Various U.S. laws, such as the Clean Air Act and the Food Quality Protection Act, require additional protections for susceptible subpopulations who face greater environmental health risks. The main ethical rationale for providing these protections is to ensure that environmental health risks are distributed fairly. In this article, we (1) consider how several influential theories of justice deal with issues related to the distribution of environmental health risks; (2) show that these theories often fail to provide specific guidance concerning policy (...) choices; and (3) argue that an approach to public decision making known as accountability for reasonableness can complement theories of justice in establishing acceptable environmental health risks for the general population and susceptible subpopulations. Since accountability for reasonableness focuses on the fairness of the decision-making process, not the outcome, it does not guarantee that susceptible subpopulations will receive a maximum level of protection, regardless of costs or other morally relevant considerations. Altruistic self-sacrifice is rare, supererogatory, and not to be expected of any rational agent; but, the possibility of giving up one's life for the common good has played an important role in moral theorizing. For example, Judith Jarvis Thomson (2008) has argued in a recent paper that intuitions about altruistic self-sacrifice suggest that something has gone wrong in philosophical debates over the trolley problem. We begin by showing that her arguments face a series of significant philosophical objections; however, our project (...) is as much constructive as critical. Building on Thomson's philosophical argument, we report the results of a study that was designed to examine commonsense intuitions about altruistic self-sacrifice. We find that a surprisingly high proportion of people judge that they should give up their lives to save a small number of unknown strangers. We also find that the willingness to engage in such altruistic self-sacrifice is predicted by a person's religious commitments. Finally, we show that folk-moral judgments are sensitive to agent-relative reasons in a way that diverges in important ways from Thomson's proposed intuitions about the trolley problem. With this in mind, we close with a discussion of the relative merits of folk intuitions and philosophical intuitions in constructing a viable moral theory. (shrink)

Means-based harms are frequently seen as forbidden, even when they lead to a greater good. But, are there mitigating factors? Results from five experiments show that judgments about means-based harms are modulated by: 1) Pareto considerations (was the harmed person made worse off?), 2) the directness of physical contact, and 3) the source of the threat (e.g. mechanical, human, or natural). Pareto harms are more permissible than non-Pareto harms, Pareto harms requiring direct physical contact are less permissible than those that (...) do not, and harming someone who faces a mechanical threat is less permissible than harming someone who faces a non-mechanical threat. These results provide insight into the rich representational structure underlying folk-moral computations, including both the independent and interacting roles of the inevitability, directness and source of harm. This paper explores the embedding of data producing technologies in people's everyday lives and practices. It traces how repeated encounters with digital data operate to naturalise these entities, while often blindsiding their agentive properties and the ways they get implicated in processes of exploitation and governance. I propose and develop the notion of ‘data doxa’ to conceptualise the way in which digital data – and the devices and platforms that stage data – have come to be perceived in Western societies (...) as normal, necessary and enabling. The ‘data doxa’ concept also accentuates the enculturation of many individuals into a data sharing habitus which frames digital technologies in simplistic terms as panaceas for the problems associated with contemporary life, figures of progress and convenience, and mediums of knowledge, pleasure and identity. I suggest that three types of data-based relations contribute to the formation of this doxic sensibility: fetishisation, habit and enchantment. Each of these relations come to mediate public understandings of digital devices and the data they generate, obscuring the multifaceted nature and hidden depths of data and their propensity to double up as technologies of exposure and discipline. As a result of this situation, imaginative educational programs and revamped regulatory frameworks are urgently needed to inform individuals about the contribution of data to the leveraging of value and power in today's digital economies, but also to protect them from experiencing data-based harms. Everyday surveillance work is increasingly performed by non-human algorithms. These entities can be conceptualised as machinic flâneurs that engage in distanciated flânerie: subjecting urban flows to a dispassionate, calculative and expansive gaze. This paper provides some theoretical reflections on the nascent forms of algorithmic practice materialising in two Australian cities, and some of their implications for urban relations and social justice. It looks at the idealisation – and operational black boxing – of automated watching programs, before considering their impacts on (...) notions such as ‘the right to the city’ and ‘the right to the face’. It will argue that the turn to facial recognition software for the purposes of automating urban governance reconstitutes the meanings and phenomenology of the face. In particular, the fleshly and communicative physicality of the face is reduced to a measurable object that can be identified by a virtualised referent and then consequently tracked. Moreover, the asymmetrical and faceless nature of these machinic programs of recognition unsettles conventional notions of civil inattention and bodily sovereignty, and the prioritisation given to pattern recognition renders them amenable to ideas/ideals from phrenology and physiognomy. In this way, algorithmic governance may generate not only forms of facial vulnerability and estrangement, but also facial artifice, where individuals come to develop tacit and artful ways of de-facing and re-facing in order to subvert the processes of recognition which leverage these modes of biopower. Thus, the datafication of urban governance gives rise to a dynamic biopolitics of the face. (shrink)

This paper considers the claim that perceptual experience is “transparent”, in the sense that nothing other than the apparent public objects of perception are available to introspection by the subject of such experience. I revive and strengthen the objection that blurred vision constitutes an insuperable objection to the claim, and counter recent responses to the general objection. Finally the bearing of this issue on representationalist accounts of the mind is considered.

An assessment is made of Rudolf Otto's criticisms of Friedrich Schleiermacher's claim that religious feeling is to be interpreted as essentially involving a feeling of absolute dependence. Otto's criticisms are divided into two kinds. The first suggest that a feeling a dependence, even an absolute one, is the wrong sort of feeling to locate at the heart of religious consciousness. It is argued that this criticism is based on misinterpretations of Schleiermacher's view, which is in fact much closer to Otto's (...) than the latter appreciated. The second kind of criticism suggests that the feeling of absolute dependence cannot play the foundational role assigned to it by Schleiermacher, since it is itself a secondary response. It is argued not only that Otto provides no justification for this criticism, but that Otto's own position is incoherent unless Schleiermacher's view is accepted. (shrink)

John Finnis's powerfully and deservedly influential modern classic, Natural Law and Natural Rights, expounds a theory of law and morality that is based on a picture of “persons” using practical reason to pursue certain “basic goods.” While devoting much attention to practical reason and to the goods, however, Finnis says little about the nature of personhood. This relative inattention to what “persons” are creates a risk—one that Finnis himself notices—of assuming or importing an inadequate anthropology. This essay suggests that the (...) “new natural law” developed by Finnis suffers in places from the inadvertent adoption of a flawed anthropology—an anthropology under the thrall of modern individualistic commitments. To explain this suspicion, this article discusses three difficulties in his natural law theory: difficulties in accounting for the basic good of friendship, for obligations we owe to others, and for legal authority. These difficulties may seem disconnected, but this article suggests that they may all reflect an inadequate anthropology—one that Finnis does not exactly embrace but that is pervasive today and that in places may affect his theorizing. Inspired by the success of generative linguistics and transformational grammar, proponents of the linguistic analogy (LA) in moral psychology hypothesize that careful attention to folk-moral judgments is likely to reveal a small set of implicit rules and structures responsible for the ubiquitous and apparently unbounded capacity for making moral judgments. As a theoretical hypothesis, LA thus requires a rich description of the computational structures that underlie mature moral judgments, an account of the acquisition and development of these structures, and an (...) analysis of those components of the moral system that are uniquely human and uniquely moral. In this paper we present the theoretical motivations for adopting LA in the study of moral cognition: (a) the distinction between competence and performance, (b) poverty of stimulus considerations, and (c) adopting the computational level as the proper level of analysis for the empirical study of moral judgment. With these motivations in hand, we review recent empirical findings that have been inspired by LA and which provide evidence for at least two predictions of LA: (a) the computational processes responsible for folk-moral judgment operate over structured representations of actions and events, as well as coding for features of agency and outcomes; and (b) folk-moral judgments are the output of a dedicated moral faculty and are largely immune to the effects of context. In addition, we highlight the complexity of the interfaces between the moral faculty and other cognitive systems external to it (e.g., number systems). We conclude by reviewing the potential utility of the theoretical and empirical tools of LA for future research in moral psychology. (shrink)

The “therapeutic obligation” is a physician’s duty to provide his patients with what he believes is the best available treatment. We begin by discussing some prominent formulations of the obligation before raising two related considerations against those formulations. First, they do not make sense of cases where doctors are permitted to provide suboptimal care. Second, they give incorrect results in cases where doctors are choosing treatments in challenging epistemic environments. We then propose and defend an account of the therapeutic obligation (...) that solves the problems that undermined previous efforts at formulating the TO. We conclude by considering how apparent problems with our proposal actually rest on difficulties with informed consent. (shrink)
