Resumen: Durante la comisión de un crimen, testigos o víctimas, expuestos al habla del agresor pueden ser llamados, en forma posterior, a reconocer la voz de quien se sospecha es el autor del delito, con el fin de establecer si ellos la reconocerían como la voz del delincuente. Un ejemplo de esta situación, donde se vio involucrado el testimonio de testigos auditivos, fue durante el proceso del caso de Emilio Berkhoff, el joven universitario que fue declarado culpable de los delitos (...) de porte ilegal de armas y municiones y condenado a cinco años y un día de cárcel. El caso no estuvo exento de cierta controversia debido a las declaraciones públicas del imputado sobre supuestas violaciones al debido proceso. En este trabajo se revisa el procedimiento ocupado para la recolección de la evidencia auditiva a la luz de los criterios más ampliamente compartidos sobre la materia.: During the commission of a crime, witnesses or victims, exposed to the speech of the aggressor can be called, later, to recognize the voice of the person suspected of being the perpetrator of the crime, in order to establish whether they would recognize it as the voice of the offender. An example of this situation, where the testimony of hearing witnesses was involved, was during the case of Emilio Berkhoff, the young university student who was found guilty of the crimes of illegal bearing of arms and ammunition and sentenced to five years and one day in jail. The case was not exempt from some controversy due to the public statements of the accused about alleged violations of due process. In this paper we review the procedure used to collect the auditory evidence in light of the most widely shared criteria on the subject. (shrink)

Resumen: El objetivo de este trabajo es describir la situación actual y las proyecciones de la comparación forense de la voz en Chile, a la luz de los estándares internacionales que se enfocan en la producción de evidencia confiable, que pueda ser utilizada en los tribunales de justicia. Para ello, en principio, se dan a conocer los fundamentos científicos que caracterizan esta rama de las ciencias forenses y, luego, sobre esa base se analiza y comenta la situación de Chile y (...) sus proyecciones, tanto en la práctica como en la investigación forense. Abstract: The objective of this work is to describe the current situation and the projections of forensic voice comparison in Chile, in the light of international standards that focus on the production of reliable evidence that can be used in the courts of justice. To do this, first, the scientific foundations that characterize this branch of forensic sciences are disclosed and, then, on that basis, the situation in Chile and its projections are analyzed and discussed, both in practice and in the forensic research. Resumen Auditores chilenos no entrenados y sin conocimientos del alemán deben identificar dentro de una secuencia de voces en alemán la voz de una mujer alemana que habló previamente en español con un retardo de 2 horas. Los enunciados fueron emitidos por estudiantes alemanas nativas de la Universität Regensburg. Los resultados muestran que los auditores identifican la voz original, pero con imprecisión al otorgarle, dentro de una escala de 1 a 7, el mayor puntaje a la voz objetivo por sobre (...) las demás, pero con un promedio general de 6,1. Esto refuerza la idea de que la evidencia auditiva solo debe tener un valor orientativo. El presente texto se basa en un manuscrito presentado en el congreso INGEACUS 2010 celebrado en Valdivia, Chile.Untrained Chilean auditors and without knowledge of German must identify, within a sequence of German voices, the voice of a German woman who previously spoke in Spanish with a delay of 2 hours. The statements were spoken by native German students from the University of Regensburg. The results show that the auditors identify the original voice, but inaccurately, by giving, within a scale of 1 to 7 the highest score to the target voice above the others, but with an overall average of 6.1. This reinforces the idea that hearing evidence should only have an indicative value. This text is based on a manuscript presented at the 2010 INGEACUS Congress held in Valdivia, Chile. (shrink)

Los autores analizan distintas posturas frente al ‘hecho’ religioso. Plantean la posibilidad de abordarlo por dos caminos distintos, ubicando su estudio en el cruce de ambos para sustentar desde ahí la viabilidad de tal hecho como objeto de estudio de múltiples disciplinas. Al tomar la ruta psicológica exponen las teorías de Freud y de Jung, concluyendo que éste último proporciona más elementos para observar los efectos benéficos de la religión respecto a la salud mental.

To practice environmental awareness is to leave a legacy for a better world and this will be achieved with the support of students and society, for this reason the main objective of this research is to describe and analyze the perspectives of environmental awareness in university students, for which the methodology of quantitative approach is used, correlational between its elements and predictive, in which 1324 university students who responded to a survey of 17 questions divided into four dimensions participated.

Burnout syndrome and obesity are two growing conditions that affect employees’ health and company productivity. Recently, several studies have pointed to a possible relationship between both phenomena. However, such a relationship has not been clearly defined. This research analyzes the relationship between BS dimensions and body mass index, the latter being treated as a moderator variable among obese senior and middle managers in the Mexican maquiladora industry through a structural equation model. A total of 361 senior and middle managers completed (...) both the Maslach Burnout Inventory-General Survey [with emotional exhaustion, cynicism, and professional efficacy as subscale dimensions] and a sociodemographic questionnaire. The results showed a statistically significant relationship between EE and PE, with BMI acting as a moderator variable. The results showed that when BMI increases as a moderator variable, the strength of the relationship between EE and PE also changes. For example, although PE had a negative value of 0.14 before the moderator effect, the value increased up to 0.32 when the BMI was factored into the relationship. Therefore, maquiladora industries are being advised to increase their investments on the identification and prevention of employees’ EE and obesity. Such interventions would promote a better quality of life and could prevent economic losses resulting from poor employee performance. (shrink)

The aim of this paper is to study the temporal de-synchronization that occurs, within the European Union (EU), between technological innovations in Artificial Intelligence and its legal regulations. To do that, I base on a thesis formulated by Hartmut Rosa, a German sociologist close to the Critical Theory of society, according to which the temporal structures of politics are no longer compatible with the pace of change in some others social spheres. This produces a new form of social pathology, (...) which Rosa calls "risks of de-synchronisation", and whose most worrying effect must be sought in the displacement of decision-making processes from the political sphere to faster areas of society, fundamentally the market. To analyze this problem, I first reconstruct the thesis of desynchronization as a social pathology derived from acceleration. Then, I map the AI legislation process at EU level. Finally, I defend the thesis that this legislative process, which is certainly very admirable, has consistently come too late. El objetivo de este trabajo es estudiar el desajuste temporal que se produce, dentro de la Unión Europea (UE), entre las innovaciones tecnológicas en materia de Inteligencia Artificial y sus regulaciones jurídicas. Para ello se parte de una tesis formulada por Hartmut Rosa, sociólogo alemán cercano a la Teoría Crítica de la sociedad, de acuerdo con la cual las estructuras temporales de la política no resultan hoy ya compatibles con el ritmo de cambio de algunas esferas sociales. Esto produce una nueva forma de patología social, que Rosa denomina “riesgos de la desincronización”, y cuyo efecto más preocupante hay que buscar en el desplazamiento de los procesos de toma de decisiones desde el ámbito de la política hacia otros ámbitos de la sociedad más rápidos, fundamentalmente el mercado. Para analizar esta problemática se reconstruye, en primer lugar, la tesis de la desincronización como patología social derivada de la aceleración. Tras ello, se hace un mapeo del proceso de legislación en materia de IA a nivel de la UE. Por último, se defiende la tesis de que este proceso legislativo, ciertamente muy admirable, ha llegado sistemáticamente tarde. (shrink)

Los convulsos acontecimientos de estos últimos años han demostrado, a escala global, cuán enajenante es nuestra experiencia presente del tiempo. Las tendencias actuales de la teoría crítica y otros enfoques histórico-sociológicos insisten en el ritmo devorador de la aceleración (P. Virilio; H. Rosa) y en la reconfiguración temporal a partir del “presentismo” (Koselleck; F. Hartog). Sin embargo, sabemos que estas cuestiones distan de ser absolutamente nuevas, y que ya preocupaban a los filósofos y a los fenomenólogos en la primera (...) mitad del siglo XX. La publicación reciente de los últimos tratados del Ereignis y de los Cuadernos negros, redactados en los años 1930 y 1940, nos permite acceder a una reflexión original sobre lo que Heidegger nombra la maquinación o fabricación [Machenschaft]. Nos gustaría analizar la manera en la que, a partir de la fabricación, se puede replantear el sentido de nuestra experiencia temporal íntima frente a la situación moderna. Más concretamente, ahondaremos en las formas en las que la primacía de la fabricación funciona como cerrazón de posibilidades, llegando a impedir que pueda ocurrir algo realmente “histórico”. O objetivo deste artigo é o de explorar as relações entre psicologia, metafísica e literatura, a partir do exame do Ensaio sobre os dados imediatos da consciência; mais exatamente, a partir da compreensão dos "sentimentos profundos", que representa, no Ensaio, o momento privilegiado para apreender a estrutura temporal da consciência. Porém, o presente estudo não abordará unicamente o texto de Bergson, suas descrições dos sentimentos profundos (como as emoções estéticas e morais), o que muito provavelmente seria repetitivo. O uso de (...) um exemplo extraído da própria literatura (no caso, o romance Grande sertão: veredas, de Guimarães Rosa) será imprescindível aqui para compreender a possibilidade de uma descrição qualitativa do "fluxo da consciência", revelando sua estrutura temporal. A partir disso, espera-se determinar com um pouco mais de clareza as interações entre psicologia, metafísica e literatura, na filosofia de Bergson. This paper aims to explore the relation between psychology, metaphysics and literature, through an examination of Bergon's Time and Free Will: An Essay on the Immediate Data of Consciousness, or, more precisely, through the description of "deep feelings", which represent in the Essay a privileged moment for understanding the temporal structure of consciousness. However, this study will not be restricted only to Bergson's text and its descriptions of deep feelings (such as aesthetic and moral emotions), which would probably be repetitive. Instead, we shall use a work of literature (Guimarães Rosa's novel, Grande sertão: veredas) to exemplify the possibility of a qualitative description of "stream of consciousness", revealing its temporal structure. We hope in this way to clarify the interaction between psychology, metaphysics and literature in the philosophy of Bergson. (shrink)

Optimization is about finding the best available object with respect to an objective function. Mathematics and quantitative sciences have been highly successful in formulating problems as optimization problems, and constructing clever processes that find optimal objects from sets of objects. As computers have become readily available to most people, optimization and optimized processes play a very broad role in societies. It is not obvious, however, that the optimization processes that work for mathematics and abstract objects should be readily applied to (...) complex and open social systems. In a backlash against the prevalence of statistical methods, recently social scientists have focused more on studying causal mechanisms. They increasingly rely on a technique called process-tracing, which involves contrasting the observable implications of several alternative mechanisms. Problematically, process-tracers do not commit to a fundamental notion of causation, and therefore arguably they cannot discern between mere correlation between the links of their purported mechanisms and genuine causation. In this paper, I argue that committing to Woodward's interventionist notion of causation would (...) solve this problem: process-tracers should take into account evidence for possible interventions on the mechanisms they study. Logic arguably plays a role in the normativity of reasoning. In particular, there are plausible norms of belief/disbelief whose antecedents are constituted by claims about what follows from what. But is logic also relevant to the normativity of agnostic attitudes? The question here is whether logical entailment also puts constraints on what kinds of things one can suspend judgment about. In this paper I address that question and I give a positive answer to it. In particular, I advance two logical (...) norms of agnosticism, where the first one allows us to assess situations in which the subject is agnostic about the conclusion of a valid argument and the second one allows us to assess situations in which the subject is agnostic about one of the premises of a valid argument. This book concerns the nature and the norms of inquiry. It tackles not only philosophical issues regarding what inquiry is, but also issues regarding how it should and should not be executed. Roughly put, inquiry is the activity of searching for the true answers to questions of our interest. But what is the difference between empirical and armchair inquiry? And what are the right and the wrong ways to inquire? Under what conditions should one start inquiring? Which questions are such (...) that one should not inquire into them? The book offers answers to these questions. It argues that competent armchair inquiry only makes explicit what was already implicit--the inquirer already had the answer to her question before inquiring into it, though this was not explicit to her. It also argues that we should avoid inquiring into questions whose answers are unknowable to us, in the instrumental sense of 'should', and that different modes of inquiry are called for, depending on which type of information is available to the subject. These answers are rigorously argued for, and they stem from a unified framework for modeling the activity of inquiry. (shrink)

Multiple realizability says that the same kind of mental states may be manifested by systems with very different physical constitutions. Putnam ( 1967 ) supposed it to be “overwhelmingly probable” that there exist psychological properties with different physical realizations in different creatures. But because function constrains possible physical realizers, this empirical bet is far less favorable than it might initially have seemed, especially when we take on board the richer picture of neural and brain function that neuroscience has been uncovering (...) over the past forty years, in which all sorts of brain activities play crucial roles beyond all-or-nothing electrical signaling. Because of its evolutionary history, the brain’s metabolic and informational processes are inextricably intertwined. The resulting complex integrated functions impose more constraints on possible realizers than the clean, single-purpose functions usually cited as examples in discussions of multiple realizability—with ramifications for the functionalist and computationalist foundations of cognitive science, artificial intelligence, and the philosophy of mind. Prior research on corporate misconduct pays extensive attention to single misconduct behaviors. However, little research has addressed recidivism – the repeated behaviors of corporate misconduct. Based on institutional theory and using the context of emerging economies where recidivism plays a considerable role, we propose the path dependency of corporate recidivism and suggest that three influential factors exist: internal preconditioning, inter-organizational imitation, and the prevailing external evaluation. Our event history analysis of 1,036 listed companies in China over the period 2001–2008 statistically (...) confirms our hypotheses. What is an inference? Logicians and philosophers have proposed various conceptions of inference. I shall first highlight seven features that contribute to distinguish these conceptions. I shall then compare three conceptions to see which of them best explains the special force that compels us to accept the conclusion of an inference, if we accept its premises.

The law of prior entry was one of E.B. Titchener’s seven fundamental laws of attention. According to Titchener : “the object of attention comes to consciousness more quickly than the objects which we are not attending to.” Although researchers have been studying prior entry for more than a century now, progress in understanding the effect has been hindered by the many methodological confounds present in early research. As a consequence, it is unclear whether the behavioral effects reported in the majority (...) of published studies in this area should be attributed to attention, decisional response biases, and/or, in the case of exogenous spatial cuing studies of the prior-entry effect, to sensory facilitation effects instead. In this article, the literature on the prior-entry effect is reviewed, the confounds present in previous research highlighted, current consensus summarized, and some of the key questions for future research outlined. In particular, recent research has now provided compelling psychophysical and electrophysiological evidence to support the claim that attending to a sensory modality, spatial location, or stimulus feature/attribute can all give rise to a relative speeding-up of the time of arrival of attended, as compared to relatively less attended stimuli. Prior-entry effects have now been demonstrated following both the endogenous and exogenous orienting of attention, though prior-entry effects tend to be smaller in magnitude when assessed by means of participants’ performance on SJ tasks than when assessed by means of their performance on TOJ tasks. The author presents a theory of meaning centred upon the notion of "immediate argumental role", which distinguishes between understandability and correctness of a language. First, the theoretical and quasi-empirical criteria of adequacy and the relevant data for such a theory are described. Then the sense of a word is defined as given by a set of argumentation rules. The immediate argumental role of a sentence is determined by its syntactic structure and by the senses of the component words. The immediate (...) argumental role of a sentence is distinguished from its global argumental role. Different conceptions of truth are compatible with the resulting theory of sense, but the author gives some reasons for preferring an epistemic conception of truth. The possibility of understandable and meaningful paradoxical languages and of many different understandable logics is a consequence of such a view. (shrink)

Delusions are often portrayed as paradigmatic instances of incomprehensibility and meaninglessness. Here we investigate the relationship between delusions and meaning from a philosophical perspective, integrating arguments and evidence from cognitive psychology and phenomenological psychopathology. We review some of the empirical and philosophical literature relevant to two claims about delusions and meaning: delusions are meaningful, despite being described as irrational and implausible beliefs; some delusions can also enhance the sense that one’s life is meaningful, supporting agency and creativity in some circumstances. (...) Delusions are not incomprehensible representations of reality. Rather, they can help make sense of one’s unusual experiences and in some circumstances even support one’s endeavours, albeit temporarily and imperfectly. Acknowledging that delusions have meaning and can also give meaning to people’s lives has implications for our understanding of psychotic symptoms and for addressing the stigma associated with psychiatric conditions. In this paper I present reasons for us to accept the hypothesis that suspended judgment has correctness conditions, just like beliefs do. Roughly put, the idea is that suspended judgment about p is correct when both p and ¬p might be true in view of certain facts that characterize the subject’s situation. The reasons to accept that hypothesis are broadly theoretical ones: it adds unifying power to our epistemological theories, it delivers good and conservative consequences, and it allows us to (...) assess processes of reasoning involving attitudes of suspended judgment. Democratic conceptions of politics are tacitly or explicitly predicated upon a functioning arena for the formation of public opinion in an associated media-space. Policy-making thus requires a reliable connection to processes of ‘public’ will formation. These processes formed the focus for Habermas’s influential study on the public sphere. This contribution presents a look at more recent ‘structural transformation’, the causes of which are by no means limited to social media communication, and examines its consequences. It proceeds in three steps: 1) (...) in some proximity to Habermas, but also by means of the theory of resonance, it seeks to determine the kind of public sphere that a democratic polity requires; 2) an analysis of problems within the contemporary public sphere will feed into 3) a discussion of the conditions for the restoration of a ‘functioning political public sphere’. In this paper I explore alternative ways of addressing the infinite regress problem of inference, as it was depicted in Lewis Carroll’s ‘What the Tortoise said to Achilles’. Roughly put, the problem is that if a claim to the effect that one’s premises give support to one’s conclusion must itself be part of one’s premises, then an infinite regress of reasons ensues. I discuss some recent attempts to solve that problem, but I find all of them to be wanting. Those (...) attempts either require the reasoner to believe that her premises give support to her conclusion, or to take her premises to give support to her conclusion, where taking is not a doxastic attitude. I conclude that, on the face of the failure of those attempts to solve the problem, there is a strong prima facie case for allowing inference to be blind. (shrink)

What are the functional units of the brain? If the function of the brain is to process information-carrying signals, then the functional units will be the senders and receivers of those signals. Neurons have been the default candidate, with action potentials as the signals. But there are alternatives: synapses fit the action potential picture more cleanly, and glial activities (e.g., in astrocytes) might also be characterized as signaling. Are synapses or nonneuronal cells better candidates to play the role of functional (...) units? Will informational signaling still be the best model for brain function if we move beyond the neuron doctrine? (shrink)

Philosophical proponents of predictive processing cast the novelty of predictive models of perception in terms of differences in the functional role and information content of neural signals. However, they fail to provide constraints on how the crucial semantic mapping from signals to their informational contents is determined. Beyond a novel interpretative gloss on neural signals, they have little new to say about the causal structure of the system, or even what statistical information is carried by the signals. That means that (...) the predictive framework for perception can be relabeled in traditional, non-predictive terms, with no empirical consequences relevant to existing or future data. To the extent that neuroscientific research based on predictive processing is both innovative and productive, it will be due to the framework’s suggestive heuristic effects, or perhaps auxiliary empirical claims about implementation, rather than a difference in the information-processing structure that it describes. Focused on the much-debated historiographical and academic status of intellectual history, this article addresses for the first time and in detail the methodological views of the British historian John Wyon Burrow . Making use both of his published works and of unpublished material left to the University of Sussex Library , its goal is to provide a thorough account of an original and eclectic intellectual historian and, at the same time, cast new light on the role of the discipline in (...) the scholarly context of the last few decades in Europe and the US. More specifically, the following pages will illustrate Burrow's work and career, with particular attention being paid to his insistence on narrative, imagination, irony and style; present his writings as an original instance of the anti-methodological practice of intellectual history; and study his opinions of what it means to carry out the métier d'historien. Finally, by examining Burrow's idea of the intellectual historian as a creative ‘eavesdropper’ on the ‘conversations of the past’ and as a ‘translator’ of past dialogues, this article will both pose some central questions and advance some proposals concerning the future of intellectual history. In the evolutionary biology of the Modern Synthesis the study of patterns refers to how to identify and systematise order in lineages, looking for hierarchies or for branching/splitting events in the tree of life, whereas the resulting order is supposed to be due to underlying processes or mechanisms. But patterns and processes play distinct roles in evo-devo: four different views on the role of patterns and processes in descriptions and explanations of development and evolution: A) transformational; B) generative; C) processual; (...) and D) complex are reviewed in this paper. Then, this discussion is related to two issues in evo-devo: homology and variation. (shrink)

What is the role of a notion of truth in our form of life? What is it to possess a notion of truth? How different would we be, if we did not possess a notion of truth? Gulliver’s description of three peoples encountered during his fifth travel will help me to answer. One might say that the basic anti-realist tenet is that we should explain the notion of truth by connecting it with our practice of assertion. In this sense the (...) outcome of my commentary of the fifth part of Gulliver’s Travels will amount to a non-reductive anti-realist conception of truth. It can be called a dialectical conception of truth because it focuses on a particular way of resolving disagreements: an epistemically virtuous practice of verbal exchange that cares for truth. The main thesis is that an implicit awareness of the epistemically virtuous practice is a necessary condition for being in full possession of the notion of truth. The commentary will also involve an argument against deflationism and a critique of some claims made by Huw Price. (shrink)

Is a rational dispute over the validity of a fundamental logical law possible? In his lecture ‘Logics and Metalogics’, Timothy Williamson criticizes Dummett’s approach to this problem and maintains that a semantic theory does not provide a way of settling disputes over the validity of fundamental logical laws. I argue that Dummett’s view is different from the view criticized by Williamson. Dummett does not think that a semantic theory alone can settle a dispute over the validity of a fundamental logical (...) law. Such disputes, according to Dummett, should be settled by the theory of meaning. A semantic theory in the sense that is usual among logicians is a theory of logical consequence . In the present paper we present a short review of some recent neuro- physiological and neuropsychological findings which suggest that self-generated actions and actions of others are mapped on the same neural substratum. Since this substratum is neutral with respect to the agent, correctly attributing an action to its proper author requires the co-activation of areas specific to the self and the other. A conceptual analysis of the empirical data will lead us to conclude that from a neurobiological point of (...) view the problem is not 'how is it possible to share the intentions of others', but rather 'how one can distinguish one's own action/intention from those of other people'.
