Commemorative artefacts purportedly speak – they communicate messages to their audience, even if no words are uttered. Sometimes, such artefacts purportedly communicate demeaning or pejorative messages about some members of society. The characteristics of such speech are, however, under-examined. I present an account of the paradigmatic characteristics of the speech of commemorative artefacts (or, “commemorative artefactual speech”), as a distinct form of political speech. According to my account, commemorative artefactual speech paradigmatically involves the use of an artefact by an authorised (...) member of a group to declare the importance of remembering a subject, in virtue of some feature of the subject. Then, I outline a variety of ways that commemorative artefactual speech can go awry. Such speech can be unauthorised, involve unfair exclusion or incorrect identification, be aesthetically inadequate, invoke clandestine explanations, and be directed at inappropriate subjects. I conclude with a discussion of the implications of my account for resisting problematic commemorative artefactual speech. (shrink)

Theatre, commonly seen as an audiovisual art, has performance at its core. Performance is mainly narrative through language, movement, dance, music, art and other forms to create an artistic image for the stage, which contains verbal and non-verbal elements. Non-verbal elements have crucial implications for theatre practice and theoretical perception. The present research investigates non-verbal performance in theatre based on semiotics and non-verbal communication theory. The study found that non-verbal performance includes (not limited to) posture, movement, gestures, props, and costumes. (...) To make a more comprehensive analysis of non-verbal performance in theatre, a mixed research method combining textual analysis and questionnaire survey to collect data was employed, comprehensively investigate non-verbal performance in theatre, and comprehensively discuss the definition, classification and characteristics of key elements of non-verbal performance in drama based on the research design of analytical study, and reveals how non-verbal performances are expressed in theatre. In this paper, I develop and defend a novel account of Moore’s paradox, which locates its source in self-reference. The main insight comes from Gareth Evans’s discussion of Transparency, which says that a normal person takes p to be directly relevant to the truth of “I believe that p.” It has been noticed by many philosophers that Moore’s paradox is closely related to Evans’s Transparency. However, Evans’s claim that Transparency is constitutively related to self-reference has received relatively little attention from (...) those philosophers. I claim that once we get the two links straight and join them, a novel and plausible account of Moore’s paradox emerges. According to this account, the absurdity involved in Moore’s paradox is traceable to a constitutive relation between Transparency and self-reference. Asserting “p but I do not believe that p” sounds absurd, because the use of “I” indicates that the subject thinks of the individual referred to as herself, while her failing to conform to Transparency implies the opposite. Asian diplomatic practices consistently frustrate western policymakers. This, I argue, is due in large part to cultural factors and the differences in interpreting political modernization. I will identify the features that contribute to a ‘diplomacy of encounter’ by, firstly, performing a historical reading of early indigenous annals that treat diplomacy in Asia, as well as of Jesuit and Portuguese encounters with Asia in the 1500s and 1600s; secondly, by reading a sample of nationalist tracts from Asia between the late 1800s (...) and 1960s; and, thirdly, by reading the practices of ASEAN and wider Asia-Pacific regionalism between the 1990s and 2000s. It is only through discourse analysis of the Foucaultian variety that one can tease out the cultural and modernization-related road bumps in so-called ‘modern Asian diplomacy’. This study hopes to contribute to enhancing appreciation of the ongoing procedural and substantive tensions between Asian states and their western, and mostly developed, dialogue partners. (shrink)

Human perception has long been a critical subject of design thinking. While various studies have stressed the link between thinking and acting, particularly in spatial experience, the term “design thinking” seems to disconnect conceptual thinking from physical expression or process. Spatial perception is multimodal and fundamentally bound to the body that is not a mere receptor of sensory stimuli but an active agent engaged with the perceivable environment. The body apprehends the experience in which one’s kinesthetic engagement and knowledge play (...) an essential role. Although design disciplines have integrated the abstract, metaphoric, and visual aspects of the body and its movement into conceptual thinking, studies have pointed out that design disciplines have emphasized visuality above the other sensory domains and heavily engaged with the perception of visual configurations, relying on the Gestalt principles. Gestalt psychology must be valued for its attention to a whole. However, the theories of design elements and principles over-empathizing such visuality posit the aesthetics of design mainly as visual value and understate other sensorial and perceptual aspects. Although the visual approach may provide a practical means to represent and communicate ideas, a design process heavily driven by visuality can exhibit weaknesses undermining certain aspects of spatial experience despite the complexity. Grounded in Merleau-Ponty’s notion of multisensory perception, this article discusses the relationship between body awareness and spatial perception and its implication for design disciplines concerning built environments. Special attention is given to the concepts of kinesthetic and synesthetic phenomena known as multisensory and cross-sensory, respectively. This discussion integrates the corporeal and spatiotemporal realms of human experience into the discourse of kinesthetic and synesthetic perceptions. Based on the conceptual, theoretical, and precedent analyses, this article proposes three models for design thinking: Synesthetic Translation, Kinesthetic Resonance, and Kinesthetic Engagement. To discuss the concepts rooted in action-based perception and embodied cognition, this study borrows the neurological interpretation of haptic perception, interoception, and proprioception of space. This article suggests how consideration of the kinesthetic or synesthetic body can deepen and challenge the existing models of the perceptual aspects of environmental psychology adopted in design disciplines. In the present paper we shall see that the different ways of understanding mind between Confucianism and Enlightenment in the 18th century. In this study each of these two different traditions is regarded as the East Asian context of mind study or as the Western European context of mind study. This idea comes from a kind of constructivism and constructive realism. The former, which comes from ideas of Lev Vygotsky, stresses that human mind is constructed on its cultural context. The (...) latter insisted by Fridriech Wallner approves that every truth constructed on its cultural context can be an absolute truth depending on its cultural context. Due to these two viewpoints, we can see that the truth about human mind is not singular but plural and it should be an important theme of discussionhow to communicate between different understandings of mind and cultural context. Therefore three steps to approach the difference between Asian and European should be discussed in the following way: first, I will explain Confucian ways of understanding mind. It is Confucian cultural context as a social being that used to be the basis of cultural construction of East Asian’s mind. There were three types of Confucianism in 18th century Korea; second I will explain Western European way of understanding mind and the philosophy of Enlightenment as the basic context of cultural construction of mind; and third, I will conclude by comparing these two different ways of understanding mind and mind construction and by looking for a feasible way to communicate and understand each other. We report one production and one comprehension experiment investigating the effect of animacy in relative clause attachment in Chinese. Experiment 1 involved a fill-in-the-blank task that manipulated the order of an animate noun phrase in a complex NP construction. The results showed that while low attachment responses exceeded high attachment responses overall (cf. Shen, 2006), a tendency exists to attach a relative clause to an animate NP in Chinese (cf. Desmet et al., 2002). Experiment 2 used a rating task to (...) examine the interplay between animacy and structural information by manipulating the order of the animate NP as well as the relative clause type (i.e., subject vs. object relative clauses). The results showed that the animate NP modification tendency found in Experiment 1 was limited to subject-relative clauses and that no animacy-related effect was found with object-relative clauses. These results are incompatible with purely structural parsing strategies such as Late Closure (Frazier, 1987) and the Predicate Proximity Principle (Gibson et al., 1996). Instead, the current results suggest that attachment ambiguity resolution in Chinese relative clauses is sensitive to animacy as well as structural information. (shrink)

This paper investigates how and why the Japanese model has undergone changes in the context of its internationalization, during which foreign countries, particularly the U.S. and Germany, adopted Japanese methods, departing from their own traditional models at the turn of the twentieth century. By examining the dynamicprocesses of these transformations in national models, this paper critically reviews prevalent paradigms of neoliberalism and institutionalism, proposing an alternative of “mutual learning by reflexive agents.” By exploring the dynamic processes of the Japanese model’s (...) internationalization and transformation, in which the Japanese model fell into crisis and underwent transformation in the changed context of international competition caused by the internationalization of the Japanese model, this paper proposes a new conception of “mutual learning by reflexive agents” in the context of international competition, in which agents, inspired by foreign competitors, critically reconsider their own institutions and, in turn, generate a new divergence in the process of creative learning. Genetic predispositions may predict different outcomes depending on one's cultural context, and culture may predict different outcomes depending on genetic predispositions - that is, genes and culture interact. Less is understood, however, about how genes and culture interact, or the psychological mechanisms through which gene–culture interactions occur. In this Element, Joni Y. Although corporate social responsibility appears to be mutually beneficial for companies and consumers, the modern marketplace has left both parties in vulnerable positions. Consumers are increasingly subjected to incongruent CSR messages such as greenwashing, while companies are trapped in a strategic positioning dilemma with regard to how to most effectively and ethically approach CSR communication. This has led some companies to instead adopt a strategically silent approach, such as greenhushing. To capture this CSR positioning dilemma and test the positioning effects (...) on consumers’ attributions, this study applies attribution theory to conceptualize four distinct CSR positions which reflect varying combinations of congruence or incongruence between a company’s external CSR communication and its actual internal CSR actions. Using an online experiment, the effects of the CSR positions on consumer attributions for intrinsic and extrinsic CSR motivations and purchase intentions were tested across three CSR domains: environmental; labor; and lesbian, gay, bisexual, and transgender inclusion. Overall, the findings attest to the significant effect of internal–external congruence-based CSR positioning on how consumers respond to CSR communication. Importantly, the results indicate that discreet positioning is perceived similarly to uniform positioning, while misleading and unethical tactics such as CSR-washing are sure to backfire. John Rawls’s use of the “fully cooperating assumption” has been criticized for hindering attempts to address the needs of disabled individuals, or non-cooperators. In response, philosophers sympathetic to Rawls’s project have extended his theory. I assess one such extension by Cynthia Stark, that proposes dropping Rawls’s assumption in the constitutional stage (of his four-stage sequence), and address the needs of non-cooperators via the social minimum. I defend Stark’s proposal against criticisms by Sophia Wong, Christie Hartley, and Elizabeth Edenberg and Marilyn (...) Friedman. Nevertheless, I argue that Stark’s proposal is crucially incomplete. Her formulation of the social minimum lacks accompanying criteria with which the adequacy of the provisions for non-cooperators may be assessed. Despite initial appearances, Stark’s proposal does not fully address the needs of non-cooperators. I conclude by considering two payoffs of identifying this lack of criteria. (shrink)

There are close parallels between Frank Jackson's case of black-and-white Mary and David Lewis's case of the two omniscient gods. This essay develops and defends what may be called “the ability hypothesis” about the knowledge that the gods lack, by adapting Lewis's ability hypothesis about the knowledge that Mary acquires. What the gods might lack despite their propositional omniscience is not any distinctive kind of information, but certain abilities of introspection. The motivating idea is that knowledge one acquires by exercising (...) introspective abilities cannot fail to be knowledge about oneself or indexical knowledge. So in order to envisage the gods' epistemic situation coherently, we need to assume that they lack those introspective abilities. But once we recognize that, it turns out that positing a special kind of information is a gratuitous addition. The two gods' ignorance simply consists in their lack of introspective abilities. Much is being written today about the changing nature of the American workforce. This article summarizes 10 of these changes: (a) global competition; (b) the changing skills of work; (c) the declining impact of unions; (d) the altered human composition of the workforce; (e) the effects of continuous improvement, downsizing, and reengineering; (f) the growing use of part-time employees; (g) the widening income gap; (h) lessened employer and employee loyalty and commitment; (i) early retirement programs; and (j) telecommunications and virtual (...) employees. Rather than just identifying and documenting these trends, this article discusses the ethical implications of such movements. In this article, employee relations ethics is defined as "treating employees properly, with respect and dignity." The term employee relations ethics is used both individually and collectively to analyze the negative human results from a moral rather than an economic perspective. The age-old clash between bottom-line mentality (economics) versus higher order thinking (ethics) is revisited with a focus on employees, not owners (old theory) or customers (new theory). (shrink)

The paper outlines a deflationary interpretation of Hegel’s metaphysics, as presented in the Encyclopedia of the Philosophical Sciences. It focuses mainly on the Science of Logic as a theory of categories, which explores the movement of the Concept. The major idea is to read Hegel’s identification of logic and metaphysics as a thesis on deflating metaphysics into logic and semantics. Hegel’s metaphysics, which may better be called logico-metaphysics, does not describe the objective world directly. Rather, as a second-order theory, it (...) unfolds and makes transparent the fundamental concepts that are necessary for our understanding of the world and our orientation in it. -/- The paper begins with a brief discussion of Hegel’s idea of philosophy as system. The argument is made that Hegel should be interpreted holistically, in contrast to the popular approach of distinguishing between what is living and what is dead in his philosophy. In the second and third parts of the paper, an analysis is given of Hegel’s criticism of Kant, with an explanation of how Hegel’s Logic further develops Kant’s project of transforming traditional metaphysics. Here, the interesting fact that Hegel’s logical categories are not derived from an absolute first principle is pointed out. Instead, the task of Hegel’s Logic is to comprehend and systematize the concepts that have already been evolved in the history of philosophy. In the last part of the paper, the deflationary approach is extended to Hegel’s Realphilosophie. While Hegel’s Logic takes the place of ontology, his Philosophy of Nature and Spirit offers a comprehensive metaphysica specialis, laying conceptual foundations for understanding various dimensions of reality, from nature through the ethical-political world to different cultural domains. The paper takes Hegel’s Philosophy of Objective Spirit as an example to illustrate how the deflationary interpretation sheds light on Hegel’s “practical” philosophy as a second-order theory that does not aim to uncover first-order normative principles for guiding actions, but rather to develop the concepts necessary for normative judgments. This article explicates Xunzi's three types of cognitive delusions in Xunzi's Zhengming Pian. The followings are my conclusions: first, general names such as “a white horse,” “a horse,” “a thief,” and “a man” are thought of as proper nouns because the classic Chinese theory of language concerned pragmatics rather than semantics. Second, classic Chinese epistemology does not address conceptual knowledge or knowledge based on argumentation distinguished from the art of description. Third, Gongsun Long believes in an extreme form of one‐name‐one‐thingism. (...) Fourth, Neo‐Moists' theory of inference is based on intensional contexts. Fifth, Hui Shi's position presupposes the art of knowing objects before any verbal expression and suggests the arbitrariness in the expressions of known objects. One recurring criticism of the best interests standard concerns its vagueness, and thus the inadequate guidance it offers to care providers. The lack of an agreed definition of ‘best interests’, together with the fact that several suggested considerations adopted in legislation or professional guidelines for doctors do not obviously apply across different groups of persons, result in decisions being made in murky waters. In response, bioethicists have attempted to specify the best interests standard, to reduce the indeterminacy surrounding medical decisions. (...) In this paper, we discuss the bioethicists’ response in relation to the state's possible role in clarifying the best interests standard. We identify and characterise two clarificatory strategies employed by bioethicists —elaborative and enumerative—and argue that the state should adopt the latter. Beyond the practical difficulties of the former strategy, a state adoption of it would inevitably be prejudicial in a pluralistic society. Given the gravity of best interests decisions, and the delicate task of respecting citizens with different understandings of best interests, only the enumerative strategy is viable. We argue that this does not commit the state to silence in providing guidance to and supporting healthcare providers, nor does it facilitate the abuse of the vulnerable. Finally, we address two methodological worries about adopting this approach at the state level. The adoption of the enumerative strategy is not defeatist in attitude, nor does it eventually collapse into (a form of) the elaborative strategy. (shrink)

The exact causes and the biological substrates underlying mental disorders remain to be elucidated; even the diagnosis of these disorders is descriptive and not based on an etiological understanding and no biological diagnostic markers have been validated. The manifestation of almost all mental disorders results from a complex interaction (...) of biological and environmental factors which encompasses the patient’s unique life history, experiences and relationship with others and the community. In the face of such uncertainties — at times extending to the types of treatment (psychiatry is generally acknowledged not be an exact science) — it has been argued that adopting a pragmatic approach is necessary.1 Accordingly, this approach necessitates high ethical standards among mental health practitioners.Some mental illnesses are associated with varying degrees and types of cognitive impairments. Others have certain symptoms like auditory hallucinations and delusions that might severely compromise the patients’ autonomy, distort their sense of reality, increase the risk of harm to themselves or others and render them incapable of making informed decisions in their treatment and participation in research.Consequently, there are issues that are particular to the provision of mental healthcare. These include the need for enforced involuntary treatment with the corollary of depriving a patient of his personal liberty even [End Page 173] though it is often justified on the grounds that it is in the patient’s best interests. However, at times, it is the legal and societal obligation of mental health practitioners to protect those who might be harmed from the patient’s action that might seem to be more pressing. In this situation of double agency, lies the tension of providing confidential care for patients and acting as “an agent of the state” where that patient’s confidentiality might be breached and his liberty infringed upon. This situation is further aggravated by the stigma that clings ever so tenaciously to those who suffer from mental disorders and where it is the norm to stereotype them as dangerous and unpredictable.Consideration of a patient’s autonomy is also challenged by characteristics that are unique to the practice of psychiatry. The prescription of certain psychotropic medications can alter how people think and feel, while psychotherapy works towards changing the patient’s views and values. The philosopher, Jennifer Radden, describes this process as “re-forming the patient’s whole self or character … akin to the responsibilities of raising children”.2 The psychotherapeutic relationship is thus particularly personal and intimate because patients are asked to provide information that often reveals their innermost feelings, fears and fantasies. This information is provided on the basis of trust and assurance of confidentiality, and with expectation of being helped.Jeremy Holmes and Gwen Adshead have elaborated on the vulnerability of patients seeking psychotherapy: they might be particularly susceptible to exploitation because their past experiences of being exploited have led to their distress and help seeking — their dependency and the extreme privacy of the therapeutic relationship make any transgression difficult to be uncovered.3 There is a calamitous combination of the “unconscious wish in the patient to be used” with the complicity of an unethical therapist seeking to fulfil his own interests.4As in any other doctor-patient relationship, the relationship between the mental healthcare practitioner and the patient is one of unequal power where the former is ascendant. While that power should be exercised to heal and to relieve suffering, it also gives the practitioner tremendous power “to harm, reject, misunderstand, or exploit patients who struggle with the experience of mental illness, which itself may generate helplessness, despair, distress, and exceptional dependence on the clinician”.5 Given the potential of doing good and harm coupled with the likelihood of being so significant in the life of the patient,6 providing care for those with mental disorders and distress is necessarily ethically exacting — arguably more so than in other medical practice settings. Interpretations of ethical egoism as advocating the unconstrained harming of others, or as an absurd meta-ethical definition of morality, are unwarranted. The social definition of morality provided by, e.g., William Frankena, fails to rule out egoism. Instead, it forms the background against which egoism develops as a possible, normative position. Examples from "The Immoralist" and "Zorba the Greek" illustrate this possibility.

Self-regulatory processes have predominantly been linked to the study of academic achievement in terms of learning behavior, cognitive engagement, and specific academic performance measures. If poorly regulated, academic behavior can have repercussions on social adaptation. Motivational processes constitute the other key element in ensuring successful regulation, as studies indicate that self-regulation can effectively influence achievement outcomes if learners have positive beliefs about their personal ability to negotiate difficulties and work towards the desired learning outcomes. An incoherent feed‐forward loop (FFL) is one of the most‐frequently observed motifs in biomolecular regulatory networks. It has been thought that the incoherent FFL is designed simply to induce a transient response shaped by a ‘fast activation and delayed inhibition’. We find that the dynamics of various incoherent FFLs can be further classified into two types: time‐dependent biphasic responses and dose‐dependent biphasic responses. Why do the structurally identical incoherent FFLs play such different dynamical roles? Through computational studies, we show that (...) the dynamics of the two types of incoherent FFLs are mutually exclusive. Following from further computational results and experimental observations, we hypothesize that incoherent FFLs have been optimally designed to achieve distinct biological function arising from different cellular contexts. Contrary to the assumption of arbitrariness in modern linguistics, sound symbolism, which is the non-arbitrary relationship between sounds and meanings, exists. Sound symbolism, including the “Bouba–Kiki” effect, implies the universality of such relationships; individuals from different cultural and linguistic backgrounds can similarly relate sound-symbolic words to referents, although the extent of these similarities remains to be fully understood. Here, we examined if subjects from different countries could similarly infer the surface texture properties from words that sound-symbolically represent hardness in Japanese. (...) We prepared Japanese sound-symbolic words of which novelty was manipulated by a genetic algorithm. Japanese speakers in Japan and English speakers in both Singapore and the United States rated these words based on surface texture properties, as well as familiarity. The results show that hardness-related words were rated as harder and rougher than softness-related words, regardless of novelty and countries. Multivariate analyses of the ratings classified the hardness-related words along the hardness-softness dimension at over 80% accuracy, regardless of country. Multiple regression analyses revealed that the number of speech sounds /g/ and /k/ predicted the ratings of the surface texture properties in non-Japanese countries, suggesting a systematic relationship between phonetic features of a word and perceptual quality represented by the word across culturally and linguistically diverse samples. A common assumption in the selection of nonhuman animal subjects for research and the approval of research is that, if the risks of a procedure are too great for humans, and if there is a so-called scientific necessity, then it is permissible to use nonhuman animal subjects. I reject the common assumption as neglecting the central ethical issue of the permissibility of using nonhuman animal subjects and as being inconsistent with the principle of justice used in human subjects research ethics. (...) This principle requires that certain classes of individuals not be subjected to a disproportionate share of the burdens or risks of research. I argue for an extension of this principle to nonhuman animal research and show that a prima facie violation of the principle occurs because nonhuman animals bear an overwhelmingly disproportionate share of the risks of research without sufficient justification or reciprocal benefit. Turnover is an important career decision that influences both individual employees and their organizations. While human resource management scholars have long sought to understand critical components of a workplace where employees want to stay, ethics has become a primary factor of interest in public sector turnover intention studies only in recent years. This article contributes to this growing line of research by investigating if and how ethical work environment influences public employees’ turnover intentions, and how this relationship is moderated by (...) an employee’s position of power measured by supervisory status. Nonexistent Objects in Buddhist Philosophy: On Knowing What There Is Not, by Zhihua Yao, cogently strings together different Buddhist schools' varied philosophical approaches to the cognition of nonexistent objects (...) (asadālambanajñāna) or non-cognition (anupalabdhi). Non-being and the knowledge of non-being have long been central to nearly every philosophical tradition. Buddhist philosophy, in particular, invests extraordinary intellectual effort to deal with these topics, since non-being (asat/abhāva) occupies a central role in the Buddhist doctrine. Yao acutely reconstructs a brief history of this philosophical enterprise of Buddhism from the early sectarian period to the time when the so-called logico-epistemological school prevailed. The book consists of an introduction and eight chapters. These eight chapters are basically based on Yao's previously published articles. They are further arranged into two parts: (1) "Cognition of Nonexistent Objects: A Historical Development" and (2) "Epistemological Approaches to Nonexistence." The first part discusses how philosophers from the Mahāsāṃghika, the Dārṣṭāntika, and the Yogācāra analyze the cognition of nonexistent objects. The philosophical development concerning this particular topic is masterfully articulated by Yao. This mastery is best shown in his unveiling of Yogācāra's philosophical inheritance from its Abhidharma legacy. In addition, his reconstruction deepens our understanding of the intricate history of sectarian Buddhism in a broader sense. The second part centers on the philosophical issues of nonexistence raised by the Buddhist logico-epistemological school. Yao's translation, presentation, and comparison of these philosophical arguments is strikingly lucid and comprehensive. Overall, one salient contribution of this book is that it highlights the importance of Pāli and Chinese sources in studying the history of Buddhist philosophy, especially Indian Buddhist philosophy. In Part 1, Yao's reconstruction of sectarian Buddhist philosophies is heavily based on the Pāli text Kathāvatthu and the Chinese translations of Samayabhedoparacanacakra, Śāriputrābhidharma, Vijñānakāya, Mahāvibhāṣā, *Janakaparamopadeśa, and Nyāyānusāra, whose Sanskrit or Prakrit originals have long been lost. In part 2, in [End Page 1] addition to comprehensively assessing Sanskrit and Tibetan materials, Yao detects a much-hidden philosophical development from Īśvarasena to Dharmakīrti by relying on Chinese commentaries composed by Chinese and Korean monks in the Tang Dynasty. Chapter 1 is of the most importance in the book; in it, Yao traces "an early origin of the concept of the cognition of nonexistent objects among the Mahāsaṃghikas and some Vibhajyavādins under their influence" (p. 13). Yao sensitively points out that "the thesis that latent defilements (Pāli: anusaya/Skt: anuśaya) have no objects constitutes the first step toward the formation of the concept of the cognition of nonexistent objects" (p. 19). The next step, as Yao analyzes it, is the proposition of awareness (Pāli: ñāṇa/Skt: jñāna) without objects due to the Mahāsaṃghikas and its sub-schools. Yao's philosophical reconstruction is eloquent and perceptive, especially when he outlines a crucial conceptual transition from the awareness that is without objects (anālambanaṃ jñānam) to the awareness that has nonexistent objects as its objects (asadālambanajñāna). However, one of the main supporting materials that he believes mentions the awareness that has nonexistent objects as its objects -- a passage from the Śāriputrābhidharma -- might be found less supportive without a more detailed justification. This passage is concerned with the concept of wu jingjie zhi 無境界智:What is the awareness without objects (wu jingjie zhi 無境界智)? There is no awareness without objects. Or, the awareness that arises when conceptualizing the past and the future dharmas is called the awareness without objects.1《舍利弗阿毘曇論》卷 9〈4 智品〉：「云何無境界智？無無境界智。復次思惟過 去未來法智生，是名無境界智。」(CBETA 2022.Q4, T28, no. 1548, p. 593c16–18)。Yao chooses an alternative reading based solely on the Taisho Edition, which interpolates one more 境 in 無無境界智 as 無境無境界智. ABSTRACTThe purpose of this article is to explain the Mohists’ perceived inconsistences of the following three propositions in the Mojing since we attribute to them an unconditional love toward human beings: A thief is a man. Killing a thief is not killing men. A thief is a man. Loving a thief is not loving men. Zang is a man. Loving Zang is loving men. The attribution of unconditional love toward human beings is not unusual to the Mohists when we render (...) the Mohist idea of jian’ai as universal love. My interpretation first suggests that we can consistently interpret the Mohist ethical position as intentional utilitarianism. Second, I claim that Mohist universal love includes some generality, though it does not have to mean universality without exception. According to a prominent argument, citizens in unjust societies have a duty to resist injustice. The moral and political principles that ground the duty to obey the law in just or nearly just conditions, also ground the duty to resist in unjust conditions. This argument is often applied to a variety of unjust conditions. In this essay, I critically examine this argument, focusing on conditions involving institutionally entrenched and socially normalised injustice. In such conditions, the issue of citizens’ duties to (...) resist is complicated. I conclude by considering how my discussions may clarify a contemporary problem about engaging in resistance to aid potential migrants who have been turned away by states in accordance with widely accepted rules. Background Recently, palliative care is increasingly important, with an emphasis on the process of dying with dignity. However, nurses who care for such patients experience the associated ethical dilemmas. Objective To explore the meaning of nurses’ experiences in dealing with ethical dilemmas in relation to palliative sedation. Research design A qualitative research design was employed with a thematic analysis approach. Participants and research context Using purposive sampling, 15 nurses, working at palliative care units for at least 1 year, were recruited (...) as participants. Data were collected using unstructured in-depth interviews, and data collection and analysis was performed simultaneously. Ethical considerations Ethical approval was obtained from the authors’ institutional review board. All participants provided informed consent. For the face-to-face interview, the South Korean standard COVID-19 quarantine guidelines, such as mandatory masking and social distancing, were followed. Results Dilemmas raised by patients, were related to concerns about appropriate drug dose; dilemmas raised by nurses, were related to passive care, sense of guilt for failure to predict death, and colleague’s disrespectful attitudes toward patients; dilemmas from patients’ families were related to demands for palliative sedation and reversal of those demands. Care actions to deal with ethical dilemmas comprised evidence-based care, person-centered thinking, reflecting on the death situation, compassion, providing explanation and help to family members. Conclusion Nurses’ ethical dilemmas were pre-dominantly influenced by themselves, rather than by the patients or their families, especially if they felt they could not do their best for patients. The core concept of care actions to deal with the ethical dilemmas, was person-centered care and compassion. Then, how patients and their family members perceive person-centered care and compassion, should be further explored to improve palliative sedation. (shrink)

One of the central claims of the neurodiversity movement is that society should accommodate the needs of autistics, rather than try to treat autism. People have variously tried to reject this accommodation thesis as applicable to all autistics. One instance is Pier Jaarsma and Stellan Welin, who argue that the thesis should apply to some but not all autistics. They do so via separating autistics into high- and low-functioning, on the basis of IQ and social effectiveness or functionings. I reject (...) their grounds for separating autistics. IQ is an irrelevant basis for separating autistics. Charitably rendering it as referring to more general capacities still leaves us mistaken about the roles they play in supporting the accommodation thesis. The appeal to social effectiveness or functionings relies on standards that are inapplicable to autistics, and which risks being deaf to the point of their claims. I then consider if their remaining argument concerning autistic culture may succeed independently of the line they draw. I argue that construing autistics' claims as beginning from culture mistakes their status, and may even detract from their aims. Via my discussion of Jaarsma and Welin, I hope to point to why the more general strategy of separating autistics, in response to the accommodation thesis, does not fully succeed. Finally, I sketch some directions for future discussions, arguing that we should instead shift our attention to consider another set of questions concerning the costs and extent of change required to accommodate all autistics. The issue of human nature or xing 性 was a major philosophical topic of the mid- and late-Warring States period of ancient China. It was famously discussed, for example, in the Mencius. Zhuangzi 莊子 lived around the same time as Mencius and one might expect that he, too, would have discussed it. Surprisingly, the term xing is absent from the Inner Chapters of the Zhuangzi. There have been different responses to this, namely, that Zhuangzi: used different terms equivalent to xing; (...) believed that human nature is bad (despite not mentioning xing); was deliberately silent on xing as an oblique way of criticizing others such as Mencius. I review these claims and provide an analysis of how xing was mainly conceptualized during the Warring States period in essentialist terms. I shall read Zhuangzi’s philosophy as transcending this conceptual framework. Instead of a theory of human nature, Zhuangzi provides stories and descriptions of the different facets of human behavior and their psychological and other complexities. These often have an epistemic focus that stand independently of any theory of human nature. (shrink)

Under Mencius' influence jen has been regarded as part of a theory of nature. As such, commentators have had difficulty resolving the apparent paradox in "Analects" 9.1 that Confucius rarely talked about jen. No paradox arises if jen is seen as a practice involving self-cultivation as a never-ending task and the immediacy of ethical commitment where a cluster of emotions, attitudes, and values are expressed. Jen is an ethical orientation from which one speaks and acts--not particular qualities that one might (...) enumerate and claim to possess. As such, the internal relation between jen and li does not amount to their being the same thing, as implied by some recent writers. (shrink)
