To commemorate 40 years since the founding of the Journal of Business Ethics, the editors in chief of the journal have invited the editors to provide commentaries on the future of business ethics. This essay comprises a selection of commentaries aimed at creating dialogue around the theme Business versus Ethics?. The authors of these commentaries seek to transcend the age-old separation fallacy :409–421, 1994) that juxtaposes business and ethics/society, posing a forced choice or trade off. Providing a contemporary take on (...) the classical question “if it’s legal is it ethical?”, David Hess explores the role of the law in promoting or hindering stakeholder-oriented purpose and governance structure. Jeffrey Harrison encourages scholars to move beyond the presupposition that businesses are either strategic or ethical and explore important questions at the intersection of strategy and ethics. The proposition that business models might be inherently ethical or inherently unethical in their design is developed by Sheila Killian, who examines business systems, their morality, and who they serve. However, the conundrum that entrepreneurs are either lauded for their self-belief and risk-taking, or loathed for their self-belief and risk-taking, is discussed by M. Tina Dacin and Julia Roloff using the metaphor of taboos and totems. These commentaries seek to explore positions that advocate multiplicity and tensions in which business ethics is not either/or but both. (shrink)

:A common justification offered for unequal pay is that it encourages socially beneficial productivity. G. A. Cohen famously criticizes this argument for not questioning the behaviour and attitudes that make those incentives necessary. I defend the communal status of incentives against Cohen's challenge. I argue that Cohen's criticism fails to appreciate two different contexts in which we might grant incentives. We might grant unequal payment to someone because they demand it. However, unequal payment might be an offer instead. I claim (...) that incentives as offers promote the ideal of society as a cooperative venture for mutual advantage. (shrink)

By definition, pain is a sensory and emotional experience that is felt in a particular part of the body. The precise relationship between somatic events at the site where pain is experienced, and central processing giving rise to the mental experience of pain remains the subject of debate, but there is little disagreement in scholarly circles that both aspects of pain are critical to its experience. Recent experimental work, however, suggests a public view that is at odds with this conceptualisation. (...) By demonstrating that the public does not necessarily endorse central tenets of the “mental” view of pain (subjectivity, privacy, and incorrigibility), experimental philosophers have argued that the public holds a more “body-centric” view than most clinicians and scholars. Such a discrepancy would have important implications for how the public interacts with pain science and clinical care. In response, we tested the hypothesis that the public is capable of a more “mind-centric” view of pain. Using a series of vignettes, we demonstrate that in situations which highlight mental aspects of pain the public can, and does, recognize pain as a mental phenomenon. We also demonstrate that the public view is subject to context effects, by showing that the public’s view is modified when situations emphasizing mental and somatic aspects of pain are presented together. This article uses behavioral theories to develop an ethical decision-making model that describes how psychological factors affect the development of unethical intentions to commit fraud. We evaluate the effects of the dark triad of personality traits on fraud intentions and behaviors. We use a combination of survey results, an experiment, and structural equation modeling to empirically test our model. The theoretical insights demonstrate that psychopathy, Machiavellianism, and narcissism affect different parts of the unethical decision-making process. Narcissism motivates individuals to act (...) unethically for their personal benefit and changes their perceptions of their abilities to successfully commit fraud. Machiavellianism motivates individuals not only to act unethically, but also alters perceptions about the opportunities that exist to deceive others. Psychopathy has a prominent effect on how individuals rationalize their fraudulent behaviors. Accordingly, we find that the dark triad elements act in concert as powerful psychological antecedents to fraud behaviors. (shrink)

I argue social and political freedom is not primarily about the absence of constraints, whether those constraints be in the form of interference or domination. Instead, social freedom is centrally about what makes us free. That is, the question of social freedom is first and foremost about determining the positive preconditions of being a free person within society. Social freedom is about what I call the social bases of freedom, or those features of our social world that we have a (...) reason to rely on in making plans or going about our business. (shrink)

This paper investigates the principles that one must add to Boolean algebra to capture reasoning not only about intersection, union, and complementation of sets, but also about the relative size of sets. We completely axiomatize such reasoning under the Cantorian definition of relative size in terms of injections.

In recent years, scholars have argued that democratic provenance of law establishes moral requirements to obey it. We argue against this view, claiming that, rather than establishing moral requirements to obey the law, democratic provenance grounds only requirements to respect it. Establishing what we view as this more plausible account makes clear not only exactly what democracy itself contributes to requirements to obey the law but also important difficulties proponents of democratic authority must overcome in order successfully to make their (...) case. In an oft-quoted passage fromThe Principles of Morals and Legislation, Jeremy Bentham addresses the issue of our treatment of animals with the following words: ‘the question is not, Can theyreason? nor, can theytalk? but, Can theysuffer?’ The point is well taken, for surely if animals suffer, they are legitimate objects of our moral concern. It is curious therefore, given the current interest in the moral status of animals, that Bentham's question has been assumed to be merely rhetorical. No-one has seriously (...) examined the claim, central to arguments for animal liberation and animal rights, that animals actually feel pain. Peter Singer'sAnimal Liberationis perhaps typical in this regard. His treatment of the issue covers a scant seven pages, after which he summarily announces that ‘there are no good reasons, scientific or philosophical, for denying that animals feel pain’. In this paper I shall suggest that the issue of animal pain is not so easily dispensed with, and that the evidence brought forward to demonstrate that animals feel pain is far from conclusive. The paper uses thompson clark's theory of the relation of perceptual parts and wholes to illuminate certain aspects of our knowledge of other minds. The thesis is that the traditional problem can be usefully broken down into two parts--One of which calls for a better understanding of the logic of perceptual concepts; the other, For a closer look at what happens when we try to take the epistemological skeptic seriously.

A prominent position in the scholarly literature is that there is no duty to obey the law or political obligation. This is in contrast with lay opinion, which suggests widespread acceptance of political obligation. When confronted with this tension, skeptics of political obligation sometimes raise the possibility that lay belief is the product of sinister interests. Against this, I argue that, even if such a belief is false, belief in political obligation may operate as a useful fiction that advances people’s (...) interests. Drawing on empirical work in the social sciences, I suggest a belief in political obligation may contribute to effective governance. Even if political obligation skeptics are correct that there is no such duty to obey the law, lay belief in political obligation may play a valuable ideological function in society. (shrink)

We develop an extension of the familiar linear mixed logit model to allow for the direct estimation of parametric non-linear functions defined over structural parameters. Classic applications include the estimation of coefficients of utility functions to characterize risk attitudes and discounting functions to characterize impatience. There are several unexpected benefits of this extension, apart from the ability to directly estimate structural parameters of theoretical interest.

Richard Penny argues that Rawls’s commitment to self-respect puts him at odds with his endorsement of unequalizing incentives. Penny draws on G.A. Cohen’s distinction between ‘lax’ and ‘strict’ readings of the difference principle to make this point. Given this, Penny concludes that Rawls faces a dilemma: either Rawls weakens his endorsement of unequalizing incentives or weakens his commitment to self-respect. By taking the difference principle in isolation, Penny creates a false dilemma. I will argue that once we place the difference (...) principle in the context of Rawls’s theory as a whole, we find that unequalizing incentives pose no danger to the self-respect of the least advantaged. Moreover, I will argue that a strict reading of the difference principle is incompatible with the self-respect of all citizens in a well-ordered society given the fact of reasonable pluralism. My arguments reveal the importance of seeing self-respect as a threshold good, rather than a relative one. (shrink)

A philosophical tradition is in part identified by its more durable controversies. The British tradition in moral philosophy running, roughly, from Hobbes to the present day, involves several fine examples of the type—the plausibility or otherwise of the compatibilist view of free will, the case for and against utilitarianism, and perhaps above all the implications of the fact/value distinction. It is always pleasing to find some new variation on such themes; you have a comforting sense of the inherent permanence of (...) this corner of the intellectual universe. Thus R. G. Swinburne's paper ‘The Objectivity of Morality’ is much to be welcomed as a contribution to a well-matured debate. Even more, perhaps, it is welcome on account of its considerable clarity. But clarity often comes at a high price, and the price in this case is too high. By setting out his version of the objectivist position with such precision and lack of ambiguity Professor Swinburne has made its difficulties and weaknesses accessible to all but the meanest intellect. To think of being inclines metaxological philosophy to ponder the goodness of being. In his chapter, Cyril O’Regan engages the various notes on evil throughout metaxological philosophy. His argument is that Desmond’s view of evil comes close to Ricoeur in The Symbolism of Evil, where symbols of evil give philosophy to think about the excessive nature of evil.

The Larousse defines recoupement as "the verification of a fact by means of information drawn from various sources." Literally, the word carries the idea of one thing cutting into another and thus suggests an overlapping or intersection. What interests Jacques Taminiaux, professor of philosophy at the University of Louvain, is intersecting ideas that provide a new context for constructive thought. As he claims in his preface, the overlapping theme of the seven essays in his book is finitude "and some of (...) the ways that modernity obliterates it." Believing with Heidegger that finitude is the basic characteristic of existence, Taminiaux shows how it can be "concealed where it is most strongly avowed and... announced where it is most casually dismissed." Thus, philosophies such as those of Heidegger and Marx come clearly together with philosophies such as those of Hegel and Plato. And the very overlapping attests to the finitude, or nonfinality, of thinking itself. (shrink)

Ethics, of increasing concern to college educators, is being given more attention in public relations and advertising courses. A vast number of respondents to a survey assessing this issue agreed that ethics is important and nearly all (93%) asserted that it is included in course work. Few educational institutions, however, include a separate course for ethics and fewer than half require it. In ethics texts and courses the emphasis is on the journalism aspect, and it is evident that a great (...) deal more attention and emphasis will be required for this critical aspect of education for public relations and advertising. Evidence of risk aversion in laboratory settings over small stakes leads to a priori implausible levels of risk aversion over large stakes under certain assumptions. One core assumption in statements of this calibration puzzle is that small-stakes risk aversion is observed over all levels of wealth, or over a â sufficiently largeâ range of wealth. Although this assumption is viewed as self-evident from the vast experimental literature showing risk aversion over laboratory stakes, it actually requires that lab wealth be varied (...) for a given subject as one evaluates the risk attitudes of the subject. We consider evidence from a simple design that tests this assumption, and find that the assumption is strikingly rejected for a large sample of subjects from a population of college students. We conclude that the implausible predictions that flow from these assumptions do not apply to one specialized population widely used to study economic behavior in laboratory experiments. (shrink)

Museums and their practices - especially those involving collection, curation and exhibition - generate a host of philosophical questions. Such questions are not limited to the domains of ethics and aesthetics, but go further into the domains of metaphysics, epistemology and philosophy of religion. Despite the prominence of museums as public institutions, they have until recently received surprisingly little scrutiny from philosophers in the Anglo-American tradition. By bringing together contributions from philosophers with backgrounds in a range of traditional areas of (...) philosophy, this volume demonstrates how their work can enhance our understanding of museums and shed light on the philosophical questions raised by museum practices. Many of the chapters in this volume make the case that the philosophy of museums is of vital concern, not only to those philosophers at work in the emerging field but also to practitioners within the museum world and to anyone who enjoys visiting museums.
