A growing group of institutional investors use divestment strategically to deter misconducts that are harmful for the climate and society. Based on Kantian ethics, we propose that divestment represents investors’ universal and absolute moral commitment to socially responsible investing (SRI). Following categorical and hypothetical imperatives and reciprocity as a norm, we hypothesize how institutional investors’ commit to SRI through a divestment strategy against ethically reprehensible behaviour of banks, especially when these investors represent banks themselves. Using a hand-collected database of the (...) revelation dates of enforcement actions on banks, we find evidence that banks are less likely to divest equity holding on banks with misconduct (fined banks) than their non-bank institutional investors peers. Banks that commit to invest responsibly by signing for the Principles for Responsible Investment (PRI) are not significantly more likely to divest on fined banks stocks than non-signatory banks. Moreover, divestment of fined banks whose own legitimacy to operate is in question is not significantly different from non-fined banks divestment. We find that European banks are more inclined to sell their holdings permanently on fined banks than their United States peers. Therefore, bank’s moral commitment to SRI via divestments is influenced more by cultural and reciprocity norms than their moral commitment to participate in the PRI. (shrink)

It is widely thought that functionalism and the qualia theory are better positioned to accommodate the ‘affective’ aspect of pain phenomenology than representationalism. In this paper, we attempt to overturn this opinion by raising problems for both functionalism and the qualia theory on this score. With regard to functionalism, we argue that it gets the order of explanation wrong: pain experience gives rise to the effects it does because it hurts, and not the other way around. With regard to the (...) qualia theory, we argue that it fails to capture the sense in which pain 's affective phenomenology rationalises various bodily-directed beliefs, desires, and behaviours. Representationalism, in contrast, escapes both of these problems: it gets the order of explanation right and it explains how pain 's affective phenomenology can rationalise bodily-directed beliefs, desires, and behaviours. For this reason, we argue that representationalism has a significant advantage in the debates about pain 's affective phenomenology. We end the paper by examining objections, including the question of what representationalists should say about so-called ‘disassociation cases’, such as pain asymbolia. (shrink)

Discussions of whistleblowing whether in academic literature or in more popular media have tended to very one-sided assessments of the moral worth of the act. Indeed, much of the current literature concentrates on psychological or managerial aspects of whistleblowing while taking for granted this or that moral position or eschewing any normative commitment on the question. The purpose of this article is firstly to reemphasise the importance and complexity of the normative foundations of whistleblowing acts; and secondly, through a moral (...) philosophical analysis of the component decisions that make up any act of whistleblowing, to contribute to a more balanced and less polarised treatment of the topic. It is argued that the polarisation of views on the topic is in part due to a failure to decompose the act of whistleblowing into a number of inevitable component moral decisions leading up to the act. It is furthermore argued on the basis of the analysis that it is impossible to state a priori as a matter of general principle that whistleblowing is always morally right or morally wrong . The article will close with a reflection on the degree to which the weighing up of good and bad in the act of whistleblowing differs sharply among cultures; and with a conjecture as to a possible relation to a people's history which may serve as a pointer to interesting future empirical research on the topic. Many have felt to be anachronistic the casting of proskynesis in the court of Alexander the Great as a matter of worship of the king. Taking this premise as its starting point, this article explores the possible origins of this presentation of Alexander's proskynesis, an understanding that is articulated most fully in the ' proskynesis debates' of Arrian and Curtius. It is argued that the misrepresentation was a deliberate strategy cultivated in the Peripatos, and that it was designed to deflect (...) opprobrium away from Callisthenes and, by extension, away from the Peripatos itself. Maurice O'Sullivan was born on the Great Blasket in 1904, and Twenty Years A-Growing tells the story of his youth and of a way of life which belonged to the Middle Ages. He wrote for his own pleasure and for the entertainment of his friends, without any thought of a wider public; his style is derived from folk-tales which he heard from his grandfather and sharpened by his own lively imagination.

Three philosophical accounts of risk dominate the contemporary literature. On the probabilistic account, risk has to do with the probability of a disvaluable event obtaining; on the modal account, it has to do with the modal closeness of that event obtaining; on the normic account, it has to do with the normalcy of that event obtaining. The debate between these accounts has proceeded via counterexample-trading, with each account having some cases it explains better than others, and some cases that it (...) cannot explain at all. In this article, we attempt to break the impasse between the three accounts of risk through a shift in methodology. We investigate the concept of risk via the method of conceptual reverse-engineering, whereby a theorist reconstructs the need that a concept serves for a group of agents in order to illuminate the shape of the concept: its intension and extension. We suggest that risk functions to meet our need to make decisions that reduce disvalue under conditions of uncertainty. Our project makes plausible that risk is a pluralist concept: meeting this need requires that risk takes different forms in different contexts. But our pluralism is principled: each of these different forms are part of one and the same concept, that has a ‘core-to-periphery’ structure, where the form the concept takes in typical cases (at its ‘core’) explains the form it takes in less typical cases (at its ‘periphery’). We then apply our findings to epistemic risk, to resolve an ambiguity in how ‘epistemic risk’ is standardly understood. (shrink)

This article argues that history played a larger role in the thought of Gottlob Frege than has usually been acknowledged. Frege’s logical writings frequently employed statements about the past as examples that included references to historical persons. Frege also described history as a science and argued that historical propositions could support valid inferences and reliably identify historical persons and events. But Frege’s eternalist theory of reference, designed primarily for formal concepts and objects, struggled to accommodate such propositions. Identifying an objective (...) referent for the subjectivity of historical actors was particularly problematic. The article suggests that Frege’s writings are interesting for the philosopher of history for at least two reasons: first, his work is clarificatory when considering the key features that historical propositions must have to count as objective knowledge, and second, it foreshadowed the issues with historicity that analytical philosophy experienced in the twentieth century. It concludes that the problems Frege raised exposed the need for a new concept of inter-subjectivity to replace his own Platonic foundation for objectivity. (shrink)

Through recourse to Gilles Deleuze’s short polemical essay ‘Postscript on Control Societies’ and the accompanying interview (in Negotiations) on ‘Control and Becoming’, this article attempts to map out the conceptual contours of an artistic war machine (Deleuze’s ‘new weapons’) that might be pitched against control and also play a role in the more ethico-political function of the constitution of a people (or, what Deleuze calls subjectification). Along the way a series of other Deleuzian concepts are introduced and outlined – with (...) an eye to their pertinence for art practice and, indeed, for any more general ‘thought’ against control. At stake here is the development of a concept of fictioning – the production of alternative narratives and image-worlds – and also the idea of art practice as a form of myth-science, exemplified by Burroughs’ cut-up method. It is argued that these aesthetic strategies might offer alternative models for a subjectivity that is increasingly standardized and hemmed in by neoliberalism. (shrink)

Holiness in the Christian tradition has often been understood in a way that devalues embodiment and practical engagement with the world of one's time. The latter understanding, for example, led to Marx's critique and repudiation of Christianity. Both interpretations of holiness can be understood as mistaken efforts to express the dynamism for authenticity in contextualised human subjectivity. Vatican 2 opposed both views by addressing itself to all people of good will, declaring that everyone was called to holiness, and that authentic (...) Christian identity involved solidarity with the world of one's time, especially those who are poor. Vatican 2, therefore, provided an authoritative faith foundation for holiness expressed through social commitment and for viewing social commitment on the part of people of good will in whatever state of life as a form of holiness. This vision was also the conviction of leading spirituality writers of the period, like Thomas Merton, and inspired liberation theologians and the Latin American Catholic bishops at their conference in Medellín a few years after the Council. The argument of this article is that the emergence and development of a non-dualist Christian spirituality is grounded methodologically in the correct appropriation of the common innate dynamism for authenticity in concrete human persons and lived spiritual experiences consistent with and capable of enhancing this dynamism. Conservative ideology in its moderate form is inspired by opposition to belief in radical political and social change on the ground that it rests on several mistaken assumptions, of which the most important are that human nature is highly malleable; that human will can refashion history in whatever ways human ideals may require; that society is the artificial product of a contract between autonomous individuals; and that evil is an eliminable feature of human existence. The unifying theme of conservative ideology, (...) by contrast, is a defence of limited politics, although different schools of conservatism have theorized the concept of limit in ways that are incompatible and even incoherent. Of these, the four principal schools are the reactionary, the radical, the moderate, and, more recently, the New Right. Dotted throughout the records of the turbulent last decades of fourth-century Athens are reports—often frustratingly vague—of prosecutions, many of intellectuals on the charge of . Most belong to the period of Macedonian domination: Theophrastus was one targeted at this time, and we hear also of actions against Demetrius of Phalerum, Theodorus the atheist, and Stilpo of Megara. Even before the Athenian capitulation to Macedon, in the immediate aftermath of the death of Alexander, prosecutions were launched against Demades and Aristotle. These (...) two early prosecutions are generally accepted to have had a political purpose, being attacks aimed at Macedonian sympathizers by the more staunchly pro-democratic Athenian elements; the later trials, however, are poorly attested in the sources and have received less scholarly attention, particularly for their political aspects. This twelfth volume of Correspondence contains authoritative and fully annotated texts of all known letters sent both to and from Bentham between July 1824 and June 1828. The 301 letters, most of which have never before been published, have been collected from archives, public and private, in Britain, the United States of America, Switzerland, France, Japan, and elsewhere, as well as from the major collections of Bentham Papers at University College London Library and the British Library.In mid-1824 Bentham was still (...) preoccupied with the Greek struggle for independence against Turkey, though his active involvement waned as he became disenchanted with the behaviour of the deputies sent to London by the Greek National Assembly. SummaryThe term ‘category mistake’ began to turn up regularly in public discourse in the 1990s as a general term to describe a confusion between different fields of thought with serious practical consequences. But it began its career in philosophy, introduced by Gilbert Ryle in The Concept of Mind in 1949 to attack Cartesian dualism and assert a monistic solution to the so-called mind-body problem. This paper traces the stages by which it came into general usage, arguing that while by the (...) later 1960s it had generally been rejected by philosophers, it was saved from disappearance by its migration into fields such as psychology and theology. From there, it moved into critical theory and then into international relations. Its entry into these latter areas first made plain its potential in political argument. Eventually, multiple meanings of the term came to coexist with one another, with the practical and rhetorical usage supplementing rather than replacing its original philosophical sense. (shrink)

This important book is an essential guide to the most recent work on ideology - a concept central to social and political theory. It offers a critical reassessment across the entire spectrum of different intellectual traditions ranging from conservatism to Marxism.

Traditionally, acts of civil disobedience are understood as a mechanism by which citizens may express dissatisfaction with a law of their country. That expression will typically be morally motivated, non-violent and aimed at changing their government’s policy, practice or law. Building on existing work, in this paper we explore the limits of one well-received definition of civil disobedience by considering the challenging case of the actions of animal activists at sea. Drawing on original interviews with advocates associated with Sea Shepherd, (...) Greenpeace and Humane Society International we find that even if animal activists are morally motivated and civil, the transnational nature of their activity makes it difficult to assess their intention to bring about a change in law or public policy. This means that a civil disobedience defence may not be available to activists operating across international borders. This raises important questions about the usefulness of the civil disobedience concept within the context of a globalised world. We conclude that while the actions of some anti-whaling activists may not meet definitions of civil disobedience as conventionally understood, this says more about the narrow way in which that concept has been traditionally defined, than it does about the type of activity some anti-whaling activists have undertaken in the Southern Ocean. Finally, we argue that activists wishing to make a stand against whaling may have no choice but to act as global citizens because policy change within a single nation-state is unlikely to lead to the cessation of this inherently transnational activity. Some theorists have argued recently that Berlinian value pluralism points not to liberalism, as Berlin supposed, but, in effect, to some form of communitarianism. To what extent is this true, and, to the extent that it is true, what kind of communitarianism fits best with the pluralist outlook? I argue that pluralists should acknowledge community as an important source of value and as a substantial value in itself, but they should also be prepared to question traditions and to respect values (...) other than community. In particular, pluralism points to personal autonomy as playing a special role when we must choose among incommensurable goods in conflict. Consequently, the pluralist outlook is at odds with conservative communitarianisms that tend to place existing traditions beyond question, and with radical variants of communitarianism, such as Marxism and classical anarchism, which look forward to future communities in which the need to cope with hard public choices has largely been eliminated. Rather, Berlinian pluralism fits best with a liberal or moderate kind of communitarianism that balances community with other goods, especially personal autonomy. (shrink)

It has been claimed that empirical work in psychology requires the attribution of representational content to perceptual states: that is, the attribution of veridicality conditions to those states. This is a claim that can only be evaluated by the examination of actual empirical research. In this paper I argue that talk of ‘representation’ in at least one area of research in the psychology of perception can be reinterpreted so as to avoid the attribution of veridicality conditions. Of the hundreds of Greek common nouns and adjectives preserved in our MSS of Cicero, about three dozen are found written in the Latin alphabet as well as in the Greek. So we find, alongside συμπάθεια, alsosympathia, and ἱστορικός as well ashistoricus.This sort of variation has been termed alphabet-switching; it has received little attention in connection with Cicero, even though it is relevant to subjects of current interest such as his bilingualism and the role of code-switching and loanwords in his (...) works. Rather than addressing these issues directly, this discussion sets out information about the way in which the words are written in our surviving MSS of Cicero and takes further some recent work on the presentation of Greek words in Latin texts. It argues that, for the most part, coherent patterns and explanations can be found in the alphabetic choices exhibited by them, or at least by the earliest of them when there is conflict in the paradosis, and that this coherence is evidence for a generally reliable transmission of Cicero's original choices. While a lack of coherence might indicate unreliable transmission, or even an indifference on Cicero's part, a consistent pattern can only really be explained as an accurate record of coherent alphabet choice made by Cicero when writing Greek words. This article offers two commentaries on two of Félix Guattari's essays from Chaosmosis: ‘The New Aesthetic Paradigm’ and ‘Schizoanalytic Metamodelisation’. The first commentary attends specifically to how Guattari figures the infinite/finite relation in relation to what he calls the three Assemblages (pre-, extant, and post-capitalism) and then even more specifically to the mechanics of this relation – or folding – within the third ‘processual’ Assemblage or new aesthetic paradigm of the essay's title. The second commentary looks at what Guattari has (...) to say about this paradigm in relation to subjectivity, that is, the schizoanalytic programme or practice of metamodelling. Here the focus is on the turn to asignifying semiotics – but also the importance of signifying material and indeed the actual material scene of encounter – in any programme for the production of subjectivity (it is here also that the symptom makes its appearance). The three books presented in this volume, _Integral Humanism_, _Freedom in the Modern World_, and _A Letter on Independence_, were all written in the early 1930s, a time of dire trouble for France. France was then surrounded by enemies preparing for war and was itself so violently split between parties of Left and Right that it seemed on the verge of Civil War. In this collection, Jacques Maritain accepts the responsibility of a Christian philosopher to actively address the agonizing practical (...) problems of the time. Maritain discusses major political issues such as the relation of freedom and religion, the opposition of democracy to any form of totalitarianism, the relation of the spiritual and the temporal, the need for an integral and Christian humanism, and the prospects for a new Christian civilization, all in opposition to the materialism of both communism and capitalism. Against the fierce antagonism of the parties of the political Left and Right, Maritain declares a plague on both their houses and strongly affirms the need for independence from both of them. He does so by distinguishing between two senses of the terms Left and Right, one denoting a temperamental or physiological disposition, the other a definite political position. In the latter sense, Maritain asserts that he is an independent, while acknowledging that he is, by temperament, a man of the Left. (shrink)

How do we become aware of the properties or states that are expressed by gestures, utterances, and facial expressions? This paper argues that expression raises peculiar problems, distinct from those of property perception in general. It argues against some current accounts of awareness of expressed states, before proposing an account which appeals to the notion of empathy. Finally, it situates the proposed account within current discussions of expression in the philosophy of music.
