Since Charles Beard first focused attention upon it in 1913, the Tenth Federalist Paper has been at the centre of the debate concerning the foundations of the American republic. Specifically, there have been three primary interpretations of this document. Each corresponds to one of the three major traditions of interpretation that have dominated the study of American political thought in the twentieth century. Each also points towards and has been evoked in the service of drastically different political philosophies.

Drawing on the works of philosophers Charles Taylor and Joseph Heath, this paper argues that the critique of consumerism is too often separated into an emphasis on “ideas” or “practices.” Taylor’s critique is set against the backdrop of his interpretation of the ideas and values that are constitutive of Western selfhood. To engage in excessive consumption, on this view, is to betray the ideals underlying one’s cultural identity. Heath, by contrast, argues that critics of consumerism must avoid this kind (...) of ideas-based social criticism because it is not only unproductive, but also illiberal and elitist. The phenomenon of consumerism must be approached, rather, by way of an institutional critique that treats excessive consumption as a collective action problem arising within the context of the market economy. The paper argues that while Heath makes an invaluable contribution to the critique of consumerism, his misunderstanding of the importance of ideas is such that his critique ultimately lacks vigor and persuasiveness. Systems for color naming across languages have been a fascinating topic for decades. Zaslavsky and colleagues challenge Gibson's argument that color names are shaped by patterns of communicative need. Using an information‐theoretic analysis, they show that color naming is shaped by both perceptual structure (as is usually argued) but also by communication need.

The United States Supreme Court's decision in Bell Atlantic Corp. v. Twombly is creating quite a stir. Suddenly gone is the famous loosey-goosey rule of Conley v. Gibson that a complaint should not be dismissed for failure to state a claim unless it appears beyond doubt that the plaintiff can prove no set of facts in support of his claim which would entitle him to relief.Now a complaint must provide enough facts to state a claim to relief that is (...) plausible on its face. Only decided last May, Bell Atlantic has been cited in over 3,700 cases. Already being described as a landmark decision, Bell Atlantic nonetheless has lawyers and judges scratching their heads over the precise pleading standard to apply in its wake. As the Second Circuit (mildly) put it, Considerable uncertainty concerning the standard for assessing the adequacy of pleadings has recently been created by the Supreme Court's decision in Bell Atlantic Corp. v. Twombly. Just what is a plausible showing that the pleader is entitled to relief under Rule 8(a)(2)?I believe an answer lies in the 26-year-old decision of the Former Fifth Circuit in In re Plywood Antitrust Litigation. Plywood Antitrust requires, at a minimum, that a complaint . . . contain either direct or inferential allegations respecting all the material elements necessary to sustain a recovery under some viable legal theory. Already used in more than half the circuits, this standard paraphrases advice found in the venerable WRIGHT & MILLER for nearly 40 years.Properly applied, this all . . . material elements standard satisfies Bell Atlantic's plausibility requirement in all respects. The Plywood Antitrust pleading standard works well after Bell Atlantic, first, because the Supreme Court referred to the standard, albeit parenthetically, with approval in Bell Atlantic. Second, it does much to harmonize the Federal Rules' goal of dispensing with pleading technicalities while still requiring enough general factual information about a pleader's claim to make the notice in notice pleading meaningful. Finally, and perhaps most importantly, it gives lawyers, litigants, and courts a standard they can actually use when drafting, or assessing the sufficiency of, pleadings. (shrink)

Following on from ecological theories of perception, such as the one proposed by [Gibson, J. J. . The senses considered as perceptual systems. Boston: Houghton Mifflin] this paper reviews the literature on the multisensory interactions underlying the perception of flavor in order to determine the extent to which it is really appropriate to consider flavor perception as a distinct perceptual system. We propose that the multisensory perception of flavor may be indicative of the fact that the taxonomy currently used (...) to define our senses is simply not appropriate. According to the view outlined here, the act of eating allows the different qualities of foodstuffs to be combined into unified percepts; and flavor can be used as a term to describe the combination of tastes, smells, trigeminal, and tactile sensations as well as the visual and auditory cues, that we perceive when tasting food. Anthony van Dyck’s period of service to the Stuart court stretches from 1632, when he was appointed “principalle Paynter in ordinary to their Majesties” and knighted, to his death at the end of 1641. After an earlier visit of a few months, beginning in December 160, van Dyck had gone to Italy to improve himself; there he had defected from the service of James I. On his return to England this was forgiven, and in the early years he was mainly (...) employed in making portraits of the royal family and household. Later he was again absent from England, spending an entire year beginning in July 1634 back in Antwerp. During the last six years van Dyck spent in England, his clientele widened further; it is chiefly the portraits of this latter period that I will consider here.These portraits have been approached and evaluated in two basic ways. First of all, they have been taken to demonstrate the adaptation of van Dyck’s preexisting skills, especially his command of the “grand style,” to the requirements of a court and aristocracy which prized grace and elegance as hallmarks of breeding and quality, and which at the same time welcomed the trappings of grandeur and the subtleties of variation, in costume, post, and gesture, that the artist could build into his presentation for their predilection.1 Second, where critical considerations have come up, these paintings have been evaluated in terms of whether the adoption of mannered and decorative traits now betokens a decline from the artist’s previous work, or whether it represents rather a different kind of achievement which gave rise, at its best, to equally outstanding successes in conveying refined and subtly enhanced distinction.2But both these approaches agree in finding no intellectual content in the works in question, either of van Dyck’s own devising or based on interests and concerns in which his subjects partook. This absence of implication to the portraits is seem as fitting with thea rtist’s tendency to make creative decisions on an ad hoc basis, as evidenced by his preference for rapidly made drawings from the life over the use of oil sketches and by the pentimenti that his finished works reveal.3 It is also seen as fitting with the whole pattern—cultural as well as social and economic—of his relationship to the Stuart aristocrazy, for which these images were fashioned. 1. Charles Taylor explains a broader understanding of faith as well as of reason in his philosophical anthropology. In leading one’s own life, faith contains more than having certain beliefs, and reason grasps more than having scientific methods. Taylor answers questions regarding the relation of his great narrative to the approaches of M. Heidegger, M. Merleau-Ponty, M. Foucault, K. Jaspers, and S. Eisenstadt (axial cultures and multiple modernities). Insofar as the secularization of Christianity involves ironic reversals, all main directions in (...) Western modernity (forms of religion, secular humanism, and anti-humanism) are faced with dilemmas. Instead of looking for scapegoats in the others, all directions are called upon to cooperate. Most of the sciences of social behavior arose initially out of social ethics. The question asked is whether social ethics can revive itself as a central occupation of social thought. Such a revival faces the challenge of rethinking the normative foundations of late modern, global conditions which themselves are seen as inhospitable to the classic terms of philosophical and social ethic reflection. Though the privileged doubt it, the world is in fact inclining towards stark conditions of economic and natural instability, (...) to say nothing of social discord—towards a triage, or latter-day Malthusian, state. These conditions require a social ethics able to sustain itself, in the absence of global cultural accords, against a world in which social ideals of the good are uncertain, if not impossible. Chronic widespread pain is one of the most difficult pain conditions to treat due to an unknown etiology and a lack of innovative treatment design and effectiveness. Based upon preliminary findings within the fields of motivational psychology, integrative neuroscience, diaphragmatic breathing, and vagal nerve stimulation, we propose a new treatment intervention, motivational nondirective resonance breathing, as a means of reducing pain and suffering in patients with chronic widespread pain. Motivational nondirective resonance breathing provides patients with a noninvasive means of potentially (...) modulating five psychophysiological mechanisms imperative for endogenously treating pain and increasing overall quality of life. Dear Comrades, On Saturday the 18th of September, I received what purports to be a ‘backgrounder’ on Alliance revenue policy. I say ‘purports’ because as a backgrounder it leaves a lot to be desired. a) Anyone not already familiar with the issues would have considerable difficulty working out what the dispute is all about. b) You would expect a REAL backgrounder on what is a controversial matter within the federal Party to present BOTH sides of the question. This ‘backgrounder’ is (...) a one-sided polemic in favour of one option, an option which breaks with previous Alliance policy and which is vehemently opposed by at least ONE of the federated parties (the NLP). It is true that the document is a badly argued and not very convincing polemic, but its defects as a polemic don’t add up to virtues as a backgrounder. This reply is an attempt a) to explain the issues, b) to argue for the alternative option and c) to respond to the backgrounder. It is a labour I perform with some reluctance and not a little difficulty since I don’t have access to much of the relevant data. I resent the fact that I have had to spend so much time on this task when a more even-handed backgrounder or a companion piece explaining the NLP’s alternative would have saved me the trouble. Undemocratic attempts to manipulate the debate - which is what this backgrounder seems to be - are not just shabby in themselves: they tend to waste the time and the energy of party workers. Cherchant sans cesse, à l'exemple des philosophes les plus classiques, la vérité par l'argumentation, Jacques Derrida n'a cependant jamais pu être enrôlé par quelque camp que ce soit, et a sans doute, à ce titre, suscité bien des incompréhensions, des déceptions, parfois des dépits (qu'ils soient amoureux ou non). Cette situation singulière est due en partie à l'essence musicale de son écriture et de sa philosophie. La "philosophie de l'écriture", que le présent ouvrage présente dans toute sa logique, son originalité (...) et sa portée, a toujours différé autant que possible ce moment de la saisie intuitive où la pensée se cristallise en positions. Bientôt quinze ans après sa mort, les jalousies et les malentendus allant s'apaisant, Derrida occupe peu à peu en France la place qu'il n'a jamais cessé d'occuper partout dans le monde : celle d'un philosophe original et brillant, qui a introduit dans l'histoire de la pensée un nouveau point de vue (l'écriture) qui permet de la redessiner et de la faire avancer. Il n'est désormais presque aucun domaine de la philosophie contemporaine (qu'il s'agisse du langage, du rapport à la littérature, de l'éthique, des théories du droit, de la responsabilité, de la démocratie, mais également de l'esthétique, de la psychanalyse, de l'anthropologie et des sciences humaines en général) qui ne se réclame de sa philosophie, ou ne lui soit redevable en quelque manière.
