Benbaji and Statman’s contractarian ethics of war offers a powerful new philosophical defence of orthodox conclusions against revisionist criticism. I present a two-pronged argument in reply. First, contractarianism yields what I call ‘decent war theory,’ a theory in which war between decent states is paradigmatic. I argue, by contrast, that states should treat wars against indecent states as paradigmatic, resulting in a Rawlsian alternative that issues in an ethics closer to revisionism. The second prong argues that the symmetrical international distribution (...) of power required by contractarianism throws into doubt the viability of war as an instrument for securing just ends. But I argue that there is a very important lesson to take from Benbaji and Statman’s analysis here. Even if contractarianism is arguably weakened by its political assumptions, revisionists frequently fail to pay any attention to the vagaries of power and their effects in shaping the outcomes of different accounts of ethics. I therefore argue that just war theory in general ought to develop an ethics with sufficient versatility to respond to shifts and variations in the distribution of military power. In particular, philosophers must consider morally defensible ways in which decent states can challenge rising indecent powers. (shrink)

This essay examines several works that contribute to an understanding of the nature of contemporary Chinese capitalism and its historical development. Core issues include the character of the bureaucracy, which has had a distinctive relationship to capital formation, and the character of the working class. The periodisation of Chinese capitalism and the relation between the pre- and post-reform periods are pressing political and analytical concerns. This essay suggests the advantages of a clearer focus on the dynamics of depoliticisation in understanding (...) the transition. The contemporary left-intelligentsia in China has in large part pinned its hopes on achieving some form of ideological hegemony within theccp, maintaining that it still operates within its revolutionary tradition. This represents a questionable strategic gamble. Acknowledging the important contributions made by Au’s book and other recent characterisations of China’s political economy from the left, this essay suggests that there remains much to be done. Shuman Questions of responsibility for serious harm are complex and potentially divisive. The way in which we frame these questions and the criteria by which we assess answers to them are colored, in part, by the lens though which we view them. I am a (...) law professor whose writings includes issues relating to criminal responsibility of person with mentally disabilities and I come to this commentary from that perspective. For me questions of moral responsibility raise psychological and philosophical, as well as legal, questions.Ciocchetti's (2003) paper addressees the criminal responsibility of the psychopathic offender. Not sure quite what the author meant by this label, I began to try to understand the concept of psychopathic offender by picking up my DSM-IV-TR and found no reference to such a diagnostic category. Absent a handy reference in the DSM, I looked in the paper for some other definition or recognition of the category of psychopathic offender and found no satisfactory grounding in any body of sound research. Left with the author's unsupported assertions that such a category of persons exists and that they behave in ways the author asks me to accept without support, my lawyer instincts cautioned me to proceed carefully. The psychopathic offender the author describes might well exist, but I am not persuaded of that, nor would be my legal colleagues, absent proof.Next, to the author's thesis that "[t]he offender must have the capacities necessary to understand relationships to justify holding that offender responsible" (p. 176) and that because psychopaths lack this capacity they should not be held criminally responsible. Is the author proposing a new test for criminal responsibility? Certainly no test for criminal nonresponsibility based on mental disability (i.e., insanity defense) in Anglo-American jurisprudence, or any other with which I am familiar, makes status (i.e., a diagnostic category) exculpatory for criminal responsibility. Rather, every test addresses the impact of a mental illness or disorder on the cognitive or volitional capacity of the offender at the time of the offense. The author offers no reason to reject the approach taken for the last several hundred years [End Page 193] by Anglo-American jurisprudence. Moreover, to the extent that status or diagnostic category is relevant in the insanity defense in Anglo-American jurisprudence, character or personality disorders (the genus to which I take it that psychopathy belongs) are often specifically excluded from consideration. For example, the Texas Penal Code (Tex. Penal Code Ann. § 8.01 (Vernon 1994)) states that:It is an affirmative defense to prosecution that, at the time of the conduct charged, the actor, as a result of a severe mental disease or defect, did not know that his conduct was wrong. The term "mental disease or defect" does not include an abnormality manifested only by repeated criminal or otherwise antisocial conduct.The federal Insanity Defense Reform Act raises the same issue: The government relies on the legislative history of 18 U.S.C. § 17, which states: "The concept of severity was added to emphasize that non-psychotic behavior disorders or neuroses such as an 'inadequate personality,' 'immature personality,' or a pattern of 'antisocial tendencies' do not constitute the defense.".... The government argues that because Dr. Lorenz would have testified that Salava was not psychotic but suffered from antisocial personality disorder, his testimony was not relevant to either prong of the insanity defense under the statute.... The openness of joint awareness between two or more subjects is a perceptual phenomenon. It involves a certain mutual awareness between the subjects, an awareness that makes reference to that very awareness itself. Properly characterized, such awareness can generate iterated awareness ‘x is aware that y is aware that x is aware...’ to whatever level the subjects can sustain. The openness should not be characterized in terms of Lewis–Schiffer common knowledge, the conditions for which are not met in many basic (...) cases of joint attention. A range of phenomena, including linguistic communication and other interpersonal relations, that have previously been described in terms of common knowledge should rather be seen as involving open joint awareness. An Appendix to this chapter discusses the relations of this approach to Barwise's discussions, and disputes the claim that these mental phenomena require the postulation of self-involving situations. The aim of the book is to make Socrates' investigation and resolution of the questions that still concern us as human beings more accessible to serious contemporary readers.

Comparatives are among the most extensively investigated constructions in generative grammar, yet comparatives involving attributive adjectives have received a relatively small amount of attention. This paper investigates a complex array of facts in this domain that shows that attributive comparatives, unlike other comparatives, are well-formed only if some type of ellipsis operation applies within the comparative clause. Incorporating data from English, Polish, Czech, Greek, and Bulgarian, we argue that these facts support two important conclusions. First, violations of Ross’s Left Branch (...) Condition that involve attributive modifiers should not be accounted for in terms of constraints on LF representations (such as the Empty Category Principle), but rather in terms of the principle of Full Interpretation at the PF interface. Second, ellipsis must be analyzed as deletion of syntactic material from the phonological representation. In addition, we present new evidence from pseudogapping constructions that favors an articulated syntax of attributive modification in which certain types of attributive modifiers may occur outside DP. In this paper, I investigate the foundations of Plotinus’ innovative theory that prime matter is unaffectable. I begin by showing that Plotinus’ main arguments for this thesis (in Ennead 3.6) all rely upon the controversial assumption that the properties prime matter underlies are not properties of prime matter itself. It is then argued that prime matter’s privation of sensible qualities has its conceptual basis in an idiosyncratic understanding of form-matter composition generally, and its primary doctrinal basis in Aristotle’s critical reports (...) on the Platonists’ substratum in Physics 1.9. While Plotinus finds Platonic authority for unaffectible matter in the Receptacle passage of the Timaeus, it is Aristotle’s testimony that provides the crucial impetus for reading that text in this way. On this basis, Plotinus develops a Platonist conception of form’s inherence in matter with distinctively non-Aristotelian features. (shrink)

The ability of international ethics and political theory to establish a genuinely critical standpoint from which to evaluate uses of armed force has been challenged by various lines of argument. On one, theorists question the narrow conception of violence on which analysis relies. Were they right, it would overturn two key assumptions: first, that violence is sufficiently distinctive to merit attention as a category separate from other modes of human harming; second, that it is troubling in a special way that (...) makes acts of violence peculiarly hard to justify. This paper defends a narrow understanding of violence and a special ethics governing its use by arguing that a distinctive form of ‘Violent Agency’ is the factor uniting the category while partly accounting for the fearful connotations of the term. Violent Agency is defined first by a double intention (1) to inflict harm using a technique chosen (2) to eliminate or evade the target’s means of escaping it or defending against it. Second, the harms it aims at are destructive (as opposed to appropriative). The analysis offered connects the concept of violence to themes in international theory such as vulnerability, security, and domination, as well as the ethics of war. (shrink)

While there are good reasons for this approach, in this paper I will examine the philosophical problems associated with the area of mathematics known as applied mathematics. Here mathematicians pursue mathematical theories that are closely connected to the use of mathematics in the sciences and engineering. This area of mathematics seems to proceed using different methods and standards when (...) compared to much of mathematics. In Hume's Social Philosophy, Christopher J Finlay presents a highly original and engaging reading of David Hume's landmark text, A Treatise of Human Nature, and political writings published immediately after it, articulating a unified view of his theory of human nature in society and his political philosophy. The book explores the hitherto neglected social contexts within which Hume's ideas were conceived. While a great deal of attention has previously been given to Hume's intellectual and literary contexts, important connections can (...) also be made between the fundamentals of Hume's philosophy and the social world in which it was developed. Finlay argues that Hume's unified theory of human nature, conceived in terms of passions, reason and sociability, was meant to account for human nature in its most articulate manifestations, in the commercial and 'polite' social contexts of eighteenth-century Europe. Through careful exegetical study of Hume's analysis of reasoning and the passions, Finlay explores the diverse aspects of sociability which the Treatise of Human Nature invokes. In particular, this study finds in the Treatise an important exploration of the tensions between the selfish motivations of individuals and their propensity to bond with others in complex and diverse kinds of social group. Analysis of Book III of the Treatise and of essays published afterwards shows how the various individualist and social propensities explored through the passions are addressed in Hume's theories of justice, morals and politics. David Brown (b. 1948) is a Scottish Episcopal priest and theologian whose work covers a vast terrain spanning methodological divisions between philosophy, Christian theology, religious studies, the arts and culture. Early work on the Trinity and Incarnation led to a Newman-inspired articulation of Scripture as tradition, and, related to this, the exploration of tradition as revelation with reference to a wide range of human experience. Moving from materially-mediated divine presence to culturally-mediated revelation, Brown's phenomenology of religious experience amounts to a (...) transformed natural religion along sacramental lines.
