Most political liberals argue that only rules, policies and institutions that are part of society’s basic structure need to be justified with so-called public reasons. Laws enacted outside this set are legitimate if and when public reasons can justify the procedure that selects them. I argue that this view is susceptible to known problems from social choice theory. However, there are resources within political liberalism that could address them. If the scope of public reason is extended beyond the (...) basic structure it could order people’s preferences in a way that circumvents the identified issues. (shrink)

This article argues that effective corporate social responsibility (CSR) of multinational pharmaceutical companies in developing countries should reflect context, opportunity, proximity, time and impact in accordance with the social integration and ethical approaches to CSR. It proposes a CSR model expressed as CSR=COPTI+SI+E, which acknowledges access-to-medicines as a matter in the global public domain, a public choice problem and a moral responsibility issue for multinational pharmaceutical companies. This model recognises the globalisation of the principle of humanity in communities of (...) place and communities of interest as highlighted by the Global Economic Ethic Manifesto 2009 as an integral part of the responsibilities of multinational pharmaceutical companies. The model reflects a global application of the concept of disadvantaged consumer already known to some national laws. The article suggests an access-to-medicines CSR framework for pharmaceutical companies which may include pricing, patents, testing and clinical trials, research and development, joint public private initiative and appropriate use of drugs. In a school choice problem, each school has a priority ordering over the set of students. These orderings depend on criteria such as whether a student lives within walking distance or has a sibling at the school. A priority ordering provides a ranking of students but nothing more. I argue that this information is sufficient when priority is based on merit but not when priority is based on criteria such as walking distance. I propose an extended formulation of the (...) problem wherein a ‘priority matrix’, indicating which criteria are satisfied by each student-school pair, replaces the usual priority orderings. This paper describes the admissible classes of parametric distribution functions of return portfolios and analyzes their consistency with the maximization of the expected utility. In particular, we present a general theory and a unifying framework with the following aims: (1) studying the implications of the classical market restrictions on the portfolio distributions; (2) establishing general rules of ordering, when the uncertain prospect depends by a finite number of parameters; (3) understanding how a dispersion measure has to be used, in order (...) to obtain the investors' optimal portfolios. A significant problem in constructing the theory of rational choice (and rationality in gen­eral) at the moment is the question of explaining irrationality, or rather the fact that an agent can act irrationally for an external observer, and the models used for it may not work. However, the agent himself “inside”, if you find yourself in his “logic”, acts clearly rationally upon verification. It’s just that his “rationality” and the “rationality” of an ex­ternal observer turn out to be different, (...) hence they do not coincide, and hence this leads to a discrepancy in the language of their description of each other. To resolve this prob­lem and find a theoretical basis for the connection between the physiological states of or­ganisms and testable the theoretical constructs, and thus obtaining the opportunity, with­out changing the optics, to work with all agents, regardless of the types of rationality they have, psychological approaches have increasingly become involved. But for them, the basic problem is always “rootedness” in the “material substrate”. This work largely suggests and shows which mechanism can allow this problem to be solved. The paper draws atten­tion to the fact that the combination of the theory of predictive processing and the theory of cognitive dissonance turns out to be extremely promising for this task. This is due to the fact that both of these theories are engaged in reducing surprise or inconsistency (prediction errors and dissonance), with the former providing the latter with valuable and informative context within the broader perception – prediction – action framework (known as active inference) and also helps us to separate dissonant cognitive elements from dissonant psychological states, while considering them as part of the same process of perception and cognition. All this allows us to set a fundamental theoretical basis for the connection between the physiological states of organisms and testable theoretical con­structs about the degree of rationality of a particular agent, and, thus, gain access to the internal information processes in the brain for study. If indeterminism is to be necessary for moral responsibility, we must show that it doesn’t preclude responsibility (the Luck Problem) and that it might enhance it (the Enhancement Problem). A ‘strong luck claim’ motivates the Luck Problem: if an agent’s choice is undetermined, then her mental life will be causally irrelevant to her choice, whichever way she decides. A ‘weak luck claim’ motivates the Enhancement Problem: if an agent’s choice is undetermined, then even if her mental life (...) is causally relevant to her choice, whichever way she decides, we cannot explain how she _settles_ her choice. Only the weak luck claim is plausible. However, its plausibility depends on our accepting that we could only settle our choices if they are settled by additional exercises of agency. This inquiry focuses on the problem of human freedom in the thought of Augustine and two of his early critics, John Cassian and Faustus of Riez. Two issues are of primary importance: the issue concerning the nature of free choice of will, and the issue concerning how free choice of will is to be reconciled with divine election. These issues arise as a result of a change that occurred in Augustine's thinking on human freedom in 396, the year (...) that he grasped the true significance of Paul's doctrine of divine election. To Augustine that doctrine entailed that the will's movement towards the Good was only possible if divine Good Itself worked within the fallen will to make it good. Cassian and Faustus, however, questioned how Augustine could affirm the reality of free choice of will when he insisted that the fallen moral agent lacked the natural ability to do good. ;In order to come to terms with this dilemma, this inquiry views Augustine's later doctrine of human freedom as a form of classical Christian compatibilism. Beginning with H. A. Wolfson's observation that in the Pelagian Controversy Augustine Christianized the pagan Stoic doctrine of fate, the study seeks to develop the implications of this observation in the context of the semi-Augustinian Controversy . Thus it attempts to carry out a task that Wolfson himself had intended to undertake but had never in fact been able to accomplish. ;In keeping with this objective, the inquiry develops Wolfson's claim by situating Augustine's response to the semi-Augustinians against the background of two key texts: Cicero's De fato and Augustine's De civitate dei . A careful study of these texts indicates not only a remarkable similarity between Chrysippus' and Augustine's solution to the problem of human freedom but also Augustine's own awareness of his indebtedness to the Stoics. With this background in mind, the inquiry proceeds, initially, to unravel Augustine's doctrine of human freedom and, subsequently, to view it in relation to Cassian's and Faustus' doctrine of human freedom. After drawing out the implications of these three doctrines of human freedom, a concluding chapter calls attention to the fact that Stoicism exerted a much more pervasive influence on the development of Augustine's doctrine of human freedom than has hitherto been suspected. Throughout the world, female students are less likely than males to take advanced physics courses. This mixed-methods study uses a concurrent, nested design to study an online homework intervention designed to address choice and achievement. A choice of three different contexts (biological, sports, and traditional) were offered to students for each physics problem, intending to stimulate females’ interest and enhance achievement. Informed by aspects of Artino’s social-cognitive model of academic motivation and emotion, we investigated: Which context of physics (...) problems do males and females select?; What explanations do students give for their choices?; Are there differences in the achievement of males and females?; and Is there a relationship between student achievement and the context selected? Fifty-two high school physics students from five U.S. states participated. Data included pre and post Force Concept Inventory scores, homework context choices and achievement, and rationales for choices. Findings indicate that females were most likely to select biology contexts; males, traditional. All students made more attempts on video questions over word questions, although females did not score as well. For all questions, students generally persisted until they answered them correctly, with females taking fewer attempts on problems. Context choice was mostly driven by interest, for males, and perceptions of difficulty level for females; however, rationales were indistinguishable by gender. On their first homework question attempt, females scored significantly better than the males. Initially, males had significantly higher FCI scores; post homework intervention, females increased their mean scores significantly on the FCI, erasing the initial gender gap, with no growth nor decline in males’ scores. Females with FCI growth were equally as likely to choose biology contexts as traditional contexts; males were more likely to choose biology contexts. Findings from this study suggest that modest changes to homework problems that provide choice and make the physics problems more contextually interesting - even without changes in classroom instruction - could increase interest and motivation students and increase achievement for both male and female students. This article is about decision making by juries in capital cases. A jury is a collection of individuals who may possess differing views about factors relevant to the task before them, but who must, nonetheless, arrive collectively at a decision. As such, the members of the jury face a classic social choice problem. We investigate how this problem is likely to be resolved under various institutional regimes, differentiated by the set of individuals who are allowed to participate and the (...) decision rule controlling their activities. As in our previous paper analyzing decision making by juries, we focus here on an aspect of the process that has been neglected in judicial opinions and academic scholarship: namely to what extent, and how, persistent disagreement among jurors can and will be resolved. St. Augustine’s De Libero Arbitrio is by far the most important of the saint’s philosophical works. Although he wrote it fairly soon after his conversion and before the Pelagian controversy broke out, he had no need to change his views in later life, but continued to recommend that it should be read. In spite of its title, it is not a discussion on the nature of free will, nor an analysis of the psychological circumstances in which choice is exercised. (...) The author himself tells us, in his Retractations, that it was written to answer the Manichaean objection to Christianity that, since the presence of evil is undeniable, it is inconceivable that God can be both almighty and infinitely good. The saint in his reply traced evil to sin, and sin to free will. Hence the title of this book. Since it was written before Pelagianism arose, there was no need to go into the difficulties of grace and free will, so the treatise is philosophical rather than theological. It contains the fullest exposition in any of his writings of his proof from reason for the existence of God, and in setting out the argument he deals with some of the deepest problems in philosophy. This paper explores some issues about the choice of variables for causal representation and explanation. Depending on which variables a researcher employs, many causal inference procedures and many treatments of causation will reach different conclusions about which causal relationships are present in some system of interest. The assumption of this paper is that some choices of variables are superior to other choices for the purpose of causal analysis. Choice experiment (CE) is a questionnaire based method that the accuracy of research questionnaire determines the validity of the research outcomes. Attribute selection has a prime importance in every CE studies. If respondents do not understand or do not have preference for a certain attribute, the attribute non-attendance problem might happen that biases overall results of the research. Qualitative approaches such as literature review, focus group discussion, and in depth discussion commonly applied in CE researches. However, especially in the (...) developing countries context where ethnical and cultural diversity is a challenge in conducting survey based questionnaires, qualitative methods are not sufficient in selecting attributes. Present study investigates the application of relative importance index (RII) in respondents¡¯ preference for attributes in a modal shift study in Klang Valley, Malaysia. The 5 point Likert scale questions were employed to enhance respondents¡¯ preferences for initial 24 selected attributes. The results of this study showed that from 24 pre-selected attributes, only 18 of them had RII>0.5 and could be included in the final CE design. The results of this study could help researchers to control for unobserved problems in selecting the attributes which could not be discovered through qualitative approaches. -/- . (shrink)

_ Source: _Page Count 19 In this paper, we tackle the contribution that history of science can make to the _problem of rule-choice_, i.e., the choice from among competing methodological rules. Taking our cue from Larry Laudan’s writings, we extensively discuss what we call _historicist naturalism_, i.e., the view that history of science plays a pivotal role in the justification of rules, since it is one source of the evidence required to settle methodological controversies. As we illustrate, there are (...) cases of rule-choice that depend on conceptual considerations alone, and in which history of science does not factor. Moreover, there are cases in which methodological change is prompted – and explained – by empirical information that is not historical in nature: as suggested by what we call _scientific naturalism_, the justification of methodological choices comes from our knowledge of the structure of the world, as expressed by our currently accepted scientific theories. As we argue, due to its backward-looking character, historicist naturalism does not satisfactorily deal with the case of newly introduced rules, for which no evidence concerning their past performance is available. In sum, we conclude, the contribution that history of science can make to rule-choice is more modest than Laudan suggests. (shrink)

The problem of rational theory-choice is the problem of whether choice of theory by a scientist may be objectively rational in the absence of an invariant scientific method. In this paper I offer a solution to the problem, but the solution I propose may come as something of a surprise. Making adaptive choices between solution strategies is a central element of contemporary mathematics education. However, previous studies signal that students make suboptimal choices between mental and written strategies to solve division problems. In particular, some students of a lower math ability level appear inclined to use mental strategies that lead to lower performance. The current study uses a pretest-training-posttest design to investigate the extent to which these students’ choices for written strategies and performance may be increased. Sixth graders of (...) below-average mathematics level (N = 147) participated in one of two training conditions: an explicit-scaffolding training designed to promote writing down calculations or a practice-only training where strategy use was not explicitly targeted. Written strategy choices and performance increased considerably from pretest to posttest for students in both training conditions, but not in different amounts. Exploratory results suggest that students’ strategy choices may also be affected by their attitudes and beliefs and the sociocultural context regarding strategy use. (shrink)

In Bermúdez 2013 I argued against David Lewis’s well-known and widely accepted claim that Newcomb’s problem and the prisoner’s dilemma are really notational variants of a single problem. Mark Walker’s paper in this journal takes issue with my argument. In this note I show how Walker’s criticisms are misplaced. The problems with Walker’s argument point to more general and independently interesting conclusions about, first, the relation between deliberation and decision and, second, the differences between the prisoner’s dilemma, which is (...) a strategic choice problem, and Newcomb’s problem, which is a parametric choice problem. Numerous authors indicate that the influence of academic education extends beyond the growth of specialized knowledge gained by the graduates. Scholars are trying to identify and examine the potential impact of higher learning on students’ attitudes and choices. One of the dimensions considered by the researchers is the effect of university training on students’ moral choices. Our paper attempts to identify differences between the students’ declared moral choices and their majors (fields of studies). Working with a sample of university students (...) of Economics and Sociology (N = 181), and using three variants of the Trolley Problem, the subjects’ responses are used to identify the similarities and differences between their choices. The participants were asked to respond to three hypothetical situations regarding a runaway trolley. Their decision in the first scenario could save a person’s life or let her be run over by the trolley. In the second scenario, their decision could either let one person die and save five lives or save one life and let five people be killed. These two scenarios required pulling a lever to switch the trolley from one track to another. The third scenario requires pushing an obese person in front of the runaway trolley to stop it from killing five persons. As expected, we found a significant difference between the two groups (the economists and the sociologists) in the case of our third scenario, however, we found no evidence supporting the indoctrination hypothesis. We conclude that the existing differences between the choices made by the future economists and sociologists may support the preselection hypothesis. (shrink)

We examined how children's strategy choices in solving complex subtraction problems are related to grade and to variations in problem complexity. In two studies, third- and fifth-grade children (N≈160 each study) solved multi-digit subtraction problems (e.g., 34–18) and described their solution strategies. In the first experiment, strategy selection was investigated by means of a free-choice paradigm, whereas in the second study a discrete-choice approach was implemented. In both experiments, analyses of strategy repertoire indicated that third-grade children (...) were more likely to report less-efficient strategies (i.e., counting) and relied more on the right-to-left solution algorithm compared to fifth-grade children who more often used efficient memory-based retrieval and conceptually-based left-to-right (i.e., decomposition) strategies. Nevertheless, all strategies were reported or selected by both older and younger children and strategy use varied with problem complexity and presentation format for both age groups. These results supported the overlapping waves model of strategy development and provide detailed information about patterns of strategy choice on complex subtraction problems. (shrink)

The burden of the present essay is to argue in favor of a proposition which is obviously true: that hypothesis choice in science is largely a rational procedure. This proposition needs arguing for because there is no philosophical theory, generally accepted as adequate, which explains why science is, or explains how science can be, rational. The main obstacles to an acceptable philosophical theory on this matter are the problems of induction . These problems seem to tell us (...) that no amount of evidence can in any way raise the probability or increase the rational believability of any hypothesis not implied by the evidence. The approach taken here is to give up on solving the problems of induction and to attempt to explain scientific rationality on some other basis. There are three main elements of this theory: rational hypothesis choice is explicated as rational acceptance of hypotheses, rather than belief; pragmatic criteria are employed to limit--always tentatively--the hypotheses under consideration; choice among hypotheses is to be made in accordance with rules that have the following property: if the true hypothesis is under consideration, then the probability of choosing the true hypothesis is greater than 0.5. Such rules correspond to what are called hypothesis testing situations in statistics. The theory is illustrated and developed through a number of examples. (shrink)

This article analyzes the problem of preference imputation in rational choice political science. I argue against the well-established practice in political science of assuming selfish preferences for purely methodological reasons, regardless of its empirical plausibility (this I call a preference for selfish preferences). Real motivations are overlooked due to difficulties of imputing preferences to agents in a non-arbitrary way in the political realm. I compare the problem of preference imputation in economic and political markets, and I show the harmful (...) consequences of the preference for selfish preferences in the field of collective action. The close association of particular races with particular classes invites a means to exhibit disdain for a race via class. Class and race do not simply occupy a list of social problems, because generally, specific races correlate with particular classes. Racism is presently unacceptable, but not classism. We may feel sympathy for the poor, but we do not refrain from disdain. The disdain of the poor centers on Neoclassical economics’ insistence on choice in regards to class. The language (...) of choice does not circumscribe race. Michel Foucault’s work illustrates that the persistent correlation of race and class is not merely sociological but conceptual. Such close associations of particular races with particular classes serve as a means to generate essentialisms that express racism through classism. (shrink)

According to Peter van Inwagen, free will is a mystery because free will appears to be both incompatible with determinism and indeterminism. Drawing on Aquinas’s account of a free human choice, I argue that van Inwagen’s dilemma is not inescapable. I argue that there might be a weaker version of determinism that is both weak enough to be compatible with a human agent’s choice being undetermined and strong enough to be compatible with a human agent’s choice being (...) self-determined. In describing this weaker version of determinism, I rely on David Lewis’s idea of “comparative possibilities”: the idea that there might be possibilities that are “more possible” than others. The idea is this: If this weaker version of determinism is true, there are many possible futures for the agent, without there being many equally possible futures for that agent. Instead, there is a possible future that is more possible than any other possible future, that is, a possible future that is the most possible future for that agent. (shrink)

The problem of theory choice and model selection is hard but still important when useful truths are underdetermined, perhaps not by all kinds of data but by the kinds of data we can have access to ethically or practicably—even if we have an infinity of such data. This article addresses a crucial instance of that problem: the problem of inferring causal structures from nonexperimental, nontemporal data without assuming the so-called causal Faithfulness condition or the like. We systematically study the completion of choice problems in the Weihrauch lattice. Choice problems play a pivotal rôle in Weihrauch complexity. For one, they can be used as landmarks that characterize important equivalences classes in the Weihrauch lattice. On the other hand, choice problems also characterize several natural classes of computable problems, such as finite mind change computable problems, non-deterministically computable problems, Las Vegas computable problems and effectively Borel measurable functions. (...) The closure operator of completion generates the concept of total Weihrauch reducibility, which is a variant of Weihrauch reducibility with total realizers. Logically speaking, the completion of a problem is a version of the problem that is independent of its premise. Hence, studying the completion of choice problems allows us to study simultaneously choice problems in the total Weihrauch lattice, as well as the question which choice problems can be made independent of their premises in the usual Weihrauch lattice. The outcome shows that many important choice problems that are related to compact spaces are complete, whereas choice problems for unbounded spaces or closed sets of positive measure are typically not complete. Most agree that, if all else is equal, patients should be provided with enough information about proposed medical therapies to allow them to make an informed decision about what, if anything, they wish to receive. This is the principle of informed choice; it is closely related to the notion of informed consent. Contemporary clinical trials are analysed according to classical statistics. This paper puts forward the argument that classical statistics does not provide the right sort of information for informing (...) choice. The notion of probability used by classical statistics is complex and difficult to communicate. Therapeutic decisions are best informed by statistical approaches that assign probabilities to hypotheses about the benefits and harms of therapies. Bayesian approaches to statistical inference provide such probabilities. (shrink)

Noam Chomsky has failed to provide a satisfactory explanation of the "creativity of language" that he maintains is an essential part of the mental representation that makes the acquisition of languages possible. I argue that Chomsky's problems in articulating an acceptable concept of creativity is symptomatic of greater problems embedded in his idea of an "innateness hypothesis." An examination of the historical development of Chomsky's views on the nature of language shows that conclusions with regard to the creativity (...) of language remain either quite speculative or else untenable. This result establishes some agreement with Chomsky on the idea that cognitive capacities are largely structure determined. However, I argue against his idea that creativity is itself a part of those structures. In conclusion, I argue that creativity is an aspect of autonomy. In view of the integrative role of autonomy with respect cognitive capacities in general, we must conclude that creativity does not belong to the biological domain that Chomsky has characterized. There is a strong moral presumption against the use of coercion, and those who are coerced seem to be less responsible for the actions they were coerced to perform. Both these considerations seem to reflect the effect of coercion on the victim’s choice. This paper examines three ways of understanding this effect. First, I argue against understanding victims as unable to engage in genuine action. Next, I consider the suggestion that victims are unable to consent to participate in the (...) coercer’s plan. Although this suggestion is promising, I argue that the inability to consent reflects a more basic problem. Victims are unable to exercise what I call ‘normative authority’: they are unable to make discretionary changes in the permissions and obligations that they and others have. This final account yields a compelling understanding of why coercion is impermissible when it is and reveals a unique way in which impermissible coercion affects the responsibility of victims.
