A problem is posed: Is pleasure choiceworthy, or not? The answerer claims that yes, it is. The questioner must refute him by asking questions—by offering him premises to accept or reject. The questioner succeeds if he forces the answerer to accept a proposition contrary to the one he undertook to defend, and fails if the answerer always accepts or rejects premises in a way consistent with that proposition. To a first approximation, dialectic is the distinctive method of Aristotelian philosophy. At (...) the heart of dialectic is the dialectical deduction. This article discusses Aristotle's philosophical method, focusing on dialectical premises, endoxa, and aporiai. It also examines the uses of dialectic in intellectual training, ordinary discussion, and the philosophical sciences, as well as in regard to scientific starting points or first principles. _Rhetoric_ is the sixth volume in The New Hackett Aristotle series, a series featuring translations, with Introductions and Notes, by C. D. C. Reeve, Delta Kappa Epsilon Distinguished Professor of Philosophy at The University of North Carolina at Chapel Hill. The series will eventually include all of Aristotle's works.

This book provides an exploration of the epistemological, metaphysical, and psychological foundations of the Nicomachean Ethics. Rejecting current orthodoxy, this book argues that scientific-knowledge (episteme) is possible in ethics, that dialectic and understanding (nous) play essentially the same role in ethics as in an Aristotelian science, and that the distinctive role of practical wisdom (phronēsis) is to use the knowledge of universals provided by science, dialectic, and understanding so as best to promote happiness (eudaimonia) in particular circumstances and to ensure (...) a happy life. Turning to happiness itself, the book develops a new account of Aristotle's views on ends and functions, exposing their twofold nature. It argues that the activation of theoretical wisdom is primary happiness, and that the activation of practical wisdom — when it is for the sake of primary happiness — is happiness of a second kind. Interactions with social robots are symbolic experiences guided by the pretense that robots depict real people. But they can also be natural experiences that are direct, automatic, and independent of any thoughtful mapping between what is real and depicted. Both experiences are important, both may apply within the same interaction, and they may vary within a person over time.

What follows is a brief description of the origin and development, results, and future plans of the Gadfly Business Ethics Project at Bentley College.Viewing himself as selected by the god to be a gadfly to sting the great and noble but sluggish horse, the city of Athens, Socrates says.

Given his view that the modern world is ‘radically evil’, Adorno is an unlikely contributor to business ethics. Despite this, we argue that his work has a number of provocative implications for the field that warrant wider attention. Adorno regards our social world as damaged, unfree, and false and we draw on this critique to outline why the achievement of good work is so rare in contemporary society, focusing in particular on the ethical demands of roles and the ideological nature (...) of management’s self-understanding. Nevertheless, we show that Adorno’s comments on activities such as art and philosophy mean that it is possible to draw on his work in a way that contributes constructively to the conversation about good and meaningful work within business ethics. Reeve's classic work provides an interpretation of Republic that makes a case for the coherence of Plato's argument.

Is there a duty to prosecute grave international crimes? Many have thought so, even if they recognize the obligation to be defeasible. However, the theoretical literature frequently leaves the grounds for such a duty inadequately specified, or unsystematically amalgamated, leaving it unclear which considerations should drive and shape processes of criminal accountability. Further, the circumstance leaves calls to end impunity vulnerable to skeptical worries concerning the risks and costs of punishing perpetrators. I argue that a qualified duty to prosecute can (...) be substantiated on the basis of a single class of reasons, though also that standard justifications of international criminal law (as currently conceived) are not up to the task. The account exploits the expressive dimension of punishment, but locates the central good of criminal accountability in its capacity to appropriately enable an agential stance on the part of subjects in transitional circumstances. It can legitimate, in a way to be specified, hope. The approach also displays the cynicism of an anti‐impunity ethos in the absence of a robust commitment to securing basic human rights in transitional circumstances. (shrink)

This paper explores cultural understandings of virtual sexual ageplay in the online world of Second Life. Online sexual ageplay is the virtual simulation of child abuse by consensual adults operating in-world with child computer characters. Second Life is primarily governed by Community Standards which rely on residents to recognise sexual ageplay and report it, which requires an appreciation of how residents view, understand and construct sexual ageplay. The research presented drew on 12 months of resident blog posts referring to sexual (...) ageplay: 263 total, with 91 residents. The analysis of this talk explores the cultural understandings of this banned behaviour and beliefs about the nature of Second Life which underpin residents’ likelihood to report sexual ageplay and so comply with the Community Standards. In considering these issues the paper is able to highlight issues regarding the unique cultural position of abuse against children and key concerns which underpin the reporting behaviour of residents. Key considerations relate to defining online sexual activity and child avatars; the moral status of ‘reporters’, and sexual ageplay as a form of edgeplay; belief in the harmfulness of sexual ageplay and its relationship to real world behaviours. There is currently unprecedented attention in Australia on the misidentification of women victim-survivors as family violence ‘predominant aggressors’—this focus has largely been oriented towards the role of the police. Less research has considered court responses to misidentification and specifically, the role that legal practitioners play in recognising and responding to clients who have been misidentified. This article addresses this key gap in the literature through an exploration of 18 legal practitioners’ experiences of representing misidentified clients in the civil protection order (...) system in the Australian state of Victoria. The findings suggest that legal practitioners face a number of challenges when representing clients who have been misidentified and that the magistrates’ courts are ill-equipped to respond to misidentification. As a consequence, a culture of respondents consenting to orders that should never have been made against them is maintained. This article calls for a greater focus on the role that the courts can play in providing a ‘safety net’ for victim-survivors who have been misidentified. (shrink)

In this article, I demonstrate that recruitment of hoplites under the katalogos system was not defined simply by the state's capacity to coerce citizens into taking up arms; rather, publication of the names of citizens chosen for military service is a practice that reflects the complementary ethics of egoistic, rivalrous competition and communitarian duty that animated the democratic polis.

Jaakko Nevasto has offered a number of thoughtful criticisms of our attempt to show that Adorno’s work can fruitfully be brought to bear on topics in business ethics. After welcoming his constructive clarifications, we attempt to defuse Nevasto’s main objections and defend our application of Adorno, focusing in particular on the topics of moral epistemology, needs, and the possibility of genuine activity – and thus good work – within capitalist society.

In his much-explored argument for the tripartition of the soul in book IV of the Republic, Socrates makes use of two principles, which I shall call the principle of opposition and the principle of qualification. The aim of the present paper is to explain, in particular, the second of these principles, so as to reveal its role in that argument and in the conception of an appetite and of the appetitive part that is central to the larger argument of the (...) Republic as a whole. Section 1 briefly introduces the principle of opposition, analyzes the principle of qualification, and presents the argument for tripartition. Section 2 uses the analysis of the principle of qualification to interpret a claim Socrates makes about the soul and its relation to the good, which seems at odds with the account of appetites uncovered in Sect. 1. Then, in Sect. 3, the relevance of the principle of qualification to Socratic intellectualism—the view that knowledge is sufficient for virtue—is explored. In Sect. 4, appetites are returned to with the focus now on the varieties of them that Socrates recognizes. In Sect. 5, a view is put forward about the nature of the appetitive part (Appetite), its beliefs, and its ability to be persuaded by the rational part (Reason). In Sect. 6, it is argued that Appetite and Reason are both souls, capable of working in harmony, but also of being opposed, thereby underwriting an important part of the analogy between the polis and the soul on which much of the Republic relies. Reducing non-core food advertising to children is an important priority in strategies to address childhood obesity. Public health researchers argue for government intervention on the basis that food industry self-regulation is ineffective; however, the industry contends that the existing voluntary scheme adequately addresses community concerns. This paper examines the operation of two self-regulatory initiatives governing food advertising to children in Australia, in order to determine whether these regulatory processes foster transparent and accountable self-regulation. The paper concludes that while both codes (...) appear to establish transparency and accountability mechanisms, they do not provide for meaningful stakeholder participation in the self-regulatory scheme. Accordingly, food industry self-regulation is unlikely to reflect public health concerns or to be perceived as a legitimate form of governance by external stakeholders. If industry regulation is to remain a feasible alternative to statutory regulation, there is a strong argument for strengthening government oversight and implementing a co-regulatory scheme. Naive observers viewed a sequence of colored Mondrian patterns, simulated on a color monitor. Each pattern was presented twice in succession, first under one daylight illuminant with a correlated color temperature of either 16,000 or 4,000 K and then under the other, to test for color constancy. The observers compared the central square of the pattern across illuminants, either rating it for sameness of material appearance or sameness of hue and saturation or judging an objective property—that is, whether its change (...) of color originated from a change in material or only from a change in illumination. Average color constancy indices were high for material appearance ratings and binary judgments of origin and low for hue–saturation ratings. Individuals’ performance varied, but judgments of material and of hue and saturation remained demarcated. Observers seem able to separate phenomenal percepts from their ontological projections of mental appearance onto physical phenomena; thus, even when a chromatic change alters perceived hue and saturation, observers can reliably infer the cause, the constancy of the underlying surface spectral reflectance. 'Incommensurability' has, in the last forty years, gained wide currency in the literature of philosophy. Kuhn and Feyerabend used the term in the early 1960's to describe an issue in the philosophy of science. They suggested that, when scientific theories are introduced that are significantly different from their predecessors, it may happen that the meanings of key terms differ significantly, and to the extent that scientists may be unable to fully comprehend the new theory until they experience a form of (...) radical conversion, in which they come to fully grasp the new theory. Key contributions have been made to this literature by Bishop, Devitt, Margolis, Sankey, and Scheffler. ;The notion of 'incommensurability' has also been widely used in discussions of ethics. Finnis has used the concept to effect a taxonomy of human values, arguing that there are seven such values and that incommensurability is the feature that contradistinguishes them. Key contributions have been made to this literature by Goodman, Griffin, Pannier, Raz, and Williams. ;In this work I discuss the literature of incommensurability in both the philosophy of science and ethics. I argue that there are at least two quite different notions of incommensurability: one is a well defined notion originally used by mathematicians; the other, less well defined, means, based on the etymology of the word, lacking a common measure. I argue, further, that the discussions of Kuhn and Feyerabend are based on the mathematical notion, while the discussions in ethics are based on the etymological notion. ;Further complicating the discussions in both ethics and the philosophy of science, is the connection between the notions of commensurability and comparability. I argue that the notions describe, differently, equivalent sets. ;Ultimately Kuhn's notion fails because he cannot resolve his arguments for both inexpressibility in a common language and for comparability of competing theories. Finnis's notion fails because incommensurability does not, in fact, uniquely describe the taxonomy for which he argues. (shrink)

Property undoubtedly has a central place in arrangements surrounding social life, a place so central that some writers have claimed that it is impossible to imagine anything which could be called a society without some property institution. A moment's thought suggests that property is a key element of an economic system, a major concern of the legal system, and a focus of political dispute. But the long‐standing recognition of the importance of property was often coupled with taking many aspects of (...) it for granted, particularly with respect to the possible justification of private property. The development of a specialized literature has occurred in the last forty years, to the extent that Becker has suggested that aspects of the theory of property cannot be developed any further. (An excellent essay by Dan‐Cohen, 2001 shows that Becker's comment may have been premature. Dan‐Cohen explores the relationship between ownership and the boundaries of the self.) This is not, of course, to say that nothing valuable or important had been said about property in the history of political and social thought: nothing could be further from the truth. But much of the political theory of property has been embedded in works with more comprehensive ambitions in political philosophy: Locke's Two Treatises of Government and Hegel's Philosophy of Right are obvious examples. The coherence of such theories of property is clearly dependent – to an extent which may be disputed – on the wider philosophical framework in which they are embedded. Again, the relevance of such theories to contemporary normative analysis depends – again, to a disputable degree – on the compatibility of the economic and political institutions envisaged by their authors with plausible contemporary applicability. Early commentators and traditionists embed and amplify Q 2:102—an enigmatic allusion to angelic complicity in the transmission of esoteric knowledge to humankind—within a rich layer of interpretive lore frequently bearing the rubric “Tale of Hārūt and Mārūt.” A close study of this verse alongside its external narrative embellishments uncovers a wealth of structural and contextual motifs that suggestively link the “Tale” with biblical and parascriptural myths about “fallen angels” and their perceived role in the corruption of antediluvian humanity. The present (...) article catalogs a representative number of these motifs, speculates about their mode of transmission, and offers some guidelines for analyzing the different versions of the “Tale” that surface centuries later in medieval Jewish interpretive and mystical literature. Particular attention is devoted to unpacking the identity of the woman who is responsible for the seduction of the angels. (shrink)

The paper considers the proper method for theorizing about criminal jurisdiction. It challenges a received understanding of how to substantiate the right to punish, and articulates an alternative account of how that theoretical task is properly conducted. The received view says that a special relationship is the ground of a tribunal’s authority to prosecute and, hence, that a normative theory of that authority is faced with identifying a distinctive relation. The alternative account locates prosecutorial standing on an institution’s capacity to (...) address the basic reasons generating criminal liability. This reframes the normative issues at stake, and has the result that various, perhaps quite heterogeneous, considerations can substantiate penal authority. It also eliminates the existence of a special relation as a necessary condition for legitimate criminal accountability. The argument proceeds by offering an analysis and account of universal jurisdiction. Not only does the alternative elegantly perform where the received view struggles, it can accommodate much of what motivates the pursuit of relational ties in existing efforts to vindicate jurisdictional conclusions. In this essay, I want to explore the possibility that the success of narrative in stimulating empathy comes from the relation that narrative bears to emotion—where emotion is a kind of proto-narrative that possibly accounts for the structure and range of narratives themselves —and that our familiarity with emotions as micro-narratives results in the motivation of narrative. That is, the resolution of events occurs in terms of feeling rather than other forms of closure, since other forms of closure represent literal (...) endings as, quite simply, the cessation of events whereas emotion achieves its end by being felt or translated in empathetic terms and in ways that endure beyond the formality of the fictive event that ends the narrative. I will be using Kim Scott’s Benang: From the Heart (1999) and Peter Carey’s Jack Maggs (1997) to discuss narrative and emotions, or the role of emotion in motivating narrative events and the role of narrative in conveying and stirring emotion in the reader. Punktem wyjścia rozważań jest teza głosząca, że kategoria wolności w teorii republikańskiej jest ściśle związana z namysłem i ustaleniami dotyczącymi istoty i celu wspólnoty politycznej, określanej w tradycji rzymskiej mianem civitas libera. Wolność jest pochodną dobrze urządzonego, wolnego ładu politycznego, w którym kluczową rolę odgrywa prawo i cnota. Analizując ideę wolności republikańskiej przez pryzmat dwóch kontekstów: klasycznej tradycji republikańskiej i jej ustaleń oraz (...) ładu społeczno-ustrojowego Rzeczypospolitej, wskazuję, że łączy się ona ściśle z innymi kluczowymi dla teorii republikańskiej kategoriami, takimi jak res publica, sprawiedliwość i prawo, cnota, ustrój mieszany oraz obywatelskość, wyrażana w ideale vita activa, i dopiero w połączeniu z nimi możliwe jest ukazanie pełnego rozumienia wolności i jej uwarunkowań. It has been pointed out to me that the book referred to in line 5 as Principles of Philosophy should in all probability be The Principles of Mathematics , and on looking into the matter I find that this is indeed the case.
