Western philosophy has long excluded the work of women thinkers from their canon. Presenting Women Philosophers addresses this exclusion by examining the breadth of women's contributions to Western thought over some 900 years. Editors Cecile T. Tougas and Sara Ebenreck have gathered essays and other writings that reflect women's deep engagement with the meaning of individual experience as well as the continuity of their philosophical concerns and practices. Arranged thematically, the collection ranges across eras and literary genres as it emphasizes (...) the intellectual significance of written work by key figures—for example, Hildegard of Bingen's visionary writings, Iris Murdoch's fiction, Hannah Arendt's historical narratives, and the oral storytelling in black women's literary tradition. Liberal societies conventionally treat religion as unique under the law, requiring both special protection and special containment. But recently this idea that religion requires a legal exception has come under fire from those who argue that religion is no different from any other conception of the good, and the state should treat all such conceptions according to principles of neutrality and equal liberty. Cécile Laborde agrees with much of this liberal egalitarian critique, but she argues that a simple analogy (...) between the good and religion misrepresents the complex relationships among religion, law, and the state. Religion serves as more than a statement of belief about what is true, or a code of moral and ethical conduct. It also refers to comprehensive ways of life, political theories of justice, modes of voluntary association, and vulnerable collective identities. Disaggregating religion into its various dimensions, as Laborde does, has two clear advantages. First, it shows greater respect for ethical and social pluralism by ensuring that whatever treatment religion receives from the law, it receives because of features that it shares with nonreligious beliefs, conceptions, and identities. Second, it dispenses with the Western, Christian-inflected conception of religion that liberal political theory relies on, especially in dealing with the issue of separation between religion and state. As a result, Liberalism's Religion offers a novel answer to the question: Can Western theories of secularism and religion be applied more universally in non-Western societies?--. (shrink)

In a book rich with historical examples she argues that spying is only justified to protect against ongoing violations of fundamental rights. Blackmail, bribery, mass surveillance, cyberespionage, treason, and other nefarious activities are considered.

In his recent Rescuing Justice and Equality, G. A. Cohen mounts a sustained critique of coerced labour, against the background of a radical egalitarian conception of distributive justice. In this article, I argue that Cohenian egalitarians are committed to holding the talented under a moral duty to choose socially useful work for the sake of the less fortunate. As I also show, Cohen's arguments against coerced labour fail, particularly in the light of his commitment to coercive taxation. In the course (...) of defending those claims, I claim that Cohen's remarks on freedom of occupational choice and taxation exhibit partiality towards the interests of the better-off to the detriment of the less fortunate – a partiality which is in tension with his commitment to equality. Do we have the right to deny others access to our body? What if this would harm those who need personal services or body parts from us? Ccile Fabre examines the impact that arguments for distributive justice have on the rights we have over ourselves, and on such contentious issues as organ sales, prostitution, and surrogate motherhood.

Treason is one of the most serious legal offences that there are, in most if not all jurisdictions. Laws against treason are rooted in deep-seated moral revulsion about acts which, in the political realm, are paradigmatic examples of breaches of loyalty. Yet, it is not altogether clear what treason consists in: someone’s traitor is often another’s loyalist. In this paper, my aim is twofold: to offer a plausible conceptual account of treason, and to partly rehabilitate traitors. I focus on informational (...) treason, as the act of passing secret intelligence to foreign actors without authorization. I argue that informational treason is sometimes justified, indeed morally mandatory; even when it is morally wrong, its beneficiaries are sometimes justified, indeed obliged, to make use of the intelligence thereby provided. The first comprehensive analysis of the philosophical issues raised by the hijab controversy in France, this book also conducts a dialogue between contemporary Anglo-American and French political theory and defends a progressive republican solution to so-called multicultural conflicts in contemporary societies. It critically assesses the official republican philosophy of laïcité which purported to justify the 2004 ban on religious signs in schools. Laïcité is shown to encompass a comprehensive theory of republican citizenship, centered on three ideals: equality (secular neutrality of (...) the public sphere), liberty (individual autonomy and emancipation) and fraternity (civic loyalty to the community of citizens). Challenging official interpretations of laïcité, the book then puts forward a critical republicanism which does not support the hijab ban, yet upholds a revised interpretation of three central republican commitments: secularism, non-domination and civic solidarity. Thus, it articulates a version of secularism which squarely addresses the problem of status quo bias - the fact that Western societies are historically not neutral towards all religions. It also defends a vision of female emancipation which rejects the coercive paternalism inherent in the regulation of religious dress, yet does not leave individuals unaided in the face of religious and secular, patriarchal and ethnocentric domination. Finally, the book outlines a theory of immigrant integration which places the burden of civic integration on basic socio-political institutions, rather than on citizens themselves. Critical republicanism proposes an entirely new approach to the management of religious and cultural pluralism, centred on the pursuit of the progressive ideal of non-domination in existing, non-ideal societies. In Liberalism's Religion, I analyse the specific conception of religion that liberalism relies upon. I argue that the concept of religion should be disaggregated into its normatively salient features. When deciding whether to avert undue impingements on religious observances, or to avoid any untoward support of such observances, liberal states should not deal with ‘religion’ as such but, rather, with relevant dimensions of religious phenomena. States should avoid religious entanglement when ‘religion’ is epistemically inaccessible, socially divisive and/or comprehensive in scope. (...) In turn, states should show special deference to religious observances insofar as they exhibit what I call integrity – whether personal or collective. The upshot of this interpretive strategy is that liberal law need not recognise religion as such. As a result, there are gaps between the liberal construal of disaggregated religion and the lived experience of religion as a uniquely integrated experience. Are these gaps morally regrettable? Many believe that agent-centred considerations, unlike agent-neutral reasons, cannot show that victims have the right to kill their attackers in self-defence, let alone establish that rescuers have the right to come to their help. In this paper, I argue that the right to kill in self- or other-defence is best supported by a hybrid set of reasons. In particular, agent-centred considerations account for the plausible intuition that victims have a special stake, which other parties lack, in being to thwart the (...) attackers. That special stake plays an important part justifying victims' right to obtain help, and rescuers' right to give it. (shrink)

The recent wars in Iraq and Afghanistan have been characterized by the deployment of large private military forces, under contract with the US administration. The use of so-called private military corporations and, more generally, of mercenaries, has long attracted criticisms. This article argues that under certain conditions, there is nothing inherently objectionable about mercenarism. It begins by exposing a weakness in the most obvious justification for mercenarism, to wit, the justification from freedom of occupational choice. It then deploys a less (...) obvious, but stronger, argument – one that appeals to the importance of enabling just defensive killings. Finally, it rebuts five moral objections to mercenarism. According to the doxastic wrongs thesis, holding certain beliefs about others can be morally wrongful. Beliefs which take the form of stereotypes based on race and gender and which turn out to be false and are negatively valenced are prime candidates for the charge of doxastic wronging: it is no coincidence that most of the cases discussed in the literature involve false beliefs. My aim in this paper is to show that the thesis of doxastic wrongs does not turn on (...) the truth-value or valence of beliefs. (shrink)

Just war theorists who argue that war is morally justified under certain circumstances infer implicitly that establishing the military institutions needed to wage war is also morally justified. In this paper, I mount a case in favor of a standing military establishment: to the extent that going to war is a way to discharge duties to protect fellow citizens and distant strangers from grievous harms, we have a duty to set up the institutions that enable us to discharge that duty. In this paper, I provide a compositional semantics for sentences with enough and too followed by a to-infinitive clause and for resultative constructions with so... that within the framework of possible world semantics. It is proposed that the sentential complement of these constructions denotes an incomplete conditional and is explicitly or implicitly modalized, as if it were the consequent of a complete conditional. Enough, too, and so are quantifiers that relate an extent predicate and the incomplete conditional (expressed by the (...) sentential complement) and are interpreted as comparisons between two extents. The first extent is the maximal extent that satisfies the extent predicate. The second extent is the minimal or maximal extent of a set of extents that satisfy the (hidden) conditional, where the sentential complement supplies the consequent and the main clause the antecedent. This approach permits to predict (a) the context-dependent interpretation of these constructions and (b) the duality relations between the degree words. (shrink)

At least since Athenian trade sanctions helped to spark the Peloponnesian War, economic coercion has been a prominent tool of foreign policy. In the modern era, sovereign states and multilateral institutions have imposed economic sanctions on dictatorial regimes or would-be nuclear powers as an alternative to waging war. They have conditioned offers of aid, loans, and debt relief on recipients’ willingness to implement market and governance reforms. Such methods interfere in freedom of trade and the internal affairs of sovereign states, (...) yet are widely used as a means to advance human rights. But are they morally justifiable? -/- Drawing on human rights theories, theories of justifiable harm, and examples such as IMF lending practices and international sanctions on Russia and North Korea, Fabre offers a defense of economic statecraft in some of its guises. This book articulates a cosmopolitan theory of the principles which ought to regulate belligerents' conduct in the aftermath of war. Throughout, it relies on the fundamental principle that all human beings, wherever they reside, have rights to the freedoms and resources which they need to lead a flourishing life, and that national and political borders are largely irrelevant to the conferral of those rights. With that principle in hand, the book provides a normative defence of restitutive and reparative justice, the (...) punishment of war criminals, the resort to transitional foreign administration as a means to govern war-torn territories, and the deployment of peacekeeping and occupation forces. It also outlines various reconciliatory and commemorative practices which might facilitate the emergence of trust amongst enemies and thereby improve prospects for peace. This article asks whether discrimination law should be symmetrical: whether it should offer the same level of protection to dominant and dominated groups. It articulates a structural inequality theory of the moral foundations of discrimination law and defends it against prominent alternatives, such as the view that discrimination is wrong because it is irrational or disrespectful. The paper then argues that while direct discrimination is symmetrical, indirect discrimination is asymmetrical. It cannot be claimed by those – men, or white persons (...) – who are not at the sharp end of structural inequality. Furthermore, even dominated groups cannot claim to be indirectly discriminated against by just any law that has a disparate impact on them. If the structural inequality view is correct, the protectorate of discrimination law is not as extensive as is commonly assumed. (shrink)

This article explores the possible convergence between the capabilities approach and utilitarianism to specify CSR. It defends the idea that this key issue is related to the anthropological perspective that underpins both theories and demonstrates that a relational conception of individual freedoms and rights present in both traditions gives adequate criteria for CSR toward the company's stakeholders. I therefore defend "relational capability" as a means of providing a common paradigm, a shared vision of a core component of human development. This (...) could further lead to a set of indicators aimed at assessing corporate social performance as the maximization of the relational capability of people impacted by the activities of companies. In particular, I suggest a way of evaluating the contribution of extractive companies to the communities close to their industrial sites in extremely poor areas, not from the viewpoint of material resources and growth, but from the viewpoint of the quality of the social environment and empowerment. This paper argues that the self, as both the centre of our identity and the focus of our spiritual life, has not been given enough consideration with regard to the ethics of managers and leaders. Informed by models of self-realisation and the Jungian process of individuation, our discussion suggests that the way we perceive and interpret our self affects our moral behaviour. In particular, integrity of the self fully participates in enhancing servant leadership and consistent ethical practice. The republican tradition seems to have a blind spot about global justice. It has had little to say about pressing international issues such as world poverty or global inequalities. According to the old, if apocryphal, adage: extra rempublicam nulla justitia. Some may doubt that distributive justice (as opposed to freedom or citizenship) is the primary virtue of republican institutions; and at any rate most would agree that republican values have traditionally been realized in the polis not in the (oxymoronic) cosmopolis. (...) The article sketches a republican account of global non-domination which suggests that duties of distributive justice are not bounded to the institutions of a single society. In particular, it argues that republicans have good reasons to seek to curb those global inequalities which underpin what I call capability-denying domination. (shrink)

This paper argues that, if one thinks that the needy have a right to the material resources they need in order to lead decent lives, one must be committed, in some cases, to conferring on the sick a right that the healthy give them some of the body parts they need to lead such a life. I then assess two objections against that view, to wit: to confer on the sick a right to the live body parts of the healthy (...) violates the bodily integrity of the latter; and constitutes too much of an interference in their life. I conclude that although the sick sometimes have a right to some of the body parts of the healthy, the latter still retain a considerable degree of autonomy. (shrink)

In his recent book Killing in War, McMahan develops a powerful argument for the view that soldiers on opposite sides of a conflict are not morally on a par once the war has started: whether they have the right to kill depends on the justness of their war. In line with just war theory in general, McMahan scrutinizes the ethics of killing the enemy. In this article, I accept McMahan's account, but bring it to bear on the entirely neglected, but (...) nevertheless interesting, issue of what the military call killings or, as I refer to such acts here, internecine war killings. I focus on the case of the soldier who is ordered by his officer, at gunpoint, to go into action or to kill innocent civilians, and who kills his officer in self-defence. I argue that, at the bar of McMahan's account of the right to kill in self-defence, the officer lacks a justification for attacking the soldier as a means of enforcing his order, and the soldier thus sometimes (but not always) has the right to kill his officer should the latter so act. Practical Knowledge, Science and Disasters. The History of Social Science Disaster Research, 1949–1979. During the second half of the twentieth century several US-American social science “disaster research groups” conducted field studies after earthquakes, factory explosions and “racial riots”. Their aim was to provide practical knowledge that could be applied in the planning and managing of future disasters of both peace- and wartime nature. In this paper, I will elaborate on how this research goal conflicted with some scientists’ aspirations to develop (...) more theoretical knowledge and their own ideals of “scientificity”. I will also show how the generated research results came to be ‘impractical knowledge’, which was difficult or impossible to apply. Furthermore this paper analyzes the scientific practices that were involved at different stages of the knowledge production process and contributed to disaster research's ‘precarious’ character. International law and conventional morality grant that states may stand ready to defend their borders with lethal force. But what grounds the permission to kill for the sake of political sovereignty and territorial integrity? In this book leading theorists address this vexed issue, and set the terms of future debate over national defence.

One of the important—yet often underestimated—dimensions of the intellectual legacy of Isaiah Berlin is his contribution to the demystification of the totalitarian temptation in the twentieth century. This paper starts with an apparent paradox: Berlin is described as a major figure of the anti‐totalitarian camp, yet his writings nowhere touch explicitly on the totalitarian regimes of his time. Nonetheless, it is argued that Berlin's notion of “monism,” and his unique insight into the totalitarian mind, are an indirect yet valuable contribution (...) to the understanding of the appeal exercised by totalitarianism within the modern political imagination. Despite Berlin's highly contestable account of the origins of monism—which he situates in the Enlightenment movement—it is asserted that Berlin's denunciation of utopias remains very much pertinent in light of the emergence of new fundamentalist utopias in a post 9/11 world. Consequently, there are grounds from which to dismiss those claims according to which Berlin's work belongs to an age—that of the Cold War—unfamiliar to the present. (shrink)

The study of the reception of Rawls in Europe provides some insights into the persistence or erosion of national and European traditions of political thought since the 1970s. It notably allows us to test the relevance of the divide between `analytical' and `Continental' philosophy, and to measure the impact on political thought of the `liberal' turn of the 1980s. Reception should be seen not a process of absorption but as one of dialogue. The filamentous and branched thallus of Antithamnion plumula is constitued of two different kinds of branches with apical growth: the cladomial axes with a continuous or indefinite growth, and the pleuridia with a limited growth. The size of the pleuridia depends on their position with respect to the lateral cladomial axes.The growth kinetics of 35 pleuridia were analysed using Nelder's generalized logistics. Each sigmoidal curve, which was divided into four growth stages from the instantaneous acceleration variations, was thus characterized by (...) ten kinetic parameters: lengths at the time of the changes in growth stage, durations of the growth stages and maximum growth rate. L’objet de l’article est de discuter de méthodes d’observation et d’interprétation des arbitrages résidentiels de salariés face à la flexibilité de leur emploi. Après avoir montré les limites de l’investigation quantitative sur cette question, la réflexion s’appuiera sur les résultats d’une enquête qualitative auprès de salariés confrontés, en 2000, à la fermeture de leur usine et à sa délocalisation à 200 km de leur domicile. Dans ce type de situations, ce n’est pas la seule mobilité résidentielle suscitée par l’emploi qu’il (...) s’agit d’étudier mais bien les arbitrages entre, à la fois, mobilité et non-mobilité. Cette posture rend ainsi possible l’identification du caractère multidimensionnel de ces choix : les logiques professionnelles n’expliquent pas tout, les logiques familiales et résidentielles jouent un rôle important dans le refus de déménager ou l’aménagement d’un système de double résidence. Cette approche permet d’appréhender en quoi ces décisions reproduisent, voire aggravent les inégalités sociales, tout en incluant les possibilités de stratégies résidentielles et spatiales.Based on the results from a qualitative enquiry of employees faced with the closure of their industrial plant, in 2000, and its further relocation 200 km away, this paper provides an approach to residential choices in a context of professional uncertainty and economic constraints. In this type of situations, it is not only residential mobility which is at stake but also the choice between mobility and non-mobility. This method also enables the analysis of the multidimensional characteristic of these choices : professional considerations alone do not explain everything, family life and residential considerations play a role in choosing « residential anchoring » or dual residence. This approach shows how the choices made reproduce or even worsen social unequalities, whilst including spatial and residential strategies. (shrink)

After presenting the recent republican revival, focusing in particular on the neo-republican school of thought, this chapter assesses the exact nature of the differences between liberalism and republicanism, and notably the republicanism of freedom as non-domination associated with Philip Pettit. Drawing on the tools of ideological analysis, as laid out by Michael Freeden, it shows that some of these disagreements are conceptual; others are normative; and yet others are strategic. In particular, republicans have a distinctive understanding of the concept of (...) liberty; their focus on non-domination and ‘anti-power’ shapes a more comprehensive, progressive political agenda; and their language is more effective as a critique of real-world neoliberal politics.
