (shrink)

This article addresses two controversial open questions in philosophical aesthetics: the nature and value of the aesthetic and of aesthetic experience when approached from the standpoint of ‘aesthetics of everyday life’ (AEL). Contrasting ‘strong’ AEL accounts that consider them radically different from those in the sphere of art, I claim that extending the realm and scope of aesthetics towards everyday life does not necessarily dispense with the concepts of the aesthetic and aesthetic experience as shaped in relation to the arts. Drawing on ‘weak’ formulations of AEL and on theories that call attention to concepts of art different from modern ones, I defend a normative but open model of the aesthetic and aesthetic experience pertaining to both art and everyday life. This more integrative theoretical framework needs to include clear and consistent views of the aesthetic as well as of the self, intersubjectivity, and everyday life. (shrink)
