Screening programmes are becoming increasingly popular since prevention is considered 'better than cure'. While earlier diagnosis may result in more effective treatment for some, there will be consequent harm for others due to anxiety, stigma, side-effects etc. A screening test cannot guarantee the detection of all 'abnormal' cases, therefore there will be false reassurance for some. A proper consideration of the potential benefit and harm arising from screening may lead to the conclusion that the programme should not be offered. In the United Kingdom, the debate about how best to meet the shortfall of organs for transplantation has persisted on and off for many years. It is often presumed that the answer is simply to alter the law to a system of presumed consent. Acting perhaps on that presumption in his annual report launched in July, the Chief Medical Officer, Sir Liam Donaldson, advocated a system of organ donation based on presumed consent, the so-called “opt-out” system.1 He is calling for (...) a change in the law in England and Wales whereby consent to organ donation is presumed, making a person’s organs automatically available for transplantation after death, unless they registered objections to this while alive. Subsequently, the British Medical Association lent its support to the introduction of such a system.2 The BMA contends that “the practice of presumed consent legislation has had a significant effect on the number of cadaveric donors per million population.”2It is often taken for granted that there must be a correlation between the enactment of legislation on presumed consent and an increase in organ donation and procurement. However, the correlation is not as straightforward as it might seem. It may be that other practical measures to encourage organ donation could be implemented without changing the Human Tissue Act 2004, an Act which has been in force for barely a year.An analysis by Abadie and Gay demonstrated that “presumed consent legislation has a positive and sizeable effect on organ donation rates”,3 but they themselves admitted that the correlation between rates of donation and presumed consent legislation is “not completely unequivocal”.3 It is true that among the most successful cases in procurement rates are countries with presumed consent legislation . Forensic science and its influence on policing and the criminal justice system have increased since the beginning of the twentieth century. While the philosophies of the forensic science pioneers remain the pillar of modern practice, rapid advances in technology and the underpinning sciences have seen an explosion in the number of disciplines and tools. Consequently, the way in which we exploit and interpret the remnant of criminal activity are adapting to this changing environment. In this paper, nine postdoctoral research fellows from a multidisciplinary team discuss their vision for the future of forensic science at the crime scene, in the laboratory and beyond. This paper examines the ethical and legal duties of confidentiality owed by the nurse, with special reference to obligation to the employer. The main focus is on exploring the parameters of that duty and determining circumstances in which it might be ethically and legally justifiable to disclose confidential information. It is submitted that the obli gation to preserve the confidence of the patient or employer is relative rather than abso lute. In exceptional cases, disclosure is permissible in order to prevent (...) harm to others or to promote a greater public good. A number of suggestions for reform are also made, with a view to reinforcing nurses' ethical and legal rights to exercise discretion to dis close confidential information in appropriate cases in order to protect themselves from victimization by employers. This, the third volume in The Pelican History of the Church, offers an extremely perspicacious view of the entire period. While there were nationalistic, economic, and political interests responsible for the Reformation and while there was no one, simple religious motivation, underlying all of these causes was a profound dissatisfaction with the moral and religious tone of late medieval society. However haltingly and destructively the Reformation proceeded, it is evident that the result was a general strengthening of authentic religious life (...) in both Protestant and Catholic countries. And where the state assumed some of the secular functions of the medieval Church this seemed to eventually benefit both Church and State. However, Chadwick does not gloss over grosser aspects of the period: the so-called wars of religion, the endless and destructive polemics between churches, and the ruthless confiscation of ecclesiastical property. If greedy lords helped free the Church from the mammon of iniquity, this was accompanied by cultural and artistic losses with no improvement in the lot of the poor country cleric despite the reduced status of the wealthy bishop or abbot. Chadwick is particularly good in his descriptions of the relationship of the political to the religious. But what is of special interest are the sometimes bewildered and reactionary responses of the little Christian to the dramatic events of the time.—D. J. B. (shrink)

Mathematicians often describe the importance of well-developed intuition to productive research and successful learning. But neither education researchers nor philosophers interested in epistemic dimensions of mathematical practice have yet given the topic the sustained attention it deserves. The trouble is partly that intuition in the relevant sense lacks a usefully clear characterization, so we begin by offering one: mature intuition, we say, is the capacity for fast, fluent, reliable and insightful inference with respect to some subject matter. We illustrate the (...) role of mature intuition in mathematical practice with an assortment of examples, including data from a sequence of clinical interviews in which a student improves upon initially misleading covariational intuitions. Finally, we show how the study of intuition can yield insights for philosophers and education theorists. First, it contributes to a longstanding debate in epistemology by undermining epistemicism, the view that an agent’s degree of objectual understanding is determined exclusively by their knowledge, beliefs and credences. We argue on the contrary that intuition can contribute directly and independently to understanding. Second, we identify potential pedagogical avenues towards the development of mature intuition, highlighting strategies including adding imagery, developing associations, establishing confidence and generalizing concepts. We defend a noetic account of intramathematical explanation. On this view, a piece of mathematics is explanatory just in case it produces understanding of an appropriate type. We motivate the view by presenting some appealing features of noeticism. We then discuss and criticize the most prominent extant version of noeticism, due to Inglis and Mejía Ramos, which identifies explanatory understanding with the possession of well-organized cognitive schemas. Finally, we present a novel noetic account. On our view, explanatory understanding arises from (...) meeting specific explanatory objectives. We defend a cluster-concept account of explanatory objectives and identify four important subfamilies within the relevant network of resemblance relations. The resulting view is objectivist (in the sense that it takes explanatory success to be a matter of observer-independent fact), broader in scope than why-question-based accounts, compatible with empirical findings on experts’ explanatory judgments, and capable of generalizing (with appropriate provisos) to scientific explanation as a whole. It thus fulfills Friedman’s half-century-old demand for a general and objectivist theory which accounts for the link between explanation and understanding. (shrink)

This paper presents a critical analysis of dual-class share structures (DCSS) within an ethical and logical framework for ownership and control. Moreover, it contends that the existence of DCSS constitutes a de facto infringement on the ownership rights of shareholders. By adopting a conceptual approach rooted in symbolic logic, the paper demonstrates that DCSS falls short of the ethical precept of “one share, one vote” and is therefore an unjust and inefficient equity arrangement. In "Digital Doppelgängers and Lifespan Extension: What Matters?", Iglesias et al. argue that “some of the aims or ostensible goods of person-span expansion could plausibly be fulfilled in part by creating a digital doppelgänger”. Since person-extension aims are deeply heterogeneous, however, no single type of doppelgänger system is likely to suffice to meet all such needs. We propose a partial typology of doppelgängers—the family heirloom, the research archive, the public legacy, the project surrogate—and suggest appropriate training methods, design features and (...) governing norms for each. The role of the environment in producing the correct classical limit in the Bohm interpretation of quantum mechanics is investigated, in the context of a model of quantum Brownian motion. One of the effects of the interaction is to produce a rapid approximate diagonalisation of the reduced density matrix in the position representation. This effect is, by itself, insufficient to produce generically quasi-classical behaviour of the Bohmian trajectory. However, it is shown that, if the system particle is initially in an (...) approximate energy eigenstate, then there is a tendency for the Bohmian trajectory to become approximately classical on a longer time-scale. The relationship between this phenomenon and the behaviour of the Wigner function post-decoherence is discussed. (shrink)

Eugenics casts a long shadow over contemporary genetics. Any measure, whether in clinical genetics or biotechnology, which is suspected of eugenic intent is likely to be opposed on that ground. Yet there is little consensus on what this word signifies, and often only a remote connection to the very complex set of social movements which took that name. After a brief historical summary of eugenics, this essay attempts to locate any wrongs inherent in eugenic doctrines. Four candidates are examined and (...) rejected. What has come to be known as “a priori physicalism” is the thesis, roughly, that the non-physical truths in the actual world can be deduced a priori from a complete physical description of the actual world. To many contemporary philosophers, a priori physicalism seems extremely implausible. In this paper I distinguish two kinds of a priori physicalism. One sort – strict a priori physicalism – I reject as both unmotivated and implausible. The other sort – liberal a priori physicalism – (...) I argue is both motivated and plausible. This variety of a priori physicalism insists that the necessitation of non-physical truths by the physical facts must be underwritten in a certain fashion by a priori knowledge, but the a priori knowledge need not amount to a simple deduction of the non-physical truths from a complete physical description of the world. Further, this sort of liberal a priori physicalism has the advantage that it offers hope for a genuinely satisfying account of how the physical facts manage to necessitate the facts about phenomenal consciousness – thereby in effect solving the “hard problem” of consciousness. The first half of the paper sets out the motivation for liberal a priori physicalism and its superiority to the strict version; the second half presents one strategy available to the liberal a priori physicalist for showing how consciousness can be accommodated in a purely physical world.
