Social death, central to the evil of genocide, distinguishes genocide from other mass murders. Loss of social vitality is loss of identity and thereby of meaning for one's existence. Seeing social death at the center of genocide takes our focus off body counts and loss of individual talents, directing us instead to mourn losses of relationships that create community and give meaning to the development of talents.

In this paper we want to examine how the mutual understanding of speakers is reached during a conversation through collaborative processes, and what role is played by abductive inference (in the Peircean sense) in these processes. We do this by bringing together contributions coming from a variety of disciplines, such as logic, philosophy of language and psychology. When speakers are engaged in a conversation, they refer to a supposed common ground: every participant ascribes to the others some knowledge, belief, opinion (...) etc. on which to rely in order to reach mutual understanding. As the conversation unfolds, this common ground is continually corrected and reshaped by the interchanges. An abductive reasoning takes place, in a collaborative setting, in order to build new possible theories about the common ground. In reconstructing this process through the use of a working example, we argue that the integration of a collaborative perspective within the Peircean theory of abduction can help to solve some of the drawbacks that the critics of the latter have outlined, for example its permissivity and non generativity. By reference to the Aristotelian meditation, this essay undertakes to articulate an understanding of phronesis and sophia, praxis and theoria, in their belonging together. In so doing, it strives to overcome the traditional opposition of these terms, an opposition preserved even by those thinkers, such as Gadamer and Arendt, who have emphasized the practical over against the theoretical simply by inverting the order of the hierarchy.What is at stake, ultimately, is thinking ethics as first philosophy, i.e., seeing the philosophical articulation (...) of scientific knowledge, even of ontology, as resting on (belonging in) living-in-action, as phenomenologically, phenomenally, sensibly grounded. Of course, “ethics as first philosophy” here can mean neither a normative-prescriptive compilation nor a self-founding, autonomous discourse. Rather, the phrase names the comprehensiveness of ethics vis-à-vis all mannerof human endeavor and the openness of ethics vis-à-vis that which exceeds it, that which is irreducible to discourse and in which the ethical discourse belongs. Although the exclusion of LGBTs from the rites and rights of marriage is arbitrary and unjust, the legal institution of marriage is itself so riddled with injustice that it would be better to create alternative forms of durable intimate partnership that do not invoke the power of the state. Card's essay develops a case for this position, taking up an injustice sufficiently serious to constitute an evil: the sheltering of domestic violence.

In this paper we consider the relations existing between four deductive systems that have been called categorial grammars and have relevant connections with linguistic investigations: the syntactic calculus, bilinear logic, compact bilinear logic and Curry''s semantic calculus.

The aim of this paper is to suggest that a necessary condition of autonomy has not been sufficiently recognized in the literature: the capacity to critically reflect on one’s practical attitudes (desires, preferences, values, etc.) in the light of new experiences . It will be argued that most prominent accounts of autonomy—ahistorical as well as history-sensitive—have either altogether failed to recognize this condition or at least failed to give an explicit account of it.

Health-care goods are goods with peculiar properties, and where they are scarce, societies face potentially explosive distributional conflicts. Animated public and academic debates on the necessity and possible justice of limit-setting in health care have taken place in the last decades and have recently taken a turn toward procedural rather than substantial criteria for justice. This article argues that the most influential account of procedural justice in health-care rationing, presented by Daniels and Sabin, is indeterminate where concrete properties of rationing (...) institutions are concerned. Such properties inscribe substantial norms into institutions. These norms can derive validity only from democratic majority decisions, which must be seen as an instance of pure procedural justice. We therefore have to move the discussion to a meta-level and ask how concrete properties of institutions are being chosen. I suggest four criteria for sufficiently democratic institutional design choice and conclude that as institutional properties are likely to have effects on the resulting distribution of health care, design choices should be empirically informed and taken both democratically and deliberately. The paper considers Martha Nussbaum's motivation for departing from her earlier cosmopolitan position in favour of now promoting a globally sensitive patriotism. Her reasons for endorsing patriotism will be shown as exemplary for related argumentations by other authors, especially insofar as love of country as a motivating force for civic duty is understood as in tension or even as incompatible with cosmopolitan aspirations. The motivation for turning to patriotism as articulated by Nussbaum and others will be demonstrated to rely on (...) misleading understandings of love of country as a possessive emotion. Relying on Alice Crary's critique, it will be argued that sound moral judgement with regard to the patria as well as from a cosmopolitan stance is equally tied to our sensitivities and equally requires their education. Furthermore, I will discuss Axel Honneth's notion of solidarity, a form of love inflected by justice, as a possible alternative for conceptualising the social bonding patriotic attachment is supposed to provide. However, a critical patriotism ultimately needs to transgress this inward-directed focus and take into account how a country is seen by non-citizens, the historical relationships and the obligations that arise in terms of historical justice in relation to other countries. If we take patriotism in this outward-looking perspective seriously, we also come to understand why it would be a mistake to skip patriotism altogether. Rather than constructing cosmopolitanism and patriotism as mutually exclusive opposites, critical cosmopolitanism and critical patriotism can be shown to have different but complementary and mutually corrective functions. Situações históricas produzem marcas físicas e/ou emocionais significativas na vida das pessoas que vivem no Brasil, causando desequilíbrios em toda a sociedade, com problemas sérios de convivência, sobretudo no que tange ao racismo estrutural. Com base nisso, esse estudo parte da seguinte questão geradora: considerando o Brasil um país composto por migrantes de diversas raças/etnias, por que prevalece o racismo? Para tanto possui como objetivo geral analisar a gênese do racismo a partir dos processos migratórios, especificamente, discutir legislações, mitos e (...) costumes para compreensão do processo de racismo à brasileira que coaduna com a intenção de seu combate, analisar as situações históricas de controle de “uns” sobre os “outros” inventariados nos encontros coloniais. Trata-se de uma revisão de literatura dissertativa e configura-se como uma pesquisa exploratória. Constata-se que a gênese do racismo, subjacente às legislações, mitos e costumes pretéritos, continua a se reproduzir. Portanto, é fundamental epistemologias descolonizadoras, educação no sentido da inclusão, pertença nas representações e construções de identidades para pôr fim ao racismo estrutural e à brasileira. The analysis of various Heraclitean fragments, furthermore, may call into question the view of politics as constitutively involving war and violence and contribute to the task of understanding politics otherwise. And yet, however obliquely, this study points to a meditation on politics as genuinely and meaningfully resting on the practice of peace—or, one might say, on a radically other understanding of the word “war.”. El presente ensayo explicita una serie de supuestos teóricos hacia la construcción de una perspectiva sociocultural e histórica de las emociones. Entendiendo que las políticas de cuidado promueven acciones y estrategias tendientes a que la escuela pueda funcionar como soporte afectivo para la tramitación del sufrimiento singular y colectivo.

In this article, I draw on Adorno's concept of the non-identical in conjunction with Lacan's concept of the Real to propose a "theoretical outline of the subject" as central for feminist political theorizing. A theoretical outline of the subject recognizes the limits of theorizing, the moment where meaning fails, and we are confronted with the impossibility of grasping the subject entirely. At the same time, it insists on the importance of a coherent subject to effect transformations in the sociopolitical sphere. (...) Since the non-identical is more grounded in the material world than the Real, and the Real allows us more than the non-identical to grasp the anxieties and desires that lead to totalizing theories, a complementary Adornian-Lacanian theoretical framework holds a central promise for feminist political theorizing. Esports is a rapidly growing industry worldwide, and it is making significant inroads in Hong Kong as well. However, owing to debates regarding the distinction between Esports and video gaming and the potential negative effects of engaging in Esports, its development in Hong Kong is still in its infancy. Therefore, this qualitative study investigated the perceptions and attitudes of teenagers and young adults toward Esports development and engagement, using the theory of planned behavior. Twenty-five teenagers and young adults participated in (...) this study, with their ages ranging from 15 to 29 years. Our results revealed the views of Hong Kong teenagers and young adults on the beneficial and deleterious outcomes, subjective norms, and barriers and facilitators of participating in Esports. Additionally, the results of this qualitative study may contribute toward a deeper understanding of Hong Kong Esports players to develop a theory of planned behavior construct for capturing the beliefs and perceptions of Hong Kong teenagers toward Esports. Is it true that utilitarianism can accommodate the modern belief that human beings have certain moral rights against everybody ‘just in virtue of their human nature?’ I should have thought the most a utilitarian could grant was that we had rights just in virtue of the utility of respecting such rights, not just in virtue of our human nature. In fact, that is more like the view Professor Brandt actually supports. What he argues is that there is not the a (...) priori difficulty with the idea of utilitarian moral rights that some philosophers have thought there was. However, I think the possibility of utilitarian moral rights is not the same as the view that we all have human rights against everybody just in virtue of our human nature. As I hear it, ‘just in virtue of our human nature’ is an alternative to a utilitarian basis for rights. I'll return to that. (shrink)

It has been claimed that most of the world’s preventable suffering and death are caused not by terrorism but by poverty. That claim, if true, could be hard to substantiate. For most terrorism is not publicly recognized as such, and it is far commoner than paradigms of the usual suspects suggest. Everyday lives under oppressive regimes, in racist environments, and of women, children, and elders everywhere who suffer violence in their homes offer instances of terrorisms that seldom capture public attention. This paper relates Arendt's critique of a labor society to her thoughts on the “good life.” I begin with the claim that in the post-mass production era, Western societies, traditionally centered around gainful employment, encounter a decrease in the relevance of labor and can thus no longer rely on it as a resource for individual or social meaning. From Arendt's perspective, however, the current situation allows for the possibility of a transition from a society based on labor to a society (...) centered around activities. In 1994, Joyce Trebilcot retired from teaching at Washington University in St. Louis, where she had founded the Women's Studies Program and had been a member of the Philosophy Department since 1970. In the Fall of 1994 I participated on a SWIP conference panel on her book Dyke Ideas conference; I used that occasion also to reminisce and place her work in the context of her life as a SWIP activist.1 What follows is adapted from that presentation.

The iconography of Maria Regina in eighth-century Rome illustrates a deep connection between sacred painted images and architectural spaces in the basilicas of San Clemente, San Lorenzo fuori le Mura, and Santa Susanna. This essay focuses on the concept of zones of transition, i.e., liminal spaces, within sacred buildings. Distinct iconographic similarities among these sites suggest a common prototype drawn upon by artisans working at the same time. Altars situated in these transitional areas served both funerary and catechumenal purposes, emphasizing (...) Mary’s role as intercessor and guide. This consistent depiction underscores her significance in rites of passage, providing spiritual support during transitions such as physical death and the figurative death of baptism, thereby highlighting her importance in these ritual contexts. In this chapter, I challenge existing definitions of social class and rethink the class concept from a post-structuralist perspective. I draw on Michel Foucault’s concepts of disciplinary power to outline the subtle ways in which the control and subjugation of the raced and gendered working classes happen inside and outside academia. I also draw on Theodor W. Adorno’s concept of “non-identity” to theorize those moments when the raced and gendered working classes resist disciplinary power and redefine what it means to (...) be “working-class.”. (shrink)

While fundamental individual rights are unquestionably taken as subjective rights, the same does not happen with fundamental social rights (health, education, work and housing – all of them guided by the idea of human dignity). If they are subjective rights, they are justiciable. The main argument in favor of this understanding is based on liberty. The main argument against is the so called formal argument. In relation to the pro argument, liberty can be juridical or factual. Juridical liberty has no (...) value without factual liberty, because the right to liberty is only put into practice if one has the factual preconditions for its exercise. The argument against is that their justiciability displaces the competence of the elaboration of public politics from Legislative and Executive to Judiciary Power, what violates the principles of separation of powers and democracy. In fact, they are subjective rights, but special ones: they are prima facie subjective rights, so that their rules present exceeding content and the determination of the definitive right is only possible in the concrete case. There is only one subjective right that is a priori considered definitive: the right to Existenzminimum. Its content is not settled, but it is quite unequivocal that the rights to simple housing, fundamental education and minimum level of medical assistance are part of it. So Existenzminimum represents what is essential to assure human dignity. It is then related to the minimum necessary for factual liberty. Against the justiciability of fundamental social rights, besides the arguments referred above, the following ones have also arisen: (a) Juridification of politics; (b) Legal permission of administrative discretion; (c) Possible reserve clause. These are the counter-arguments: (a) Legislative and Executive Powers have the original competence, but Judiciary has the exceptional one; (b) It is not enough to state economical incapability of the State. It is necessary to prove it objectively; (c) Powers have discretion, but State’s will is not allowed; (d) Public administration is under the principles of legality and of non-obviation of Judiciary jurisdiction; (e) The Existenzminimun guarantee is untouchable, prevailing over any opposite allegation. Rawls's hypothesis implies that the worst evils that target women and girls will disappear once the gravest political injustices are gone. This chapter explores those hypotheses in relation to women's self‐defense and mutual defense against evils of misogyny. It extrapolates and adapts to this case values, concepts, and methods from Rawls's life's work, especially his writing on war. Despite its exemplary Constitution, the United States, like most societies, has laws, practices, customs, and attitudes that create environments hostile to women's and (...) girls’ development and thriving. Women need principles for forming social units of defense against global and local misogyny. Meanwhile, women need principles now for defending themselves and each other as individuals. The chapter considers the adaptability of Rawls war principles to the case of women. In the 1970s and 1980s guerrilla feminists in the United States carried to another level defense of women against misogyny. (shrink)

ABSTRACT Aristotle's account of rhetoric goes beyond its previous consideration as an art of persuasion to be regarded as a suitable logic for human affairs. In the realm of ethics and politics, he needs to appeal to a logic that can deal with contingency without discarding the concept of truth. I claim that the double rapport of rhetoric with dialectic and ethical-political issues links public discourse with the question of rationality and practical truth. I will start with a brief overview (...) of two passages of the Rhetoric that account for the liaison of rhetoric with dialectic. Secondly, I consider two contributions that rhetoric theory makes to the enhancement of the rationality of ethics. Lastly, I will reflect on the relationship of rhetorical discourse with practical truth. RESUMEN La reflexión aristotélica sobre la retórica va más allá de su consideración previa como un arte de persuasión para ser comprendida como una lógica adecuada a los asuntos humanos. En el ámbito de la ética y la política se necesita apelar a una técnica de razonamiento que pueda lidiar con la contingencia, sin descartar el concepto de verdad. En este artículo defiendo que la doble relación de la retórica con las cuestiones dialécticas y ético-políticas vincula el discurso público con la cuestión de la racionalidad y la verdad práctica. Comenzaré con una breve descripción de dos pasajes de la Retórica que explican el vínculo de la retórica con la dialéctica. En segundo lugar, consideraré dos contribuciones que hace la teoría de la retórica al realce de la racionalidad de la ética. Por último, reflexionaré sobre la relación del discurso retórico con la verdad práctica. (shrink)

This article analyzes the work and thought of Lélia Gonzalez on the experience of Black women in Brazil. It highlights her legacy within studies of Black Feminism in Latin America and the Caribbean, as well as the importance of her articulation between sex, class, and race with the intention of understanding the social inequality Indigenous and Black women suffer. Gonzalez's political-cultural category of Amefricanity is presented in this article as an instrument of analysis specific to the region, which promotes an (...) epistemological shift within Black feminism. This category seeks to interpret the stories and survival strategies of previous generations of Black women on the continent, as well as to learn their methods and transgressive practices of asymmetrical power relations as pedagogical processes.
