Avant de configurer «un monde», l’art humain configure un lieu et même l’élit et le transfigure en le métamorphosant, faisant de milieux donnés des «lieux» habitables voire mémorables aux multiples formes de délimitations, d’échanges et de devenir. La notion de milieu habité est mise en perspective et pensée en termes de limites, passages, liens et métamorphoses.

Ancient philosophy is “applied” in a number of ways, and for distinctive reasons, some perhaps rather different from those to be found in contemporary philosophy. In the case of Socrates, Plato and Aristotle, one important basis for this lies in their views about the scope and purpose of philosophy. A second ground derives from their reflections on method. The methodological approaches discussed and implemented in the works of both Plato and Aristotle have significant implications for ideas about applied philosophy. This textbook introduces students to the various arguments for and against the prohibition of recreational drugs. The arguments are carefully presented and analyzed, inviting students to consider the competing principles of liberty rights, paternalism, theories of punishment, legal moralism, and the social consequences of drug use and drug laws. Meyers extends this examination by presenting alternatives to the prohibition/legalization dichotomy, including harm reduction, decriminalization, and user licensing or on-premise use. In this article I investigate the extent to which perspectival realism (PR) agrees with frequentist statistical methodology and philosophy, with an emphasis on J. Neyman’s frequentist statistical methods and philosophy. PR is clarified in the context of frequentist statistics. Based on the example of the stopping rule problem, PR is shown to be able to naturally be associated with frequentist statistics in general. I show that there are explicit and implicit aspects of Neyman’s methods and philosophy that are incompatible and (...) both partially agree and disagree with PR. Additionally, I provide clarifications and interpretations to make Neyman’s methods and philosophy more coherent with the realist aspect of PR. Furthermore, I deliver an argument that, based on Neyman’s methods and philosophy, one is dealing with genuine and non-trivial perspectives. I argue that, despite Neyman being a normative anti-pluralist, there are some elements of perspectival pluralism present in his methods and philosophy. In conclusion, firstly, due to their ambivalence, Neyman’s conceptions align more closely with PR than with alternative, less moderate stances. Secondly, from the perspective of the statistical approach analysed, PR should be treated as a descriptive rather than a normative position, and as case (or aspect)-dependent, rather than a universal, absolute, or binding stance. In 2021, there was a significant amendment to the legislation on medical experimentation. In particular, Chapter 4 of the Law of December 5, 1996 on the Profession of Physician and Dentist (Journal of Laws 2023, item 1516) was amended, in which the prerequisites of legally relevant consent given by the participant in the experiment or by other entities that express a position on their behalf were specified. In addition, procedures related to the opinion of the research project by the so-called (...) bioethics committee were described. Its members were obliged to maintain confidentiality with regard to information obtained in connection with the fulfilled function. These norms became protected by criminal sanctions, set forth in the amended Article 58 of the law. New generic types of criminal acts were introduced, primarily aimed at protecting the participant's right to self-determination, the voluntariness of participation in the experiment, and the confidentiality of data submitted by the experimenters in their proposals to bioethics committees. These norms fill in the gaps that have existed so far in the criminal law protection of these values. The article systematically discusses the generic types of criminal acts that have been penalized in Article 58 (4) to (6) of the referenced law. Their object of protection, object side, subject, subject side, punishability and potential confluence with other regulations are presented. The historical-dogmatic justification for the introduction of these regulations is also shown. (shrink)

The political theorist Michael Walzer has usually been taken as an opponent of global distributive justice, on the basis that it is incompatible with collective autonomy, would endanger cultural diversity, or simply on the basis that principles of global distributive justice cannot be coherently envisaged, given cross-cultural disagreement about the nature and value of the social goods that might be distributed. However in his recent work, Walzer demonstrates a surprising degree of sympathy for the claims of global distributive justice, even (...) of the egalitarian variety. But the precise contours of his current position on global equality are not yet clearly developed. The paper, therefore, attempts to reconstruct what that position might be, paying particular attention to the conclusions we could draw firstly for our understanding of the opposition between global equality and national self-determination , and secondly for the relationship between global equality and shared understandings.Keywords: global equality; global justice; collective autonomy; shared understandings; Michael Walzer. In our paper we investigate a difficulty arising when one tries to reconsiliateessentialis t’s thinking with classification practice in the biological sciences. The article outlinessome varieties of essentialism with particular attention to the version defended by Brian Ellis. Weunderline the basic difference: Ellis thinks that essentialism is not a viable position in biology dueto its incompatibility with biological typology and other essentialists think that these two elementscan be reconciled. However, both parties have in common metaphysical starting point and theylack explicit (...) track of methodological procedures. Methodological inquiry involves less demandingassumptions than metaphysical, and therefore it is justified to analyse abovementioned discrepancy between Ellis and other essentialist in this context. We do it by bottom-up investigation whichfocuses on the practice of taxonomists in the particular field of biology. A case study helps us todiscover four characteristics of biological typology practice: impossibility of algorithmization,relativity, subjectivity and conventionality. These features prove non-realistic and therefore anti-essentialistic character of biological classification. We conclude by saying that any essentialismrelated to the notion of biological kind cannot be regarded as justified by scientific enterprise of creating typologies. (shrink)

The aim of this paper was to prove that reduction of social, cultural and spiritual explanation of religion, to the purely biological one, is unattainable, and what is more, that such efforts are redundant and give threat to the quality of science, as well as to the quality of religious beliefs. With regard to elementary methodological scientific criteria, the examples of limitation in biological investigating and explaining of religion was shown. Subsequently, the paper presents a few important logical mistakes (pseudoarguments) (...) as examples of ontological underinterpretation of scientific facts. Finally, the discourse concentrates on the threats (to science and religion) that are associated with biological investigation of religion. (shrink)

This paper is an attempt to meta-subjective revision of contemporary “ecological” issues concerning glorification of science (called by the Author „science-centrism) present in paradigm and practice of nature protection. Assuming that science can be often treated as conditio sine qua non of effective pro-ecological activity, and that such approach isn’t in fact appropriate, the Author led diverse arguments supporting the thesis that the presence of science isn’t necessary in theoretical and applied protection of nature. Within the discourse he tried to (...) defend the possibilities of the wide spectrum of environmental-friendly approaches and appreciate alterscientific paradigms and tools of nature protection. The Author attempted to emphasize that science-based tools of nature protection aren’t of absolute type. He tried to present a relativized scientific approach (possibility against necessity) as an opportunity to create wiser and more rational vision of nature protection, not based on idolatry of science. Bertrand Russell in his essay On Denoting [1905] presented a theory of description developed in response to the one proposed by Gottlob Frege in his paper Über Sinn und Bedeutung [1892]. The aim of our work will be to show that Russell underestimated Frege three times over in presenting the latter’s work: in relation to the Gray’s Elegy argument, to the Ferdinand argument, and to puzzles discussed by Russell. First, we will discuss two claims of Russell’s which do not do (...) justice to Frege: that we speak of a sense by means of quotation marks, and that all Frege does to cope with phrases that might denote nothing is define an arbitrary object as their reference. Second, we will show that Russell omitted the fact that Frege’s theory provided some answers for the puzzles presented by Russell in his essay. (shrink)

The Chief Medical Officer of Health of the United Kingdom has recommended that the 1990 Human Fertilisation and Embryology Act should be amended to allow cloning in humans for research purposes only. He also recommended that: “The transfer of an embryo created by cell nuclear replacement into the uterus of a woman (so called ‘reproductive cloning’) should remain a criminal offence” (recommendation 7, Ref. 1). This recommendation implies that nuclear replacement and cloning are the same. They are not. Nuclear transfer (...) constitutes reproductive cloning only when the individual created is genetically identical to the nuclear donor. In this paper, we describe a possible future use of nuclear transfer for the treatment of infertile individuals. The treatment yields an individual that receives approximately equal genetic contributions from each parent. We use this example to illustrate how semantic confusion might lead to plausibly moral and justifiable treatments being legally banned. In doing so, we hope to encourage a more accurate and informed use of language in science, law and politics, so that legislation is properly informed by science and achieves what it intends. Polish medical law does not explicitly regulate the possibility of off-label use of medicines. Such procedures therefore raise doubts in medical practice, where medicines are often prescribed beyond the Characteristic of Medicinal Product. This phenomenon particularly affects the treatment of children, as there is a lack of registered medicines in this age group, but they are registered for use in adults. Since such treatment goes beyond the scope of registration, a dilemma arises as to whether it is permissible and, if (...) so, under what conditions and whether sanctions are imposed on the medical professional using the off-label medicine. These issues are addressed in an article by Dr Maria Gutowska-Ibbs, entitled 'Off label - practical consequences of unclear legislation". The present study complements these considerations and is in part an ad vocem statement. The article attempts to differentiate between the use of off-label medicines and medical experiments, following the criterion of the purpose for which a given medical action is performed. The limits of admissibility of such actions under criminal law are also discussed in more detail. Off-label treatment is considered through the prism of the required precautionary rules, compliance with which is the antithesis of inadvertence. It is assumed that if the drug was administered in accordance with current medical knowledge and the treatment is adequate to the patient's condition, there is no violation of these rules, which excludes the imputation of inadvertence. An extensive section of the study is devoted to the issue of the patient's consent to treatment outside the indications. Above all, it emphasises the need to explain in detail to the patient the circumstances of prescribing such a drug and, on this basis, to obtain informed consent. It also stresses the importance of the written form of consent, which can have a significant evidentiary impact in potential litigation. (shrink)

In the ongoing debate about the impact that studies of public ignorance should have on the study of culture, Mark Fenster and Bret Chandler assume that wider political participation must be our goal, because, to them, political ignorance is a culturally imposed, and therefore removable, obstacle—as if, without the baleful influence of culture, political participants would be well informed. Culture is indeed a primary influence on people's political opinions, so political scientists should indeed study the role it plays in the (...) formation of political beliefs. But such studies should begin with ignorance as people's default position, and should refrain from assuming that the source of ignorance is cultural domination or manipulation. (shrink)

We show that if among the tested hypotheses the number of true hypotheses is not equal to the number of false hypotheses, then Neyman-Pearson theory of testing hypotheses does not warrant minimal epistemic reliability (the feature of driving to true conclusions more often than to false ones). We also argue that N-P does not protect from the possible negative effects of the pragmatic value-laden unequal setting of error probabilities on N-P’s epistemic reliability. Most importantly, we argue that in the case (...) of a negative impact no methodological adjustment is available to neutralize it, so in such cases the discussed pragmatic-value-ladenness of N-P inevitably compromises the goal of attaining truth. While recognising the power and fundamental importance of Wickham’s Framing the Early Middle Ages, this essay explores some of the problems associated with the relative silence within the text about the issue of the forces of production and their development. By contrast, Harman suggests that Wickham’s most important contribution to our understanding of the period, his concept of a peasant-mode of production, is best understood against the backdrop of prior developments of the forces of production. We review Potts’ influential book on the semantics of conventional implicature (CI), offering an explication of his technical apparatus and drawing out the proposal’s implications, focusing on the class of CIs he calls supplements. While we applaud many facets of this work, we argue that careful considerations of the pragmatics of CIs will be required in order to yield an empirically and explanatorily adequate account.

In this incisive study of the biological and cultural origins of the human self, the author challenges readers to re-think ideas about the self and consciousness as being exclusive to humans. In their place, he expounds a metatheoretical approach to the self as a purposeful system of extended cognition common to animal life: the invisible medium maintaining mind, body and environment as an integrated 'field of being'. Supported by recent research in evolutionary and developmental studies together with related discoveries in (...) animal behavior and the neurosciences, the author examines the factors that have shaped the evolution of the animal self across widely different species and times, through to the modern, technologically enmeshed human self; the differences between which are presented as relations of degree rather than absolute differences. Much like our primitive ancestors, he contends, routine human behaviour is governed more by unconscious instinct than self-conscious rationality, and is generally resistant to any major changes in customary habits of life, until compelled in time to do so. However, in extreme and rapidly evolving circumstances, as with climate change, tardy responses may become so detached from reality as to constitute an actual threat to survival. (shrink)

In The Ethics of Authenticity, Charles Taylor speaks of the malaises of modernity in which individualism and authenticity lose their moral force by becoming simply a type of relativism and/or soft despotism. In contrast, Taylor suggests that individualism and authenticity need to be understood as holding moral salience through the dialogical nature of human life and the external horizons of meaning necessary to the very formulation of the authentic self. Individual choice only makes sense when some choices are more socially, (...) politically, and/or ethically valuable than others. Taylor’s discussion of the ethics of authenticity can be applied to the religious movement of contemporary Paganism and the marked hesitation on the part of Pagans to claim any expected responsibility on the part of other Pagans toward nature and/or the environment. This paper is concerned with Thomas Reid's account of the role of instinctive exertions in the development of one's conception of power. I consider whether such exertions can shed any light on the matter of how certain sensations can appear to us to possess spatial content. Reid denies that sensations have such content; I argue that the introduction of instinctive exertions into his account might allow Reid to avoid some of the less palatable consequences of denying spatial content to sensations.

In this work, we explore the epistemic import of the value-ladenness of Neyman-Pearson’s Theory of Testing Hypotheses by reconstructing and extending Daniel Steel’s argument for the legitimate influence of pragmatic values on scientific inference. We focus on how to properly understand N-P’s pragmatic value-ladenness and the epistemic reliability of N-P. We develop an account of the twofold influence of pragmatic values on N-P’s epistemic reliability and replicability. We refer to these two distinguished aspects as “direct” and “indirect”. We discuss the (...) replicability of experiments in terms of the indirect aspect and the replicability of outcomes in terms of the direct aspect. We argue that the influence of pragmatic values is beneficial to N-P’s epistemic reliability and replicability indirectly. We show that while the direct influence of pragmatic values can be beneficial, its negative effects on reliability and replicability are also unavoidable in some cases, with the direct and indirect aspects possibly being incongruent.
