This ambitious literary history traces the American novel from its emergence in the late eighteenth century to its diverse incarnations in the multi-ethnic, multi-media culture of the present day. In the last few decades, the ethics of care as a feminist ethic has given rise to extensive literature, and has affected moral inquiries in many areas. It offers a distinctive challenge to the dominant moral theories: Kantian moral theory, utilitarianism, and virtue ethics. This chapter outlines the distinctive features and promising possibilities of the ethics of care, and the criticisms that have been made against it. It then examines the ethics of care’s recognition of human dependency and of the (...) importance of responding to needs; its interpretation of the roles of emotion and reason in moral understanding; and its critique of liberal individualism and development of a conception of the person as relational. The ethics of care contrasts care with justice, tries to integrate them, and reconceptualizes public and private life and morality. (shrink)

Despite apparent political concern and action—often fuelled by high-profile cases and campaigns—legislative and institutional responses to image-based sexual abuse in the UK have been ad hoc, piecemeal and inconsistent. In practice, victim-survivors are being consistently failed: by the law, by the police and criminal justice system, by traditional and social media, website operators, and by their employers, universities and schools. Drawing on data from the first multi-jurisdictional study of the nature and harms of, and legal/policy responses to, image-based sexual abuse, (...) this article argues for a new joined-up approach that supports victim-survivors of image-based sexual abuse to ‘reclaim control’. It argues for a comprehensive, multi-layered, multi-institutional and multi-agency response, led by a government- and industry-funded online or e-safety organisation, which not only recognises the diversity of victim-survivor experiences and the intersection of image-based sexual abuse with other forms of sexual and gender-based violence and discrimination, but which also enables victim-survivors to reclaim control within and beyond the criminal justice system. Contemporary society is in the grip of contractual thinking. Realities are interpreted in contractual terms, and goals are formulated in terms of rational contracts. The leading current conceptions of rationality begin with assumptions that human beings are independent, self-interested or mutually disinterested, individuals; they then typically argue that it is often rational for human beings to enter into contractual relationships with each other.

This essay attempts to work out how justice and care and their related concerns fit together. I suggest that as a basic moral value, care should be the wider moral framework into which justice should be fitted.

Rethinking the in/visibility of race within the Australian nursing workplaceThis article presents an analysis of data from a critical qualitative study with 14 skilled black African migrant nurses, which document their experiences of nurse‐to‐nurse racism and racial prejudice in Australian nursing workplaces. Racism generally and nurse‐to‐nurse racism specifically, continues to be under‐researched in explorations of these workplaces; when racism (...) is researched, the focus is nurse‐to‐patient racism and racial prejudice. Similarly, research on the experiences of migrant nurses from a variety of ethnicities in Australia has tended to neglect their experiences of the social dynamics of the workplace, thus reinforcing their racialisation. When racialised, the migrant nurse becomes ‘the problem’ through a focus on English language competency and ensuing communication barriers. This paper applies Essed’s framework of ‘everyday racism’ to theorise narratives of racism by black African migrant nurses in Australia. In so doing, it not only brings to the fore silenced discussions of nurse‐to‐nurse racism in Australia, but also exposes the subtle, mundane nature of contemporary racism. For this reason, while the data we present must be read within their context, that is, the Australian nursing workplace, it has significance for advancing a critical analysis of racialised minority groups’ experiences of racism within seemingly ‘race‐less’ nursing workplaces internationally. Kravchenko.: Kravchenko encourages language science to approach languaging as “a species-specific semiotic activity that has a biological function.” Languaging as a form of social agency is broader than semiosis but not necessarily “above” it nor driven by biological function. By focusing on participation and becoming, the enactive approach to linguistic bodies offers conceptual resources to bridge human and non-human sense-making without resorting to codes.

Whether we should respect international law is in dispute. In the United States, international law is dismissed by the left as merely promoting the interests of powerful states. It is attacked by the right as irrelevant and an interference with the interests and mission of the United States. And it follows from the arguments of many liberals that in the absence of world government the world is in a Hobbesian state of nature and international law inapplicable. This article reviews the (...) thinking of Kant, Locke, and Rawls, among others and shows how arguments against respect for international law can be answered. It questions arguments based on the analogy between states and individuals, and between international law as it has developed and law based on an ideal social contract between individuals. It then turns to the ethics of care, a recent addition to moral theory, and examines its major characteristics and recommendations. It considers how the ethics of care would view international law and the guidance this moral approach could provide for international relations. The article shows how the ethics of care is compatible with various current trends, and how thinking about globalization and greater international interdependence would benefit from greater attention to it. The article argues that the ethics of care would clearly support respect for international law as it has developed, but that it would even more strongly support addressing current problems in ways that would, in the longer term, make appeals to law and its enforcements ever less necessary. It has been observed that some groups in society tend to report their health to be better than would be expected through more objective measures. The available evidence suggests that while variations in self-assessed measures of health may act as good proxies of mortality and morbidity in homogeneous populations, in some groups, such as the Aboriginal and Torres Strait Islander communities of Australia, these subjective measures may provide a misleading picture. Useful insights into the formation of health perceptions can be (...) drawn from a range of disciplines, in particular, from social comparison theories, models of illness behaviour, survey literature and linguistics. These theories and models help to provide an understanding of the different ways in which illness may be perceived, evaluated and acted upon by different kinds of people. Such considerations can have very direct implications for those planning and evaluating public health programs as well as those responsible for funding such programs. (shrink)

Issues of responsibility in the world of nanotechnology are becoming explicit with the emergence of a discourse on ‘responsible development’ of nanoscience and nanotechnologies. Much of this discourse centres on the ambivalences of nanotechnology and of promising technology in general. Actors must find means of dealing with these ambivalences. Actors’ actions and responses to ambivalence are shaped by their position and context, along with strategic games they are involved in, together with other actors. A number of interviews were conducted with (...) industrial actors with the aim of uncovering their ethical stances towards responsible development of nanotechnology. The data shows that standard repertoires of justification of nanotechnological development were used. Thus, the industrial actors fell back on their position and associated responsibilities. Such responses reinforce a division of moral labour in which industrial actors and scientists can focus on the progress of science and technology, while other actors, such as NGOs, are expected to take care of broader considerations, such as ethical and social issues. The Kimberley Process Certification Scheme is an innovation in global governance that combines a voluntary industry-led certification system with an inter-state import/export control regime. States, industry, and activists speedily negotiated it in large part due to the concentrated structure of the industry, and the complementary nature of emerging norms regarding both corporate behavior and international intervention in civil conflicts. The potential strength of the Kimberley Process lies in its state-led border controls, but these are being undermined by weak national governments. (...) The main argument of the article regards Aristotle’s anti-realistic account, which presents a different viewpoint from that which simply fulfils or negates the truth-values of our statements on Mixed Constitutions. In modern times, the idea of a Constitution of many minds or of many individuals is proposed by Sunstein and by Hart, who maintain that neither intentions in juridical procedure nor Constitutional provisions can produce an ideal Constitution. Thus any interpretative procedure assigning to legal reality any definite, once-and-for-all meaning is (...) precarious, according to Aristotle who asks whether we can gain epistemic access to the real essences of Constitutions and their structure. These ideas respond to a challenge in the Works of Contiades, who will help us to turn the ideal Constitution into a realisable model in the situation in which we live nowadays. This is the main challenge to be met by the institutions of Europe in order to safeguard the nature of historical and intellectual values. (shrink)

Se realiza un análisis de los proyectos a innovaciones educativas financiados en la Universidad de la República, Uruguay. Se presenta el perfil de los docentes innovadores, los problemas y los elementos de virtualidad presentes en los proyectos. Se encontró que se ha trabajado con cuestiones de virtualidad en los proyectos financiados, favoreciendo la enseñanza en línea durante la pandemia.

Este articulo realiza un recorrido por algunos textos de Toni Negri con el fin de ofrecer, a pesar de los desplazamientos conceptuales presentes en su obra, una visión de continuidad. Desde Dominio e Sabottaggio hasta los más recientes Imperio, Multitud y Commonwealth se rastrea en su obra un mismo propósito: a saber, imaginar una forma organizativa que pueda dar cuenta de las fuerzas del trabajo vivo, así como la definición de una nueva gramática política capaz de hacer frente a los (...) desafíos del mundo contemporáneo. Este recorrido se traza aquí a través del análisis de las nociónes de violencia y de amor como hilos conductores que atestiguan el persistente intento negriano de volver una y otra vez a iluminar el nudo problemático entre subjetividades diversas, afectos y la construcción de lo político. O principal objetivo deste artigo é articular a noção de antropologia, contida na tese complementar de Foucault a História da loucura, Gênese e estrutura da Antropologia de Kant, e em sua obra de 1966, As palavras e as coisas, reconhecendo no uso deste conceito uma cumplicidade teórica entre os dois textos. Em segundo lugar, procuramos entender os motivos que levaram Foucault a abandonar Kant como referência crítica às ciências humanas. Ao desvencilhar-se da filosofia kantiana, o pensador francês é forçado a (...) construir outros pressupostos que tornam possíveis o estudo do homem, tanto inspirado pela tendência estruturalista dos intelectuais franceses, sem, no entanto, estruturar condições atemporais dos discursos, como na crítica de Nietzsche à tradição filosófica. This paper examines cross-national differences in the development of sectoral collective bargaining in the European telecommunications industry following comparable changes in market regulations. The authors seek to explain why centralized, coordinated bargaining institutions were established in Austria and Sweden, both within incumbent telecommunications firms and at the sector level, while Germany and Denmark experienced decentralization and disorganization of bargaining at both levels. The authors argue that these outcomes resulted from differences in institutional loopholes employers were able to exploit to avoid (...) centralized bargaining and past union structures that influenced patterns of interunion cooperation. These two explanatory factors were interrelated: the presence or absence of institutional loopholes affected the basis for cooperation between unions, while labor cooperation was an important power resource unions could draw on to close emerging loopholes. Findings demonstrate the importance of sector-level political dynamics for the construction or erosion of solidaristic bargaining structures under pressure from market liberalization. (shrink)

Using content analysis, the authors categorize all Social Issues in Management (SIM) Division papers and abstracts (636) from 1972 through 1996 by subject matter and methodology. Showing the development of the field over time, the authors integrate their findings into previous SIM frameworks. Adaptation to the changing business environment is apparent in the subject matter. Although terminology and context (such as employee rights concerning electronic mail) may have changed, the topics are similar. Nevertheless, evolution in the SIM field is apparent. (...) Methodology has become much more sophisticated as researchers use existing and newly created databases and more rigorous techniques-such as event studies and meta-analysis. (shrink)

In Just Fodder, Josh Milburn defends the view that sentient animals have negative rights. Since non-human animals are not moral agents, and can’t themselves violate anyone’s rights, wild predation is normally ethically unproblematic. However, Milburn argues, there are occasions when humans can become morally responsible for an animal’s predation. In cases like these, predation does violate the prey animal’s rights. The difficulty here lies in determining when a human is ‘sufficiently’ morally responsible for an animal’s predation for the predation to (...) count as a rights violation. In this paper, I pick out what I take to be the relevant criteria Milburn identifies for moral responsibility: creating increased predation risk, foreseeability of increased predation risk, intending predation to happen, having some kind of special responsibility for the predator, and having some kind of special relationship to the prey. I argue that, at least as applied by Milburn, these criteria can lead to a kind of moral over-extension, one that rules out most forms of wild animal rehabilitation, species reintroduction and rewilding.
